representing him, even though a prosecutor says the suspect has $1 million trust fund in his name. he is 45 years old. police say he kidnapped this child as she was walking from from a friend0s husband on tuesday. one woman says the coach grabbed her by the arm and threw her in his truck. neighbors reported the plate to police. investigators found the little girl's body in that man's basement hours later. the floor still damp with bleach. they said the coach was parked outside the home with a roll of duct tape in his hands when he was arrested. annie young gets both sides of this case good to have you today. how exactly -- >> thank you. >> -- would you describe the case against the coach? >> i think it's safe to say this is every parent's worst nightmare. it raises the notion of stranger danger to the next level. i read the probable cause statement and the complaint, and the evidence -- obviously the vision ongoing, but the evidence

is overwhelming. the prosecution is going to use building blocks to prove he is guilty. broad daylight abduction, positive identification, and the license plate and the body in his basement. >> you talk about a building block. one of them has to be a motive. >> the prosecution is not required to prove motive but it helps, and i you present case in front of a jury, the jury is going to want to know why? why would he do these things? that's why i suspect an autopsy as well as an examination of the child will be conducted. if there are findings of sexual assault i anticipate there will be more inflammatory charges might bell the basis for the motive. >> we don't know about that yet. i know attorneys have a way of talking to each other and i heard this word come up. the defense would have to get craig michael wood, the suspect, some returning. what does that mean?

>> that means they need to get him psychologically evaluated. they need to explore all options to see if he has any potential defenses here, including whether he suffers from any kind of mental illness. there is a possibility that he didn't know the difference between right or wrong? and so, therefore, they could enter a not guilty by reason of insanity plea. is he a documented pedophile? a series of tests they have don duct on him in order to establish a defense for this man. >> you know, i'm curious. you mention the element of stranger danger. does the law look. any differently if the victim and perpetrator know each other or don't. >> not necessarily. when you think about child abduction cases, usual live there is a relationship between the child and the abductor, and very rarely -- i don't want to say rarely but often times you don't see that relationship. the will you doesn't distinguish the relationship between the victim and the child molester, but that's a factor that is taken into consideration when

the court looks at it. >> because of the nature of this, teacher, youth football coach, somebody that parents would trust their child to be around. because of that this case is growing in its high-profile nature. parents looking at this because it hits close to home. there might be some twists ahead because of what he does for a living. why would you say that? >> i think it's going to be interesting to see if more parents come forward or more children come forward. were there any red flags in the past? my understanding this man worked in the education system since 1998. so, are we expected to believe there were no red flags? are there going to be more children who come forward and say, something unusual happened in the past, or perhaps something sexually inappropriate happened? i don't know. i'm interested to see what happens in the future, especially in light of all this publicity. >> we'll check back with you on this. thank you for joining us today. a warning now from the head of the internal revenue service.

the tax agency is no where near ready for some of the big changes coming under the affordable care act or obamacare. the irs commissioner is warping they won't have the manpower to answer all the phone calls next year when the new healthcare law shows up on people's tax returns. in fact the commissioner says they don't have enough people to answer the phones right now for this tax season, even before obamacare goes into full effect. the staffing issues after the congress cut the budget of the irs, and the -- mike emanuel is live in washington. this commissioner has a list of complaints. >> that's right. the new irs chief says money and resources are definitely a problem. they have 150 people working to provide documents to investigators, looking into the targeting of conservative groups by the irs. and he says customer service is suffering due to a lack of manpower. a former irs commissioner is sympathetic.

>> the new commissioner has to make some tough choices because there just isn't quite enough money to go around and he has to pare back certain areas, and the acknowledge to get through on phones, that's levels not seen since the '90s. so this is a challenge and the american people deserve better. so, i'd like too see congress give more money to the service at this point that seems rather unlikely. >> you have those needs with the phone calls and everything else and finding money in the budget to do that. yet the irs is taking heat because it did have money for executive travel expenses. >> that's right, and inspector general's report says senior irs executives should have paid taxes on expensed they ran out for out of town travel for work in a statement the irs says, quote, cutting cost atop priority and the irs has nut place a number of steps to reduce expenses involving

executive travel. the irs agreed with the inspector general's recommends and has put in place steps to prevent future issues in the area. a leading critic in congress says this just shows the irs cannot be trusted. >> now they're going to have a greater role in obamacare with a web site that is not secure and the problems with the legislation. certainly doesn't instill a lot of confidence in the minds of taxpayers and citizens across the country. >> jordan says millions of americans would not dare underreport on their taxes, but irs executives were doing it. harris? >> very interesting. already a contentious relationship because most people don't like to get call from the irs. mike emanuel, good to see you in the past few hours a federal judge in illinois ruled gay couples in chicago do not have to wait until june to get married. even though the law legalizing same-sex marriage does not take been effect until then. the judge said gay couples in

