>> also, police are hunting for the pusher who sold philip sea hour hoffman a fatal dose of heroin even as the left says drug dealing is a nonviolent crime. we'll continue that debate tonight. caution, you are about to enter the no spin zone. the factor begins right now. ♪ ♪ hi oil bill o'reilly. thanks for watching us tonight. getting the president on the record that's the subject of in this evening's talking points memo. it's interesting to watch the discussion after my talking with president obama on sunday. the usual suspects are complaining that i was rude, obnoxious. on the other side the hard right is moaning that i didn't slam the president to the floor or something. but the vast majority of americans were given a clear view of some very important issues. the interview was not a debate. it was a discussion.

i managed to get the president on the record about some very controversial topics. something that has not been done before. in fact, the viewer post lead editorial today was about the president saying there is not a smidgen of corruption in the irs. so mr. obama is now "on the record." a good thing for the country. now, initial ratings say about 20 million people watch the interview live with hundreds of millions more seeing it on the world net. big and pretty much everybody knows it. >> with all the game yesterday president obama was was interviewed by bill o'reilly. about the irs scandal he told broirl there wasn't a smidgen of evidence. that tells you even the president of the united states is afraid of the irs. i saw nothing. >> before the show they had big bill o'reilly talking to president clinton -- president clinton. [ laughter ] and that got a little prickly i thought. >> i didn't see it k the president was cool throughout. and i did my usual stuff. i pressed him. i wasn't annoyed and if mr. obama was he certainly didn't show it enter the far left zealots who cannot report anything honestly because their job is to distort. >> this is the third time o'reilly sat down with the president. by far the roughest and nasaest exchange. >> nasaest exchange? that guy is intellectually dishonest flat out. he writes a column for the "the washington post." and he spouts nonsense on tv. this is the same guy who appeared on msnbc dressed up as a hunter in order to mock vice president cheney after the shooting accident in south texas. i mean, real "the washington post," what are you doing? on a wider front, the mainstream media pretty much ignored or covered the story casually. the best coverage was on the

cbs this morning broadcast which has emerged as a very good source of information. in a surprising move. cnn almost totally ignored the story. perhaps they didn't have enough time being a 24-hour news channel but all in all we have more information about the president of the united states now than we did before super bowl sunday. and no nastiness was involved. and that's the memo. now, for the top story tonight. reaction, joining us from dallas, katie pavlick who covers the news from town hall.com. host of fnc media buzz seen sundays at 11 a.m. you know this milbank guy. what did you think of that nasty comment? >> it wasn't nasty. it was aggressive. i'm surprised dana milbank can't see the difference. sure, you interrupted the president a lot, bill. maybe walked up the line of appearing annoying. is he master with running out the clock with lengthy answers. it's funny to see somebody like joy reid saying you

were scolding obama when she was telling this to chris matthews when matthews presidential interview made no news because it was such love fest. >> you made the "the washington post" on page 2, the big picture of me and the president with this milbank guy totally distorting the conversation. i believe the far left does this to play to their crew who didn't watch and doesn't know and they tell them what happened and then they believe it. i got a whole bunch of emails with no town and what do i say every night? name and town, name and town. no town, same thing and it was directed lie a left wing web site. and this is what it is. they want their own to despise me and fox news. go. >> right. well, the best part of when you hear people criticizing fox news and you in particular you ask them what show they watch and they can't even name the show. joy went on this tirade about your interview saying that you only covered topics that were far right conspiracy theories. if you break down the main topics you covered.

benghazi, the irs, obamacare, obamacare and the irs in particular, you know, the general public polling shows that 70% plus want a special prosecutor for the irs scandal. irs is something that effects every single american. on obamacare, it's president obama's signature achievement. also effects the american families. they have seen their premiums go up. so those aren't far right questions. they just don't like them because they take down their guy who is a liberal. >> we got into philosophy we got into nanny state. we got into keystone pipeline. in 20 minutes, cutters, do you this for a living, i jammed in pretty much all i could jam in interrupting bologna. had you an hour and 10 minutes of the state of the union. hour and a half not interrupted now we have a conversation about it. >> let me interrupt you to say it wasn't just the left

he wiped the floor with bill o'reilly. people on the right were saying president of the united states flames fox news for benghazi, blames fox news for the scandal. i thought that was overstated as well one place i would quibble. while i think the irs story. the cincinnati office unfairly targeting conservative groups is very important. in the nine months since that has broken it hasn't been tied to the white house when you brought that up you did give critics am nation to say o'reilly is dealing with the right whing obsession of scandals didn't go anywhere. >> i will rebut that indicatedy can probably do it better than me. go ahead, indicatey. >> i would like to site the quinnipiac poll that showed 70% of americans want a special prosecutor for the irs. let's not forget that the woman leading the charge in the investigation on behalf of the doj is big time democratic donor who donated to president obama's campaign.

