number needed as they predicted by the end of this month. we're 30 days away from that seven million number originally projected, targeted by the white house and impels -- and kathleen sebelius kept saying four million. they have a lot of work to do before the end of the month. take a listen. >> because of you, we now have four million americans who have signed up for quality private health insurance through the marketplace exchanges. four million people have already signed up because of you. four million. four million. four million. that's on top of the three million young people who have been able to get coverage by staying on their parents' plan and on top of the millions of americans who are signing up to get medicaid for the first time. so you've already, because of the work that you've done, made sure that people

all across america are getting better coverage. >> perhaps the repeat of the numbers there is in hopes that we'll add all those four million together? >> really curious to find out how he's going to come up with four million because what we found out over the past whatever it is, four months -- october, december, january, february -- five months since this thing started is president obama's numbers don't exactly add up. he said four million on top of the three million young people and the millions of people who have signed up for medicaid, the problem is that is not what the pass says. it says four million are signing up for medicaid. they are taking out of the system rather than putting in. four million new payers? i'm not sure. the other thing, people would go on to the website and say i'm interested in this plan and they would count them before they signed a check. >> it is like when you're in the store, you're in wal-mart, walking around and there is stuff in your

cart, they're counting that as a sale when it is really not. they have the means to get that number because that back area where they figure those numbers out still isn't working. that four million is, i don't know, -- >> let's see if we can give you four million. before that number is adjusted to fulfillment, let's give you the four million. the problem is you need seven, and time is running out. or do you need seven? kathleen sebelius said i don't know where you came up with seven. >> first of all, seven million was not the administration. that was a c.b.o., congressional budget office prediction when the bill was first signed. i'm not quite sure where they even got their numbers. there are numbers all over the board and the vice president has looked and said it may be closer to five to six. >> i know she has a lot going on and it is hard to remember where that seven million number came from. let's remind her. >> i think success looks

like at least seven million people having signed up by the end of march 2014. >> oh, that was you. >> she said that marilyn tavenner also projected the targets at being seven million. that was also in -- that was september 5 of 2013. to go ahead and suspend, and tell everybody you never said seven million, never used s-fpb -- seven million, seven million wasn't the magic number is an insult to our intelligence. >> the memo was actually sent, projected monthly enrollment for health insurance marketplaces sent by tavenner to sebelius september 5, 2013, which is where that number came from. >> the real reason why any of these numbers matter is they're trying to score how much is obamacare going to cost us. remember originally it was going to be revenue neutral, wasn't going to cost america a dime. then it was $400 billion. then it was $800 billion. if they don't get seven

million enrollees and they are not young people, which they aren't, the cost of obamacare is going to skyrocket. >> adding to eric, charles krauthammer. listen. >> it tells you how cynically the administration is manipulating these numbers which it pretends it doesn't have, but when it needs it, it produces the numbers so it can cover another story. you know, it's an old rule. say the truth. it's easier to memorize. they keep changing stories on this, and they can't even remember what their last story was. the administration is way behind. everybody understands that except in a release real numbers tk-rbgs -- and it isn't a real number because it is not a person enrolled. they aren't counting the enrolled. it is the people who put the plan in the shopping cart. amazon doesn't count as a sale stuff that is in the cart. it has to be something that actually is paid for. >> this is what i would do if i was them. you want seven million. just say we wanted seven million. we got off to a bad start.

today and it reveals that the food and drug administration spied on its own employees. the f.d.a. is accused of tracking down its own scientists' e-mails in order to keep them from going public with safety concerns. an f.d.a. spokesperson calls the report, quote, inaccurate. kind of a fun story to bring out of california this morning. a california couple striking gold as they found $10 million in buried treasure in their own backyard. look at this. the husband and wife -- they say they want to remain anonymous -- they noticed something shiny in the ground so they started digging and found eight metal cans filled with rare gold coins. it was a total shock even for a rare coin expert. >> they looked at one another and kind of whispered a little bit. and with a big smile, they said we found about 1,400 and my jaw dropped.

