"the factor" begins right now. hi, i'm bill o'reilly, thanks for watching us tonight. an outrage in afghanistan. that is the subject of this evening's talking points memo. this man, afghan president hamid karzai, doing everything he can to humiliate the usa and destroy his own country. today karzai ordered the release of 65 captured taliban terrorists who were supposed to be tried for crimes against civilians in their own country. these killers have also been linked to the deaths of 32 americans and allied troops, according to the u.s. command. right now there are about 38,000 americans in afghanistan and there's little doubt the men released today will kill them if they can. but karzai doesn't care.

>> afghanistan is a sovereign country. it's the afghan judicial authorities decide to release a prisoner, it is of no concern to the u.s. and should be of no concern to the u.s. and i hope that the united states will stop harassing afghanistan's procedures and judicial authority, and i hope that the united states will now begin to respect afghan sovereignty. >> karzai is simply a despicable person. talking points is not monday morning quarterback but i can tell you what i would do if i were president and commander in chief. i would have u.s. special forces deal with those released terrorists, quietly and effectively. u.s. embassy in kabul has issued a statement calling the release regrettable. what's really regrettable is how the entire afghan campaign is falling apart.

for 13 years america has tried to stabilize that country, giving afghans freedom and hope for a better life. women have been freed from virtual salavery, children are being educated and karzai spits in our face. so far it's cost the taxpayer about $750 billion. more than 2,000 american been killed, almost 20,000 wounded. there comes a point when diplomacy just doesn't cut it. karzai has been lenient on heroin merchants, has overseen a corrupt government that is stealing billions and is now putting coalition forces in danger. he's supposed to leave office this summer but in the meantime will not sign a security agreement with the usa that would protect his own people from the taliban that will surely try to retake that country once we leave. president obama is faced with a very difficult situation over there. he needs to impose some power simply in order to protect the americans he's directly responsible for, the guys and

gals over there now. as for karzai, he's a villain who should be tried for corruption in the hague. now for the top story tonight, reaction with editor of the daily caller who's fed up with the afghan campaign and bret stephens who says our effort is worth it. why? >> i guess in two sentences. if we had the advice and gotten out in 2009, we never would have gotten bin laden. if we got out right now, we would have been proven bin laden's contention which is at the end of the day, americans always cut and run. that's why he struck us in 2001 and that's a point we don't want to see proved. >> how much abuse are we supposed to take? this is abusive to let these guys go. there were many in the afghan government who didn't want to let them go. >> right. and it's despicable. >> so how much abuse do we take, we the taxpayer and the military, and the president has to protect our 38,000 guys over there. and now karzai is actively putting them in danger. >> right. and we should above all protect

our strategic interests, bearing in mind that karzai will be gone in june. the united states government spends $10 billion a day so our entire afghan campaign comes to about 75 days of u.s. government spending. >> $10 million. >> $10 billion. >> it's $10 million. >> we spent billion a day. >> oh, you mean overall, not in afghanistan. >> so when you say $750 billion, keep that number in perspective is what i'm saying. >> well, okay. what are we getting out of this? the karzai family war lords are getting rich. he's spitting in our face, as you said. in return what? what's the upside exactly? afghan girls are going to school. that's great, but that's not in our strategic interest. we're not acting in our interest. we can't even install an obedient puppet. by the way, after thousands of americans killed, we have the right to do that. the bottom line is we're not a good colonial power. we're not good occupiers. the british weren't, the soviets

weren't, we were never going to be. >> get out of there now, if you just say okay, karzai, forget it. because he's going to leave. as soon as we leave, he's going leave. >> remember the 2500 members unanimously voted for the bilateral security agreement. >> the afghans want us there. >> we don't have a moral obligation to help the afghans. we have an obligation only to act in our own interest. >> it comes down to two words, obama and the strategy that this administration has pursued in afghanistan. number two, karzai, a despicable, corrupt, incompetent governor who will -- >> let me ask tucker a question. if we say, okay, we've had enough, like we did in iraq. the reason we pulled everybody out of iraq is because the iraqi government wouldn't assure that our soldiers wouldn't be prulted -- prosecuted by iraqis. so say we pull out. you know the taliban will retake the country. you know the afghan forces can't

