now getting rain and snow, but all at once. and now it is a nightmare. also -- >> that's disgusting behavior. >> trouble at a college basketball game. a player, a fan, getting way out of control. i'm harris faulkner. new outcry today that the obama administration is overreaching its constitutional powers. recently, it was the minimum wage. now, the latest reaction coming in response to attorney general eric holder's announcement on a national policy regarding same-sex marriage. it came this weekend in new york, and it takes us back tomorrow. holder says the justice department will now give lawful same-sex spouses equal protection under all of its protections, even if they live in a state where same-sex marriage is not legal. this as president obama reiterates threats to use his pen to take executive action on other issues. molly has the debate on the constitutionality of the new policy changes from washington.

>> harris, attorney general eric holder says he wants to recognize gay marriages, quote, to the greatest extent possible under the law. so, for example, starting monday, same-sex married couples cannot be compelled to testify against each other in federal court. even in states where same-sex marriage is not recognized. >> the federal government will not use state views as a basis to object to someone in a same-sex marriage invoking this right. >> the supreme court ruled last year that federal benefits could not be denied to legally married same-sex couples, but the court left the door open for states to determine who's allowed to be married. 33 states have laws defining marriage as between one man and one woman. the family research council, which advocates for traditional marriage, says the federal government should not be trying to, quote, change these states to change their definition of marriage. >> we believe this is yet

another example of the lawlessness of the obama administration in going well beyond what any court has required or what any statute says and starts pushing their own liberal idealogical agenda to the maximum extent possible. >> on capitol hill, reaction was mixed. >> the attorney general is saying we're going to apply the same rules as we do other married couples, for same-sex couples in the courts. >> it appears to be another example of the obama administration imposing it will on the states. >> attorney general holder also said the department of justice will recognize gay and lesbian couples when it comes to bankruptcy cases. >> an enormous piece of legislation that did pass congress, the affordable care act/obamacare. at times, the president has used his executive authority to change it or stall portions oit.

to date, there have been 25 changes to obamacare since november of 2012. for example, delaying the employer mandate, and the president's decision to allow insurers to continue offering plans that were being canceled. reaction to a nonpartisan government report which predicts obamacare will result in 2 million fewer workers in the economy in the next decade. the head of the congressional budget office, douglas alman dofr, telling congress last week, obamacare creates a, quote, disincentive for people to work. steve is live with the news from washington. >> there's a deep partisan divide over this issue, and it was on display today on the sunday talk shows. democrats say the affordable care act provides a new measure of freedom for american workers, while republicans say it's a terrible blow to an already struggling economy. the gop view is people are encouraged to leave their jobs and because of that, ineconomy suffers. >> we've got in our country right now a 35-year low in terms

of labor participation. we don't have as many people in the work force as we did in the recession, in the middle of the recession. and yet you have democrats almost giddy about, oh, boy, now we're going to have fewer people in the work force. that doesn't help the workers. it doesn't help in terms of fighting poverty. >> the figures analyzing obama care came from the nonpartisan congressional budget office and were released last week. they show some 2.3 million workers will leave full-time employment by 2021 as a result of the health care law. harris. >> well, the numbers are pretty straightforward. how are democrats characterizing this report? >> wem, yeah, they say the economy won't suffer because the workers will still contribute in various ways and the full-time jobs they leave will be filled by others. now, they claim obamacare provides workers with more choices and as a result, employees won't be locked into jobs they don't want simply to keep their health care benefits. >> what cbo said is many

american workers will have freedom. now that's a good word, freedom to do things they couldn't do. the single mom who is raising three kids has to keep a job because of health care. can now spend time raising those kids. that's a family value. >> no matter which way you see it, there's no question obamacare will be a major issue in the upcoming midterm elections. >> thank you. the tech giant aol is making a change. apologizing to employees all over a controversy surrounding obamacare. which has also ignited a firestorm within that company. the ceo tim armstrong's troubles began when he decided to cut employee retirement benefits to make up for a $7.1 million increase to the company's health care costs due to obamacare. the skyrocketing costs a problem shared with many companies scrambling for ways to pay for the difference, but armstrong got into hot water for singling out the health problems of two

babiy ies whose parents work atl and how much it would cost to take care of them. in a memo, he concedes his comments were a mistake and he's agreed to return full retirement benefits to the workers. now to a news conference that wrapped up a few minutes ago about a situation playing out in the world of college basketball. it has captivated people, stunned them, really, involving one of the best players in the nation and a fan from an opposing school. here it is. >> a technical foul. >> so that was the incident. it happened during saturday night's game between oklahoma state and texas tech. cowboys all american guard marcus smart fell into the first row of seats chasing a ball. when he gets up, he turns and shoves a tech fan with both hands. he claimed the fan used a racial slur. just moments ago, he apologized for his actions. >> this is not how i condone myself, how the program is ran.

