argued? >> tonight, we'll show you how this family is fighting back. and we told you about his life after death experience. >> i'm a truck driver and i think i'm having a heart attack. >> he joins us tonight with his amazing story on "the kelly file" right now. and breaking tonight, america's leadership in question, as a series of crises goes from bad to worse around the globe. welcome to "the kelly file," everybody, i'm megyn kelly. moments ago, president obama addressing the bloodshed in the heart of the satellite nation, ukraine, the president speaking from an international summit in mexico saying he believes they can reach a peaceful solution but not saying much more than that. in the ukraine, the fires continue to burn in protest camps. more than two dozen are dead, hundreds are injured after days of violent clashes. we are told these are folks that are pro-western and want to

change in that country, facing a brutal crackdown that has left 26 people dead so far. tonight there are reports of a truce but there are no actual signs of that on the ground. at the same time, as i said, at least -- well, several are dead and dozens are injured as protests rock the south american nation of venezuela. this is elsewhere. in the middle east, the administration all but admitting defeat in the effort so far to end the brutal fighting in syria. nearly 150,000 are dead, millions forced from their homes and no solution in sight there. and long and complicated negotiations over iran's dangerous nuclear program are beginning again. but already the report shows little hope for success there raising brand-new questions about the president's foreign policy and what it means for america. and ralph peters is a strategic analyst and retired u.s. army colonel who was trained specifically as a soviet russian analyst. all right, ralph, let me start

with you on what is happening in ukraine. a lot of people are saying ukraine, you know, why do we care what is happening in ukraine? if you can speak to that question and the president yet again coming out and using the term "red line" saying we're going to have to draw lines here. >> well, ukraine is actually more important than syria despite all the bloodshed. it is important because it is part of europe. and even if putin is trying to gobble it back up, the western two thirds of ukraine has always belonged to europe until the bolsheviks took it over. the ukrainians don't want to be putin's slaves. the obama administration today said they want russia more engaged in ukraine? this entire production has been brought to you by vladimir putin who is pulling all the strings behind the yanukovych government.

russia wants to re-claim ukraine, and it matters because it would increase russia's strategic power enormously. the president said there would be consequences. when have there ever been consequences in libya, syria, iran, when karzai betrays us. there are never consequences. megyn, if this administration had a symbol it should be a duck. because this president has ducked responsibility for everything. >> let's listen to what the president, how he actually put it when trying to warn the folks in ukraine, the government there and others about their behavior. listen. >> we expect the ukrainian government to show restraint. to not re sort to violence in dealing with peaceful protesters. we've said that we also expect peaceful protesters to remain peaceful. and we'll be monitoring very caref

carefully the situation, and there will be consequences if people step over the line. >> and leather me talk to you about that, mark, because he says there will be consequences if people step over the line. the same conversation he used during syria, which people criticized. because there are no consequences there in syria and they're not agreeing to turn over their chemical weapons. why would he? >> he has nothing to the accomplish, so he has to say something. so he says consequences, it is the go-to word when you have no policy. this is a president that threatened consequences if bashar assad used chemical weapons against his people. 13 months later, there are 150,000 people dead and the cia

says that al-qaeda has reconstituted a safe haven in syria that it could use to attack us here at home. >> and clapper, the intel chief said that assad's grip has only gotten stronger. >> consequences, absolutely, if they're looking at consequences in syria they're pretty comfortable right now. there are no consequences right now, our enemies don't fear us, our allies don't believe we have their backs. look, every time the president talks about foreign policy it is telling us we have to focus on nation-building at home. no one fears a nation in retreat. we're in retreat in iraq, syria and afghanistan. in iraq, al-qaeda has reconstituted all the lands, all the safe havens taken with the blood of american heroes. and the taliban are in a murderous rampage, they're totally unafraid of us in having

consequence for having a nuclear weapon. there are no consequences for anything with the administration. weakness is provocative. people don't fear you and they do what they want. >> the president and the administration is coming under fire because secretary kerry came out and said climate change, in the face of all of this destruction we're seeing. it led newt gingrich calling for him to step down. the point is, do they have their eye on the ball? and what of this charge that we basically have no teeth anymore. we're not feared the way we used to be and the way we need to be? >> we don't even have false teeth. i have to say as far as the climate change incident in indonesia goes, you can't win the climate change debate on either side. it is too loaded. but you know, there is real pollution in the world we do have to address.

