has turned into a regional conflict and the weapons flow in from russia and the training from iran and all of it is evolved into the situation that we are in today. >> president obama once announced that a red line for us military action in syria would be assad's use of chemical weapons on his own people but he has ruled out direct american military involvement promising to work towards humanitarian resolutions for the civilians. the civilians got an apology. >> i am very, very sorry. i aapologize to the syrian people that their hopes which were very, very high that something would happen here. >> and talking about the unsuccessful peace talks in switzerland secretary of state john kerry says the assad regime

was not cooperating. and while it stalled in geneva the regime intensified its barbaric assault on civilian population with barrel bombs and starvation. it has even gone as far as to add some of the opposition delegates at geneva to a terrorist list and seize their assets. right now there is no date set for a third round of peace talks between representatives for the regime and the opposition. >> peter doocy. president obama is a asking for a review of u.s. options on syria after peace talks in geneva stalled. violence in the war-torn country has been escalating this week. joining us is retired four star general jack keen. thanks for coming in. >> good to see you. >> a review of new options. what does it mean? >> i think what is driving it is the recognition that u.s. policy as pertains to syria has failed.

the peace diplomacy initiative is not going anywhere. the russians are backing assad and providing supplies. assad is not going anywhere. even though chemical disarmor manipulate policy we know the intelligence sources told us assad has not declared chemical weapons. he is slow rolling us on the ones that he has declared. given all of that it is fine to take another look at where we are. and new options have got to be put on the table. >> despite what secretary kerry said jay carney offered a different perspective this week saying president obama is always looking at options on policy matters like syria. i wouldn't see this as some new announcement or new consideration. what do you make of that? >> it is basically true. they are always considering what options are on the table. the fact of the matter is things have changed. the other that changed

dramatically, rather significant. the director of national intelligence says the 7,000 fighters there represents 27 to 30. that puts it on a scale that is largerer than afghanistan prior to 9/11. this is sitting central to the middle east bordering our neighbors. the huh manitarian -- humanitarian catastrophe. >> what is the eend game here? where does it result if the united states does not take a fresh look and if the united states does not become more involve in some manner? >> the fact of the matter is that the status quo which is what we have right now with the continuing civil war and the

potential spillover into our neighbors and this catastrophe of the humanitarian proportions is unacceptable. i think the administration is beginning to recognize that we have to do something else. it probably will be robust resources to the opposition forces. this is finally kind of weapons that they truly need and the kind of money that they need to go on. and i think limited military operations dealing with the al qaeda sanctuary i would imagine covert operations as we see with al qaeda and pakistan. the only people that are fighting the rebels who are in those sanctuaries are the opposition forces. the regime does nothing against it. >> i want to change the topic quickly here in the minute we

have left. the afghan release, president karzai not to release the 65 prisoners linked to attacks on civilians, u.s. forces, coalition forces. 17 of them linked to production and placement of road side ob a bombs. >> that is outrageous. we have had agreements. we have had a veto agreement that if we believe a prisoner is about to be released is a threat to our interests we can veto that. karzai has blown that away and has released these people. it is outrageous. i mean, the fact of the matter is we are leaving and they will probably be more of a threat to afghan soldiers and people than they are to us. after december we will have a small force there. but the fact that he would release people who have so terrorized his own population

and ours on a scale that is very serious it is irresponsible on his part. >> he is buying his own survival here, preservation through the taliban. >> that is part of it. the fact of the matter is he has a couple more months left in office. he does not a follow on government or taliban chasing him down. so he is trying to ensure his future security and also he is desperately trying to aavoid the appearances of lame duck. he is a lame duck. >> always appreciate your expertise. >> secretary of state john kerry says climate change is just as important of a fight as that against terrorism. kerry made those comments in a speech today and criticized skeptics as being in the same category as those who believe the earth is flat. kerry says nations much act quickly to combat climate change equating it to some of the biggest threats the world is facing. >> when i think about the array