finally, much needed relief for drought-parched california, innorthern part of the state getting rain this weekend, a lot of it, as you can see. wow, look at this. the earth just opened up. it's a welcome sight for farmers but a night mare for people who live in sonoma county. one road buried under a mud slide, and tonight, the entire area remains under a flashflood watch. but despite the sudden deluge, state officials tell us california's drought crisis is far from over. donna joins us live from our bureau. we're seeing across the associated press wires, portland, oregon, is issuing its first text alert to people city wide to stay indoors.

the ice storm is hitting as we speak. >> yeah, absolutely. further to the nort, they're getting it pretty bad. we have what is called a pineapple express storm system coming up the pacific from hawaii bringing with it lots of moisture. it's really drenched up there. that's piling on several feet of snow in oregon. in seattle, for example, up in washington state, they had about 2 inches of snow there. they weren't expecting at all. picture on your screen you're seeing is the russian river in sonoma county. that's doubled in height since the rain starting falling on saturday. we just are seeing reports from all over the place of fresh flood warnings up until 9:00 this evening. they were expecting thome to stop around 3:00 p.m., but all the officials saying, look, we haven't seen levels like this in quite some time and we need more to come. take a listen. >> i would have to say considering the lack of rainfall, bring it on. we want as much rain as we can

get. we feel like our water shed can absorb a huge amount of this rainfall. >> so that pray for rain being answered. you know, it's been so dry here, harris, that the rain we had this weekend accounts for half of all the precipitation we have received so far this year. and we're actually only the third of the seasonal levels we should be having. even as we're seeing roads swept away, you know, that mudslide took a road down a hillside for 200 feet, the rain was so intense in that area of sonoma that people are caught by surprise. they have mixed feelings whether this is a good or bad thing. >> kind of weird how dry it's been, and all of a sudden, it's raining so hard. >> what i heard, nis is going to take care of about 20% of the shortfall, so we need this times five. >> forecasters saying that actually even if it rained every other day from now through until may, it still wouldn't be enough to get it back to the levels we

need to prevent a drought from happening. >> back to you. wow. that's unbelievable. that would be a lot of water and it still wouldn't be enough. thank you very much. for more, let's bring in caitlin roth with wtfx in philadelphia. you just heard domtalking, and i mentioned, too, what's happening in oregon tonight. that ice storm on top of, what, 8, 9 inches of snow? >> that's right. we had a record amount of snow for seattle last night. we have the ice issue in portland, and then the rain and flooding in the bay area. so we'll zoom in, showing a lot of rain moving into northern california. we're happy to see them get rain, but it's too much too soon on such dry land. that's why we have the flooding concerns. persistent onshore flow, eureka, redding, the higher elevations in the mountains, heavy snow. we have winter storm warnings in effect for the mountains for

tonight. flood advisory for sacramento. the north bay under a flash flood watch through tonight as they'll continue to see the rain overnight. it should taper off. they'll get a break tomorrow morning. further inland where you see the reds is avalanche warnings. plenty of moisture, even into the mountains of idaho, utah, western wyoming. winter storm warnings extend into colorado. the whole storm system bringing the snow, the ice, and the rain to the northwest will take a southerly track inland over the next 24 to 36 hours. and this will bring winter weather to the southeast. winter storm watches posted from arkansas, northern louisiana, through northern mississippi, alabama, and northern georgia. that's monday through tuesday. we'll time out the rain for you. starting with this evening, you will see a break by tomorrow morning by the coastline. the rain is good, but it's too much too fast. snow continues inland in the mountains from salt lake to denver. by tomorrow night, places like kansas and oklahoma seeing snow. that merges with the front along the coast and then we turn our

president hassan rouhani, the newly elected leader is a conservative. he's also concerned a pragmatist and is shaping things up in tyronn. elected by moderate group s pledging to jump start the economy and open up talks with the united states. he faced a hard-line element in iran who have long used the nuclear program to govern the republic. his outreach to the west and temporary nuclear deal threatens the idealogical base of the hard liners, particularly the revolutionary guard. by scaling back on the program, cancelling missile tests and building projects, he's also undermining the hard liners influence over iran's economy, and that has them angry, but so far, the supreme leader has allowed rouhani to do this, even though it has angered many hard liners. and earlier, they announced iran

will allow inspectors back into the country to examine many sites, including a uranium mine. they're not allowing total access to inspectors as several other sites are still off limits. harris. >> thank you. a big week ahead for the woman who just took the job of leading the federal reserve, the central bank in terms of keeping the country's financial system safe. janet yellen is scheduled to talk on the hill with members of the house financial services committee on tuesday. many in the gop are concerned about the effects of years of near zero interest rates and trillions of dollars in money printing and the weakening of the u.s. dollar. they want to know yellen's vision going forward. we have more on what the testimony will mean for the markets. >> harris, it's her first test as the new head of the fed. yes, janet yellen, chair of the central bank for a little more