so i don't have a huge problem with that except when he starts saying it is the worst weapon of mass destruction. china, the united states, russia, we have enough nuclear weapons to destroy the world with some left over so i would say that is a slightly larger threat. i don't understand where conservatives are not for conservation, but this administration is going to walk away from ukraine, let putin gobble it back up and it will be a tragedy for freedom everywhere. >> we'll continue to monitor it again, everywhere. they say there is a truce, but reports are on the ground saying where is it? there is no evidence of it so far. gentlemen, good to see you. >> thank you, megyn. and developing tonight, angry reaction is building from a variety of groups over what is said to be a new plan from the obama administration to monitor america's news rooms. and not in a way that you monitor it from home on the couch. much more invasive way, and we have the report from washington,

shannon? >> reporter: well, megyn, the federal communications, or fcc wants to send questions in to the radio stations, who decides which stories are covered? well, the stated purpose of what is being called the market study for critical information needs is to determine how media outlets make editorial decisions and how much time they're spending on several key topics the fcc is concerned about, like the environment. news about this proposed project so unnerved a group of house republicans that they sent the fcc chairman, tom wheeler, a letter saying this is a startling disregard for the bedrock constitutional principles. adding they have no judgment and expertise. one representative says he sees a disturbing pattern. >> it is very reminiscent of the kind of questions that were

asked of my clients in the irs matter that is currently in federal court. same kind of questioning process of content, determination on point of view. and i think this government, this administration is bent on aiming and targeting those they don't like and this is another way to do it. this time it is the fcc. >> the study was conceived under the previous head of the fcc. there are reports that the current chairman is considering tweaking it. >> we'll look forward to that. my next guest is calling this creepy. katy pavlich talks about the fairness doctrine. >> you know what, megyn? i don't understand why the obama administration has not understood this idea that when the department of justice monitored the phone line of journalists and their parents, by the way, that was not enough to them. now they want to send investigators into news rooms all over the country whether it

is broadcast or prints. they have no business sending those people into our news room. how we gather news is none of the government's business. and this is not about the fcc getting the information that they say they need, this is about controlling the people and intimidating the news -- >> what kind of crazy talk is this? i mean, they're saying oh, and now we're going to take a second look at this. whose brain child was this in the first place? and it gives you a window, does it not, katie, into the window that they're thinking. >> absolutely, i just think it is such an asinine that government bureaucrats will come in and monitor the correspondents, the reporters as if they don't know what they're doing. and to try and shift the focus on some stories to others. why is it that we need somebody like that to come in? >> let me guess, we've heard

enough about obamacare, somebody is going to come in and tell me and my news producer that you should not lead with that, this story here that you think you're doing so great, this is what the people need to hear. >> you know, megyn, you are just not covering what the people need. on another point here it is really important to point out that we live in an era, the year it 2014, where we have more access to information than we've ever had in the history of mankind. and the government now is coming in through the regulation saying they want to cater to the needs of people who are being under-served by the news? we have more news outlets than we've ever had. serving many different kind of people and outlets. catering to anything you want to

(vo) so do we, business pro. so do we. go national. go like pro. well, democrats against the rails again trying to explain why projected job losses in this country are a good thing. earlier this week, the nonpartisan cbo said that obamacare will lead people being in the work force, and the white house said this is great. then yesterday, the cbo announced that the president's proposal to raise the minimum wage in this country to $10.10 an hour will cost about half a million jobs in 2016 and they're attempting to dismiss that.

dr. charles krauthammerer is author of the book "things that matter." so today, they say raising the minimum wage will cost between half a million and a million jobs. you can't believe that cbo, that cbo we touted to you as nonpartisan? forget them. >> look, the administration, when they have been counting cbo as the nonpartisan, the arbiter of disputes, whenever it brings something that doesn't help them politically they say it is not true. look, a child can tell you that if you raise the minimum wage by a third you're going to get fewer jobs. there are reams, years of economic studies that show that it is obvious. all the cbo was to give it a number, roughly half a million. so what you get is a trade-off.

some of the people with minimum wage are going to get more income, and that is good. and there are going to be about half a million who are going to go from $7 an hour to zero. they're going to be destitute. and worse, because more than half the minimum wage earners are people under 25, this is their one chance at opportunity. the first job to get experience, to get the habit. to get into the work force and they're going to lose that leg up on the ladder. the one that obama always talks about as the idea that he is trying to construct. so it totally contradicts what obama pretends his economic policy is, which is to give people the tools and the opportunity to climb into the middle class. that is why the white house had to dismiss the numbers even though they are obvious to everybody who can see them. >> but it is so awkward to be cherry-picking these numbers after all the touting they have done of the cbo to come out and

