>> good afternoon to you and yours. it's 3:00 on the east coast. noon on the west coast. first, a big clue in the mystery of the missing airlines jet could lie in the last words from the cockpit. what -- who said them, and did that person know what was about to happen? moments after he radioed the ground controller, all right, good night. it's now been ten days since the jumbo jet vanished while flying from malaysia to beijing with 239 people onboard. investigators say it's obvious to them this was no accident. that somebody flew that jumbo jet off course on purpose. after more confusion from malaysian officials over the weekend it's getting tiresome. they say they finally nailed down the timeline. it was 1:07 a.m. local time when the maintenance transmission stopped. the final words from the cockpit

came a few minutes later, at 1:19 a.m. the last word. it seems a routine signoff to ground controllers. and then only minutes later, at 1:20 a.m., the transponder went dark, basically making the plane invisible to air traffic controllers. the plane's computer was scheduled to send the next maintenance report at 1:37 a.m., 17 minutes later. that never happened. so now the big question, when on this timeline did somebody shut off the system. that could tell us where one of the pilots involved. now malaysian officials said that came after the transmission stopped, but they have now backtracked. they say they don't know the exact time the system went dark but claim they know who said the final words. >> the initial investigation indicated it was the copilot who

spoke the last time on tape. >> we have a picture of the 27-year-old copilot. investigators searched him home, along with the home of the plane's captain. investigators say the plane kept flying for close to eight hours after the tracking systems went dark. first they told us they thought it was four hours, then six or seven. now eight. even though two systems were off the jet computer kept trying to macon tact with the satellite high in the sky. it didn't send any information that is very useful, but investigators say because of that pinging they can use the signal and they narrowed the plane's path two these two arcs, either heading as far north as kazakhstan. the other path stretches far into the southern indian ocean with no real place for it to land. some 26 countriers helping with

the search on mountains and deserts and oceans. catherine herridge is live. what are you learning today? >> well, shep in terms of the house homeland security committee telling fox news the fbi sent a team after the investigation was formally declared a criminal case. the 53-year-old pilot, who logged more than 18,000 hours in the air, and showed off his flight simulator on youtube, is now at the heart of the investigation along with his copilot. >> two scenarios are possible. one is ran another of fuel and crashed into the indian ocean. the other one, the plane landed somewhere in the southeast asia, possibly indonesia, that could be used later as a weapon. >> search warrants were executed ted homes. computer hard drives and a simulator were recovered, which reports flight 370 flew as high

as 46,000 feet, then dropped precipitously. a soaped fbi investigator says there may be evidence of premeditation. >> if there was some sort of practice in the simulation that would give somebody the confidence to try to be able to make those maneuvers. >> and what is not on the computers, including efforts to wipe or destroy files, may be just as telling. >> anything new today on the search for the jet? >> there is. a key data point is when the flight was diverted. the crews signed off with vietnamas air traffic control saying everything was sky then never connected with the chinese controllers. it was during the handover the aircraft was diverted, a kind of no man's land between chinese and vietnamese air space. pilot suicide is not being ruled ute because it may explain why they flew for eight hours and then suddenly vanished. >> if they crashed, the only reason for going that a far into the indian ocean and crashing was for the plane to never be found and that would be a

suicide that couldn't be proven, which whether they were looking for insurance payoffs or a shame in committing suicide. >> while counterterrorism officials did an initial scrub of the passenger manifest, and they came up with no connection to terrorism, we're learning today that there are gaps and that these two iranians who used the stolen passports are very much in play. >> let's bring in tom blank now. tom, what do you think? >> well, i think we have to begin to look at the fact that we very likely have a conspiracy here. in other words it's the right thing to do to look at those pilots, at their backgrounds, their associations, even their families' backgrounds and associations because they have the skill set. it's highly unlikely what we're seeing is the work of one single perpetrator. this had to be more than one person in my view. >> we're learning now bat flight engineer who had some

significant training. >> and that is exactly the kind of video would want to look at. find out whether or not he is capable of flying the airplane, attempting to fly the airplane, and there's just a number of things that begin to fall into place. this aircraft did not go on for eight hours in the air in the hands of one single human being. >> all right. we are now told that in the beginning part of all of this, after the signal went dead, after the transresponsibler -- strand responder went dead it climb to 47,000 feet. >> that could be the flight syndrome from 9/11. the passengers understanding a hijacking is underway and they're trying to take their fate into their own hands. maybe somebody attempted to get control of the air craft among the passenger group, and you see erratic behavior happen and maybe that was the beginning of the -- potentially the beginning