stop them. so you have another lawless state where all the al qaeda will gather and we're back to 1999. we're back to exactly before 9/11. >> the first thing we ought to do is recognize -- >> but deal with that question. we're back to where we were in '99. where there's a lawless nation, harboring al qaeda and letting them do whatever they want. >> it's possible -- >> no, it's going to happen. >> no, here's what's possible that there's no option to that. that it was always going to be that way, we've only forestalled the inevitable and let thousands of americans company. >> that's not inevitable. >> some conservatives say the government who's unable to run a health care website, say it has the power to create a civil society? >> we should not have been nation building in afghanistan. our job there wasn't to build roads and schools. our job was to make sure that the taliban wouldn't come back to power and we'd have drones that could hit al qaeda again

and again and again and have a base to ultimately get bin laden. >> i don't remember that at all. i was here for the bush years. i remember our job was to liberate afghan women to go to school. >> well, the country becomes developed enough to fight against these people. it's not working right now because there's bad leadership. i think -- i think power could be used there. we only have 38,000 troops left, all right. that will go down to 10,000 before the president is out of office. but right now i think he's got to show some power. i'd arrest them. i'd arrest karzai. i would arrest him. >> you know what, by showing american power in the first place, we have revealed our weakness. the most powerful country nld world can't subdue -- >> it didn't work out in iraq, it's not working out in afghanistan. maybe we get a surge, arrest karzai, we put in a puppet who will at least do the right thing here. i think we have to do it. gentlemen, thanks very much. next how liberal is hillary

have at least some snow on the ground. every state except florida. one guy in the northeast said snow has become a four-letter word. we'll have complete coverage at 10:00 eastern, 6:00 central. back to the factor. will the real hillary clinton please stand up? the form secretary of state and senator from new york has quoted both the far left and the moderate wing of the democratic party. a new poll says she is running well ahead of all potential republican presidential contenders at this point in time. joining us from washington with her assessment of mrs. clinton, laura ingram. how liberal do you really think she is? >> well, bill, she's probably a lot more liberal than your viewers or i would like, that's for sure. but she's also not as liberal or progressive or left-leaning as the folks in like the net roots nation like. that's that group, a very

progressive group. group like think progress and all these other organizations that find lots to be dissatisfied with with the obama administration, of course, of which she was a part. number one, nsa surveillance, they're very unhappy about that. hillary clinton didn't really do anything to voice her opposition to what was going on at the nsa. they think she's too corporatist in her leaning. >> in relation to president obama, is she more liberal, less liberal or the same? >> it's probably a little less liberal than obama, to tell you the truth, but again, i think she comes from more of the establishment wing of the democrat party. she wouldn't be -- wouldn't be pulling us out of every military conflict. the left really wants us to do that. and i think they're unsure. they hear people like brithe montana governor out there almost making the case for his

own candidacy in the future and he's worried that she might take a hard right turn if she's elected. i think that's ridiculous. >> well, if she's a realist, she'll do what she has to do. i think she'll repudiate a lot of the president's economic policies because you absolutely have to. this poll comes out and she's just whacking every republican. i mean i'll just give you an example. clinton/christie, 58 clinton, 37 christie. that's big. >> yeah, i mean the -- she's still more -- you know, she's still more from the establishment side of things. but if you run an establishment republican. let's say you run jeb bush against hillary. let's say that what it is. >> do you want the poll number on that? >> yeah, it's bad. >> clinton 58, bush 38. >> yeah, about 20%. so look, i think if the choice is kind of two establishment figures, the democrats always going to win that. the democrats not going to lose that contest. so there's concern both on the left, bill, it's very interesting, and the right of

the activist types. they don't feel like their party leaders are necessarily doing all that much to advance their agenda. look at obamacare, it's turned out to be a complete disaster. everyone put their hopes into that but they wanted a single payer. they didn't get single payer. >> she's going to have to run repudiating a lot of this stuff just to build a base among the independents and among people who aren't ideological. she's going to get all the left wingers as much as they complain about her. they're still going to vote for her. >> they hate tea party types and conservatives more than they hate establishment democrats, so you're absolutely right about that. >> the gender thing will be big. and any time you criticize her, then you'll be anti-woman. >> yeah, that's a snore. but elizabeth warren i think is interesting to a lot of folks on the left. martin o'malley, but hillary, if you have to bet today, it's going to be hillary and probably jeb bush. i think a lot of people will see a replay of the establishment

