taking heat from new critics who want the name changed. who and what is behind this controversy. on the kelly files, right now. we have learned the house judiciary committee is planning to push back. president obama is accused again of ignoring the constitution and overstepping his authority. we brought you this news last night about the president's decision to delay parts of the obama care law for certain employers. this marks more than two dozen changes he's made to the affordable care act without ever going through congress. and while executive orders are nothing new. this newest edition prompted angry new reaction from lawmakers. joining the growing number of voices who say this president is going too far. here is some of what we've heard in recent days.

>> we have an increasingly lawless presidency. congress doesn't write laws, presidents do. >> what this president has done is to repeatedly change laws. even laws that he himself has pushed through congress. for his own political benefit. >> he's violated the law, he's exceeded his constitutional authority. >> this president seems to have an extra frustration and reacts to it for un lateral reactions that are counter productive. and borderline unconstitutional. >> for the president to simply declare i'm going to change this law that congress has passed is unconstitutional, he's outside the bounds of his article ii limitations. >> he has a pen and a cell phone, the american people have a constitution, and the constitution doesn't give him the authority to unilaterally change the law. he has to come to the president to do that. >> this president and this administration enforce the laws they choose to enforce and ignore the laws they want to

ignore. this is the very definition of lawlessness and something the american people do not tolerate and will not tolerate, nor should they be required to tolerate. >> you just heard article ii of the u.s. constitution. it establishes the executive branch and outlines the powers of the president. granting to him the authority to execute and implement the laws of the united states. where does implementation end and rewriting begin? the constitutionality of this president's behavior turns on that question. more and more legal scholars from the left and right are saying that president obama has crossed a constitutional line here. we have team fox coverage on this tonight with ed henry. former federal prosecutor andrew mccarthy and brit hume. we begin with ed henry live in washington, who's covering the decision that touched off this new reaction, ed? >> good to see you, megyn.

a lot of big foreign policy issues to tackle. it was a nagging domestic matter that was also brought up by a reporter. the president tried to make two big points to push back on what you're saying, he said that all he's doing with this latest executive action is buying people more time. giving them a transitional time to deal with the new law. but republicans pushed back and said, wait a second, what it's really about is buying more time beyond november. basically delaying some of the unpopular parts of the law. democrats particularly in the senate don't have to explain the voters what's actually in the law, they can delay that until after the election, the second point the president made today, he said that this only affects a small number of people. in terms of this change for median sized businesses. we checked the numbers, and it turns out that it affects about 7.9 million people in terms of companies that have employees between 50 and 99 blemployees tt

have now seen these penalties, delayed until 2016. final point i make is that today at a congressional hearing, the nonpartisan chief of the congressional budget office was pressed by republicans. what kind of impact will these more than 2 dozen executive tweaks to the health care law. what impact will they have on part time jobs. the chief said i don't know, i have health care experts right now working on it overtime. trying to figure all this out. >> ed, thank you. turning now to discuss legal and other questions, andrew mccarthy, a former legal prosecutor and contributing editor for the national review. he can implement the law, he cannca cannot flout the laws, he cannot rewrite the laws. how do we know that he's crossed over? >> he's got first and foremost, he has a constitutional oath

that he takes to faithfully execute the laws, and what that means is, he has to execute them the way congress has written them, the laws are not recommendations, they're the rules under which we live as prescribed. now, he's got some leeway to, if you're dealing with criminal statutes, there's a doctrine called prosecutorial discretion. which means you don't have to enforce every instance of violation of the law, because resources are finite and you have to allocate them in a sensible way. maybe you decide to go after drug distributors rather than drug users. >> okay. >> those are the kinds of divisions that get made all the time. he's also got leeway if he believes congress has passed an unconstitutional statute. >> we've seen that. >> at least until the courts resolve that, he's got a good faith reason not to enforce a law, he believes --

>> how do you get -- you say but he must execute the laws that congress passed. now, obama care, he likes this law. >> right. >> and they passed it because he pushed it, signed it into law. lawmakers are saying, he's gone too far here, for example delaying this employer mandate until 2016, because there's a provision in the law that specifically says, this is section 1513 of the law, that says, penalties and employers shall apply to months beginning after december 31, 2013. they shall, they're supposed to kick in after 2013. what allows him to cross out 2013 and 2016? >> he doesn't have any authority to do that, because it's a constitutional law. we may think it's a bad law, but there's no question that it's a constitutional law. there's no question that the president believes it's a constitutional law. if it's constitutional, he has to faithfully execute it the way it's written.

he doesn't have authority to change the terms. >> the reason that employer mandate and these other provisions within obama care are important, is because they work together. the whole law of these provisions work together. you have to have the employer mandate kick in, so you can have some of the funding, the individual mandate and so on. they're supposed to be paying for a lot of these benefits that were given out under the law. >> that's a great point. it's not his money by the way, if you -- in theory, if you wanted this law to work properly, and whether it's a good idea or bad idea. the people who are implementing it, should want it to work properly, the money is the public, it doesn't belong to the president. he doesn't get to say, you know, i don't think i'll collect this three year's worth. that belongs to us, it doesn't belong to him. it is a law again that he has no constitutional qualms with, he must implement it as written. he does not have discretion.