of the end. somebody with flight skills apparently got back in control of the aircraft. >> you take it to 45,000 feet, those oxygen masks last for a 15 minutes and that's it. everybody in the back is dead. >> that exactly right and that could have been part of the conspiracy. that certainly is a very sophisticated way to go about getting control of an air craft. >> at some point this thing went down to 5,000 feet. way below where any commercial jet should be flying. what are the reasons one might do such a thing? >> well, first of all, you're not concerned about your passengers because their cell phones would work so either they're dead or their cell phones have been confiscated, which indicates a conspiracy. you could do that so you could avoid radar. trying to avoid radar, you intend some bad outcome, like crashing into a building, potentially going to commit suicide and go straight into the drink. but you don't do that for any decent or good purpose. >> it's hard to come up with a

scenario under which any of this makes sense, unless you're landing it. if you're going to commit suicide, who needs all the dramatics. >> that's exactly right. so, it's hard to think you could actually land this without someone detecting it, whether that's a physical detext or whether it's a satellite that cover our globe these days. but it would certainly seem that was an intent unless things went very wrong and there was an intent to land and it it did wind up in the drink. >> tom blank, former tsa deputy direct you. >> think of what tom is suggesting. once you. >> to 45,000 feet, if you stay there long enough, 10-15 minutes or so the oxygen in the back runs out and every person in the back dies, which is why you don't have to worry about the plane anymore being taken over by passengers because they're all dead. and then you get down to 5,000 feet. to allow you to avoid radar and all the rest. if his scenario adds up, a

>> fox 11 where earthquakes come with south tracts. tony was -- a 4.4. epicenter outside westwood from 15 miles from downtown los angeles, and kind of deep, too, five miles. locals reported a few aftershocks but officials say there was no major damage of any kind. on the east coast, late winter blast slamming the mid-atlantic and parts of the anymore. record-breaking amounts of snow just days before the official start of springtime. folks from west virginia to new jersey reported snowfall overnight and this morning. looks like a winter pattern. the storm's movement shows you what happened. the national weather service officials say at least one town in virginia got more than a foot of snow. meantime, the storm dumped several inches on the nation's capitol. government offices shut down again today. forecasters say most of the snow has moved out over the atlantic by now. here's a look at system from

world leaders will not recognize crimea's vote to split from ukraine. that's the word from president obama. he also announced financial punishments against russian officials who supported the vote. >> the international community will continue to stand together to oppose any violations of ukrainian sovereignty and territorial integrity and continued russian military involvement in ukraine will deepen russia's isolation and exact a greater toll on the economy. >> the white house says the president has frozen the u.s. assets of seven top-ranking russian officials and says the u.s. is ready to go after people in the russian weapons industry

if moscow keeps interfering in ukraine. u.s. officials have slapped financial sanctions on the president of ukraine. the russian president vladimir putin sign a decree recognizing crimea as a sovereign and independent country. russian lawmakers in crimea said 97% of voters chose to join russia and quit ukraine. that's a figure means so little. the while lot gave the crimean people no choice. u.s. officials say there's also evidence that some ballots came with marks already on them and there were, quote, massive anomalies in the vote. supporters of the referendum of rallying here last night in crimea, and here you can see huge crowd in lenin square which is right in the heart of town. that's the de facto capital of

crima. proukraineian e demonstratores gathered. this where is all the protests were taken. this is where the police barricades are. that's the ukrainian hotel and the barricadeses were here and police came down from parliament and that's where the clashes happened that left some 100 people dead when that went down. greg is live in kiev for us tonight. greg? >> the mood here in kiev is defiant. ukrainian defense minister telling us today that crimea was, is, and will always be ukrainian. in fact the ukrainian military is flexing their muscles today. take a listen to what we saw. >> just a few weeks eye they were proitsers, -- protestes are fighting for the overthrow of the regime. now they're training to be national guard members. who knows if diplomacy fails

they might find themselves against another foe. the russian army. >> 20,000 regular soldiers have been mobilized today. 20,000 more national guard volunteers. we watched as live fire exercises were conducted at the base. the ukrainian troops have been active in the south as 22,000 russians in crimea and the east where there are violent prorussian rallies. the ukrainian military would be vastly outnumbered in any faceoff with russia. that's probably why presidential contender and former boxer had some brave but careful words about russian intervention. >> i hope we not go over the line where we use the weapons, but if russia continue in direction against ukraine, we

sanctions against russia, is notable. are they effective? the markets are way up. >> the markets in russia are up. >> which suggests that russians think, these are not going to have an effect on us. >> they'll have to be more and stay united, because the kremlin is still on the move in the east of ukraine. it's not as if they haven't moved into the east of ukraine. they have. >> and we have a story about this. russia is moving very quickly now. putin has already cut a stamp for approval crimea's independence. that's the first step that russia would need before it is allowed to annex the land into russia. so, it looks like it's moving apace. putin is going to talk to his own parliament tomorrow about this. russia is not stopping. whether the u.s. and europe now ratchet up the sanctions really sharply to more notably get russia's attention, is a big question mark. yes, you can provide sanctions

