>> good this afternoon to you and yours. first from fox. president putin is flex moscow's muscles again. there's word russia is gaving safe haven to ukraine's president. a swinging lap slap to the another and all the protesters. now the question in washington, how do you respond to vladimir putin? our secretary of defense gave a warning to russia today like sort of cold war style. it is unclear whether putin is listening. a top russianing new agency says the ukrainian president is staying in a kremlin guesthouse and still considers himself the president and plans a news conference tomorrow. he scened from ukraine during protests. ukraine is smith between a pro-east and a pro-west. the future of the ukrainian
12:02 pm
people is hanging in the balance. and putin ising ignoring calls from the west to stand down. putin is pushing his tough-guy image these days, made famous in these shirtless pictures. he has ordered war games along russia's western border right where it meets ukraine and making sure the world sees him flexing his military muscles. releasing this ridow of fighter jets training. secretary of state john kerry says putin claims the drills have nothing to do with ukraine. secretary kerry says he is asking the russians to let ukrainian make their own doeses. >> i talked to the foreign minister and we talked about the transition and the events in ukraine and the region, and i asked specifically that russia work with the united states and with our friends and allies in order to support ukraine, to
12:03 pm
rebuild unity, security, and a healthy economy. >> but there is no sign of unity just yet in ukraine. witnesses say heavily armed men stormed government building in the southern part of ukraine and raised a russian flag in crime -- crimea. >> war games along the border. what do you make of it? >> it's intimidation by the russian government these war games are meant to send a new government in kiev that it better not drift far from the russian orbit, and you pat together with president yanukovych is in russia, and what you also reported, the storming of parliamently building and russian flags.
12:04 pm
this is russian trying to make sure that it both protects the ethnic russians in the east and also tries to exert its authority over the new very untested government, just taken power over the last 24 hours in kiev. >> and testing the west. i thought it notable, if not extraordinary, the defense secretary chuck hagel's words today, it was so cold war that it makes the hair stand up on the back of your neck. lisp. >> i expect russias to be transparent about these activities, and i urge them not to take any steps that could be misinterpreted. or lead to miscalculation. during a very delicate time. >> carefully forecasted and specifically read statement there. that means something. >> well, it certainly does and the united states is in the position of having to rally other countries to send the same signal, most notably, germany,
12:05 pm
angela merkel. she has some influence in moscow and has to speak out or counsel them profitly. it would be positive nor u.s. if other countries spoke out. and you'll see the obama administration trying to turn this into an economic direction. the u.s. is thinking about a big economic aid package for the new ukrainian government and the eu the same, and the big message will be let the ukrainian people decide this in the may 25th 25th election. this country is divided between the the ethnic russians in the minority, and that should be the proper places to be adjudicated. that will be the message of the u.s. and the other western governments. >> with these war games on the border there, not to suggest that even putin would be stupid enough to take his troops across the border, though he coot. but we are one mistake away for
12:06 pm
very serious trouble for the whole world. >> i think it's much more likely the russians will use their economic influence to intimidate and try to blackmail the knew government. russia controls the natural gas coming into ukraine from russia that powers the ukrainian economy and heats home and russia can trade trade off and on at the border. that's where they will go first. one thing to look for, if some of the ethnic russian governors and mayors in the big cities will call for the russians to come in and protect ethnic russians, that could possibly be a pretext for the russians to intervene militarily. i think you'll see the saber rattling of putin but probably not over the border. >> thank you. now our food. we love food.

the nutrition labels we see on foods and drinks could soon change in a very big way. the fed plan to overhaul the labels for the first time in two decades to help us make healthier choices. we have it up here. on the left, the current label. calories on the left, fat, saturated fat. trans-fat always a zero in new york. on the right, a version of the proposed changes. more information here. the bolder type shows the changes. the feds say they include larger, more realistic serving sizes because we don't eat small portions, and the percentages are now on the left side of the label. you can see it's more information, some vitamin information at the bottom is similar, but this is the proposal. first lady michelle obama announcing the changes at the white house today. the feds say some 700,000 products have nutrition labels and estimate the changes will cost food companies $2 billion.

