are using putin against republicans. we'll tell you what that's all about. and dennis miller will weigh in. please welcome the wickedly talented one and only adele dazim. >> huh? also tonight what the heck was john travolta doing at the academy awards? it was beyond bizarre. we will explain it. caution. you are about to enter the no-spin zone. the "factor" begins right now. hi. i'm bill o'reilly. thanks for watching us tonight. the irs investigation goes nowhere again. that is the subject of this evening's "talking points memo." to bring you up to date, there are charges the internal revenue service targeted conservative groups, tea party groups, trying to deny them tax-exempt status. for almost a year congress has been trying to get to the bottom of the situation. fbi also investigating. but still we know very little.

that's because the irs people involved are taking the fifth. >> my counsel has advised me that i have not waived my constitutional rights under the fifth amendment, and on his advice i will decline to answer any question on the subject matter of this hearing. >> also, you may remember president obama telling me there is not "a smidgen of evidence of any irs corruption." but if that's true, why did former irs big shot lois lerner, who you just saw, take the fifth? why not just explain what happened in a calm, rational manner? as you may know, i'm a simple man. that's a simple question. and it remains unanswered. talking points does not know who in the irs violated the law, but i do believe someone did, and there's evidence pointing to white house people. you can't link it to president obama, but certainly the former irs commissioner visiting the white house more than 100 times is some kind of evidence. mr. obama told me in that super bowl sunday interview that

douglas shulman was discussing obamacare. it does not seem that the house oversight committee which miss lerner deidentified again today, is getting anywhere. in fact, they're fighting among themselves. >> for the past year the central republican accusation in this investigation -- >> close it down. >> -- directed by -- on behalf of the white house. before our -- >> thank you. >> if you will sit down and allow me to ask a question. i am a member of the congress of the united states of america. i am tired of this! >> well -- >> we have members over here, each who represent 700,000 people. you cannot just have a one-sided investigation. there is absolutely something wrong with that. and it's absolutely un-american. >> our tax dollars at work. absolutely pathetic.

congressman cummings obviously does not want to know what happened with the irs. from the very beginning he has been denigrating and stonewalling the investigation. and as the ranking democratic member of the committee he has the power to do that. so all in all, the irs chaos continues and we the people still don't know what really happened. that's the memo. now, the top story tonight, just where are we with all? joining us from washington, hans van smikovsky, who works at the heritage foundation and has co-authored the book "who's counting: how fraudsters and bureaucrats put your vote at risk." now, i'm begging you to advance this story. i'm so tired of lois lerner and the fifth amendment and cummings and all of this. do you know what happened? do you know what the irs did? >> well, what we know for sure is that for almost two years and more they held up granting tax exemptions to almost 300

conservative organizations. the same thing didn't happen to liberal organizations. and by coincidence this all happened just before the president's re-election. many of those organizations still haven't been granted their tax-exempt status. >> so we know that but we don't know who did what. respond to this, if you would. this is an e-mail from lois lerner, who won't say anything. "tea party matter very dangerous." this is an e-mail from her to her subordinates. "this could be the vehicle to go to court on the issue of whether citizens united, overturning the ban on corporate spending applies to tax-exempt rules." what does that mean? citizens united, overturning the ban. what does that mean? >> what it means is they were very unhappy over the fact that the supreme court said in that case that non-profit organizations can engage in political speech. i mean, that's -- >> this is a political memo, lois lerner venting she didn't like the supreme court's ruling. and then she says, "cinci," that's the irs office in

cincinnati, "should probably not have these cases." what cases? >> the cases of all these organizations applying for tax xefr -exempt status. they didn't want cincinnati handling it because routinely those would be granted within a month or two of an application coming in and they didn't want that happening. they wanted them held up before the election. >> so we saw in the beginning allegations that the cincinnati office was the villain, that they were going after tea party, but what you're telling me is that cincinnati office was too lenient in giving tax-exempt status and lois lerner was trying to shut them down from doing that. am i correct? >> yeah, look -- it's very clear. this was coming out of the washington office of the irs. >> that cincinnati was too lenient, don't let them have this, give it to somebody else who will hold up the tax-exempt status for the conservative groups. that's the way you see it? >> yeah, that's exactly right, bill. >> do you think this memo proves that? >> oh, i think it does. and look, we have more.

we now have stage 2 of what the irs is doing with these latest new regulations they've proposed that would completely shut down the political speech of these same organizations. >> all right. so let's say that it happened. there's enough evidence to say that it happened. and we have plenty of anecdotal evidence from tea party people themselves. we tried, they gave us the run-around, they audited us. dr. ben carson got audited. now, somebody had to order this. somebody had to make it happen. lois lerner, obviously her attorney feels she's got some criminality problems or she wouldn't take the fifth. if lois lerner didn't have any criminality problems, why would she bother? maybe she's shy. i don't know. do you see it that way? >> i do see it that way. particularly because remember, before she asserted the fifth the first time she said, "i did not do anything wrong" but then she went ahead and asserted the fifth amendment. >> okay. so suspicion falls on her, and then if it falls on her and they

