the way. >> hello. president obama is not backinging down as congress will not do what he wants, he'll bypass lawmakers and do a solo. today, the president spoke more about his economic goals for the year. more spending on job training and education, for example. and suggested he'll try to make it happen with or without congress. >> i want to work with congress on this agenda wherever i can. but in this year of action, whenever i can take steps without legislation to expand opportunity for more american families, i will. i've got a pen and i've got a phone. a pen to take executive action. and a phone to rally citizens and business leaders who are earring to create new jobs and new opportunities. >> reporter: the president has not been shy about going around congress in the past several years. he used an executive order to change the health care law and push back the penalty phase for businesses. he used an executive toward change immigration laws. and he also used an executive

>> thank you, uma. >> do you think it can be in the long term something that the president can count on to push his agenda? >> it really isn't. it's one thing for him to do an executive order for promotion. or do an executive order pursuant to context of the law. but the president is making executive orders that bypass the law, ignore the law and violate the law. a president can't do that. my gosh, i wish when i'd been governor, i co-just decide i didn't want to fool with the legislature and go it alone. use my phone and my pen. but there's a little technicality called the constitution that separates the branches of government. it's intended to make sure one branch doesn't take power that it was never given. that's what the president is doing. and the president doesn't the legal authority to just say i'm going to change the immigration law. or i'm going to change the health care law because it's not working out like i wanted it to. and because congress isn't working with me. if the president wants congress to work with him. quit traveling the country making speeches that demonize

them. spend some time with them. work face-to-face work with them and build a relationship. that's how you govern. >> if you continue to see this particular reaction from the president, it just continues to signal that the show downwill be in place for some time. and it only signifies a concern that he is going to be working under a lame duck strategy. >> it very much does. and when why was a kid, we used to have a device we could call chinese handcuffs. they were a webbed device, you put both fingers in. the harder you pulled to try to get your fingers out, the tighter they came. in a way, what president obama is doing is playing with chinese handcuffs with the members of congress. instead of trying build bridges of relationship, spend more time talking to them, he spends more time talking about them. and the result is, they have less trust. they have less willingness to work with him.

so instead of moving toward his so-called year of action, he's absolutely guaranteeing a year of total gridlock. but i believe it will work against him and work against the democrats in the 2014 election. >> do you think this is also said that the clock should run its course because of the midterm election? >> there are a lot of things that aren't going to happen this year because neither party wants to take the risk. the democrats, they don't want to defend obamacare. the senate is in the balance. and i think the senate will tip towards the republicans this year because those democrats, they really got nowhere to run. nowhere to hide. their fingerprints are all over the weapon. they're going to have to sit there and explain why they voted for obamacare. why they can't guarantee that people will end up with a better system than what they had. they didn't do it. and he could love to change the subject vantd candidates talk ago somebody else. there are many reasons that

republicans, for example, don't want to get into the details of immigration reform and the main one is they can't trust harry reid and the democrats to be honest brokers. so i don't blame them to say we're going put that off until we have both houses of congress. we can make it something that we can live with and make it something that really does reform the process. which i think everybody agrees, we definitely snead some reform but it's got to be responsible. >> i want to move on, governor, to another big head line out of washington this week. the fact that there was testimony once again on capitol hill regarding the irs scandal. and there are now allegations that this targeting of conservative groups has not stopped. that it continues to this day. what's your reaction to this? >> cleatum mitchell which is the attorney before the house committee this week.

cle cleata will be on our show tonight. one thing i want to talk about is the president's ridiculous statement to bill o'reilly that wasn't a smidgen of evidence. that word "smidgen" means something where i grew up. for him to say there wasn't a smidgen of anything corrupt going on it ludicrous. i believe that may end up becoming already, even though we're just barely into the new year, that may end up being the new political fact of the new year. >> but this revelation raises concerns given the fact that there's supposed to be an investigation underway to try to find out who's behind this and who's responsible for giving those orders. and yet, we're still hearing that nothing's really been done and the targeting continues, what does this is a?

>> well, it says that if this administration continues to ignore something, the press will ignore it and it will all go away. this is not going away. there are a lost people, there are hundred us of organizations that have been targeted. they're out tens of thousands, in some cases, hundreds of thousands of dollars. they've been harassed by their own government. the irs has become a criminal enterprise. it's got to be stopped. and i don't think members of congress, the responsible ones, the ones who actually understand what they swore to do when they went into office, will or can stand back and allow a government agency to take their boots and trample over the constitutional rights of people who utilized their rights of free speech, freedom of association, freedom of religion. freedom of expression. and have the government shut them down and shut them up by using the brutality of all the power the government can muster together. and that's what's happening with the irs. and it hasn't stopped. these organizations are still