clintons, james carville. i said that miss clinton is going to have to repudiate some of president obama's economic policies if she wants to win the presidency. was that an astute observation, carville? >> i would have said that she'll have to have some different -- she'll have to differentiate herself, she'll have to add things. i don't know if there's any economic policy that the president has that she would repudiate but she may say we need to do more things. >> more entitlement spending? >> well, she's not going to repudiate it. she's certainly not going to repudiate the health care act. it's starting to work now. >> you know, you tell me that but all the other people say the health care act is still a mess and chaotic. so i don't know why i should believe you and combs because you guys are rooting -- it's like, you know, you have a basketball team in new orleans, your hometown. the pelicans. why would any team be named the pelicans? what are they, diving for fish at halftime? but the pelicans are not going

who's really an ideological man, barack obama, and his wife is too, michelle obama, who has a lot to say behind the scenes. so here's my next question. i don't think hillary clinton is that liberal. i just don't. i think she mouths it, but in her heart i think she's just going to do anything she can to win. if that means saying she loves to watch "the factor" that's what she's going to say. >> you know, i think if you look at her history, first of all, she's pretty committed to the children's issues. she was on the board of the children's defense fund. she's certainly a lot of things but she's not in terms of foreign policy as secretary of state -- she's not -- she's not -- she certainly believes in some interventions and she believes in muscular foreign policy. look at health care. when she was first lady, she was very involved in trying to pass a health care act. somewhat different, but certainly trying to insure everybody. i think she's pretty open-minded. but you're right, she is a

first, the latest on the storm that's tied up travel across the country. more than 10,000 flights delayed or cancelled as hundreds of thousands, 800,000 at last word, people in the south still wait for their power to come back on. this time it's north carolina's turn to clog the roadways. crews working to remove all the cars that folks just abandoned overnight. some spots in the mountains got more than a foot and a half of snow. the lower level areas got closer to 6 inches. now philly is getting the worst of it. this marks its fourth storm with more than half a foot of snow and that's a record since they started keeping records more than a century ago. more than 800 to a,000 national guard troops. much of the storm is moving on out, a little left for new york. a few more inches here maybe. some more for new england later. in fact we'll get it all to you in a valentine's day forecast in a special edition tonight at

roll. >> he's arresting me. >> when we responded to this rollover accident, this is when our crew caught this scuffle on camera. a driver of a chula vista fire engine put into cuffs by chp. we're told this happened when he refused to move his engine truck from the freeway during this accident. >> all right. this is south of san diego, chula vista, so obviously a serious accident. the guy, the firefighter is trying to treat the guy. the cop says your truck is blocking traffic, move it and they arrest him. what happened? >> so ridiculous. did you see that white car? overturned. the victim with the whole neck thing going on. another fire truck -- there were only three, had just been sent away to help victims in another accident. now they're down to two and this cop removes one of the two. this guy was administering aid to the victim of the car crash. >> so what happened to the firefighter? what happened to the cop? >> his fire truck was in the fast lane and the cop wanted him to move it.

the firefighter said no, i'm kind of busy right now. and the cop in my view on a power trip decided to put cuffs on his fellow emergency responder, put him in the car. no charges were brought. it was a power trip. the guy had to sit there for an hour and was removed from helping the victim. >> what happened to the cop for doing it? >> nothing. now they're in a turf war. now they're saying we'll work together in the sglurt was that a chp cop, state cop or local? >> i think a state cop but they're both speaking to it now, both chp and the locals and they'll say we'll try not to let this happen again. >> that would be a good idea. >> the firefighting association says this is outrageous what they did to our guy. >> "the kelly file" coming up right after us. you've got a lot of good stuff, right? >> we do. mitt romney. >> watters is on deck. we showed him the snow and then we forced him out the door to cover the snow and to answer a very simple question. is god punishing new york city? right back with it. en caws
