>> how can you be a champion of women's rights and turn around and do what she's done to a woman like me. >> the experience this husband and father of three had that made him a believer. >> there is an after life, and people need to believe in it, big time. >> his amazing story tonight on the kelly files. developing tonight, new questions about whether the president is about to break new ground in his controversial use of executive actions and whether lawmakers can do anything to stop him. welcome to the kelly file, i'm megyn kelly. the senate's top democrat, is urging president obama to rewrite u.s. immigration law without the consent of congress. senate majority leader harry reid urging the president to unilaterally halt the deportation of some illegal immigrants. and that comes at the same time that more than 100 house republicans have now signed on

to sponsor legislation designed to reign in the president's recent run of going around congress. we'll have brit hume on this in a moment. but first, we begin with shannon breem live in washington. >> immigration is just one of the topics a grow number of house republicans say is worthy of a lawsuit. more than 100 have signed on to the stock resolution, which if it gets a majority of house member support would authorize a civil lawsuit against the president. along with welfare to work requirements and immigration laws. former democratic congressman filed suits against both president george w. bush and says congress has a duty. >> the founders intended this to be a balance. and often the balance goes out of kilter and we find that we have a government where congress isn't doing its job by standing up for its legislative

prerogatives and the president will use executive orders to be able to take a course of action that actually was intended for congress. >> so far, no democrats have signed on, experts say they ignore this issue at their own peril. >> in the long run, in the grand scheme of things, these are very -- this is very destructive of our separation of powers, it won't always be this president, this congress. it always will be this constitution, and that is the thing that these -- that our legislators should be protecting above all else. >> back in 2008, then senator obama said that one of the most pressing problems in this country was the vast expansion of presidential power by george w. bush, and he promised as someone who understood and loved the constitution to reverse the trend. megyn? >> shannon, thank you. turning to brit hume. i love the florida color scheme. it's great, it works for you. you're just rubbing it in that

you're down there and we're not. >> thank you, megyn. you have to love harry reid, i love this quote. i would hope that administratively, the president will do what he can to take a look at deportations. but he is being burdened by the law as it exists. and we need to change it. that darn law is such a burden. >> well, it is a burden, and i think the president so far at least has recognized the law and done what harry reid wants him to do. itry mains to be seen if the president will do what harry reid says, and if he does, whether that will stand, the question that was raised by shannon's report, and we talked about before. if congress tries to halt this they will not do it

legislatively, it will never get out of the senate. the president never signed a law -- he feels free to ignore the law, it hardly matters, the question is whether some litigation could be mounted outside of congress by an injured party of some kind that would get the courts attention and end up on the president's cease and desist, where he's outside the executive authority he's been granted by congress. >> by the time that happens, having practiced law for nine years, it's a long time. i have some cases that started in the first year by the time i was there as a ninth year attorney. it takes a long time. as a practical matter, is that a good solution? >> it's not clear to me how quickly it would happen. it's certainly possible that these cases counting all the possible appeals and the delays between them, it could drag on for as long as you say, the court's going to act more urgently when there's reason to

do so, however, and that might be the case here. the other question is whether this authority that the president has taken for his own and on his own would still be around and, therefore, available to the next president who would perhaps be a republican. what that could then mean, some of these people like harry reid are at vow indicating could happen then, republicans who are running in 2014 and 2016. and whoever runs for president on the republican ticket in 2016, would be campaigning against what they would consider to be executive excess. and it would, therefore, make it awkward for them to start using it once in office. >> but if they did -- >> a long term consequence, wouldn't come about. >> what are the likes of harry reid and others going to say. the democrats and many in the mainstream media have been all but silent on president obama's use of executive authority in some controversial matters.

jonathan turley was on the program twice last week, sounding the alarm on this, and saying, they ignore this at their own peril. >> well, that's precisely the point, and, of course, what you would expect to happen is precisely what's happened with president obama. you may recall, as megyn noted -- i mean, as shannon noted, megyn, president obama spoke out strongly against what he considered to be the excessive use of executive power by president bush. one he promised to reverse, he's got a bad case of shoe on the other foot disease which would aflekt democrats -- if the other party started doing that again. 2016 and beyond. >> i think there's a vauk sination for that now. i have to look into that. >> believe me, it's a bipartisan affliction. and it's been going on for years.

