his take on that. three weeks out from the obamacare enrollment deadline, critics say the program is falling sort of its stated goals, supporters say it is working. we will have a fair and balanced debate on the impact of obamacare on previously uninsured americans. that's straight i had. ahead. we begin this planned new hour, though, with a volatile crisis in you rainukraine. russia is ramping up its military presence in the crimea region despite a warning from the u.s. it should pull back. russian forces are seedsing control of a border post in the contested area and taking dozens of ukrainian border guards hostage. meanwhile the white house is announcing ukraine's acting prime minister will make the trip to washington this week to discuss the escalating crisis. amy kellogg has been in kiev for us. she now has the very latest.

what's going on, amy? >> reporter: well, jamie, moscow keeps warning the west about taking inflammatory steps in this situation we know the west, europe, is united inner caning that precious steps have been completely illegal when it comes to moving its troops into crimea. russia's line remains the same the government if kiev has been taken over by a bunch of armed fascists. therefore, it needs to protect russian speakers in crimea against that supposed threat. but the only war drums with ve heard here in kiev this weekend are from this caustic drummer you see on independence square. it's a national holiday if you crane the birth date of the poet and there were celebrations today albeit under the cloud of a grave threat to ukraine's territorial integrity. with the new prime minister

saying ukraine won't budge an inch, a centimeter to be specific of its territory. but the situation if crimea as we have been saying is increasingly difficult t. crimea blocked state accounts, the prime minister there says no problem, they have opened accounts in russia which is offering $1 billion u.s. dollars to crimea according to russian duma member. and there have been, jamie, a number of incidents. journalists have been attacked in crimea and there is a demonstration today in crimea in which a bunch of ukrainian nationalists brighting the birthday of the poet chevencko were attacked. >> as amy describes as risk as journalists are not being welcomed to the region. thank you. eric has more for us. eric. >> ukraine's prime minister is set to visit the white house on

wednesdaych russia continues its bold defiance by reenforcing its troops in crimea and ignoring u.s. warnings about potential sanctions. a fox news contributor has said the president need to get tougher. >> obama's whole theory of international relations was, if i'm nice to iran, if i offer them all kind of goodies, if i'm nice to the north koreans, if i'm nice to any adversaries anywhere, i'll give them an open hand, remember? open hand, more respect for the muslims. he wanted to show the russians he was willing to bury the hatchet on all the past and then he wanted cooperation in other areas. putin looks at this guy and says i'm dealing with an ad less sent. this is a community organizer. he doesn't understand how the world works. >> what's next, could moscow's reach expand to south ukraine and other former soviet union states, if so, how do we stop

him? joining us now is rich cohn, a long-time noted venerablet ab serve of the kremlin. professor, welcome. >> venerablet means old. >> you have observed this for years, now the crimea prime minister is coming to the white house wednesday, what could possibly come out of that meeting? >> nothing good. let me say where we are a. i think we are three steps with war with russia the first time ever. there is talks of moving nato troops to the polish western ukrainian border. if so, putin will almost certainly send 100,000 troops into south and east ukraine. he is only in crimea now. that's the cuban missile crisis, only worse. then the next step let's don't even talk about it. the problem at the moment in terms of negotiating is the white house says the government in kiev, which overthrew the elected president on february 22nd, i believe, is a legitimate government. the russians say it's not le nit mat and they're not going to

talk to them. so bringing the foreign minnesotaster of this government to the white house isn't moving forward. >> three steps from war, how do you climb down from that? we had seven days in okay. this is march. who blinks? >> nobody blinks. what you do is you ask yourself is russia right about anything in this crisis? even this much. does russia have any legitimate national interest? even on its border. if the answer is no, you have to go to war. technically if you call putin hitler. then the lesson is war. if, however, you say, okay, we see it, russia is worried about this. that's where you start talking. putin will make major compromises if we acknowledge his legitimate interests. but in this country, except for a few people like maybe senator paul, from kentucky, my home state, i reveal. he's not saying russia has any case at all. i mean, we aren't saying. we got to get some common

ground. because that's where you stand when you negotiate. >> you think that common ground is possible. the president's had several phone conversations with mr. putin. what does putin want? >> two things. putin has nothing but contempt for obama. he thinks he is weak and decisive and doesn't keep his word. putin trusts america merkel. obama is also i am sure talking to merkel. what does putin want? he wants an end of nato expaings to russia's borders. he said that about georgia in 2008. he crossed that line. we had a war. he is saying you cross that line in ukraine, back off. if we assure him nona to membership for ukraine and a neutral government in kiev, he will give us some of what we want. >> how do you see this shaking out, how do you see it ending? when you say three steps from a war.