can crack her somewhat then she might be able to give up people in the white house if indeed they were involved. and the only reason i say is because this shulman, i don't believe in 100 visits to the white house talking about obamacare. i mean, i'm sorry. you can do that on the phone. but right now my analysis is that the house committee, it's just chaos, they're not getting anywhere and it's just a dog and pony show over and over again. it's groundhog day. that's what it is. right? >> well, yeah. and that's because supposedly the justice department is doing a criminal investigation although there hasn't been a lot of activity in the justice department. >> nobody knows who they've interviewed. holder is the attorney general of the united states. the fbi has to take its cue from him. so i don't know. and then there's not a smidgen of evidence according to the president of the united states. >> yeah. no, in fact, look, that was so improper. what he said to you, he basically was telling the people who ultimately report to him at the justice department, here's where your conclusion should be

impact segment tonight, little movement in crimea as russian troops continue to occupy that part of the ukraine

allegedly. western powers are getting some kind of sanctions against russia together but i'll believe it when i see it. in the meantime, some obama supporters are saying republicans are actually rooting for putin. >> republicans are practically cheering for vladimir putin today. he's given them a new excuse to bash president obama. republicans are out in droves suggesting that if the president weren't such a weak leader putin wouldn't be threatening the ukraine. first of all, did the same republicans call george w. bush weak when putin invaded georgia in 2008? no. >> joining us now from washington with reaction, republican kate obenschein and democrat kirsten powers. do you think sally kohn is onto something here, kirsten? >> oh, yeah. absolutely. i think that this is -- i don't know if i'd go so far as to say they're cheering for putin but they seem to be blaming obama for putin's behavior. they seem to be suggesting that while they'll claim that president obama is so naive he doesn't understand, you know, evil dictators but then they'll

turn around and claim that putin wouldn't have done something but for barack obama when of course this is something that he would have done regardless of who was president of the united states. >> i'm not sure that's true. i'm not sure he would have done it had andrew jackson been president. >> this is a regional conflict, bill. >> it would have been a little -- >> this is a regional conflict. he didn't sit around and think about oh, if the united states is going to do something i'm not going to do it. and if that's true, then sally raises a point that i've been raising. why wasn't george bush blamed for what happened in georgia? and i don't think he should have been. but i'm just saying if that's true then it has to be true that that was the case with bush. and i don't remember republicans blaming bush. >> these are all points that have to be debated. so let's go to our republican presence tonight on the "factor." kate obenschein. >> actually -- >> does sally kohn have a point? >> actually, back in 2007, before the invasion, you'll remember john mccain famously sort of mocking president bush's

naivete, saying about how he looked into his eyes and saw his soul and mccain said, well, i looked into his eyes and i saw a k and a g and a b. and then lindsey graham, who's been one of the most outspoken critics of president obama's foreign policy actually at the time wrote a "wall street journal" editorial in 2008 that said that russia's action was threatening to the world order. he wasn't direct but he generally was critical of the u.s. policy. so look, i don't think that it's limited. and if you're going to say republicans are rejoicing, then the democrats were rejoicing over saddam hussein and rooting for him? i don't think so. i think what this is is an overall criticism, very legitimate one, by the way, of barack obama's weak foreign policy. and i think there is some consensus over that that since day one with the world apology tour and as it went on to sort of this bowing and scraping, doing everything he could to bend over backwards to the world's dictators, to our enemies, be it in iran with the pro-democracy protests and iran's acquisitions of nuclear

weapons, and syria, and all around the world i think that you can see a pattern. and obviously vladimir putin -- >> well, you missed a big one. >> the -- >> let me pose the question. let me pose the question. kate missed a big one, which is syria. that's what i think -- >> i said syria. i mean, the red line. absolutely. there are so many, bill. >> they were watching. >> that's ridiculous. >> if i had been president obama and a guy had gassed after i said don't gas and if you do -- i would have bombed the airport. okay? i would have taken out all his fleet of planes. assad's planes. i would have done just something. >> if you say it, you've got to do something. >> i can't go on anymore listening being lectured by people who supported the iraq war and all these genius decisions that george bush made, claiming that they're the experts. i mean, why are lindsey graham and john mccain the experts? they have led us down these trails into these horrific -- the iraq war is going to go down in history as one of the stupidest things that this

how will the west handle put snin joining us on the phone -- well, he was supposed to join us on the phone but we don't have james rosen because i think he dropped his cell phone in the seine. but we do have fox news chief

political correspondent carl cameron from washington. rosen punks out on us and the reason he did it is because kerry is running him all around. let's just deal with kerry first. secretary of state, he goes to kiev, to ukraine, he says we'll give you a billion dollars in loan guarantees, we'll take care of you guys. you know, and then he says bad things about putin. then he hops on a plane with rosen. rosen and kerry are buddies. and they fly to paris, three hours, and they get off. now kerry's in paris. what is he supposed to do there? >> well, he's doing a lot of talking and james has been doing a lot of talking about that, obsessively keeping us up to date on all this stuff. kerr ji meeting with his allies and counterparts from the uk as well as the new ukrainian foreign minister and the french foreign minister and he's going to meet with russian foreign minister sergi lavrov who has been pretty tough on american secretaries of state over the last few decades. there is virtually nothing expected to get accomplished here. and according to james even the americans don't seem to agree on what's actually happening. remember yesterday when the president said perhaps putin is maybe having a pause in well, at