say don't believe the cbo. here is just an example of how lauditory they have been on other issues. watch. >> i understand that suspicion, that skepticism. but the nonpartisan congressional watchdogs at the cbo estimate. >> and the smile for this, i think you all interested in the cbo, or i hope you did, the cbo report yesterday. >> the cbo report that we have again, speaks so eloquently. i love numbers, they're so precise. >> she loves the numbers, charles! >> they love numbers except when they come out on the wrong side. but here is why the democrats are so upset about this obvious result. because we know that democrats like to redistribute income. and they pretend it is always from the rich to the poor. what the cbo has shown absolutely clearly is that when you raise the minimum wage, you redistribute the income from one

set of low income people to another set of low income people. there are some who will get a raise and who will be better off. but there are others who are going to lose their job, lose everything, as i said going to go from $7 an hour to nothing. going to lose their opportunity. and the irony is that the winners get a marginal advantage. but for the losers it is devastation. and you don't really think about this administration as sort of robbing the people it says it really wants to help. and that is why they have to run away from these numbers. >> they maintain other studies have backed them up that this will not happen. they point to an example in new jersey. charles, great to see you. >> pleasure. >> after fighting with the hospital over medical treatment for their daughter, one family had to watch in horror as the state stepped in and took their child away. and that was just the start of this battle. wait until you see what has happened since then.

breaking tonight, federal officials issue iing a new warn to airlines suggesting that terrorists could be targeting flights that are heading into the united states. trace gallagher, live with the latest details, trace? >> and megyn, we're being told there is no specific threat or actual plot in the works. but that intelligence gathered in the united states and other countries indicates that terror groups might be working on a new type of shoe bomb. so now the department of homeland security has warned anybody that travels overseas to be looking out for the shoes.

while he was in the oval office, and says that hillary clinton set out to ruin her. >> hillary clinton is the war on women. and i think that she needs to be exposed for all of the terror campaigns that she has raised against women who were in the wrong place at the wrong time with her husband. >> even before that interview aired last night the larger media had declared that discussing hillary clinton's past or her handling of her husband's inappropriate behavior was sexist and irrelevant. but is that how the media has treated coverage of conservatives and republicans? brent, i pointed out on the show the other night, "the washington post" has pointed out mitt romney's bullying incident, that his high school bullying was front page news for them. but hillary clinton's behavior in the oval office, in the white house, that is not relevant? >> it is such a double standard, it is extraordinary.

if you're a republican, anything you did in your past is newsworthy. ie, what george bush and what was the 1971 in the national guard is newsworthy. what mitt romney did when he was 15 years old is front page on "the washington post." but if you're bill clinton or a democrat, anything you did is met with the phrase "move on." we need to move on, that, megyn is where the organization, moveon, came from. but the clintons do this and they're masters at it. they will even leak a little bit of dirt on themselves, and then announce the story is done with, the media go along with it and nobody ever gets the bottom of the story. >> they want to say there, there is no there, there, because you

can't tar hillary with bill's misconduct, his affairs. but that is not how most folks are discussing this. they're pointing to it, kathleen willey did, and this is our sound bite from last night so the viewers can hear how kathleen willey is phrasing it. >> she has enabled him, because she knows the power he has and wants a ride on the coat tails. and the easy way to handle the scandals is to ruin the women who happen to cross paths with him. >> to ruin the women. i'm not saying this is true, i am saying this is why kathleen willey says this is relevant. >> i'll tell you, my colleague and i, tim graham, wrote a book on this. the media have done nothing but give hillary clinton a free path in her career. either portraying her as a victim of her husband's abuses

or a fighting champion when she fights back. they have never held her accountable for her own actions. the problem that kathleen willey has, is she has three problems, number one she has her own baggage. she has to come across as not bitter, and how difficult is that? the third thing that is important, bill clinton is old news. i think the focus of a conversation with hillary clinton is absolutely warranted. but i think the media will have a fair statement to say we don't want to go through bill clinton all over again. >> and that is my final question for you before i let you go. it may be fair game to discuss what happened with the clintons and his behavior, but is the real objection, we already did discuss it? it is over, like we discussed it ad nauseum?