it's not an epidemic at the moment, but we can get there. >> brit, great to see you. >> thanks, megyn. a deal in the works to trade some of the terrorists at gitmo. the deal reportedly calls for the release of five taliban prisoners at guantanamo bay in exchange for his freedom. the ceo of concerned veterans for america. so are you for this or against it? >> well, it's not something i like. it's a trial balloon likely coming from the state department. >> they're traveling and floating it out like me? >> that's getting a sense of how the public would work with this. this deal is a reflection of a

weakened u.s. position. the folks at guantanamo by are there for a reason. they're terrorists, many tied to 9/11, if we were to release them as part of the deal, now a signal that america negotiates to get ours back without doing what's necessary, moving heaven and earth to bring that personnel. >> there's a reason we don't negotiate with hostage takers, it only tends to encourage more hostage taking. does this do that? does this endanger more men and women in uniform? >> it could. i know our government is doing what it can to find berg. sometimes there's too many hands in the pot, and the essential command to make sure we're doing everything we can. but it does send a signal, why five, why not ten, 15 taliban. israelis were forced to give

over 1200 palestinians at one point. where does it stop? when you show you're willing to do that, it demonstrates that they have the cards and you don't. it's an unfortunate position to be in, and it's a reflection of policies in afghanistan for a long time that haven't been tied to having the upper hand or being successful, but the taliban. >> he would go into protective custody in qatar. i want to play this sound bite from d.j. gordon. he thinks this is a bad idea. listen to him. >> we're talking about some of the top leaders that they had, two former governors, a former deputy minister of defense. a former deputy of intel. >> could you believe that? that's what we're talking about right now.

>> sergeant bergdaal's family is behind it, and the state department is pushing this. thinks it's a good idea. >> who doesn't want him back? i do. but at the same time, guys tied to 9/11, like j.d. just said, we're going to let them walk out in exchange. we may even know where he is, but he's in pakistan, and that's a bright line right now of how far after the bin laden raid can we go into pakistan to deal with this threat. it is unfortunate, i wish we would go after him. there's negative and down sides for that, releasing leadership from the taliban many times from 9/11, undermines the whole aspect of this mission. >> good to see you. >> thank you. after the president and top democrats launched a new push on global warming, we may now know the reason why. didn't that just come up in a lot of circles? our investigation into a liberal billionaire, his political agenda, and his hundred million dollar plan for the midterms.

candidates who support his take on the issue. we wanted to know more about mr. styer and his plans for the 2014 midterms. jamie weinstein has been researching this issue. good to see you. >> good to see you, megyn. >> who is this, like the liberal david koch? >> this is a guy who thinks david koch is evil for sure. he's a liberal whiz kid hedge funds guy. in 2004 when john kerry lost, he even held a wake at a san francisco nightclub to commemorate the loss in 2008 he backed hillary clinton from the start, and went on to support president barack obama when he was campaigning. >> it seems like liz one issue is climate change, anyone who doesn't believe in it as he does, is a nut case. there was one quote i read from him saying, there's gridlock in washington, step outside the

beltway, you hear the real conversation on climate change. step outside the beltway and all the way to san francisco. i don't know that middle america feels the same way he does. >> he doesn't think that honesty plays a role in this. one of his ads last year which was against the keystone pipeline. they said, even by the standards of normal political ads, this one fell below those. he's an activist against the keystone pipeline, which his investment company invests in a competitor of the keystone pipeline. his investment fund has invested in all sorts of programs that he's now opposing, companies that he's now opposing. >> he's a true believer. i mean, i think if the ad got the pinocchios and i know some nbc affiliate in d.c. declined to air it, he's a true believer in this phenomenon, and he plans on putting a bunch of money. the quote was on that 100 million, why not more? he said, i think that would be a

really cheap price to answer the generational challenge of the world. it's going to be perhaps more than 100 million, which is perfectly legal. thanks to citizens united he can do that, the koch brothers can do their thing. he seems to only channel it to candidates who back him on climate change. is that how it goes? >> that's right. the question is, how effective will it be. there was a poll last year, and americans were asked to rank the top 20 issues, global warming was 250 out of 20. it's not clear how effective it's going to be in the midterms when voters don't care about the issue. >> he may be going after democrats as well. they took a poll of who they should go after, marco rubio was one, mary landrieu from louisiana was another one. it's basically, you're with him