or enact sanctions against officials but is that going to change the mood of nationalism within russia that is forcing this? >> the propaganda mince on a level we haven't seen maybe even during the cold war. was noticing as well can klitschko, talking but how they'll fight. they're not equipped to get into a fight. >> the markets north worried and that's the last thing that europe wants. gorbachev was quoted on the wires saying, look, you know, just let this go, we never should have in 1950s when we were the ussr, allowed crimea to become part of ukraine to begin with. it fixes that. that's not the way that europe sees it. once crimea -- well, what other parts of the ukraine and what other states that were once part of the ussr might become part of the nationalist effort within russia to reannex for influence

a fox report now. president obama says he still believes the israelis and palestinians can find peace but it will be a challenge. the president met with the palestine palestinian president at the white house two weeks after he hosted the israeli prime minister benjamin netanyahu. usual officials set a deadline for both sides to hammer out a framework for peace agreement. >> the indianapolis colts owner is under arrest, facing charges,

including drunken driving and drug possession. that's according to a sheriff in central indiana. in october, he tweeted that he had not touched alcohol in more than 15 years. and a driver trapped in the middle of a fast-moving river south and east of seattle. look at that. took rescuers an hour to pull him to safety. paramedics took him to a hospital with hype hypothermia. it's not clear how the car ended up in this place. updating our top store. the search for the missing malaysian airlines flight which has become a criminal investigation. a team of fbi agents is on the ground in malaysia. but "the new york times" is reporting that malaysian authorities are limiting what american investigators can do. and one official told "the new york times" the u.s. simply does not have the right to take over the investigation. more than two dozen countries

are involved in the search that doubled in size since last week. investigators are focusing on two arcs, based on the last contact with the satellite. you can see this is -- it's a massive area. it's six times the size of the united states or something like that. sarai going to give us contact. this is interesting. >> think of the area you just showed with the arcs as central park. the park is about two and a half miles long and a half mile wide. so, looking for flight 370 is like trying to find a postage stamp in central park. >> that's how the area bases out. the size of the plane versus the size of the search area, the size of a postage stamp in central park. that would take a while. you wouldn't know where to begin. >> exactly. >> they don't, either. >> a lot of people still out there but it's a totally massive area. >> itself is totally massive. tracet( gallagher is live. what is the white house saying about this investigation now,

trace? >> just a short time ago jay carney was asked about the fbi being locked out of the investigation over in malaysia, and he very much dodged the question. listen to what he said. >> i can tell you that the ntsb, the faa and the fbi are all assisting in different ways in this effort. the department of depths has obviously provided assets as part of the search effort. >> so far the u.s. has been very careful not to criticize the malaysian authorities about this wreckage, but a lot of countries not doing the same. especially china, which had the most citizens onboard the flight. china says the false information coming out of malaysia has been a waste of time for search crews and, more importantly, waste of time that could have saved lives. listen to the chinese authorities. >> translator: we hope malaysia can take better responsibility in the planning and coordination of the search by providing more accurate information, expanding

the search area, and intensifying search efforts. >> experts say you have to remember there's some bad blood between china and malaysia, and it's a very good bet neither one is showing their full hand. their radar or satellite or ables because of national security concerns. >> there are reports the jet -- we know the jet flew to 45,000 feet and then went down to 23,000 feet, and now we're hearing 5,000 feet. what do we know? >> 5,000 feet, when you talked about earlier, common tactic that fighter pilots use and drug runners use to avoid radar. the key thing is exactly where that flight was when it was flying presumably at 5,000 feet. that could tell authorities a great deal. and it puts a lot more focus on the captain having that flight simulator mockup inside of his house that he built with tv monitors and computers and video games. remember, this guy has 18,000

hours of flight time. he is already a flying instructor. so, what exactly was he trying to learn? some said he did it for fun but some speck laced was he training somebody else? that's why the fib wants to get back involved in the investigation so they can happen scour the computers of the captain to see if they can flint information from them. >> it would be interesting. we have a former commercial airline pilot and nautical engineer. i heard about the flight simulator and i heard that sort of person describe as a flight nerd. this is not that unusual. >> not unusual at all. you could probably have a couple thousand airline pilots around the world that have built stimulators, not as extensive as his but with their own pcs. >> we were told they didn't search his house.