being harassed. and the president can deny it all day long. but the facts are stronger than his words right now. >> very quickly, i know you're getting set to travel to israel. is this a big trip for you. and i know a lot is planned on this journey for you. >> well, i've been going for -- soon, 41 years, that i've been making journeys to israel. so many, i can't even remember how many. this year it's especially interesting because john kerry's recent comments putting pressure on the israelis to give up more. and asking the palestinians to give up nothing is so out of line, so out of touch with reality that i hope that one of the things that many of us can do as americans, is to assure the israelis that this is not how we treat our friends. the heat is not represent -- maybe the u.s. official policy, but not the sentiment of the american people, who do believe that israel is our ally. and know that of the 1.6 million arabs who live in the world

former deputy assistant fbi director. he joins us now from texas. welcome, great to see you here on our program today. there are about 40,000 russian security forces in and around sochi. us warships off the coast black sea. and despite the enormous effort russia has undertaken to keep the peace at the games, it still might not be enough to prevent an attack likely for militants hiding already inside the city, correct? >> absolutely. the chechens have a history of prepositioning people, weapons, explosives, equipment, alongside terrorist targets that they want to have. and they're very good at what they do. they'll commit large numbers of individuals, more like a military operation where they'll use 40 or more terrorists to conduct an assault. and, frankly, the russian government has been a pretty poor track record resolving terrorist incidents within the confines of their country. so there's a lot of things to be

concerned about here. not just inside the olympic venues, but throughout russia. hotels, shopping malls, restaurants. there's reason to be concerned here. >> to that point, you have extensive experience when it comes to tracking these efforts, terrorist efforts, and trying to stop them. russia did hire thousands of workers, though, for hospitality and service jobs before the so-called ring of steel was set up. from your experience, how difficult is it to stop an inside attack like this then? >> it's very difficult. inside the so-called ring of steel, they'll do a good job. it's the softets outside of that. because you have hundreds of thousands of people coming to russia as tourists. they're not going to stay inside that ring of steel. they have to stay in hotels, they have to go to restaurants, they have to go to hotels. if they can't get inside the venues, the village of the stadium, they'll have to go out. and dedicated terrorists, some of the most vicious in the world

are active in afghanistan, they have a long history of hatred of the russian people. our people who are there are very concerned about the safety and security. >> isn't it also true that the fact that the russians' lack of that compound in keeping folks safe? >> no doubt about that. they should be looking to the world to help them and they did not do that. i'd like to see a s.e.a.l. team or delta or the fbi i would hope they would be there. but the likelihood of the russians cooperating with them allowing them do their job or sharing is very remote. >> this week, an alert went out about explosives in toothpaste tubes. and it's been called a credible threat. now a ban on flights between usa and russia. what does this is a about the methods used by terrorists? >> they get very sophisticated. they come up with a new technique. we have to counter it. i can see the issue with regard

to tooth taste tubes. you know what, it's a small inconvenience. if i was going, sigh am sure i can buy some there. but i think it at least shows that we are tuned into to the traffic and the chatter. that's a good thing. they should listen to that. >> at this point then, would you have advised people in this country, though, to think twice before attending these olympic games. knew you have big time concerns about security there. so is it something that you would say to those if anyone is asking should i go? what would your answer be? >> i have clients talking about that. and i advised them not to go. if there's a major tleeevent th russia will close down. it will close down the airport. and transportation. while it may not impact you directly. the impact or inconvenience of trying to get out of russia would be enorm miscellaneous. i'm watching it on nbc. nbc does a nice coverage.

groups continue, despite the uproar that the revelations created months ago. and a justice department investigation that is supposed to find those responsible. have you been contacted over the past eight months by the fbi or justice department to discuss your concerns? >> no, ma'am, not a smidgen of contact from the fbi. >> so when you listen to how emotional your testimony was back then, what went through your mind knowing that nothing could this point has been done to at least investigate the allegations that you have raised. >> it is completely unbelievable. and i do feel like our country is slipping away. i just -- when you hear what happened eight months ago when six of us testified. there was a lot of evidence of corruption. yet nothing has been done. and at the same time, the irs is rewriting new rules. recent e-mails show that lois

lerner back in 2012 was conniving these new rules with top officials from the irs. recently around thanksgiving, they came out to the public and these are rules that will basically shut us down as a tea party group. >> so in essence, you feel that the obama administration has closed the book on this. and the investigation that's supposed to take place is intentionally dragging its heels to let the clock run out before the upcoming election? >> that's certainly the way it looks. what we're hearing from congress, they are not getting much help from this administration or the irs. there's a lot of stone walling going on. i can't believe the american people are sit back, letting it happen. >> when you talk about the new irs regulations. when you say they're designed to shut you down. how so? >> well, under these new regulations i am not allowed to use the words, reject, vote, oppose." that's just a few of them. we are not even allowed to have on our website the name of a