a hotel in the heartland has decided no more bibles in the nightstand. the decision comes after the group freedom from religion foundation complained that the bibles should be banned at the iowa state university hotel. calling the practice alienating to nonbelievers. tony perkins is the president of the research council. it all comes down to the fact that this is a state run college

and hotel and, therefore, they can't be endorsing religion over nonreligion. >> i think it's good to remind ourselves what the first amendment says, congress shall make no law respecting the establishment of religion or the free exercise there of. it's hard to conceive how a donated bible in a drawer is the establishment of religion. they're doing this across the country. some are standing up against this. governor dele of georgia said take a hike. >> everyone's gone to the hotel and seen the bible in the nightstand. i don't know that i ever felt someone is pushing religion on me. they make it sound this is anhorrent incident. >> that bible has been a help to many people. as a police officer there's a lot of things i found that happened in hotel rooms, one of

clinton's 2016 potential bid. any discussion about the clinton's handling of bill clinton's affairs and alleged misconduct which is discussed at length in these papers is sexist, even misogynistic, but my next guest has a different point of view. she's been a victim of the clintons, claiming they harassed her and intimidated her for years. her name came up in the hillary papers when a little known journalist matt drudge wrote a report about kathleen willie, about president clinton and her claims that he sexually groped her in the oval office. while earlier, i spoke with miss willie about all of this, she was a little nervous, and recovering from some neck surgeries, but she had a lot to say. after all this time, your name surfaces again through no fault of your own, they're in the hillary papers that were kept by her friend which have just become public. they talk about you, and your

allegations that president clinton groped you in the oval office against your will many years ago, you were a long time supporter of his and a volunteer in the white house, that was talked about quite a bit in the 1990s, you've come out now and said, you do believe this is relevant by any potential run to hillary clinton in 2016. why do you think that? >> hillary clinton is the war on women. and i think that she needs to be exposed for all of the terror campaigns she's raised on women who were in the wrong place at the wrong time with her husband. and it's been going on since before they were married. that's how she handles it. she enables him to do it, because she realizes the power that he has, and she wants to ride on his coat tails like she's done all along.

the easiest way for her to handle scandals is to ruin the women who just happen to be -- cross paths with him. and that's horrible. and they do a good job at it. >> we've heard so many people say this should not be an issue for her candidacy. many are saying bill's affairs or misconduct, depending on the allegation don't bear any relevance to her, and to tar her with that brush is unfair. >> i disagree. because if she's going to run on women's issues, like she says she is and she's going to go after republicans on this war on women, she needs to be exposed for the war that she's waged against people like me she has choreographed every single investigation and terror campaign against every single woman practically who she thinks

again is she's enabling his behavior, and i don't know, if she wanted to save her marriage, because this has been going on since before they got married, and she found out about it. everybody deserves a second chance. think that she should have said to him, all right, we need to work on this, you have a problem, maybe we have a problem, and i want you to get help. because this won't happen again. that's the way she should have managed it. >> there were, of course, a long list of women who were accusing him of engaging in consensual affairs or unwanted groping, and paula jones and juanita broderick. >> not all -- >> it's all been fully established in a court of law. if it's not directly relevant to hillary, do you think it's relevant to the american public in assessing the character, the

behavior of our potential first gentleman? >> i do. i do. yes, absolutely i do. i think it talks about her judgment, it talks about her character, it talks about her power mongering, it talks about all of that. >> what do you think of the behavior, some on the left are saying it's misogynistic and sexist to have this discussion, even though they talk about history, there's a documentary coming out next month on clarence thomas' alleged sexual harassment of anita hill, and some on the left have an interest. >> well, it's a double standard. it's always been that way, it's never going to end. i can't see it ending any other way, it's just a double standard.

it just is. if george bush or any other person had done what bill clinton did, they would have been gone. i mean it's just that simple. he just got a bye and he continues to get a bye. and she continues to enable his behavior and looks the other way, and that's the way it is. i think the thing that bothered me the most when i was reading the article last monday, the thing that bothered me the most was, when she was having a discussion with somebody about how they were going to handle gennifer flowers and she was trying to find a way to hang a crime on her, she wanted to send that woman to jail, that's when i thought, this isn't right. this is not right. it's just not right. i think it should be discussed. we're talking about the president of the united states and what he did, lack of judgment. he dishonored the office, he dishonored the presidency. and she just stood by and watched.