it's one of our military's most notorious tragedies. four navy seals on a top secret taliban mission and only one survives. but would that outcome have been different if these seals were not white? an explosive new book claims a politically correct white house is weakening the navy seals to be diverse and politically correct. the authors of ice in the target are here to -- of eyes in the target are here to explain. first off, you talked about hunting bin laden. you cowrote with chris kyle, number-one bestseller. characterize the seals as you know them. >> i would like to address that initial comment. it is not an argument in our book that they're

trying to make them, quote, white. this is one of the most diverse groups in the united states just like our military in general. there's every ethnicity, if you will, in the seals and that is not our argument that they're trying to make them, quote, white. what our argument is they're trying to make them politically correct. there is a big difference between the two. >> what do you mean politically correct? >> they are trying to make their whole culture be a different group of people in the ways they do their rules of engagement, the way they handle themselves in different situations and the way the white house is looking at also integrating different areas including female soldiers. >> the white house is also politicizing the seals. first of all, they never should have been announced by bin laden was killed by seal team 6. a lot thought this put a target on their back. after that we had the shoot down of a helicopter named

vulture 17. the white house has not explained how the taliban found out about the existence of that flight. >> you have eyes on the target when you talk about rules of engagement. let them fight is what you're saying, scott? >> exactly. we're saying you can't politicize this group in order to make it correct, if you will. they are the tip of the spear. they are out there to protect this nation's interest. and one of the stories that we go over in detail here is benghazi and what ty woods and glenn daugherty were able to accomplish there, two navy seals that basically saved the lives, we believe, of at least 30 to 40 state department personnel there. >> they head off the enemy attack for more than eight hours. two men holding off almost 100 people for eight hours is an incredible task. without rescue -- one of the things we look at in this book and say the president had military options where he could have brought in rescue operations out of a base in sicily or other u.s. naval bases in italy or nearby.

there was a carrier in italy for the 9/11 celebration. >> drones in the area as well? >> two drones in the area as well. >> this is why eyes on the target worbs -- works perfect because the way the navy seals work, they will fight despite the odd. the fact that there was no help is inexcusable. >> there was a question posited by a former secretary of state to congress in which she said what difference does it make? the difference is four lives were lost in benghazi. we believe the lives could have been prevented to be lost totally. eight hours into the fight glenn daugherty and ty woods could have been saved. >> what does it mean to you and do you think to them knowing susan rice would say no regrets about the message they got out in which she claims the intelligence community gave to her? >> i think if susan rice has no regrets she is on strong medication.

we found in writing this book, we found three intelligence reports circulating including susan rice's desk in the months prior to the benghazi attack showing massive al qaeda build-up at the time. at the same time they saw those reports including photographs of al qaeda rallies, hundreds of people in downtown benghazi. at the same time they had intelligence reports they were turning down security requests for additional protection for u.s. personnel in benghazi. >> you work with chris kyle and you see how many deployments they have. what do these men sacrifice in terms of their lives and quality of the rest of their lives in order to be effective navy seals? >> i think they sacrifice their entire life. >> even if they live through it, what they do for their families and what we've told of christian's story in american sniper is the amount of duty to this country they go through when they're deployed or training to be deployed, their life is devoted as patriots to this country, and this book and eyes on the target, we try to describe how much they commit to this country and

people if they were christian or muslim. and she joked about pulling a columbine in her own school, so why is a teacher now suing the nypd for $6 million? she was a teacher in brooklyn, new york, when she said this to her colleagues -- quote -- "if i had a trench coat and a shotgun, it would be columbine all over again." police arrested her for making terroristic threats but a grand jury did not indite her. go figure. elisabeth? >> thanks, brian. instead of planning for prom or looking over college applications, a high school senior's life is in limbo due to his school's zero to cans policy. david tkapbder drove his -- david sander drove his dad's car to school and a fishing hook was found in it. he was suspended for ten days. >> he's facing criminal charges even though he didn't know the knife was in the car. david and his grandmother

join us with the story. david, tell us how this went down. a random check of the car. how did that go down and tell us where the knife was. >> they took me out to my car and they asked if that was my car. i was like, yes. they asked if there was anything i was hiding in there or something i need to know about. i said no, but my dad choose so there might be snuff. they searched it and that's when they found the knife. >> they find the knife. you are now looking at a suspension for ten days. they brought you in for questioning. you were a willing participant. i understand you signed something there. what's your greatest fear right now? you're looking at possibly not being able to graduate for criminal charges? >> yeah. my biggest fear right now is not being able to walk with my classmates or seeing them again or possibly moving to a different school. >> david, let's talk about this. you got suspended for ten days. you got sent to an alternate school for nine