candidate 60 days before a general election. i can't even name the political party, if they have a candidate within 60 days before a general election. as a leader of this group and other leaders in the group, we cannot speak publicly about legislation, incumbents' voting records or it will jeopardize our tax status. what we do is update the group on american history, candidates, the forms, no longer will we be able to have those closer than 60 days before a general election. >> what does it say to you about free speech? >> they don't care about free speech. and with a pen and a phone, they're going to destroy it for us. >> your words back in the summer when you said, quote, i am a born free american woman, wife, mother and citizen, and i'm telling my government that you have forgotten your place really struck a chord with so many americans. do you think then, your government continues to forget to follow the founding

turning now to concerns over iran. iran is now helping al qaeda terrorists based in the islamist republic. this news coming from the white house which now suggests iranian officials are backing both sides in civil war. joining us, oliver north, a regular contributor here on fox news. welcome. >> great to be here. it's a total misread on the part of the obama administration of what's going on. sunnis and shia have long held the philosophy that the enemy of my enemy is my friend. even though hamas is a sunni supported and sunni organization it receives support through the international guard corps and in

qods force. and third, they are both committed to the idea of driving westerners from what they call the land to the prophet. and so the new sanctions announced by the treasury to members of an organization called islamic jihad union based in iran should not surprise any of us. rt fa the fact that they're bringing pressure against these two and not against the government of iran who has clearly let this happen is further sign of how wrong-headed this administration is. because this administration is bending over backwards to try to make sure that this so-called nuclear weapons accord launched in geneva by john kerry is going to succeed. >> it's amazing though that this administration is not targeting the government of iran for meddling in this way and backing the operativesing.

for closing the syrian chemical weapons deal. closing the deal with the iranians on the nuclear weapons program in geneva. and on what they're doing to force israel into a box, so that they have to agree to what obamacare you want, in terms of living up land for peace. of course, they'll give up land, but they won't give up peace. on top of it, kerry is actively supporting the eurozone's idea of an economic boycott against israel. soda stream, one the very first products to be targeted, it can't be bought in the european union anymore. that's the goal. while we were there, tony blair came to israel to back up what kerry is doing in terms of economic boycott. and kerry says israel can't support itself economically or with security without this new plan. what that means ultimately, is if israel doesn't acquiesce, they will be boy kotd all across the globe. and we will start cutting back

on our support. >> why is it happening in such a way that's clearly shows that there's a bigger plan in play? >> well and the what the obama administration has done, they've decided, they've got so few things of note that they can claim as successes in foreign policy. their withdrawal from iraq has become a disaster what's likely to become a disaster is if you recall withdrawals in afghanistan. the so-called arab spring has been a nightmare for the people in the region to include moderate realists like those in jordan and even the saudis. so what israel is now looking for is a new alliance. i'll give you a prediction. i see israel aligning itself with saudi arabia, box the israelis believe the united states will not support them in dealing with an iranian nuclear weapon. >> who would have thought an alliances would possible just even a year ago? >> well again, the idea, the

we'll cheer our team usa on as it goes for the gold. thank you for joining us today. >> thank you. it was supposed to simply be a three-month mission to mars. we are now celebrating a ten-year milestone for a space rover known as "opportunity." this robotic explorer passed its warranty date and beams back fantastic images along with valuable scientific data from the surfaces of the red planet. joining us is dr. jim breen. welcome. great to see you. you must be very excited about this anniversary for the mere fact this robot continues to thrive and bring us incredible information and data. >> indeed. actually, i get asked a lot why the 90 days? we did not know enough about the mars environment to understand

much about the atmospheric conditions. we thought that the dust would filter down and coat the solar panels such that eventually after about 90 days, no power would be able to run the rover and it would die. >> it has made news even on the anniversary date. the fact that it has been giving us incredible information about ancient mars, stuff you didn't know about before. >> absolutely. what we are finding out now that the atmosphere blows the dust off and it keeps going, that mars actually was quite a bit wetter than we imagined. one of the things it found were these little hematite nodules. we first called them blueber blueberries. what they are are iron oxides that form in water. these are beautiful little nodules. that is an earth one that came from utah. >> but just like this.

it's giving you that data. there's been a bit of a buzz over these before and after pictures. the fact you've got a rock that is in the spotlight, a jelly sized donut rock. a few days before there was no rock at that site. a few days later there is a rock visible for all to see. we show these before and after pictures. there is the stone right there. what do you make of that? there is a mystery behind this, isn't there? >> there is. what is exciting about this particular rock is that we believe that as opportunity was making its move to settle down in a particular place, it bumped a particular area and this rock rolled out. what happened then that rock is upside down. mars has been an oxidized surface. typically we want to know what's underneath it. this rock provides us that opportunity. it's about the size of two or three inches.