>> he sees things since we're on change number 28. that's not even counting these other executive actions. you and i talked before about this, about what the congress's remedy is. as a practical matter, it's either to defund a law that they don't think he's implementing properly, or to impeach him for not doing his job as the chief executive? they tried to defund obama care 44 times, didn't work. >> right. >> as far as impeaching the president, there doesn't seem to be any political appetite for that in this country right now. what are they to do. on capitol hill, they're talking about more legal action against him. >> the two tracks are not mutually exclusive, they don't just have to defund obama care, they can start slashing the president's budget on all kinds of things to try to bring him to the point where he faithfully executes the law. as far as the case for impeaching the president is concerned, i do think the lesson

of the clinton impeachment is, it doesn't matter how many high crimes and misdemeanors you have, and not faithfully executing the law would qualify, is there a will in the american public to remove the president? if there's not, it doesn't make sense to start going down that road. but the case still has to be made. >> what do they do? sit back and watch it? >> no, they should start slashing money, today. the house of representatives does not -- you know, look, congress has to approve money that gets sent. i know they'd like everybody to believe everything's on auto pilot, they're impetent. they can stop, the government can't do anything unless the president signs off on it. joining us tonight, brit hume. just trying to rub it in that

he's in florida and you're not. let's pick up where i left off with andy. there's no political will to impeach the president. there is among some people in the country. what is to be done in. >> that's a political matter, it's worse than that, you think about these delays that the republicans are objecting to on constitutional grounds. on policy grounds, these are things that they favor. in other words, if a bill were before them, to delay these various mandates, which is a big piece of what he's done here, they'd all be voting for it, so they could go to -- and you heard it came right back on him from harry reid. all those republicans you heard him checking. they didn't like these mandates, now he's delayed them and they don't like that either. as a political matter, not as a legal matter, that's not a bad argument. they're in kind of a bind here, they all voted against the law to begin with, so if they went to court, for example, to argue they were being hurt by a law --

failure to enact the law they impo impose. there they are, they're not in a good position on this. >> they seem to be concerned about a precedent here. if they allow the president to just sort of do -- let's say, make it 48 changes to obama care, where will it end? >> that's right. and it does raise this question that at some point -- if we had an aggressive mainstream media on this story, the question would be put everywhere that what is eliminating principle here. why couldn't the republican president, one were elected in 2016 simply delay the whole law until 2080 as someone suggested today. the administration has articulated no limits of this principle, they're talking vaguely about implementation authority that applies to tax

laws. because the penalty has been found by the supreme court that they have attacks. maybe some of these, but not for this individual mandate that's been delayed. that's explicitly set out in the law. and they have a case. there is a strong case, but members of congress. republicans in congress are not in a good position to say anything. >> but the question is, how does this play out? they're not in a great place, to hear the growing chorus on capitol hill, and you hear it in the public talking about how 72, 73% believe the biggest threat right now is big government. and it's getting bigger by the minute. >> all that is true, you're looking for a way to deal with it, this is what elections are for. we got one coming up later this year. people can go to the polls and

express their dissatisfaction in the way this is all being done. they could certainly vote against the president's party in 2016 when he won't be on the ballot, and that would give them a chance to vote for a candidate who might take stronger action to either repeal this law or enforce or stall implement in the way the president is trying to do it. but what they can't really do is go in and say, we are going to go to court and say, we don't like this on constitutional grounds. they have to be directly affected. it's possible there are people in this country who will be negatively affected by -- they might have standing to sue. and if they did, my sense is, they would -- if they could -- the court would recognize them as a legitimate plaintiff, in some kind of legal action, the president would be in trouble. >> that might change things. the great difficulty in government lies in this, you must first enable the government to control the governed and then in the next place, a budget