sideways and cars had gone under the length of it or the back end of it. the cars were intact. just crushed front ends. >> meanwhile, in northeast alabama, emergency officials say wind gusts destroyed at least two homes, two apartment complexes sustained severe damage, some rooftops gone. the officials say paramedics took two people to the hospital. >> the word miracle gets assed around a lot. but when you done gets tossed around a lot but when you see one you know it. a five-month-old now in stable condition after he stopped breathing along a busy expressway, his aunt was driving when she says she noticed her nephew was turning blue in the face. she quickly pulled over, screamed for help, and began performing cpr. drivers started stopping to help. in fact the photographer who took the pictures says he tracked down the police officer and the three of them worked frantically. the baby started breathing again, and then stopped.

finely rescue workers arrived, took him to the hospital. witness says the entire thing brought traffic to a standstill. phil is live in our south florida newsroom. what a story. >> amazing, harris. this is one of the very few stories, chock-full of heros and this afternoon a couple of parents rejoicing with life. their five-month-old boy, sebo as he is called, is alive, and his aunt, an absolute hero. the mother trusted her five-month-old baby boy with her sister, pamela. well, a miami herald photographer happened to be right behind her on the highway when she pulled over screaming for help, bringing traffic to a halt as the woman performed cpr on the shoulder. >> it was the scariest moment of my life. i don't knoll how i remembered what to do. i just enough i couldn't let him die. i had the baby in my arms and he

was completely limp. and i kept screaming for help. >> this is about the first scare for -- not the first scare for sebastian. he was born prematurely and had preparesser to issues before. this afternoon at the hospital he is listed as stable. >> we have some brand new pictures now we'll share with everybody. i called this a miracle. my goodness, gracious, look at him. so precious. sebastian -- what did you call him? >> they call him sebo. >> look how big he is now. and survived not one but two rounds of trouble today, and he is right okay. and speaking of right. right place at the right time. what too you say? >> no kidding. because not only was the aunt, who deserved all the credit here for saving sbe o's life, really spot on. but nearby in traffic on the expressway war couple of miami-dade paramedics and a cop

well, looks like protesters in ukraine could get what they demanded, a new government. many of them say it's not coming soon enough. the president and opposition leaders have reached a deal to end their bloody revolt. the deal calls for officials to name a new government in ten days and one that would also include leaders from the opposition. so they'll recruit the guys they're fighting, and they're demanding presidential elections now, not waiting until next year, and it limits the current

president's powers as well. he demonstrations began when ukraine's government aligned itself with russia. that angered protesters who called for ukraine to go by the way of europe and the west. the white house reports president obama and the russian president putin are talking about the deal today. a live look at independence squarey yesterday nearly 80 people died in demonstrations there. deal or not, protesters show no signs of leaving their camp. we were told there was a -- you can see it now. if you move that banner. there's a funeral going on there. and again, i mentioned 80 protesters were killed. still some activity at this hour with the time difference. you can understand that. some of them say early elections are not enough. they want the president there to step down right now. let's bring in former ambassador to the unites nations and former new mexico governor, bill richardson, good to have you today. >> thank you, harris. >> just for the point of candor

i know you can deliver, what will this conversation be like between the presidents, president putin and president obama? >> well, basically this is a big loss for putin. russia wanted yanukovych, the current president to stay in, reject the west. seems the protesters turned things around and now january knew the -- the president is going to succeed. i think what president obama will do is say let's back the deal by the european foreign ministers, the foreign minister of germany, the foreign minister of pole land, which creates a transition. the president will be on the other side, which is, have yanukovych, the current president, resign right away. basically russia is not happy with the deal their guy,an

ceviche, made. so it's important to calm putin down to tell him we'll work together. putin, you've had some good olympics. now is the time to basically let has been agreed to proceed. because putin can still have major influs on the outcome. >> we learned recently -- you talk about who is listening to the united states. looked like it kind of got left out of the conversation because the ukraine ministry of the defense has not been changing the phone call defense secretary chuck hagel. how can we make sure they'll follow through on the teal? >> we have major influence in the ukraine. we have strong relationships there. what obviously was happening was defense minister knew what secretary hagel was going to say, and hagel was going to say, stop the violence, make a deal, cool things down, and he didn't like the message. so, you know, this happens in

diplomacy, but at the same time i think you're right, the european union deserves the major credit for potentially making a deal that is going to calm things down. >> you know, it kind of comes to the point of where we stand in the world now. do you think ukraine some other countries are even listening to the united states? >> well, yes, we have influence there. here's why. it's a strategic part of the world. the ukrainian opposition -- a majority of the people there want closer ties with thewest, with europe, the united states. they want to do some energy deals with us on shale gas. there's a lot of ukrainian-americans. the united states has had major deals withukraine on nuclear power, on their nuclear weapons. but russia is still a player. i think the main message here, harris, is, the united states and russia have a lot of potential common interests, but we're not working that well.

