this is the administration's big priority and the chief domestic accomplishment and everything is riding to them getting it right. if they didn't know, you would think that heads would roll. i don't know if it is number one or number two and that no one in the top knew. i am surprised we haven't seen anyone major fired over this. >> a fox news poll expresses doubts if the americans would support it. and don't think that congress woulds in necessarily passed. 28 percent say yes. and 64 percent say no. what does that tell us? >> in that poll, you had another interesting number. and that if they are happy that obama care passed it or not. 55 percent were not happy it

passed. there are a lot of different polls on obama care. some say they don't like it because it didn't go far enough. but 55 percent is a telling number. and that's what the democrats will face with the voters. what we are realizing, the individual stories of people with cancer and preexisting conditions helped democrats, but they are swamped by people thrown off their coverage. the bad news is overwhelming the individual good stories. >> and yet other polls suggest that americans don't want the law repealed wholesale, they want it fixed. >> that is a challenge for republicans. president obama is used executive orders to delay to try to fix it and trying to preserve

and the sun angle is high enough in the sky that is aiding. and down south where there is the ice storm temperatures are warming up. it is still cold back behind this. one storm that brought all of the snow and ice in the south, that is gone. we turn our eyes to the next one which brought snow? dakotas and iowa and missouri. this is developing and continues to slide over the central part of the east coast and ohio valley and tennessee valley. and bringing rain to the south. what happens tomorrow around noon to 3 o'clock is a new coastal storm. it is around philadelphia and up to new york. and this explodes in a monster storm a little too late for hyg impact. we'll have windy conditions in maine and massachusetts. blizzard conditions for a short period of time.

here is another entry to the dumb criminal list. attempted burglary captured on surveillance video, and the the suspect tripped a utah jewelry store alarm breaking glass cases and finds himself trapped inside of the store. you can see him trying to escape through the bulletproof glass front door. >> he hit the case and tried to get into it. and the shatterproof glass wouldn't let him in. he made a mess. >> he gave up and started to smoke a cigarette on the floor and waited for the police and did not resist arrest.

>> one way to do it. pressure mounting in the state of oregon over a dysfunctional obama care website. that state is yet to sign up a single person for health insurance on line despite receiving 160 million in taxpayer money. there is a call for investigation. how are doing, jay. good day to you. >> depend day to you. >> they bring money back and give the money to where it belongs to. can you do a call back on a case like this? >> in a situation like. this first thing to do a recoupment of the funds that are given is for there to be an investigation and so what happen. hundreds of millions of dollars spent and not a cipe up. you have fake front pages of website and no substance and it doesn't work. similar to the obama care roll out except for the state.

and the legal challenge has standing to do that and congress comes in and justice department try to recoup that money. you have to have an investigation to find out what happened. >> and on that front, one legislator went to the fbi, you have top officials resigning and a state investigation in oregon, and yesterday, republicans in calling are ca -- congress are calling for a federal probe. >> they could sue to get it back if there was a misappropriation and the people of the state of oregon, citizens of oregon and taxpayers may have a standing although that is more difficult. but the fact if there is misappropriation or negligence, the federal government can say we need the money back for the

taxpayers. it was not spent the way it was supposed to be. it is serious problem to get to the problem with. >> specifically that is in oregon, you have 16 different states that set up their open exchange. you think it is a bigger problem and how so and where? >> we are not getting data. there is not numbers coming forward. people will call in and i ask if they got an policy and paid for premiums. no one is. i am sure people have gotten them but we are not seeing the numbers. my concern is in addition to the problems in the federal exchange that are significant. some states may be experiencing not to the degree of oregon where it is 0, but the numbers are so low, that it will throw the entire system out of balance. in the end of the day, if the

young people don't sign up, the whole obama care whatever you call it doesn't work economically. not many people are focusing on the economics, but they look at numbers. >> just to the last point and then i have to run, jay. if the numbers don't add up and the math is not there, what do you do? in the past washington goes out and finds more money; is that what they would do here or would that be stopped? >> i don't think you have enough money to fix. it you are talking about billions of dollars. the president seems to be using executive orders these days, perhaps it would be this didn't work and the bill is gone and they reverse. just because the economics don't work out. or do they come back to a single payer system.

number of flight delays in 25 years and u.s. airlines had to scrape them sense december 1st. according to the national oceanic and atmospheric association snow is on the ground and only florida is snow free and hawaii has snow in the volcano peaks. and millions lost power as the storm moved south to the northeast. 21 people have died including a 36-year-old pregnant woman who was hit by a snow plow. doctors delivered her baby in a emergency c- section and they performed under 60 seconds to save the baby. the boy, is in critical

oscar pistorius breaking his violence a year after the shooting death of his girlfriend. the trial is set to begin in less than three weeks. >> it's the first anniversary of the kill iing of reeva steenkam. he feels sorrow for the trauma of the death and goes on to say, no words can capture my feelings

about the devastating accident that has caused such heart ache. accident is a e key phrase. the legal team claims he thought there was an intruder in the house and acted in self-defense when he said he mistakenly fired four shots into the bathroom. the prosecution is assembling 107 witnesses including a close friend of reeva steenkamp all to prove ultimately that the killing was premeditated murder. there's no death penalty in south africa. there's no jury either. just one judge and she will be casting the verdict in the case. it is a woman with a background in social issues. that got women activists very happy to hear. and with such a high profile personality as oscar pistorius, huge media attention is expected. it should decided in the coming days whether there will be cameras in the courtroom. not usual for south africa. not stopping a 24/7 tv channel