their leadership to get this thing through, and get out of town before the blizzard. >> how do we go from -- we have to take a stand. we can't keep raising the debt limit on the backs of our children. we need these concessions from the democrats on spending. we can't have a constitutional crisis, we need to vote for this right away. >> these republicans that they say that they're going to fight a president who uses executive order to change laws and do things that they say is unconstitutional. they make an awful lot of noise. when you get down to brass tacks and this was sure brass tacks. this was a moment they could have exacted a price from this president, we're going to skate right on by, $18 trillion, they could have exacted some price for this, and they were unwilling to do so, because they would have rather had perfect voting records and said, i never voted for a debt ceiling increase, and allowed the debt to go up anyway. if that's the best they got,

they are totally talking out of their ear when they say they're going to fight him on extra constitutional authority and all that stuff. >> right. i mean, i don't even get how politically these republicans who wantsed us to believe they were so principled on the debt ceiling can turn around and continue claiming that, i'm not advocating one way or the other, i'm noting the sudden shift from 234e6r, it's horrible, our children, to -- okay, here you go. >> as long as i don't have to do it, as long as somebody else does it for me. marco rubio gave these guys a way out. he said, you can't have obama care if you don't have the obama care bailout. at least make the senate vote on enacting those obama care bailouts, so you can get senate democrats on the record. >> say, no, we're not in favor of bailing out the insurance companies. >> or say, we are in favor of bailing out the insurance companies. and at least would have been good politics. the democrats are good at politics. they're good at forcing

new outrage over the washington redskins name, as a pair of lawmakers writes to the nfl commissioner saying the league is on the wrong side of history, and it's inappropriate for the league to profit from the degradation of tribes. the redskins were quick to react saying senator cantwell should be aware that there are many challenges facing native americans, more pressing than the name of a football team which has received strong support from native americans.

forecasters rarely use as they warn people to brace for crippling ice that could leave the region in the dark for days. >> some of the language from the national weather service, high impact, life threatening. epic proportions, historic proportions, paralyzing. if you're in your home right now, you might not get out of there for days. we could see infrastructure problems because of a crippling ice storm that is unfolding right now across the southeast. are we seeing this next wave of pressure across the south moving into texas, arkansas, louisiana, mississippi. the real big event is going to happen across georgia and the carolinas, where we're going to see hours of freezing rain on the roads on the power lines, we could see have an inch to an

inch of ice which is deemed crippling, destructive and life threatening. this is extensive for all of these folks in the southeast. then we're going to be dealing with a nor'easter for the northeast. the big story is this crippling, once in a lifetime in some cases ice storm for these areas. you hope for the best at this point. because if the forecast comes true, this is going to be so destructive. we're going to see this move up toward the northeast and mid-atlantic where we could see impressive snowfall totals from wednesday into friday. this is a big event. people need to pay close attention to their local forecast. >> thank you. >> you got it. >>. new attempts tonight to push back against the irs, as it stands ready to crack down on conservative groups again. the irs claims it's narrowing

the scope of what these groups can do for purely innocent reasons. this is really an attempt to remove conservative groups from the public square all together. dave camp is the chairman of the house weighs and means committee. he's with me now. good to see you. we have the iris saying sorry about all that stuff we did before, we got the perfect solution. we'll just shut down these conservative groups and other groups. even though it's largely a conservative issue. from engaging in voter registration activity right before elections, and that is the solution to all that problematic behavior we engaged in over the past couple years. you say what? >> today in the committee we passed a bill that would delay this proposed rule for a year. get it outside election, let us complete our investigation i don't even have all of lois lerner's e-mails yet. to pick out what we call the

social welfare groups and target them is putting into a rule the rule we found out about months ago. they don't do anything about unions, chambers of congress, they don't do anything about charitable groups. they go after these groups. that's just wrong. we need. >> the irs will go forward, the conservatives won't be able to do that, the unions can have at it, that's no problem whatsoever? >> unions can go forward, they can do all their get out the vote, voter registration, these groups that have been targeted already, this adds insult to injury. now they're going to put them out of business. >> let me ask you this, they say, the only reason we're doing this is because we're so confused, that's the only reason we targeted conservatives in the

past couple years when they applied for tax exempt status, we kept their applications pending for months and years. we were confused. we're going to pass this new rule that says whatever kind of entity you are, you can't do this stuff before the election. you say that's bull and that you think they've been laying the foundation for this crackdown on conservatives for years? >> we have gotten some e-mails, one of the e-mails from lois lerner says it's going to be offline, not for public view. there was no confusion, i mean this has been law for 50 years, the groups knew what they were doing. this was brought to the attention of washington officials and the irs because of media attention, not because of confusion. the rules are clear and the