exact segment tonight. the impact of the president's interview. did it do president obama any good? joining us from miami rick klein director for abc news and larry sabato who teaches at the university of

virginia. so, president obama's poll number, doctor are bad. all right? and he goes on and enormous amount of people see him. not only in the united states but around the world. do you think that's going to help his poll numbers? >> well, i think he gets credit for one thing, bill. he let himself be interviewed by you. that's not always easy. you are not a powder puff interviewer. look, we live in a polarized era, bill. this is year six of his president. there is hardly anybody left who hasn't got a firm opinion about obama that's not going to change. but polling goes up and down based on what's happening in the country, mr. klein. so you have got him at a base of about 40 job approval. i asked him the questions that have driven those numbers down. i asked him all about the things that have driven his numbers down. in your opinion, did his

answers will that rise his numbers up? were his answers enough to convince americans that he didn't do anything wrong? >> i don't think you are going to undo six years worth of stories in one interview. what i do think you do in an interview like this and win for president obama you reach an audience that is hard to reach. six years into a presidency, five plus years it's hard to get anyone who wants to tune into the president anymore. you are reaching a different segment of the population and a big one. and then i think for the president's critics they are not going to be convinced anyway. none of the answers there are going to change anyone's minds. >> hard core conservative group that doesn't like him. i'm going it read some more of their mail at the end of the show. is he not going to suede. that big middle is really where he has to live in live and the democratic party has to live in november. >> nature. he and he had a an opportunity and i think he did a good job by his account in defending his view where government is and defending his view on the various scandals and issues he has had to face. i think going toe to toe with bill o'reilly counts for something among the

democratic base that voted for him maybe once or twice before. >> maybe. but he didn't answer very very simple questions because as both of you know i'm a simple man. why didn't you fire sebelius? didn't d. panetta tell you it was a terrorist attack on the day that the ambassador was murdered? those are simple yes or no questions. he didn't answer them. i think the audience picked up right away that he didn't answer them, doctor. you say? basically they were the same canned dancers we have heard from some time. you elicited one of the oddest spawpses i have heard from obama. you asked him whether i was the most liberal president ever and he said richard nixon. i don't know too many people who would evaluate richard nixon as being more liberal than he obama. >> he had a good point nixon did start a lot of federal programs to do certain things that nixon thought would help the country. that wasn't a bad point at all. i was surprised. that was the strength of the interview he did say some things. i skull, mr. cline what i

asked the doctor. if you ask a simple question: why didn't you fire sebelius? and then he doesn't answer but he says he holds everyone accountable when he obviously isn't and this is off the obamacare computer debacle. doesn't that hurt him in the eyes of people walshing the interview? >> he clearly was ducking around a couple of questions. the sebelius one is a case in point of that he doesn't have a good answer right now. i don't think there is a way to actively defend the secretary other than to turn it around the way that he did and say look this is about fixing it going forward. look, i don't think there is any interviewer in the world that's going to nail down the president on some things that he doesn't flat out want to answer. i think that true: that's what i'm trying to tell me people, i can't make him answer. but, again, you guys aren't answering my question now. you got hundred million people watching the interview. he didn't answer some very simple questions. does that hurt him, doctor in the eyes of the public not answering? well, i think it always

hurts the president or a politician when they can't answer a question directly when he had helmand haul a a -- hem and haw a lot. he lost some points there although he is better on a one-on-one interview than he is in white house press conferences when he is stale and dry and boring. >> he likes to go head to head with me. two alphas, he is up for it no doubt. dr. klein mr. sabato says, not answering those direct questions will hurt him in the public. do you concur? last question? >> i do not. i think his problem is trust not of -- i don't think the korean he has been suffering in the poll is because is he seen on ducking around on issues. the biggest issue is whether he is honest and trustworthy. that's where he needs as much help as possible to try to bring things around for this election year. >> all right gentlemen thank you very much. dr. sabato has a fine book on the market called the king and a half century.

punishing drug dealers. as you may know philip sea hour hoffman died from overdose of heroin in new york city on sunday. police say they are hunting for the pusher who sold him the deadly dose. interesting, because many times the coshocton do not pursue pushers who supply deadly drugs. one journalist is furious about that. >> i will never leave this without saying the guy who

gave an addict the drug that killed him deserves to go away for life. >> ms. banfield is absolutely correct. president obama has campaigned to lessen some drug sentences involving crack cocaine. >> i look forward to signing into law a bipartisan bill to help right a long standing wrong by sentencing disparities between those convicted of crack cocaine and powder cocaine. it's the right thing to do. >> and he did sign that law. now, if you know anything about narcotics, you know there is a dig difference between crack cocaine and powder cocaine. with us monica crowley and alan colmes. drug dealing, selling narcotics narcotics is nonviolent crime. >> it is a nonviolent crime any more than selling a gun is a nonviolent crime. if you use a gun badly that's a. >> you are talking about gun dealers. >> some guns being sold are crimes. but it's not a violent crime