let get to lea gabrielle in a grocery store. >> i'm eating ice cream, and when i dig into one of these things i'm going to the bottom. now, these new labels will tell us things that will add information. for example, new serving size on this. it's a full coup rather turn full cup rather than half cup. this is a single serving container. there's actually two section in here. the new labels will tell us how many calories in the container. this snack here, single serving but actually two servings, so this will give us how many calories in the entire package. and my favorite, the family size chip. >> that's a single serving? >> you know what, sometimes it is, isn't it? sometimes this is a single

12:10 pm
nutrition label came to be, our main concern at americans was fat and that's why shares so much focus on fat. we now know that fat is actually an important part of our diet and we need a certain amount of fat and it's not the enemy. >> well, shep, now we don't know how labels actually impact consumers' decisions to buy foods and could be three years before the labels are seen at stores like this local supermarket. >> lea gabriel. would the new labels help you change your diet? tweet us or hit us up on facebook. >> the feds say this could be ounce of the driest years in california since the started keeping record. ahead, pictures of the drought you have to see to miami. for instance, we have a speed limit marker for boats there.

>> fox in california got some much-needed rain as the deal with the driest conditions they state of california hag -- has recorded. the storm triggered big headaches for drivers along the freeway in los angeles. an inch of rain fell in the bay area. officials say the next storm could be floods and possible mudslides. more on that in a minute. first, i mentioned the historic drought condition. this is the united states drought monitor, shows where we have problems. the darker color, the worse it is. extreme drought in this part of california. never had exceptionol detroit. extreme is red and exceptional is this darker color. never happened. the dry spell marks the first time any part of california has fallen into that category since 2000. not just that.
12:15 pm
the feds say the past 12-month period has been the driest for california since they began keeping records in 1895. we created a slide show to show you how bad and receive sear thing -- severe things have gotten. this is signs on the freeway. it's hard to get people to change heir -- their habits. this is a tomato field near fresno, and there's not much of it. fresno is one of the areas -- in the middle of this extreme drought, and fresno -- that it this bred -- bread basket of the state. this is a reservoir. that's in san jose. and look at this. this was a lake in chico, california. not any water. you see that thing right there? that's a water mark. guy walking across it with his dog here.
12:16 pm
uncredible. this is fullsome lake, near sacramento, this is july of 2011 and now look at this. there's almost nothing left. that's the electric from 2011, and this is the lake one month ago here in 2014. incredible doubt happening in california. obviously faking millions and millions of people, among them farmers and ranchers. robert gray has much more on that for us. he is leave -- live in california. >> you know, it has been bone dry out here. we had also rain yesterday but less than half an inch roared by local ranchers and they're 10% to 15% of what they should have. that's why it's extreme drought. that's not helping the grass grow which the companies behind me other which we feasting on.
12:17 pm
pushing hay prices up. all the costs are going into keeping the cattle alive so it's forcing some ranchers, like frank to sell off part of the heard. >> i think we're all about the same. lack of rain no grass no grass to feed the cows so how have a chance of sell them or buy hay. hay price has tripled so we're trying to sell 10-20, 30 at a time. >> these are hi prize cattles and the ones he'll hold on to the last. what is interesting is that you're seeing cattlemen taking more of the cows to market, but the prices are going up. futures hit a record high in chicago today and have been tripling here versus a year ago at the local markets and that's because they're taking the cows to market and there's been a huge drought in the southwest so there were fewer available, and then as they cake the cows to market they have to wait a few
12:18 pm
more years before the heifers grow up. and that is going to make the burgers burgers andsteaks we buy and eat cost more. >> robert good, to see you. let's go to the extreme weather center. a little rain isn't going to fix anything but won't hurt. >> they need probably about five or six of these kinds kinds of s in order to cure this drought. it's not a bad thing we had the storm yesterday we saw a half inch of rain. when the ground is so completely dry the water can't get absorbed into the ground. so the rain from yesterday's storm will help moisten the soil for this big rainmaker. big-time snow, few feet across the sierra nevada. southern california has not seep
12:19 pm
anything like this in years. a lot of areas will see over four inches inches of rain, or n inches by the time we're done it's great news. >> it's a mess, rick. to the east, snow and ice. lots of it. >> this exact same storm. look at the temperatures here. the cold air is diving down. by the weekend everybody back in the deep freeze, except for the death south and this storm will go across the southwest and then moves across the east, and we'll talk about major ice storm. kansas city, st. louis, peoria, indianapolis, columbus, ohio, potentially dealing with incredible power outages. ice storms to the south of that. this time it's along the ohio river valley. >> rick, i'm concerned. stick your right arm out. you happen to be disintegrating.
12:20 pm
>> that's nice. your tech manager will wonder. >> call 9-1-1 for fire you're melting away. >> take also off here. >> there are doctors for that. rick, what's left of him in the extreme weather center. >> prosecutors say the former track star oscar poise store -- pose -- -- here's a word you should keep in mind "unbiased". some brokerage firms are but way too many aren't. why? because selling thfunds makes them more money. which makes you wonder. isn't at a conflict? search "proprietary mutual funds". yikes!! then go to e*trade. we've got over 8,000 mutual funds and not one of them has our name on it. we're in the business of finding the right investments for u. e*trade. less for us, more for you.

