fresh breath. you and a koala bear together. >> you came back to the united states in the a good time. >> yes, you did. >> the fcc this week caused quite a bit of controversy when it announced that it was going to look into this controversial study which would have gone into numerous across the united states and to figure out exactly what content was going on the air, talk to reporters, media managers, and also study stud diversity of the newsroom. but that, of course, raised the eyebrows of many. >> well, the federal government putting monitors in numerous to monitor news content. this was all in the name, of course, of racial bean county. the federal government feels a need to make certain the diversity goals it holds out to the country are met in numerous. they have suspended it though in the wake of outcry. here is a statement from the fcc:

>> but the only reason we even know about this is because of a whistle blower from the fcc itself, one of five bosses there. and really what seems alarming about it is he is the only one of the five who felt the need to come forward. we wouldn't even know about it and it took media outcry for this reversal. let's take a listen. he went "on the record" with greta van susteren last night. >> this is a big victory for the first amendment. the fcc has announced that it is not going to send researchers hired by the government to -- into newsrooms across the country. that's a good thing from all citizens. i have heard from hundreds of americans across the country on email and twitter who have expressed their own concern. they come from across the ideological spectrum. that's one of the good things about this dialogue it's imented that everyone, regardless of where they come from in political issue

shares that bedrock of what our constitution means when it says the press shall be free. >> it is remarkable. we are learning this morning about the company going to conduct this study. maryland company called social solutions international founded back in 2005 which tries to promote racial diversity. scieno study h.i.v. and aids and diversity. what are they doing studying the media and being able to go into a news station and say you are not doing enough diversity coverage. you are not studying the effects of food stamps in the community. we think you need to cover this more on your airways. >> which seems to be as bad. more diversity in the newsroom and more minorities and more women. that was one of the goals of all of this supposedly. the ideas that it could incorporate fringe on them and get them to change their media coverage which is clearly a violation of the first amendment. >> it's not the government's business what color people are by the way is anybody else creeped out by the federal government keeping track of people by their

race? isn't there something a little creepy about that? i have to say this is a victory for the first amendment, maybe? also an ominous threat to the first amendment that they would each consider this and there was no outcry. where are the civil libertarians on the left? they are gone. >> especially on the crack side they support. this diversity -- let's talk about. let's make sure that our airwaves are covering these things. food stamps. voter i.d. laws. >> it's not the congress' business what reporters cover. that concept is totally contrary to the first amendment. >> it might not be the last that we have heard of it either. this has been suspended. it's been derailed for the time being. >> that's a good point. >> the other thing is pai when he was on the greta van susteren show. i don't know who carried it out exactly, we realize that now, this social solutions company, this maryland based

business business recognize raising employees. they end up having lower turn diswrofer rates. higher productivity. higher morale. this is not just good policy it also happens to be good politics. >> that was president obama yesterday continuing to tout his executive power to increase the executive rage to $10.10 an hour. new ceo reports will cost 500,000 jobs. is the obama administration wanting to help. we're asking a professor at the university of maryland peter morici. >> nice to see you this morning. >> nice to be with you. >> republicans have jumped on 500,000 job loss number. say don't pay attention to that number. it's squishy at best. governor o'malley says we will lift up 16 million people out of poverty if we move it to 10.10 an hour. what would do you say? >> whenever you raise a wage by a union contract or law, you are going to make some people better off. you are also going to throw other people out of jobs.

that 500,000 is not an inconsequential number. it's very large in the grand scheme of things it would raise unemployment by 3/10ths and throw those 500,000 folks deeper into poverty. it's robbing peter to pay paul. it's just bad economics. it's not good business policy. what the president is looking for is a wedge issue to distract attention from the healthcare debacle, you know, for the fall elections. >> so the cbo prediction for this 10.10 an hour would put it at 900,000 fewer below the poverty line as a result of it in their prediction. is there though a better way where we wouldn't have to have that amount of job loss? is there a middle ground? >> well, absolutely. if we raise the minute pump wage to about $8 an hour. i think we can go to 8.25 and not have much of an impact on employment. that's really inferred by the cbo study. but the president doesn't want to do what other

presidents, other democratic presidents have done in the past and that's keep the minimum wage in line with inflation, which is generous considering that most workers are not keeping up, instead he is looking for a wedge issue for the fall election. this is frankly demagoguery. >> let's look at the larger number though which is the amount of money that would be infused into the economy. again, martin o'malley that governor's association meeting yesterday saying people who don't understand it are probably making more than $400 a month, the rich that are complaining about this, but such an infusion of money into the economy up wards of $30 billion that woe can't not do this. >> well, there wouldn't be infusion if you create more unemployment. in addition, got to remember if we pay that mcdonald's worker $10 an hour. cost of the big mac, happy meal fries and soda is going to group 1 or $2. working poor that most frequent those restaurants, so they will be worse off. this is basically money allusion. what we will do is create a the love inflation and at