than a week now, faces congress. she will surely be asked about plans for easing up on the easy money policy. the fed has been tapering its bond buying binge twice since december, to $65 billion a month. also, how long will interest rates remain near zero? her testimony comes just after another lackluster jobs report. a market sell-off, and weakness in manufacturing. no surprises expected, though. yellen has been a longtime supporter of her predecessor's policies and her view is well known after more than three years as number two at the fed. she may point to a decrease in the unemployment rate and to low inflation as cause for more cuts in stimulus. but it is a republican committee she appears before on tuesday, and she may get some flack from lawmakers who are critics of the bond buying for fear it will create a bubble. they could press for quicker action. you can be sure wall street will be listening very closely to

congressman, pat cordle, doug shown, fox news contributor as well. so the news of the day that is coming on the heels of this announcement by the ag, holder, is what i want to get your response on first. the argument that some people are making now is this is overreaching in terms of the constitution, that states have their own vision of this. this goes against it. your thoughts. >> it is overreaching, harris. i would call your attention to where the attorney general made the announcement, the human rights campaign benefit. bottom line, this was a politically inspired move. the attorney general following on the president's state of the union a year of action. the bottom line is this is political. and it's designed with two thirds of the states being against gay marriage. it's designed to raise money for the democratic party in the midterms. >> same way two years ago, harris, before the presidential

race, remember when joe biden was heading out, the president was about to go to george clooney's house for a big hollywood fund-raiser, and the vice president so goosed the president into coming out for gay marriage. and it unleashed a torrent, i think, of democratic money for the democrats from the gay part of the party. >> that's all this is, first of all, eric holder is the most lawless attorney general before he became attorney general, when he was in the justice department, since john mitchell. this man has about as much respect for the law as the moon does. what you do in this administration, whether it's on the environment or, they're playing to get votes, and also to distract young people, for instance, particularly, who are more pro gay marriage. the same with women. distract the young people in the fact they don't have jobs, they're getting screwed on obamacare, and the rest of it because they can't deliver on what really matters, so they

take issues that are not very important, but the republicans are so inept that -- >> and this was 36 hours after a terrible jobs report. >> absolutely, but i don't think you guys would mean that same-sex marriage and marriage in this country is not port. what i think you're saying -- >> no, people in the public, what is critical, but they keep making everyone victims to raise money and get votes for, because the entire thing that brings us together is the substance of the issue. >> what we're siaying is with to thirds of the state not having come out for gay marriage, to have the attorney general by fiat say that the federal law will apply, that at a time when we're facing crippling economic problems, a health care law that's not working, that's just not something that makes sense. >> can i ask you about a power grab idea? when i hear you say words like fiat, and i hear executive orders and, you know, it has people asking, well, where is the conversation, then, for what is important to people, pat?

when you make that kind of a grab, you don't hear anybody. >> there is no conversation because they don't want to have that conversation. they just want to dominate the news cycle on their terms. they do not -- and this is every president. wants to be on offense, not on defense. >> the vast majority of the american people believe that we have passed in both parties like harry reid, who by the way is proposing he might make new rules in the senate after he did the nuclear option. if we have the votes, we do what we want. the constitution can go to hell and so can the law. this sense of politics before country is, people get it. they get it like by two to one. >> i was dgoing to say this announcement on gay marriage does not even involve a vote in the legislature and it's something that the american people are deeply divided on. two thirds of the states haven't passed in a favorable way the initiative.

>> that's right. but we have the pen. we will do -- this is -- we have leaders who do not care about preserving the law. the president took an oath to preserve the constitution, and he's supposed to be a constitutional president. he cares as much about preserving the law as i do getting on a rocket ship. >> it's interesting because you say it's not the substance of the issue. that could apply to many of the things we're talking about. it could apply to minimum wage. >> absolutely. and let me be clear. the bottom line, the issues should be litigated in each state or in the congress. it's not something for the president to make law or the attorney general to make law. that's why i use the word fiat. i think that why we're speaking as we are. >> it's interesting, too, how it was done, and it takes effect tomorrow. boom, 48 hours and it's in effect. it's a policy within the justice department, but you say it could be a slippery slope. >> it is a slippery slope.

because all civil and criminal matters involving the federal government are now going to involve no discrimination at all between gay couples and straight couples. >> no matter what the state law says. >> that's what i was going to say, pat. no matter what the state law is. if a massachusetts couple has an issue in alabama involving federal law, it's the federal law, not alabama law, that croy controls it. >> i asked the question before we went to break, where have all the jobs gone? to get the conversation started, john on my twitter page says, many of the jobs have gone underground, working off the clock and off the book. senator portman was asked about this issue today, and the economy, and the tie-in now with the affordable care act and this message from this bipartisan report that perhaps it's better if you work fewer hours, take advantage of the subsidies and health care. you don't have to work as hard, get fewer people working full-time jobs.