of global threats, think about this, terrorism, epidemics, poverty, the proliferation of weapons of mass destruction, all challenges that know no borders, the reality is the climate change ranks right up there with every single one of them. >> state department officials say kerry will be making more speeches on climate change. his push comes ahead of negotiations on possible global climate change treaty next year. president obama is defending obamacare's latest change, the employer mandate delay. critics say he is crossing the line by skirting congress yet again. today senator mike lee called the changes a, quote, shameless power grab. >> republicans say the president is overstepping his bounds while

democrats say he is only doing what every president has done in the past. the president delayed the employer mandate giving medium sized companies another year to comply with obamacare. the mandate for larger companies pushed back one year. all of this without congressional action to change the health care law. and some claim the president is violating the constitution. >> this is a shameless act, shameless power grab designed to help the president and his political party achieve a particular outcome. and that's wrong. look, the constitution doesn't give the president that power. the power belongs to the people. the people delegate that power to their senators and congressmen. >> the troubled affordable care act has given an issue going to mid term elections. democrats say the law is working, billions are eligible

for health care and defend the president saying he is making administrative changes that don't need congressional approval making it easier for the business community to comply with the law. >> if you were going around congress to re-write law that would be different than trying to use the flexibility given by the congress to execute the law. the president is not trying to rewrite. the president never said i'm going to go it alone. >> the administration is now allowing businesses between 50 and 99 full-time employees extra time. they have until 2016 to provide health care coverage for full-time employers. >> thank you. we appreciate that. congressman bob goodlight is the chairman of the house judiciary committee. the latest on the unilateral action from the president. thanks for joining us. >> good to be with you.

>> tell us your reaction. >> it's very concerning when you have a president of the united states that works as hard as he does to jam a law through the congress 2,500 pages long, 20,000 pages of regulation. it is not going the way he intended it. instead of going back to the congress which under our constitution has the authority to make changes. there is nothing in obamacare that allows him to give these extensions, these delays to waive the mandate for people who have not met certain criteria under the law. many of these things are good. the house has twice passed both last summer and this fall with regard to the if you like your health care plan you can keep it when people found out they couldn't. we passed legislation to address the problems. the senate ignored it. the president ignored it and

asked something that obamacare does not give them the authority to do. the constitution provides that it is the congress that legislates, not the president. >> mr. chairman, nevertheless, mr. obama is not the only president to make these unilateral actions executive orders. on the spectrum of executive orders he ranks fairly low. previous presidents made more of them. what makes this different? >> well, this is a massive new change for americans in terms of the health care they are going to be provided. as you know virtually every republican in the house and senate has voted to repeal obamacare. but we also have work to make changes in the law where it is necessary to do so. and we are willing to do that in these instances, as well. the president doesn't have the authority to take these actions unilaterally. we held a hearing on this.

it is not just the health care area. it is lack of enforcement of immigration laws and drug laws and some of our environmental laws are being enforced in ways that are not contemplated by the law. so we held a hearing. we had four constitutional scholars, three of whom voted for president obama. three of the four said the president was exceeding his authority under the separation of powers doctrine. that is why the separation of powers doctrine exists in the first place. now we hold a hearing here in the next couple of weeks on looking at new solutions that can be explored for how to hold the president accountable in these areas and make sure that the power of the congress is not given away. >> some say he can do it. >> some suggested one solution is to file a suit to stop this.

senator lee said that is not possible because you don't have damage done here. in fact, the businesses effected are getting reprieve from taxes. so there is no technical damage done there. what is your perspective on that? >> well, that's a good point because standing for whoever brings the lawsuit is the case. and, in fact, the person who has agreed here is the employer who has 100 employees. they are not getting the delay. the guy who has 99 employees gets the delay. the guy with 100 says that is not fair. the guy with 100 is required by obamacare to do what he is required to do. he may not have the standing. but there really should be a stronger look at the matters by our courts. and the courts should take a more enlightened view of grand standing particularly to the congress itself. historically we had a hard time. there were a few instances where we brought suit against administrations. the fact of the matter is we need to be looking at whether we can enhance the standing of the