gain access to his now locked iphone. the olympic sprinter, wildly known as the blade runner, admits he shot and killed his girlfriend last year but says it was a mistake. that he thought she was an intruder. the prosecution claims he had a fight with his girlfriend leading up to her death and information on his cell phone could shedlight on the incident. the prosecutors have been working with the fbi to gain access to the sprinter's iphone. lawyers will acknowledge have a few days to analyze the iphone records. i don't know why they couldn't crack open the iphone. i have a niece that can do that. >> they should call my son. that is exactly right. this is a very unique development because the prosecution, although they're playing this down and saying
12:25 pm
they have loads of evidence and are confident, they know they have to bet into this iphone 5. a tipping point. several witnesses have compelling testimony but they were not in the compound at the time of the crime. so no one will know whether or not they were able to get access into the critical phone. >> if you're prosecuting this thing you want that information as quickly as possible. i don't understand how you can put off a meeting with apple if that is necessary, for a whole year. >> that's right. and their response to that, which is curious, we had to go through the united states judicial system and the fbi, but i agree with you, it's very curious timing, and the defense is screaming foul. iphones and cell phones in the kind of prosecution are treasure troves of information. it's very abundant information in there tells all kinds of information not only with respect to information such as messaging and texts they can find that is already in there but even evidence deleted.
12:26 pm
deleted information can be restored bay forensic expert and can uncover a trail of deceit. so this is a critical tipping point in the entire case. >> from the prosecution's perfect you better hope there's something in there. they were saying he had put his prosthetic legs on because they could tell by the trajectory of the bullet. now that is over. he didn't put them on. he was on his stubs. >> that's exactly right. and although they have witnesses that were outside the compound that say they heard screams it's going to be very difficult with precision for them to demonstrate if the screams occurred right before or right after the shots. the defense strains decreed outity. he said it was dark. i thought it was an intruder. when you're in bed with somebody, whether the lights are on or off it's going to be hard to imagine you have in idea whether she is next to you or

there's an intruder in the bathroom. so it's challenge. >> for future reference, when preparing to shoot through a closed door, check and see if your girlfriend is asleep first. nice to see you, thank you. >> my pleasure. >> the feds say more than a dozen government workers have tested positive for aidation exposure after a leak at a toxic waste dump. >> nuclear north korea, has reportedly fired a number of missiles, as thousands of is troops participate in military exercises in associating. is that a coincidence?