to sell it. it depends on what a person does when they use it. >> what is the only use for heroin? what is the only use? >> well, it is used for some -- i mean. >> what is the only use for heroin. >> only use for heroin is people get high on heroin. >> drugs you have some protection. >> correct. >> and you have hunting. >> correct. >> and you have a number of other things. now, i think selling narcotics is a violent crime because it leads to the harm. you are selling a harmful substance to another human being and you say? >> you are also talking about an illegal substance. >> i wouldn't even care if it was legal. >> those are all legal substances. here you are trafficking in illegal substance. i tend to agree with you that perhaps it should be classified as a violent crime because it tends to lead to violence. more often than other things do. so, for example, a drug deal can go bad, erupt in violence. acquiring those drugs in order to sell them on the street or to clients that can go bad and erupt into violence. every drug deal go bad, no.

>> a guy like philip seymour hoffman is obviously a troubled individual. he he had a long history of addiction. he can't help himself and many people feel he has a disease. he has a disease. but, by selling him the heroin, colmes, you are exacerbating the disease. you are infecting the man. and you are telling me it's nonviolent action? >> we're not controlling what the person does by how we treat the dealer. you are scapegoat somebody. >> no, i'm not. let me pose it this way. if you give someone aids, if you have aids and you give it to someone, all right? through sexual contact, you are charged with a crime because you are communicating a disease -- >> -- aids is a death sentence. drugs don't have to be a death sentence. they don't have to be. >> well, i think philip sea hour hoffman's family might disagree with you on that one. >> people who recreationally use drugs. it should be up to the individual to decide what they do? >> that's crazy. >> the problem here from a legal standpoint is how do you regulate causation?

so if the dealer is selling philip sea hour hoffman that heroin, number one it's the heroin cut with say rat poison? i don't care about any of that. you are splitting hairs. >> no, as a legal matter which is what you are talking about how to classify this as a violent crime versus a nonviolent crime. the reason why it's been so tough to grapple with how do you prove that that dealer sold bad heroin to that user who then used it and then died. >> here is how you prove it. if you sell any heroin and the person dies, you are charged with a violent crime. >> well, that's felony murder. >> felony murder, that's right. >> anything. >> so what do you charge it with the person gets sick? >> if you are selling a dangerous drug, all right, classified by the united states government as a dangerous drug which heroin, crack and powder cocaine is they are all classified as dangerous drugs. if you are selling that, it is a violent crime. you are committing a felony. >> the selling is not. the answer to decriminalize

precincts. all the polls say that president obama's popularity is dropping and the issues that he is champions obamacare, other issues, abortion are going the republicans' way. and you say? >> not in florida. we are increasing democrat registration, which is great, in my opinion. >> you are a democrat running on that ticket so yeah, that would be great in your opinion. >> absolutely. but i just think that people participating in democracy in voting is the most important thing. whatever party they choose. >> i was surprised that you switched over. i know a lot about florida. i used to live there. in 2006 for example, you ran as fairly conservative republican on abortion you wanted in the state of florida to outlaw it except in rape and incest. but now you morphed into hey it's a woman's body and she can do what she wants. it's a pretty big change. >> not really. let me explain if i can, bill. i appreciate it. when i ran in 2006 in the republican primary i said look, on different social issues i'm a live and let

live kind of guy. who am i to judge. that's for somebody else and not me. very fiscal conservative. i don't want to waste anybody's money. i don't think anybody does especially when it's not your money. it's the people's money. >> sure. >> i really haven't changed that much. my former party changed. and what happened is the tea party emerged. after i got elected governor in 2006. and in 2008, that's when that really came into fruition. and, you know, i guess the sin that i created was when i was with president obama in fort meyers, florida, he was down there to tout the recovery act, the stimulus, and while that occurred, what happened is a lot of republicans didn't like the fact that i literally embraced him and his policies. >> sure and christie got the same wrap and we understand that. but you did change on abortion. i mean, you have and that's a pretty signature issue not really if i might you have got to tell me because if you were championing the state of florida outlawing abortion except for rape and incest and now you are telling us a woman should

control her body that's a big switch if i might. >> sure. when i was a young state senator from tampa bay back in the early 1990s when i got elected. one of the early votes i had as a state senator was on a healthcare committee. bill said you have to have a 24-hour waiting period before a woman can have an abortion if she is making that decision. as a republican back in the 90's i voted against the bill. as a result of my no vote it died on a ty vote. i have always been pro-life personally but in terms of wanting to change the law what i said in 2006 was i would rather change hearts than laws and that's still how i feel. >> all right. obamacare kind of going down the drain in public opinion. are you still behind it. >> i am, yes, sir. i think it's the right things to do to have healthcare. >> why against it. >> i think it had problems obviously coming out of the gate with how it's done on the web and things like that. and that's probably frustrating. i'm sure that it is. but that doesn't mean that the idea is a bad notion.