so kathleen's point is look, i'm not talking about bill clinton's past, or the affairs of monica lewins lewinsky, that is old news. but the democrats began this ridiculous and phoney news on the war on women, but if hillary clinton is going to be the primary contender for president of the united states you need to look at her record in terms of how she actually handled women in her own life. so you can talk about her record as first lady, as senator, as secretary of state and that is pretty thin gruel. but if the democrats are going to persist on this war on women, what the republicans have been talking about is absolutely relevant. >> the witnesses are going to come forward and say she was the head of this bimbo investigative unit. like, let's tear them down. we'll ruin their credibility. isn't it relevant to people making their decisions about her? >> it is, if you have evidence she was in charge of this bimbo

now, to a dramatic legal and medical ethics case that pits parents against the commonwealth of massachusetts, and against the hospital who called the state when the parents argued over the medical treatment for their daughter. trace gallagher has an unbelievable case for us from our west coast, trace? >> and megyn, when she was 15 years old, now, she -- at 11 years old she was diagnosed with a disease at the tufts medical center. a disease that causes weakness in the muscles as well as pain. she, in february of 2013 got the flu, her parents then rushed her to children's hospital in

boston, where doctors say she had rather, a mental condition and the symptoms were in her head. now, the parents tried to discharge her and take her back to tufts, but the hospital refused and called the children's department, saying they were not getting her mental help. now, the department of family services took custody with her. since then, the family has had limited contact with justina, they will not comment because a child is involved. and after the media was investigating the parents were slapped with a gag order. despite the threat of prosecution they are still talking, listen. >> we're talking indirectly about you know, i don't feel that this is a bad thing to say. this is my daughter, i have to say something. >> somebody has to defend her, if not this court system it is not the state of massachusetts. >> justina has been out of the

hospital for a better part of the month. her parents can still not get custody. they say she is not in a wheelchair, not being treated. and she is declining. and the next hearing is being held on this monday, megyn. >> wow, all right, trace, thank you. so can the state really take your child away from you when you are simply following that child's doctor's advice. criminal defense attorney and former prosecutor. the question, they're telling the parents two different things, the parents went with a, b, winds up getting the state involved and the child is taken away. >> right, this happened in the united states. i'm just checking. for a country that allegedly values due process and free speech, because again there is a gag order in effect. you would think it happened somewhere else. it is completely outrageous. >> how does the hospital obtain a gag order, saying you will not talk about what happened to your

child. >> there is no jury that is waiting because the father or mother contaminated the speech. this is a judge, i would have challenged the gag order, pro bono, i am sorry he didn't. >> this has to be a violation of the first memory morning, how can they tell a parent we will take your child from you and you will not say anything about it. you will keep your mouth shut. >> of course it is a violation of the first amendment. here is the problem, as outrageous as it is, the judge made the order and he has to follow it. he has to challenge it before he violates the judge's order. and now he has a shot. >> the father is frustrated. now only has dcs stepped in and taken custody of the child, the parents never see her. >> once a week and then two phone calls, 20 minutes twice. and it is monitored. megyn, look, i would understand a little bit more if these people got the diagnosis that she had the rare genetic

disorder from dr. feel good in an alley way when he used his ouija board to come up with it. okay, litigate it in court but you don't strip a parent of their responsibility to look after their own children. >> but the second hospital went to dcs, and dcs went in court and said this is abuse, this treatment plan they have been following from tufts is basically child abuse. and therefore her custody needs to be with us a and the parents need to be out of the equation. because they say it is all in their head. >> how about dcf? maybe they're the ones that are abusing the child. here is the question, how is the child doing, better or worse? us lawyers ask questions we know the answers to. maybe dcf should be indicted here.

>> what can the parents do? >> well, unfortunately, prepare for trial. unfortunately, dcf has extraordinary power. if there is anyone who is willing to get in there and appeal what is going on maybe they should do that. but ultimately there will be hearings sooner. and i expect that dcf will not carry their burden. they're the ones who have to show the parents are abusing their child. there are two equally plausible diagnoses. by the way, the girl's older sister was diagnosed with the same thing. >> right, right, they're saying it is all in her head, she didn't need the treatment because it was in her head. tufts disagrees. up next, he died, for 45 minutes he was did. heart stopped, no pulse, and wait until you hear what he says he saw as he was quote, walking towards the light. that is next. plus, "hannity" at the top of the hour. >> the key word there is republican. that means the media won't get on their back and look at their

grabbed my hand and said it is time for you to go on back. you have things on this earth to keep on doing with. >> did you remember that as soon as you woke up in the hospital? >> i don't -- my wife might know more of that. but she says i was talking real faint and soft. >> roberta, what did he say when he first woke up? >> when he first woke up he said he had seen my dad and mom and had seen the light. he was talking real shallow from all the medical equipment they had on him. >> it is incredible to hear, you don't belong here. that could lead to some worry, what do you mean? where should i go? right, she was telling you it was not your time yet. did you believe prior to this experience in after life? >> oh, i have always believed in the lord and after life and everything. the biggest thing is i wanted to