particular. the pentagon used this as an unannounced weapons test but is not overly concern. >> the missiles landed in the sea of japan. >> that's right. 124 miles off the northeast coast of the korean peninsula. they landed in the eastern waters but did not hit anything, we're told. the annual's and south korea military exercises, are separated to last for six weeks. a spokesman for the south korean ministry of defense says they're watching for any additional watches on north korea but no assets are being moved into the region as a result of the launch. there will four missiles fired, all described as very short range. >> thank you. we're waiting for a new conference on the toxic leak at a nuclear waste dump, where more than a dozen workers tested positive for aidation --

radiation exposure, in new mexico. this is carlsbad here. this is the city of carlsbad, and if you go east, almost duest, go out route 62, this is the wipp, the place where the dump happened. i don't know if you can see these dots. everywhere you look? if you zoom in, every one of these has an oil derrick on it. i mean every single one of them. hundreds and hundreds. but here is this wipp where they -- you can see this waste plant. nuclear waste just dumbed out here, and it's a big spot. you can see all the different silos and buildings. congress authorized the facility to serve as a safe site for radio active waste disposal. this new leak is the first of

its kind at the facility since it started taking plutonium waste 15 years ago. there were also elevated radiation levels in the air around the threat but say there is no threat to the public. trace gallagher is live for is this afternoon. do they know what caused this or how it happened? >> not yet, shep, because there was nobody actually underground when the leak happened. so now they're in the process of putting this team together to go down there and investigate, and if you don't know, this cavern is 2,000 feet underground. kind of carved out of these ancient salt beds, and over the past 15 years it's taken in some 80,000 cubic meters of nuclear waste. that's enough to fill up' p5 -- fill up 35 olympic size swimming pools. radiation levels spiked a mile away from an exhaust system. four days later they went back and said the levels dropped below what you would normally