vociferous critics recognize that ecigarettes are far safer for smokers than are cigarettes. you will get the nicotine. remember, the nicotine is not what is harmful. the nicotine is what addicts you and that's why we don't want minors to have access to them. it's smoke that kills. but, we don't -- as i said, they haven't yet made their proclamation on it. and we want to do -- we do want to keep it out of the hands of young people. they are concerned about a gateway effect that young people might start vaping and then move on to cigarettes. and that would be a very bad outcome. and this is something we have to follow but the cdc data that exists now shows that smoking in youth is at an all-time low at 18%. ecigarette use has gone up a little bit.

congress, wherever i can, but whenever can i acted on my own to expand opportunity for more americans and help build our middle class, i'm going it do that. we're going to double the distance our cars and light trucks can go on a gallon of gas by 2025. we are going to double it. >> well, of the president rolling out new regulations on the trucking industry. but some truckers are pushing saying they can't afford these changes after they just went through a series of costly e.p.a. upgrades. joining us now is director of governmental affairs and communications for the western trucking alliance joe, a former trucker of over 30 years as well. good morning, joe, how are you? >> good morning. >> okay. so the issue with all of this is these changes are to be made to these trucks is going to end up costing some $200,000, you say and this could crush mom and pop businesses. >> yeah. the majority of the trucking business, 97% of trucking companies in this country are small businesses. they operate 20 or fewer trucks. and we have gone through a series of e.p.a. mandates in

improving the emissions of trucks. that have dramatically increased the price of trucks, in '97 when i bought my last period built it actually cost $97,000. that same truck today, if you could buy it is $165,000. and the majority of those increases are directly related to e.p.a. mandates. it all sounds warm and fuzzy that we're going to increase fuel mileage, and average people say hey they do it for cars, why not trucks? it's really dynamic environ many where trucks are used very differently enemy different applications. this is an example of one size fits all mandates from the government. >> and we're noticing companies like u.p.s., they are actually supporting president obama but they are also accepting taxpayer money. what do you make of all of this? you mentioned that the majority of these trucking companies own 20 trucks or fewer. it's not just the majority. it's 97% of the 1.3 million

of them. what do you make of big companies siding with the president? >> yeah. that's something that we have seen through this whole process where a large motor carrier interests wrap themselves in a green flag and they are supportive and from our point of view, that is nothing more than them trying to use the government to basically monopolize the industry. knock the little folks out of marketplace and they themselves benefit through increased rates. in the example you are describing, u.p.s. is very supportive of this, yet, u.p.s. sits there and garners $2.2 million from you and i as taxpayers here in southern california to buy new trucks. money that allegedly is available to small businesses but as in the document i supplied to your producer, it's large businesses who get that corporate welfare from us as taxpayers. it's not a level playing field. >> it radio. i know that you argue that diesel is burning cleaner than ever before to people who say this is very

unions still have problems. >> yeah, it is. and i was surprised to see the indictment happened. what i found out basically is for four decades, at least, the construction trade unions, not just iron workers, have been totally dominating the industry. they do it through violence, vandalism, harassment and i've talked to people who have been shot at. it's very scary stuff. they've gotten away with it. >> how is that, exactly? if organized labor turns criminal, it's organized crime, by definition. why isn't the justice department on this? >> well, it is this time. there are all kinds of federal protections for unions. probably the most notable is 1973 edmunds ruling says you cannot prosecute or investigate a union for criminal activity under the hobbs act, unless it's engaged in quote/unquote

legitimate union business. f so what's so unique is they're making the argument that the iron workers were no longer engaged in union business. . that will be interesting in court. it's not unheard of. but it's rare to attack it. it's like a mafia organization. >> how sad. i mean, there's so many decent union members, especially in the construction trades. i know a ton of them. they're not hacks. they're not bad people. they're just working men. they're discredited by behavior like this. >> yeah, it gives them a bad name. if you go into philadelphia and you're talking to people in the construction trades and you mention unionism, i mean, the wall comes up. it's something that is definitely an agent of fear there, and i think that's a purposeful image they projected in philadelphia but it's definitely not the p.r. that the unions want. >> you said the feds have jumped in on this. what about the city of philadelphia. if you're the mayor, how could you not vp known about this? >> that's the question.