almost the exact same time james says kerry was telling the traveling press that the russians are in his view, kerry's view, on the verge of invading ukraine. lots under consideration but not much imminent apparently. >> a couple of things stand out. the cia didn't give us a heads-up apparently because a lot of american diplomats including john kerry are caught by surprise and i think president obama was as well. but i don't have direct knowledge of that. but it doesn't seem like our intelligence said hey, putin's going to do x, y, and z. >> congress is going to investigate it. they're going to start -- >> congress is going to investigate. that means everybody will take the fifth amendment. maybe they bring lois lerner back, see what -- >> maybe it's behind one of those secret doors. >> we don't have a lot of confidence in that. talking about congress, they can slap, they being the house and the senate, sanctions and banking stuff on russia. can they not? are they going to do that? >> they can and they're thinking about it but right now there's nothing imminent there either. based on what's happening in the crimea, the obama administration

is considering a possible visa ban and freezing some assets of some of the senior russian officials. but there's a republican senate bill to expel about -- russia from the g8, to suspend its representation at the nato council, to close its consulates in the u.s., and maybe even to suspend some -- >> it's all small ball. >> it is. >> you've got to go after their currency. >> well, harry reid put up a big slow down thing. he said he thinks that the u.s. should let things play out a bit, in his words, and says if they are -- if the u.s. is going to go with stiff sanctions then it's absolutely necessary in reid's view that the europeans get involved. there are some eastern european countries who think that russia should be sanctioned right away, but you've got countries like italy and france and germany who depend on gas from russia that comes through the ukraine. and they want to wait more time too. >> okay. so right now what you're saying to me is there really isn't anything effective going on in the usa. the secretary of state is trying but he's just bloviating. he's just talking.

i don't even know where the president is today. he's not visible today. then you've got a congress who want to slow things down. how do you slow down non-existent? i don't know what you do. >> well, they're sort of saying that in effect by not doing mvp they're putting the ball back in putin's court. if russia moves forces into eastern ukraine, then the white house has suggested that they would go after sort of iran-style banking sanctions. if -- >> so there's another red line. the red line is moved back to eastern ukraine now. we're going to give up crimea. putin's going to have that. but if he does anything more then we might do -- >> it's kind of like an if then. if russia does this then we'll do that. he could also sanction russian individuals and businesses. >> i've got to ask you something. a new fox news poll came out. president obama's job approval, lowest rated since he's been in office, 38%. foreign policy is down the drain. do you really feel that the obama administration's falling apart here? it seems that way. >> they're under tremendous pressure on so many fronts.

really a lot of americans. should we annex that town? should we kind of just occupy it because a lot of americans are there? should we do that? >> no. in the crimea there's a lot -- the only naval base in russia that doesn't freeze -- >> it's on ukraine territory and they were nice enough to give the russians access to the naval base. >> i'm not defending what he did. he crossed international borders with troops en masse without -- my point is one, we have no dog in this fight. and two, there's no simple solution by cutting their banking off that's going to do anything to affect this. >> all right. so you say -- >> you can call me dovish and -- go ahead. >> you say there's a dog who invaded but we don't know who that dog is. he ran away. you say we don't have a dog in the hunt, a play on your last anytime. >> thank you. >> but of course we do. because china's watching this. and if barack obama does nothing china probably seizes those

japanese islands they want, even though nobody lives on them. they want to do that. then you've got north korea, they're nuts and they'll fire missiles wherever they want to fire them. and the mullahs, they've got the nuke thing. so you know because you're a man of the world there's a sophisticated chain reaction that happens when the big dog, again, america, is perceived to be weak and ineffectual. you know that. >> bill, this is unrealistic. what you're doing is putting obama in the middle of this first with putin. it does not matter. it didn't matter in '08 when bush, who was a serious wartime president, about attacking, if it's about terrorism. he was in war. and putin still went after it. this is about putin and what he wants, not about u.s. foreign policy in this case. >> well, wait. >> hungary, czechoslovakia, georgia, or ukraine that we can or actually should do. we have never done anything -- >> i disagree with you. i think we could decimate their currency and we should. >> how? >> how?

impressive in impotent scenarios. i mean, kerry's over there yesterday, he's acting all avuncular and all that, but the fact is this thing, it left the station, this train. you've got to stop this way back there. we didn't. and now our guys are going to look professorial and they're going to look, like i said, avuncular, and they're going to look like they've got it all together. we've lost this one already. the simple fact is if we're going to abdicate our power willingly in this dangerous a world i would do it quickly because the real problem lies, and if you try to phase down from being real power to being the fourth power, i'd get down to four real quickly if i was these guys because it gets confusing when they still think are we in the game? we're not in the game anymore. we now depend on the good offices of bad people. we assume that putin's not going to take over the rest of ukraine. we assume that if iran gets a bomb or they just want nuclear energy for power purposes. we are betting on a lot of bad people and their good offices.