12:43 pm
this 15-year-old justina pelletier. she used to be an active, healthy girl. now her parents say she can hardly walk, serious stomach issues, but first got sick and her parents took her to tufts university hospital. doctors started treating her for a rare genetic disorder that her sister also head. the parents said the treatment was making her feel better but when she came down with a bad case of the flu her parents rushed her to boston children's hospital, very well respected hospital. there at children's hospital the doctors tossed her out of her regular treatment and said the other doctors got it run, she does not have a medical disorder. that disorder is mental. that she has a mental illness.
12:44 pm
when her parents tried to take her back to the regular doctor, the doctors at children's hospital took the parents to court and accuse them of child abuse for giving her medical care instead of mental treatment. the state of massachusetts agreed and took her from her parentss parent locked her in a psychiatric ward. now the facility -- as the battle plays out in court, the parents say their daughter is stuck in the middle and wasting away. her a father is live with us. thank you so much. >> shepard good, afternoon, how are you? >> i'm fine. we have poured through this, and as journalist one of the most frustrating things to happen is you get one perspective and not the other. i have this open story that
12:45 pm
comes from you and your family but i don't have an understanding why it happened. >> bottom line, you're looking at the events that caused this to happen, like you said earlier, all her doctors at tufts medical center, and were treating her successfully. unfortunately she had the flu. severe case, in february of last year, and her main physician, dr. corson, said she needs to be seen by her former stomach doctor, who a month earlier had left tufts to go to boston children's. so she went there to be a direct admission to the gi floor, so her new doctor, -- dr. flores, could see her and help her recover from flu. when you have mitochondrial disease, you get something bad. >> here's the apart don't understand. there's a missing piece here.
12:46 pm
i feel like the hospital or the courts can answer it mutt they're not allowed. when you have disagreement between doctors over patient that almost never ends in the child being taken from the parents there is something that i don't know, and that our viewers don't know. what is it? >> two days or so into the situation -- remember, the facts of the case. she arrived there. within 12 hours, both a young neurologist and a young psychologist came up with this definition of somotaform. they didn't say it publicly the first few days and said there was no such thing as mitochondrial disease, and they wanted to true a in treatment. a few days later they had not yet still spoken to the doctor that referred her there and more importantly the doctor she dame
12:47 pm
to see, she was being blocked from seeing her. just made no sense at all. so we demanded in the morning that they speak to the doctor that sent her there, since he knows the situation, and they speak to the stomach doctor. later the afternoon we get theirs paper called the guidelines of care for justine ya, which says you are not allowed to speak to any other physicians, including tufts. we're in control. we're going to take her off all medication and including among the medications she had rapid heart rate. she was not being treated for that. and they took her off of lyrica because she had a. tube into their colon which is painful. >> this does not explain why it is one when set of doctors says one thing and the other says
12:48 pm
another thing you're accused of child abuse. doesn't make sense and there's a missing piece. i can't get it from the hospitals or the courts. i want to know what it is. can you please help us understand? >> i am going to certainly try. it's called the power play. boston children's said point blank we're not following their protocol, which was saying that she has this mental illness, saying none of her physical was real, wasn't being manifested by anything medical. obviously we disagreed since we've been going through this with this daughter for two years successful and five years earlier one of her older sisters was medically diagnosed with a muscle biopsy showing the had mitochondrial disease, and unfortunately -- it's been around for 30 years, the testing is still in its infancy. hers came backstive. and on top of it there ten to be
12:49 pm
a genetic marker. so once you're testing something and doing something that is working, you don't veer off it. whether you michiganly diagnosis somebody or clinically diagnosis it, if you treat the person and it's working, then you're successful. now look what happened. she has been there 12 and a half plus months, she went from ice skating, playing with the dog, now she is paralyzed below the hips, almost no strength above, and in fact what happened last friday, when my wife and my oldest daughter went to see her at, what they saw was appalling. the dcf -- instead of having two people in the room, they had five, including management people. then on top of it, for good measure, they had a massachusetts state trooper right at the door. nice comfy little meeting there. what changed the world was that
12:50 pm
by accident, the bottom of her shirt lifted up and my daughter and wife both saw the same thing. severe dark red lines coming from where the port was, which is poisoning, search sis, which could -- sepsis, which could be fatally and the dcf people were laughing around it. so they had to raise a stink. if not she might not be here. >> there's no way to put myself in your shoes and all i can say is best of luck to you and your family and all the best health to all your kids. >> thank you, just keep the prayers coming in. >> thank you very much. i apologize. if you have been paying attention to this story you realize there's a missing piece here and that is the reason for all these things he explained. why are all these people -- this does not happen in a vacuum. there are reasons for this. we cannot get information from the hospital oar from the court and there's a hole in the story and i can't fill it. when we can, we will. until then we report.

into orbit. now to the new planets. scientists say they all are in solar systems like ours and four are in habitable zone, not too cold, not to hot. now more with bill nye the science guy. a lot of new planets. >> we have a technique for -- i say we -- these guys have a technique for finding planets faster. uses statistical techniques to sort for stars that have big planets and so you watch them to dim, the planet as they go by. two deep questions, shepard. >> yes, sir. >> where did we come from? are with alone? if you want to answer those two questions you have to explore space. so, when i was in school, people used to say, maybe there's -- traumatized -- people used to say there might be one planet on every hundred stars.
12:56 pm
that was speculative. now looks like there's dozens of planets around every star, and so then if you can home in even more and say, there's several planets that are in this zone where you would have liquid water, you're not too far from the star where it's ice, not a close where the water is cooked away and balloon into space. so the planets might be suitable for life so that's where you point your radio telescopes and listen and do your optical search for -- it would change the world. now, not that people would come here and we take a meeting, but if you had proof or reasonable evidence that there was life on another world, it would utterly change this one. >> certainly would. >> one way to make sure you never find it is never go