jamie. >> fox news alert right now with the very latest on the missing malaysian airlines gentlemen sources are saying the ntsb has sent a team to asia to help in this investigation. meanwhile, there is unbelievable anguish tore the families of those on board that plane. can you imagine at beijing airport, they are awaiting any word about their loved once as the massive search effort for the plane continues. we have a report from bangkok, thailand. what is the latest for these families, are they getting any information, david? >> reporter: for all of us there seems to be more questions than answers to what happened to that malaysian airlines jet. there has been a search in the south china sea, ships, planes, but they haven't found any trace of it again. malaysian officials now say radar signals show the plane may have tried to turn back to malaysia before it vanished. the crew didn't, though, notify

ground control about any change of course. the international search is now looking in a broader area of the gulf of thailand to take into account the airline may have turned back. the viet namese military said yesterday their aircraft had seen two oil slicks and could be from the fuel tanks of the plane. the boeing 777 went missing early saturday time from cule kuala lumpur, two hours into the flight, they lost contact. vietnam has said the plane didn't enter its airspace. there were 239 passengers and crew on board, including three americans. there were 14 different nationalitys on the plane, investigators are focusing on two passengers on board, traveling on italian and austrian passports. they were holding passports lost or stolen a couple years before here in thailand.

their tickets were bought together. they had onward trips to europe. investigators are studying cctv of passengers boarding to see if they can recognize them the malaysian authorities say the fbi and other agencies are involved in the investigation. they say they are not ruling out anything, jamie, including terrorism. back to you. >> moments from now, congressman peter king joins us to talk about the latest of that angle obvious terrorism. thank you so much, david piper live for you was from bangkok. jamie, at plane crashes over the vast expanse of the oakscea it's happened before, a plane from rio de janeiro to paris, it took three years to recover that plane's back box. sfishl officials blamed a speed indicator clogged with ice. it gave the pilots incorrect air speed information as the plane

flew through huge thunderstorms. in 19 nierngs an egypt air 767 from jfk to cairo went don't in the atlantic 60 miles off of nantucket. investigations showed one of the pilots flew right into the ocean on purpose. he reportedly had mental problems. others thought he may have killed himself and all on board as an act of terrorism. and, of course, in july of 1996, twa flight 800 broke off from jvg to paris. hundreds of people thought they saw a missile hit the blaerngs an exhaustive federal investigation concluded a spark likely ignited fumes in the empty center fuel tank. in 2008, luckily not over the ocean, in a runway in heathrow, this triple 7 crashed when the engine kompgd out. investigators say frozen ice cast crystals were the cause. they ordered corrections. that was the first major incident involving a boeing 777.

amendment right. on the advice of my council, i respectfully exercise my fifth amendment right and decline to answer that question. >> if the irs hands over the e-mails, what can we expect? joining us is texas congressman from the house committee on oversight and government reform. he joins us now from austin, texas. congressman, good morning. >> good morning. glad to be with you. >> do you expect miss lerner will be cited for contempt of congress this week? >> there is certainly talk ab about it. speaker boehner indicated that might be a response. we will see what happened. we have a business meeting coming up next week, not on the agenda yet. it may be added. >> why are you so troubled she has taken the fifth so many times. it is a right under the constitution and what you have or have not so far been told? >> well, i don't think she took the fifth.

she waived her fifth amendment right when she came into that first government reform hearing and gave her side of the story. we have a right to cross examination her. she waived her fifth amendment right at that point. >> the irs says they will be handing over this material. what do you expect, what do you think it will show? what do you think these e-mails and tax and other documents could show? they were accused of stonewalling the committee in the past few months. >> my concern is where did it come from, where did the idea come from that we will target these tea party groups. even if there wasn't a specific directive from a higher up, which i think there was. there was a culture in the irs where this sort of behavior seems right t. american people deserve honesty from their tax collecting agency. it's not a political too. it's supposed to be a fair arbitor of taxes. >> do you think it was used as a political tool in this case? >> it is pretty clear, if you look at the number, substantially more conservative groups were targeted than groups

termed with progressive in them. so it seems obvious to me just by the numbers. >> democrats say, yes, it was wrong, tea party groups were cited. they also say some progressive groups were. do you buy that? do you think that's enough of an explanation or do you definitely see a test? >> again, i think it was much more conservative groups. you go back and look as far back as the nixon administration. one of the biggest scandals nixon faced and one of the articles of impeachment on nixon was the fact that he misused the irs. the irs is a voluntary tax collection system here in the country. if the irs is charged when forcing it when you don't voluntarily comply isn't being fair. we've got a huge problem. >> you know, what does the say about government power and about the way we operate and live under our constitution and the democracy t. government could have to much power over us. whether it's the irs. they make decision, they affect