days. you may not be allowed to graduate and all this because there was a knife you didn't know was in the car? by the way, that isn't your knife? your father is a fisherman? >> yes, that's his knife. he is a commercial fisherman. >> you've told them this? >> yes. >> can we talk to your grandmother for a second. here is your grandson. i understand he is a very good student. tell us about him as a person. why do you think they're being so tough on your grandson? >> i don't -- you know, my grandson is a great kid. polite, quiet, honor roll student, really a pleasant person both in class and at home. and i don't know that they're being so tough on him. this is the way the schools are going now. it's like our kids are being held hostage. they're being terrorized in school for ridiculous things. it's just gone overboard. you know, we all understand zero tolerance.

you can't get into a school in this country nowadays without getting buzzed in. they're all on lockdown. you know, somebody has to use common sense. >> i think common sense should play a part in it. certainly we all want kid safe in schools. i understand there is a hearing today at 11. there's also been a petition with over 6 hundred signatures to try to get the school to drop charges moving forward. what do you want the school to know? >> well, i think they need to take it case by case. i think when they did the search, they did the lockdown of the schools and they had some of the students come out to the cars, search the cars. i think that they need to understand some of these kids are driving their parents' cars. it wasn't, you know, it wasn't an ak-47. it was his dad's fishing knife. and he didn't know it was there. they need to look at each case. they don't need to -- he

saw ann romney beautifully defend himself. joe biden makes it out like all single women are stuck in some dead-end job. you know, i'm a deadbeat, i'm just here for my health care. it's ridiculous. a lot of single women are working out of necessity because they want to provide a thriving home for their children. many women, as you know, because of the recession, have had to reenter the workforce because their husbands have been laid off. it's just mind-boggling. but joe biden, as you guys pointed out earlier, is the gift that keeps on giving. i guess now white guys can play basketball as good as black guys. can you imagine if a republican said that? oh my gosh. >> there is no challenge on the other side to this in terms of what jobs mean for women, the freedom that comes with it, the opportunity. why not? why try to paint someone coming out of the work force depending on government as something

i have headlines to bring you. they survived a terror attack and not only are the soldiers at fort hood being denied benefits, they're now being asked to pay more in living expenses. according to a new proposal out of washington, prices are about to get hiked at the texas base on food, housing and also medical treatments. this news obviously upsetting to those who already have felt abandoned when the government classified the attack there as workplace violence. >> i got out recently about a year ago, and i feel that the time i served in, times in deployment, it's stuff i earned, stuff that i don't think should be taken away. >> almost 70,000 jobs are directly linked to the fort hood base and other military installations affected by what's going on in washington as well. 28 more people indicted in a disability scandal that involves some new york retired cops, fire fighters and also jail guard. they are accused of ripping

off the social security disability system and taxpayers by faking psychological disorders linked to the 9/11 attacks. >> these are dollars that are reserved for people who truly need it the most in our communities. and the allegation in the indictment is that these individuals fabricated the extent of their disabilities in order to defraud the social securities administration. >> another 106 people indicted last month. this scam netted more than $20 million in social security disability payments. we'll keep you posted on that. a controversial medical technique is up for debate in washington this week. listen to this one. using three parents to make one baby. the f.d.a. is holding hearings on a new fertility procedure that let's doctors combine d.n.a. from three people to create embryos completely free of inherited diseases. critics say it is simply playing god and people

might be tempted to pick and choose their baby's traits. wow, what a debate. what do you think of that? imagine reading about your own death while you were still alive? this happened to cherly beaver, a 79-year-old woman from maine. she got a letter from her insurance claiming her prescription drug coverage had been canceled because she was dead. listen. >> my son, i said you've got to come read this letter. i'm dead. he says what? i said i'm dead. he said how can you be dead when you're here? i said you read this letter. >> exactly. beaver says she can't afford to pay her $1,000 for her heart medication she needs. she went to her local social security last week to tell them about the mixup and she hasn't heard back just yet. we hear more and more stories about that happening, don't we, where insurance company or somebody thinks you're dead and you're right there. we'll watch that story. >> you were saying before