abandoned gold mine trap in south africa. emergency responders evacuated 11 of them. paul tillsy is in johannesburg. >> i wonder if you have heard of something like this. 11 miners have been rescued. according to emergency services the rest still underground have made it clear they don't want to be rescued. that's because within minutes of coming up to the surface from where they have been trapped some 20 to 25 meters underground these miners are being arrested for illegal mining. rescueers say those left underground which could number between 20 and 200 have refused to communicate further. police are standing by to arrest anyone else who pops out. there is more that is bizarre. the miners were trapped after

finding gold illegally in an abandoned shaft which runs under the field. the officials say there was an attempt by other illegal miners to steal that gold. and in the after math this second group threw large boulders down the ventilation shaft used for access blocking the shaft completely and trapping those underneath. those who came out looked fine, dusty and more than anything surprised to see a huge media presence and the police. >> that's remarkable story. these guys prefer to stay in the mine shaft rather than come to the surface. i presume that this was not a collapse of an abandoned mine. it sounds like people were trying to sabotage their exit because they were thieves. >> that is indeed the case. it appears to be the case. underground there is known to be

gangs of illegal miners trying to find gold. there have been fights underground and people have died. not surprisingly rescueers don't want to go down there into the closshaft. they say it is too dangerous. in this case the mine shafts are many miles long and the miners right now could be escaping in the legal sense and coming up literally in another town a long way away from here. >> it is fascinating. i want you to keep us posted on developments there as rescue efforts are underway to get these miners who don't want to come to the surface. two skiers are missing following a saturday night avalanche in colorado. emergency responders in lake county, colorado, are back on the scene today. yesterday the colorado avalanche and information center issued a warning. five skiers escaped the avalanche safely.

>> 19-year-old miranda barber and her husband have been charged in a murder of a man they met through craigslist. she claims the murders were part of her involvement in a satanic cult. >> 19-year-old miranda barbara confessed she and her husband murdered a man in november. they say she lured the man and claims there are at least 22 other victims. in a disturbing phone interview from inside the county prison in pennsylvania miranda gave chilling details of the night of the murder stabbing the victim 20 times as her husband strapped a cord around his neck. quote, he said the wrong things

and then things got out of control. i can tell you he was not supposed to be stabbed. my husband was just supposed to strangle him. when asked about her alleged dozens of other victims in alaska, texas, north carolina and california she said i can pin point on a map where you can find them. when i hit 22 i stopped counting. miranda said she would lure victims in, study them and become their friend but only kill bad people, the majority of her murders, she says, took place in alaska where she joined a satanic cult at age 13 shooting and murdering her first man with the help of the leader of the cult. though miranda released few details about the alleged murders police in pennsylvania are taking claims seriously and working with investigators from other states and the fbi. police are reviewing the recording from the jailhouse interview and prosecutors are seeking the death penalty and want to try the couple together.

coming up a look at how mid term election pressure is impacting congress's 2014 agenda and a possible break in a nearly 40-year-old cold case. first a jury dead lock in the case of a man killing a teenager over loud music. >> jurors said they couldn't agree on 47-year-old michael dunn's fate so the judge was forced to declare a mistrial for the most serious charge of first degree murder. dunn was found guilty of attempted second degree murder and firing into an occupied car.

reporters on thursday. >> could be. a lot of them retired all of a sudden. congress is off this week and although it is only february many believe the start of the 2014 mid term campaign season is already in high gear. the republican controlled house voted to pass a debt ceiling bill without any spending cuts. and democrats have to go home to defend an ever-changing health care law. joining us now for a fair discussion on this and other key issues is allen coombs. let's talk about the debt ceiling vote. speaker boehner obviously in a very difficult place here trapped between his conservative caucus, also more modterate republicans, democrats, talk radio. lots and lots of pressures. jim, you want to tackle that? >> i think what speaker boehner realized was that twice now and since he has been in congress in

1995 and 2013 the attempt to shut the government down to prove a point just fails. the democratic president has the benefit of the bully pulpit and the media. the better strategy which is where i think the republicans is headed is trying to win the senate back in 2014 and hopefully the presidency in 2016. at that point i guarantee fiscal policy will be a great deal different. >> you hear talk radio all the time that these tea party types in the house are sticking to their principles and the republican party does best when sticks to principles. what would you say to speaker boehner? >> i would say america is about compromise. you don't compromise your principles by compromising. you keep exactly as you are and vote your conscious and realize under our constitutional system the other guys have power, too. if the republicans really wanted to change the system they should have won the 2012 election.