we're not working well in syria, here in the ukraine we went different ways. i think the conversation hopefully between the two presidents will make things easier, but it might not. >> you mentioned some of the troubled water recently with the ability to influence peace around the world. you talked about syria, the red line the president drew, and he didn't do anything even though the weapons were used. you had the deal with iran which seems to give them much more than what the world was led to believe they would get. so the bottom line i'm asking, will history look back at this time and point to this as perhaps the beginning of an erosion of our influence reasons the world? >> well, i think the middle east has really changed with arab spring, with -- what you see around the world today in venezuela, in syria, in ukraine, is the opposition, democracy sprouting, and i think we have to be associated with this

programs but the white house says the offer is still on the table if republicans offer to close some tax loopholes for the wealthy. g.o.p. leaders say this shows the president has no interest in doing anything about what they call our looming debt crisis. chris moody is politics reporter for yahoo news. did the president break a promise here? >> i don't think it's fair to say he broke a promise. the president puts out his budget every year, and this year he is treating it more of a wish list for what he reside like to see done as opposed to perhaps a blueprinted for something that can get passed. according to the white house, in years past there was possibility or a big budget deal, grand bargain, and so the white house put things lining change cpi and entitlement reforms on the table as part of the talks. but a lot has changed since then and doesn't seem there's any possibility for a grand bargain in the near future. so the obama administration is just saying, here's what we

want. negotiations don't seem like they've been working out as much as before so this is our wish list, and we'll see what happens. >> all right so the national debt is way above $17 trillion. in fact the national debt has its open twitter page, it's so big. 80,000 followers. that's not on your wish list to play that down? how does that happen? >> well, this also works as an opportunity to reach out to the left. you have to remember his liberal base has been very frustrated with him putting that on the table. officially putting it on paper in this budget. we'll see if john boehner wants to renegotiate and look at the possibilities for a grand bargain, but as we saw in the state of the union, this does not look like the year for the big things. a lot of proposals were small steps. now they can have an impact on a lot of people but we're not going to mars. these are small things and that's the scope of divided

government. >> maybe you can reconcile. the president said can't get big things done and then calls this the year of action. how can those two things exist at the same time? >> he'd like it to be the year of action but the political landscape is such where you can do maybe a couple of small incremental things, but nothing big. and also doesn't help it's an election year, a lot of members of the senate and all the members of the house are up for re-election in november, and that makes is difficult to do controversial things when voters do remember what were voted on. the things close to the president's hart, heart, can't too this year. >> americans are tired of hearing these words: it's an election year.

is this a strategy of the white house to put out the wish list and then cherry pick. >> president does this. paul ryan's budget was a wish list. republicans who voted for that over the past several years, know that -- knew it's not going to get passed in its entirety but that's what they want if they had control of the entire government and that's what the president is doing here. he is saying these of my priority, and i hate to use the phrase in an election year, politicians want to show their priorities, want to show their base, they're supporters, what they believe in, and this is a really good opportunity for them to do it, even if it has no chance of passing. >> it's an election year. chris moody. good to see you. thank you. >> great to be on. thank you. >> fox urgent now. word, a grand jury has indicted a california lawmaker for corruption. according to the u.s. attorney, the democrat, california state senator ron calderon, took bribes, including cash, lavish

trips and meal prosecutors say it added up to $100,000 in bribes. lawmakers' brother is also accused of corruption in this indictment. >> the leader of antigovernment protests in venezuela is rally supporters from behind bars. reuters reports he has passed a note to his wife, urging people to continue demonstrating peacefully against the country's president. protesters seemed peaceful bus last night hundreds of. the naught with riot police farther west. opponents say the government cut internet service to one college taken after violent protests. six people reported dead across venezuela. the government is holding that opposition leader at a military base outside the capital. steve harrigan is live with more on this. what's the latest on this protest leaders?

>> since leopoldo lopez turned him in voluntarily he hayes been held in almost exclusion at a military base but has managed to get a note to his wife to encourage his supporters to keep on protesting. don't stop. he said. i will keep going as well. he is planning to encourage major march on saturday. this march known straightors hope will be peaceful. we have seen flairs of violence from both sides, molotov cocktails and tear gas. as many as eight people killed. they began as student protests early in the month bus as the government has cracked down they've gotten larger and larger. >> talk about what the government is doing in terms of cracking down on these people? >> one of the newer ways the government has cracked down is apparents live by cutting off internet access, especially in areas where the demonstrations have been intense, like some college towns. keep in mind the venezuelan