records so there would be no evidence that all these veterans were waiting six to nine months for an exam. >> the voices we hear, do we know who they are? >> yes. one was at the time the head of radiology at the va los angeles medical center. she was in charge of overseeing this process, which began in march 2009. >> look at what we just have on the screen. we can put that back up again. veterans benefits backlog pending right now, 672,999. over 125 days, just about 60%. so with those numbers and with with the destruction of those claims, it is still grossly backlogged. >> oh, absolutely. and in fact, at the beginning of the year, 2014, there was still well over 400,000 veterans waiting over a year and a half to get their benefits. the president mentioned that in

his state of the union. there's tremendous pressure on the va right now. you're seeing all over the country ethical lapses this department is making to try to cover up, you know, their gross incompetence. >> and this is out in los angeles. there's no idea if it's happening anywhere else. did you contact them to get their side of the story? >> i did. they declined to comment. since then, other outlets have contacted them. they still have not made any statement. a congressman has written them a letter and tried to get a statement. they still have not said anything. >> what is so ridiculously stupid and shows gross incompetence is it's not hike these people go away. they're going to say, where are my claim? then they're going to have to process the claims again. it's not like they're helping their cause. >> exactly. and these are veterans who still needed those exams. they still needed help from this medical center. but it didn't matter. the only thing that mattered was the politics of the situation and getting that backlog down to make the department look gad. >> this is out of control. as far as i can tell, very

so if you don't like a law, just ignore it. that's the message from attorney general eric holder this morning to his counterparts all across the country. he's telling state attorneys general to look the other way on same-sex marriage laws if they don't align with their personal believes. quote, engaging in that process and making that determination is something that's appropriate for an attorney general to do, close that quote. joining us now, allen wilson, the attorney general of south carolina. allen, is attorney general eric holder correct? you, sir, can decide what's right for the state of south carolina and no one else? >> well, the first thing you learn in law school is fidelity

to your client. when you're an attorney, you have to represent the interest of your client. my client is the state of south carolina. in 2006 the voters overwhelmingly supported this amendment on the marriage amendment. 78% voted for that ban. whether you agree or disagree with the ban, an attorney should represent the interest of their client. attorney general holder said that on the rarest of occasions, we should not uphold our state laws and it should be rare. the problem is, what looks rare to him looks like a trend to me. this administration has chosen not to enforce immigration laws. they've chosen not to enforce an entire class of drug trafficking la laws. they've chosen not to enforce doma. they've created waivers for obamacare. they've created exemptions. they've moved deadlines. it's a slippery slope when the lawyer for a government chooses when and how they're going to enforce the law. >> very interestingly, and you make a very good point. so attorney general holder says

to you, if you don't agree with the law on the books regarding gay marriage, then don't enforce it. does he feel the same way about the immigration laws and the marijuana laws, frankly? does he also say you should have that discretion as well? one person in the state. >> well, i'm a criminal prosecutor. when you look at the adversarial system we have in our criminal justice system, you have to have an advocacy on both sides. criminal defense attorneys don't support crime, but they represent the interest of their client. when you're suing someone because you feel like you've been harmed by them, you know, you're not supporting -- when someone is defending them, you're not supporting the harm. you're supporting the adversarial process. if the state attorney general doesn't stand up for the citizens of their state on a particular law, who else will have standing to go into the court system and represent the interests of the state? usually nobody. >> i want to speak to the fact that eric holder is the one delivering this message. where is president obama on this? we all know president obama over the years has quote/unquote

evolved on the gay marriage issue. why are we hearing this from eric holder? >> well, you know, he said that he and the president had spoken about this at great lengths and the decision not to defend doma several years ago was one he did not take lightly. that's when he conveyed to the ags. by the way, i appreciated him coming and talking to the 50 attorneys state generals. that meant a lot to me. he said he and the president made the decision not to defend the doma law. i can appreciate he has an opinion. if that's where you stand on that position, you can say what your personal views are. but you have to give a voice to the law in the court system. when you remove that voice, that advocacy, a future administration may come in later when it is unsettled law it's just been a policy and they may enforce it. that creates problems for the people who detrimentally rely on the policies of one administration. >> you really have to think about this when you think about border states and whether or not they're going tone force some of the laws on the books right now. the administration may have a different opinion on that. we'll have to leave it there.