us. i mean, sometimes it feels like we are almost helpless. >> you know, it's a government of the people by the people for the people. because of scandals like this you can go down the list, benghazi, fast and furious. the american people have lost faith and trust in their government and that's a really horrible thing for our society. it's healthy to be distrustful of the government. when are you to the point, you don't believe a word that comes out of their mouth, if you can keep your policy, if you like your dock tren you can keep it. if you like your policy you can keep it. you got to have faith in your leadership and government for it to work in a free republic. >> you are a government official, you are a congressman, what is your advice? how do we get the belief back from those who so sadly lost it. >> you got to have government transparency, elected officials from the president on down need to be honest with the american people. there needs to be that transparency. we have the tools the internet

. >> a fox news alert for you now. the disappearance of the malaysia airlines flight is raising majority security questions yesterday because malaysian officials say they haven't ruled out terrorism and there are reports there were two passengers aboard the missing flight that use stolen passports. for more on this mystery as well as the ongoing crisis in ukraine. i have a bonus question from peter king, homeland chairman of

the subcommittee on counterterrorism and intelligence, thank you for making time. i know you are busy. let me start with interpol and the process that would have rooted out stolen passports, getting on a flight. why did it take the disappearance of this jet to learn about it? >> one thing we have to realize is malaysia airport is not the same type of security we do. there are no direct airlines flights from malaysia to the u.s. so we have no control over what they do. what happens is when a passport is stolen, then that passport is tagged. so there is no way you should be able to get through with a stolen passport. we don't know whether it was not reported or checked at the airport independent the same standard here, there is a number of airports that do not comply

with the same standards we do. >> are you saying this could not happen here? >> it would be impossible to have two people with reported stolen passports in the united states. >> that will be possible. >> what will you tell us about these two learned in briefings? were they caught on camera? do you know their names, what can you tell us? >> my understanding is there is flight camera under surveillance of them sfargs i know, there is no idea. we have no idea who they are. i can tell you who they are, especially since we talk about malaysia that has been the hub of al qaeda activity in the past. there was a meeting there on the uss cole back in 2000. any number of 9-11 hijackers went through malaysia. we have islamic terrorists

operating in southeast asia. they were going to china, that raises that issue. we don't know. it could well be. it could possibly be a technical error here. to have a plane disappear. the reports the plane may have gone off course. i spoke to the people in the airline industry. if that's the case, there would be some record of it. the fact that there is none whatsoever raises again a lot of issues, a lot of questions, serious questions. >> they've seen the course of the investigation change significantly when it was released the two passengers on board and maybe more even who could have been traveling with illegal passports. let me jump to ukraine. now the ukrainian prime minister will come to washington for talks what would you expect best case scenario to come out of those talks? >> i think it is essential the president will make it clear we

will stand with ukraine and get our allies coordinated on this. we have to take immediate firm action and take it, for instance, i think we can freeze the assets of the russians in this country. we can freeze other rulgs assets in the country. we have to make it clear we are going to begin a much larger exporting of our liquified natural gas to european countries so they won't be so dependent on russian energy and we have to also i believe increase military activity as far as poland, hungary, the latvia, estonia, lat i havia. there has been a policy drift too much. it's time now to get firm and make it clear to the russians and our allies that we are going to stand firm on this. it won't happen overnight.

jamie, the people this was supposed to help. the people that supported this president is hurting the most. in the state of mississippi, you had working class people. now they're considered as being working poor and they can't afford the premiums. so they're having to go on medicaid. so this has been a disaster. i think the only resolution to this is getting a republican in the white house in 2016 and overturning this acrossty. >> ellen, at this point we have it, we're implementing. we got three more weeks for people to get on, get signed up. ten we'll know the full impolice, i'm sure. even though i know you can defend the program and the fact that everyone in america should have ibs, take a look at these polls, i do want to get your reaction from the side of democrats. president obama on health care. the number of disapproval and approval there you know it hit a record high in september 2012. it's certainly coming down if terms of approval. but when you look at the obama

administration overall and its intention of improving health care the mostly succeeded numbers on a downward trend mostly failed at this point 57%. can you explain it? >> look. we all know that there was a lot of problems signing up for obamacare affordable care act is the actual name and that really made people very, very scared. so now, you are going to have to see as people get on, they're going to get their benefits and also as the economy grows. and we had a very good jobs report this week, then people will be able to afford it more and sign up. i am very hopeful about the president's health care plan and i think we will get more people not only thinking it's a good thing, more people who were unissued signing up particularly as they have jobs. >> but jamie i have to ask this. the actual study where you