groups were following the rules. >> the crackdown on the influx, the sudden spike in conservative groups applying for tax exempt status. the crackdown on them only began once you had media attention on how many groups were applying. the irs needs to do something about these groups. and suddenly there was confusion at the irs about them. let me ask you about this e-mail, lois lerner who pleaded the fifth, will not answer questions and will not give you documents. she's now suddenly retired on the taxpayer's dime. she was on the receiving end of an e-mail from someone at treasury that uncovered, your committee, that says this is to lois, the person says, i don't know who in your organization at the irs is keeping tabs on c-4s, but since we mentioned addressing them off plan in 2013, i have my radar up and this seems interesting. she sends an e-mail that talks

about illegal justification for going after such groups. you can bury them in paperwork, and get all sorts of questions you demand answers for from these groups. what does this mean that the treasury person is saying lois lerner says let's come up with this plan off plan, offline. >> it means not in the public view. it's very concerning, that's why we need all the e-mails, we need to get to the bottom of this, we don't have them, and hopefully the irs will cooperate. what this means is treasury was involved as well. this also means it's centered in washington. this didn't start in cincinnati, this wasn't based by a few rogue folks, and it's more widespread than what's been reported. this is bad from the get go, and the fact that they're trying to

we're tracking the fallout tonight from a detailed new report on the benghazi terror attacks that led to the deaths of four americans on september 11th, 2012. it's been months in the making and it takes aim squarely at the white house. in anticipation of the september 11th anniversary, white house officials failed to comprehend or ignored the deteriorating situation in libya and the growing threat to u.s. interests in the region.

>> congresswoman, good to see you. how do you put that on the white house as opposed to the state department as we've seen in so many other reports? >> the big takeaway is, we were unprepares, we know that we wouldn't have lost four american lives if we weren't. what is breathtaking is the lack of communication from senior white house officials to those that were on the ground in the days and weeks leading up to it the night of the attack, and one example is, general hamm, he's a commander, he wasn't asked, despite the repeated threats in that area, if he had all that he needed. and so -- this comes on the heels of a press release, the white house sent out on september 10th saying, that we were okay. that we were prepared. as you know, the next day, the terrorist attack happened and we lost four american lives. so it does fall right at the

feet of the white house. right at the feet of the commander in chief who has the responsibility over these senior national security officials and should be held accountable. >> has there been any evidence that that failure was the political consideration of the white house. the theory has been the president was wary of beefing up security in our compound in benghazi, because the message he was sending to the american people in the midst of his re-election battle is, all is well. >> we took politics out of this investigation. this was never about republicans or democrats or elections. this was about what happened in the days and weeks leading up, what happened that night, and what can we do to prevent it from happening again. this subcommittee was focused squarely in on military and dod. what assets we had, and what we didn't have. >> let me ask about dod. i know your report concludes that dod officials believe this

was a terrorist attack. and not some sort of a protest gone awry. i want to get specific, so many people have said, why did susan rice go out and talk about protests? why did she mention a video? the cia talking points. the very first draft that went out and circulated at susan rice, ultimately was provided, top officials ultimately saw talked about a protest. they did. the cia came out and said, this is a draft from september 14th, we believe based on currently available information that the attacks in benghazi were spontaneously inspired by the protests at the embassy in cairo. does that answer the question, about how how our officials came out and talked about protests and the video? >> we have a senate intelligence report that was issued a few weeks ago, that absolutely

states that we have the intelligence to prevent this from happening. that falls right in line with the findings of this committee, and their report and our report, the subcommittee report, never was there a question by the folks on the ground that this was not a terrorist attack. they knew it was a terrorist attack. they never questioned it, there was recently a letter sent to the president by senator mccain, senator graham. they're asking the question of the president based on the inconsistencies that we see go through our investigation and the senate intelligence committee. get the story straight. >> right. >> my question to you is, as someone who has investigated this, do we already know the answer how the business about the protest and video got injected into the story. i'm looking at the talking points that were reportedly given by the cia to those involved. and the very first bullet point from our intel community is, we

believe the attacks in benghazi were spontaneously inspired by the protests -- not protests in bengha benghazi, but by the protests that had been taking place in cairo, and those evolved into a direct assault on the benghazi complex. the question really is, where did the cia get that information from, if you're telling me in this report dod knew instantly this was a terror attack. where did the cia get it was all inspired by the video? >> that's a great question that would lead into the what's next. there are other committees that have jurisdiction over this. my subcommittee was based solely on the department of defense and establishing that our commanders on the ground, all the way up the chain of command to general dempsey, made very clear this was a terrorist attack, and so my colleagues that are going to continue this investigation across other committees should demand and they will, the cia, answer that very question.
