we have just learned the jury hasached a verdict on four of the five counts, they appear to be hung on the fifth count. the judge has brought the jury in. this is a dynamite charge where he tries to push and shove and cajole the juror into going back into the jury room to deliberate more. >> i am required to read to you an additional jury instruction. i'm going to read that instruction to you now. and then i will provide a copy of it to each one of you when i'm finished reading it. i know that all of you have tried hard to reach a verdict in this case to each of the counts. it apparently has been impossible for you so far. sometimes an early vote before discussion can make it hard to reach an agreement about the case later. the vote not the discussion might make it hard to see all sides of the case. we are all aware that it is legally permissible for a jury to disagree. there are two things a jury can

lawfully do, agree on a verdict or disagree on what the facts of the case may truly be. there is nothing to disagree on about the law. the law is as i told you. if you have any disagreements about the law, i should clear them up for you now. that should be my problem not yours. if you disagree over what you believe the evidence showed, then only you can resolve that conflict if it is to be resolved. i have only one request of you, by law, i cannot demand this of you, but i want you to go back into the jury room, then taking turns, tell each of the other jurors about any weaknesses of your own position. you should not interrupt each other or comment on each other's views until each of u you hayoud a chance to talk. if after doing that, if you still cannot reach a verdict,

come back into the courtroom and we will charge the case on that count. you may now retire for further deliberations and we will provide you a copy of this instruction. >> sure enough, the judge read what's known as a dynamite charge, an allen charge, it's a standard jury instruction in most jurisdictions of the wording approved by higher courts that really tries to get the jurors who are hung up on one or more counts to go back to the jury room and try to reach a consensus. you heard the judge reading that standard jury instruction. in case you're just now joining us, we have learned that the jury has reached a verdict in four of the five charges against michael dunn accused of killing a young man over loud music, he claims self-defense. but he's charged with murder and attempted murder. and so now the jury goes back to

>> it seems a majority of americans absolutely disagree. a brand-new fox news poll shows 674% of voters think the irs' targets of conservative groups is an example of corruption at that agency. this comes as several democratic senators believe it or not are calling on more tax o' ---ahead of some tough re-election bids ahead of their midterm elections. let's bring in bob kuzak. before the break, we showed the president in the o'reilly interview, basically saying it was just some bone headed decisions by a couple of bureaucrats in the senate office a. since the president made that claim, the ways and means committee has released e-mails including one from lois learner in which she calls, quote, the

tea party matter very dangerous cincinnati should probably not have these cases and we know that it was then sent to washington. dealt with by five deputies and associate chief councils. doesn't that utterly undermine the president's claim? >> there is no doubt about it that the tone that the president took in the o'reilly interview, vastly different than last year when this came to light nearly a year ago, when he said this was inexcusable, was outrageous and they were going to get to the bottom of it. and clearly washington was involved was obama asked for the irs head to step down. it's been almost a year and there's been no indictments and i think the president could have been getting ahead of himself. why? because as you mentioned the ways and means commission is looking into this.
1:53 pm
>> the e-mails may be the smoking gun in all of this. they came up with new rules specifically targeting conservatives and they did it, we learned in the hearing recently, they did out all in secret. look, bob, does it look as though, to the average person that, you know, this is a president who's trying to sweep the irs scandal under the rug? no punishment, no accountability? >> the tone is just so dramatically different, we're in an election year, the president is aiming to just make sure that the democrats retain the senate. so i think he's trying to make this, the republicans a partisan issue in the house. that's the danger for him in the senate. that's a bipartisan -- certainly the president wants to move on, he wants to talk about other things, o'reilly pressed him on it and he made those comments. we'll see when those investigations are over whether
1:54 pm
that's what they found. >> it's always the documents that underlines your claims. but look, here's the other thing that we're finding out about. just when you think the folks in washington would want to counsel the irs to, you know, you got to back off concerning these conservative groups, it's not fair. here we now have some democrats in jeopardy this this election year, achnd they are calling fo more scrutiny of the irs, can one conclude because they may care less about alleged corruption and more about perpetuating their own power getting re-elected? >> he did say i want both the left and the right targeted, but clearly these democrats are getting nervous. they actually have cash advantages over their republican competitors, but they see these conservative group who have a lot of money, and by the way, there are superpacks on the left that are not happy with what the irs is doing, they want an

active irs both on legislation and -- i think what you stayed before is right. is that the administration doesn't want to talk about this and i think they're going to tell the irs or at least it's assumed, don't be active this year, because you got in a lot of trouble the last time. >> all right, here's something that i think is pretty stunning to most people who are really looking into this seriously. the obama administration appointed a a large done for to the obama campaign to lead the justice department's investigation. isn't that a blatant conflict of interest that in the end may only diminish the credibility of the probe? >> i was surprised by that, gregg, it's a dual investigation, there's one republican, and one democrat, but it's a democratic donor. how can a donor not have a conflict of interest.
1:56 pm
that's not the end of the story, all of these investigations still haven't panned out. the chris christie investigation is going to go on for a while. certainly on the one-year anniversary of this comine ingi light. >> bob, good to see you, thanks scotch. appreciate it. >> all right, we're keeping an eye on the florida courtroom, we just learned from the jurors in the michael dunn jury trial that they have reached a decision, a verdict on four of the five counts. now we don't know if that's guilty or not guilty. they're hung up on the fifth count. they were told by the judge go back in there and continue to deliberate. so when we get a verdict, we'll continue to bring it to you. that does it for this hour of america's news headquarters. stoszal is next. i'm beth...