that's mind boggling. >> it is. that should have been the first area of suspicion, goes to the individuals' homes. you're not accusing them, just doing an investigation. due diligence, ihave a missing child, the first person you talk to is the parent. if you -- where do you think we are no. >> we're totally lost. there's nothing making progress. we're spending millions all over with noing to show for it, not even an indication, not even a blip, not even a smidgen of places where it could possibly be. >> and like finding a postage stamp in central park, i don't even know how you start now. >> that was an excellent display. just like i was saying, throw a suitcase in the middle of iowa ask say you're going to locate it. it's impossible. without someone out there that has physically seen it, some person on a fishing boat, doesn't have a cell phone, doesn't have anything, comes

into shore and says i saw this monster come over the top of my head and it was out there where i was. >> it's hard to imagine that nobody saw it. even if it was out over the ocean, it's not like there are no resources on the ocean. >> there are in that area, south china sea, the straits of malacca, the indian ocean, is loaded with fishing boats, trawlers, oil tankers. it's impossible for me to believe that someone did not see an aircraft that large at an abnormal altitude. >> you hear so many people talk about maybe the plane is tucked away somewhere for later use. given how far we know it flew that sounds like an impossibility. >> anything is possible but you but this in the boon questions somewhere, how are you going to refuel it? get the fuel to go in there unless it was so cleverly planned that you have an oil tanker to give it 30,000 gallons? i don't think so. >> it's good to see you. thank you. >> good to see you. >> a delta flight from orlandoland safely in atlanta

18 minutes before the hour. u.s. forces took a rogue oil tanker out of the hands of libyan rebels.

navy seals used a series of ladders to board the tanker in the mediterranean sea. no one was hurt on the two-hour operation and nobody fired off any shots. u.s. officials say rebels had seized the tanker this month and it was carrying stolen libyan crude oil. meantime it nose clear us yet exactly who owns the vessel. there are conflicting reports its previously sailed under a north korean flag but officials in pyongyang said they already cut ties with the ship. why did the president order this, well, military act here? >> well, shepard, because the three armed libyans who stole the oil tanker had it anchored in the mediterranean sea and were trying to sell 243,000 barrels of oil on the open market.

libyan is part of opec and there are rules who is allowed to sell libyan oil and these gunmen were not allowed to. the secretary of of -- the following statement was issued: no one was hurt when u.s. forces at the request of both the lib yap and cyprus government boarded and took control of the commercial tanker, stateless vessel, seized by libyans. the libbans are now detained onboard the vessel and well be handed over to the libyan government. the seal team launched from the uss roosevelt. the oil company had been flagged to north korea but the north koreans say it was not their vessel. >> if you're the sailors where do you take it? >> 25 u.s. sailors from the uss stout are onboard, and they are part of the uss george w. bush

group. it will take them four days to get to libyan waters from cyprus. right now a former gadhafi commander who was in charge of protecting libya's oil fields, and went rogue last summer, is now in control of three libyan oil ports. libya's prime minister fled the country last week as a result of the crisis. the u.s. navy plans to return the oil tanker the libyan government at sea, we're told. >> jennifer, thank you. late brain in chad williams, a former navy seal who served on missions dealing with pirates. i don't want you to get into operational details but give us an idea how one might accomplish this mission. >> sure. without giving away any of the details, you can say there's a couple different options. the navy could have just been very outspoken, as they're

statement from his cell in guantanamo bay in which he says bin laden's son-in-law was just a spokesperson and knew nothing about the terror group's military operation. and defense attorneys say they want to use his testimony during the ongoing trial. our chief correspondent jonathan hunt is live outside the courthouse in lower manhattan. what exactly did he say in this statement? >> it's a 14-page statement by khalid sheikh mohammad, sent in response to questions from attorneys for suleman abu ghaith, a man on trial here right now. in that statement he said that abu ghaith was an eloquent and spell-binding speaker and that's what he was used as by al qaeda but he was not a military man. the statement went on, quote, those tasks were giving statements to the media, do not necessarily know all the details of an operation and are

sometimes even unaware of the very existence of the operations. that is important to abu ghaith's defense as he is trying to disprove claims he cop spired to kill americans. the judge is deciding whether to allow the statements in. >> there was a mention of a malaysian connection. >> this came about last week during the testimony of badat, a british citizen who conspired with richard reid, the so-called shoe bomber. badat said at the end of 2001 he was given two shoe bombs and he says he passed one of those on to what he called a malaysian group that included a pilot. he was asked by the prosecutor, quote, how is giving one of you shoe bombs supposed to assist in

the malaysian's mission? but badat answered, quote, i think it was to access the cockpit. if that was proving to be difficult for the group. the prosecutors said issue did you understand that the malaysians were also involved in an airplane plot? badat replied, yes. obviously that testimony has raised some eyebrows and it's worth opinioning out if a shoe bomb was handed to a malaysian group, one of those malaysians was a pilot, this all happened at the end of 2001. more than 12 years ago. >> thank you. a fox urgent now. a senior u.s. official tells fox news the uss kidd plans to leave the indian ocean in the next day or so if it is not successful in fining the missing malaysian airliner. the navy destroyer has been involved in the search for the jet for six days now. sources indicate the military will keep searching from the air. the destroyer is not leaving yet