>> allen, you want to respond? >> good luck with that. really, what boehner realized was that he couldn't get the tea party on board to do things that needed to be done. with the tail wagging the dog the shutdown of the government was blamed on republicans by the public. that is why boehner said the tea party has no credibility. they also wanted to get this done now. they wanted to get the debt ceiling issue dealt with sot that this wouldn't be in the way of the message they want, the messaging going towards the 2014 mid term election. get it done now get it off the table. and whatever agenda they think will win them the 2014 mid term election. >> exactly. >> right. well, that's an interesting point because some are suggesting we have to keep in mind that this country, the voters in the country have a very limited attention span. the mid term elections are nine months away. >> there are other issues out

there. for example, an emerging issue is coming in california which is the water crisis out there. we are seeing a wonderful example of how green environmental policies effectively shut down agriculture in much of the central valley of california. the house republicans led by a fellow named dock hastings has pushed a bill to advance water and bring water back into the area taking away from endangered species somewhere. it dies in the senate. it is a great issue to run on. >> jim makes a really good point there. you have to talk about the man made drought. exacerbated by man made efforts to divert the water. >> mandate efforts are not the fault of democrats. the dams that are built are not the fault of democrats. in fact, the republicans, what they want to do is stop construction in some cases. but what democrats want to do is

holding those types of meetings. to establish that welch was observed paying attention to the lions sisters. he now has multiple convictions for sexual offenses against young girls and has been incarcerated since 1997 in the state of delaware for one of these offenses. >> this week police in montgomery county, maryland identified a person of interest in a disappearance case that put washington, d.c. on edge 39 years ago. 12-year-old sheila lyons and katherine left their homes to walk to the shopping center for lunch. back in those days when parents were more casual about those things the mother told them to be home by 4 p.m. they did not return. a massive man hunt ensued. there could be a major break in that case. mark firmen is here with his perspective on this remarkable story. thanks for joining us.

>> thank you. >> police have said that they have this guy who is of interest to them. his name, as we heard, is 57-year-old lloyd lee welch, a drifter, one time carney. he has a record of sexual offenses with minors. what are the problems with a 39-year-old case like this. what are the problems with the 39-year-old case? >> 39 years old, it's obvious. and you have neither victim found, deceased or otherwise. you have that problem. you really have no vehicle description. you really don't have a physical description. what is going on here is a cold case team got ahold of the case. they go back to square one. they think everybody interviewed and every name in the murder book or that is missing or that

abduction, kidnapping book or however they characterize and you look at that and you start finding out where everybody is and what they have done. and when he popped up to be a sex offender in prison that m.o. could possibly have matched a trail of victims that he actually pursued in that employment. so i don't think this press conference was a casual -- i think they are on to something and i think they believe that. the difficulties are obvious, 39 years without forensic evidence you are really relying on memory and interrogation of the suspect. >> we are having a little bit of technical difficulty but i'm going to try to ask one last question. let's assume this guy is responsible for the disappearance of these little girls 39 years ago. how do you gain a guy's

confidence to open up in a jail cell? what is his reason for admitting to it. >> that is a great question. when you look at this first you are concerned with the sisters. he has the possibility of getting out on parole on the current offense. you get other offenses from other agencies to tie him up for the rest of his life. and then he has nowhere else to go except for getting in a facility that he has more privileges than currently. that is about the only hook you have, the only thing you can give, an inmate in prison for the rest of his life. and then you have to have a personality connection that specific detective that can connect with him is really important. >> we are going to let it go at that. thanks for your expertise. always appreciate it. artist ic