and it looks like she's going to keep on -- >> let me ask you, your detractors say miss willie claims president clinton groped her inappropriately in the oval office, but then there were letters you sent to bill clinton afterwards signed fondly and they were written in a nice tone. it didn't sound like someone who had been necessarily sexually groped against her will. and then they point to the fact that a long time ago you had an incident where you claimed a false pregnancy by a man, and it turned out not to be true. your detractors say she is a dishonest person. what do you say to those two? >> i'm human, okay? i've already talked about that, i've made my amends, i'm human, it was a hard time in my life, i was going through a lot. i'm not making excuses, what i did was wrong, i just did. and i made amends for, and acknowledged the fact that what

i had done was wrong. but i'm not out ruins people, terrorizing people, trying to put women in jail, you know, the way hillary is, it's a whole different thing, it's a whole different thing. >> do you ever talk to monica lewinsky, paula jones, any of these women? >> juanita is a good friend of mine. she's a good friend of mine, and i have great admiration for her. let me just tell you, that woman is telling the truth, i sat and talked to her about it, and she told me the story, this woman is not faking what happened. i believe what she's saying. >> and yet when you look at the clinton's approval ratings, both of them, they're sky high. >> go figure. i don't know many maybe it's just -- a lot of this now with hillary, have you these younger women who are looking at -- it's

going to be really cool to have the first woman president, and i'm going to vote for her, they have no idea about what she stands for, who she is. they're just going to vote for her because it's going to be cool to elect the first woman president. i think women like that should be -- they should be educated. at least tell them what has gone on from your own experience. megyn, what happened to me, it was terrifying, it was terrifying, and what they do, a lot of the times women like me, we were single at the time, living alone, break into your home, car was vandalized. pets went missing. i was just starting to feel like i was really in trouble. and it was hard for me to admit

could accomplish almost anything. but he described women as domestic functions. it described conservatives as corrupt, self-centered, lazy and incapable of true charity. that same textbook describes liberals as much more optimistic and people who believe that others are born with infinite possibilities. which one would you choose to be? anna chapman is the university of south carolina student who first complained about this, and alex smith is the chairman of the national college. how am i supposed to feel? the mean, pessimistic conservative or the optimistic nonlazy, liberal progressive. your thoughts on reading this? >> first of all, thank you for having me. i'm glad attention is being brought to this issue. but it really is unbelievable

that a book would portray conservatives as being this one. someone who doesn't know much about politics would side with what sounded better, which liberal i liberalism, that's clear. >> it's interesting to me, you are sort of the head of republicans at the college -- the man who appointed the very first female supreme court justice, he was sexist and a pessimist, who knew. >> i know, it's completely outrageous, this is not the first time we've seen this kind of liberal bias on campus. just a few months ago, the students at michigan state university were subjected to a

tirade by a professor who said republicans raped the country. a similar situation a few years ago, republicans e-mailed they were having a recruitment drive only to have an attack by a profess professor. what bothers me are the comments that make a hostile environment on campus. >> they make you feel you're wrong if you're on the outside of progressivism. one of the other less sons you got in this class was that the wealthy find having a social class of poor people very useful, because poor people can do the dirty work for rich people that the rich people don't want to do, this is another lesson that your parents for you to get in this class. who is this professor? >> well, it wasn't really about the professor, it was more about the textbook and the fact that we were required to read it.

>> does the professor stand up to it. >> she does not. i'm the only person to speak out about this. which is another thing that concerned me, if i wasn't in this class, would these kids really be buying it? that's the scariest part about it. and the part about demonizing wealthy people, it was something that really really got my gears grinding, because it literally made no sense to say that wealthy people like to have a class of poor people so they can look down upon them? i mean, literally makes no logical sense. >> let me ask you this, the university has come out and said, we are happy that our teacher has offered this textbook that has gotten debates

started. we're pleased to see the classes inspire lively conversation, our faculty are free to select texts for their courses. they would have us believe there's nothing wrong with this, it inspires debate. >> i this it goes to the hostile environment i was talking about earlier, it engenders fear in students to speak out. for all of those that are worried about a grade or a recommendation later on, it's not an option sometimes. i think it really goes to slow how liberalism and liberal tactics occur in this generation of millennials. what do those students do? they took to social media, to get that message out there. it's unacceptable. >> anna, alex, great to see you. thanks for being here. >> thank you.