there's the pain. so i hear. well, we brought this up before, is welfare money going to pot? apparently thousands of dollars in the public were withdrawn in a marijuana shop. the atms -- how much money was being withdrawn? >> several thousand, but 64 occurrences where they found the ebt card, the card that's supposed to be for food and necessities, were used in a pot dispensary. presumably they were taking the cash out and buying weed with it. >> they didn't say, okay, here's my ebt card, give me pot. they used the atms located on the inside. there are regulations on that, but only for regulated atms affiliated with the bank. >> part of the problem is it's supposed to be -- the program is $105 billion program for nutrition, supplemental nutrition assistance. i'm not sure that -- and we need

welcome back. we told you about these brand new fox polls showing that the american people have a great deal of confidence in our military, 93%. the president and congress, not so much. >> that's what makes defense secretary's proposal to cut our military so surprising. he wants to close bases and slash billions from the budget. meantime, spending on entitlements like food stamps is at an all-time high. karl rove is a former senior adviser and deputy chief of staff to president george w. bush and fox news contributor. the numbers are staggering. they want to make a massive cut to the defense budget.

meanwhile, entitlement numbers up and up and up. fair? >> a huge mistake. the administration is asking for $113 billion in cuts to the defense budget over the next five years compared to what they proposed the defense spending be last year. if you look at it in terms of the gross domestic product, this is the way a lot of economists look at it and a lot of defense experts, we're cutting essentially from the high in 2011, 40% of the purchasing power in the military. >> that's the only thing this president wants to cut, ever. >> yeah, look, i think this is -- the bad news is he wants to do it. the good news is i think it's entirely political. i think what he is doing is saying, look, i'm going to just throw in. i'm not serious about the budget. i want to rev up the left of the democratic party for the midterm elections. if i cut defense spending and propose to shift that money to spend it on new social programs, new entitlements, new benefits, then that'll rev up the democratic left in time for the general election. it has been met in congress with

a bipartisan reaction saying, no way we're going to do this. >> look at this screen here. what's being spent when you do a comparison. 1990, we have defense spending at $568 billion. then entitlements, $568 billion. he looks like the commander in cheap by the time you get to what's being spent on defense in the military by 2014 here. it's staggering to think about a kick in the gut to the military from the commander in chief. >> exactly. remember this. remember that red bar of defense spending? in 2010 we have a lot of money we're spending on operations in iraq. that's gone. disappeared by 2012. the amount of money being spent in afghanistan is declining. so we are keeping the defense spending, you know, in decline largely because we're ending overseas operations, yet we still have the entitlement programs going up and up. >> isn't it the other way around? are those operations coming to a close to get to this?

>> well, we get some savings from the end of operations, but he wants to cut even further. i repeat, he wants to cut $113 billion in the next five years out of what he proposed we spend last year on the military. >> can we also point out where he wants to cut is alarming. he wants to raise housing expenses for current military and are retired. also, tricare, the current military health care system, he wants military people to add more to tricare, costing them more for health care. in the meantime, he's giving away obamacare to everyone else. >> even more damaging to that is the size of the military. the army will go down to 420,000. it's naturally on its way down because of end of combat operations. but it's going to 420 under this plan. we're kcutting the muscle of ou military. you can't find a significant military commander who say it's not dangerous to go below

environment. what do you mean? >> well, that's a hostile environment for a dog. they perceive things different than we perceive things. he's a military veteran. that's where he was deployed, in afghanistan. even our system, though, is a stressful environment for a dog to work in because the way they see threats is different than the way we see threats. >> we talk about ptsd when some veterans return, understandable. dogs, you're saying -- >> they do get it, but we go through -- we sit down with an army veterinarian, a u.s. army veterinarian before we adopt a dog. we go through the dog's medical file and make sure that the dog doesn't have ptsd. >> so how long is the dog going to work for the nypd before he's retired? chase bones and other dogs. >> that's the reason this program is so good. what the u.s. army is encouraging is law enforcement agencies from all over the country to transition these dogs into police dogs because they're still young and they still have a working life left. >> wow. and everyone is going to benefit, especially here in new
