flight. doug, a lot happening overnight. what is the latest? >> a lot of it has to do with the time line about what really happened that night. and a lot of that has to do with that so-called a car system, that flight monitoring system that periodically sends data about the aircraft. the switch is in the center of the console. the question has been was that switched off before or after the last voice transmission from the cockpit which we now believe came from the copilot. if this was switched off first that could indicate flight crew. if it was switched off after all bets are off. the malaysian officials talked about this expanding search area. march 13 we were talking; @&c 3 about this red circle. march 17 this green circle. now we're talking about these two arcs. what officials are saying is china and kazakhstan are handling the search in that more than arc but a lot of focus is moving south into

the indian ocean, deep into the indian ocean. australia is handling that part of the search. this morning malaysian officials asked for some assistance in the deep waters there. >> on air and surface access, i've spoken to almost all leaders to request further support including access with deep ocean [inaudible] detection capability. >> remember, they are kind of racing against the clock here because they're trying to find the black box, the cockpit voice recorder and cockpit dataç recorder. those have a battery on them to keep the ping going but it is only good for 30 days. we're a third of the way into that battery life. they have an immense area to search. >> thank you very much. also this morning we're learning more, and it

causes -- you know, if somebody high jabbed the plane, you would -- hijacked the plane, you would think that first big turn to the west, which was picked up by military radar, as it turns out now apparently they figured out that that big turn was done by the computer. a computer betweenç the captain and the copilot, it would take six or seven different key strokes and you can do that, you can reprogram it. it is not clear if the plane was reprogrammed before or after it took off. but nonetheless somebody with the knowledge of how a 777 works and that device did the changes. >> if you reprogram a computer and put in the flight path, i wonder if you can see that in the control tower. you're not able to see where that plane is charted? >> i don't think if the acar is turned off and the transponder. >> they weren't turned off on the ground which means it probably happened in the air. >> that diversion, which

"allç right. good night." evidently in the vernacular of pilots it is unusual. the copilot is thought to have said it. because he has said it, the way they did it, they think it might have been code for there is something wrong here, whether it was the transponders were off at that time or not off by that time, it goes back and forth depending on the briefing we have just gotten. but the fact is when i heard all right good night in the middle of the flight, it was only about an hour in, i didn't think anything was wrong but for pilots and investigators they thought that was unusual. >> is it indeed a message

being with us. a lot of news breaking. i want to start with the idea that this turn we keep hearing about was done not manually, was done through a computer system. will this change how that process happens where you have to verify movements like that in the air? >> you would think it already is verified or mandated that you're telling somebody th[s is the course we're going and this is the course we stay on. but i think there's less regulation once you get over areas where there's no radar. that's a big issue. there's a lot of issues coming up from this and kind of telling the underbelly secrets of security and how we in the united states vary from airline industry to outside of the united states. they still have smoking on some of these planes. they still allow human beings to light a fire on an airplane in other countries. >> what will this mean going forward in terms of changing security, information, passport checks and funding for, you know, safeguarding our airways? >> it's a serious thing.

a passport is really an international identification now. everybody has one if they want to travel abroad. when you get on a plane you have to use it. there needs to be a system where you can't counterfeit those things. it isç old system and there is a lot of things to be upgraded and i think they need to step towards that. >> is the u.s., are we prepared to put more money behind defense and also proactive investigation here in terms of protection? should we be taking a note from israel? >> we should always take a note from israel because israel looks at them unconventionally like the attackers do and they look at their vulnerabilities and fill in those gaps. those are the same vulnerabilities that unconventional attackers look to exploit. unfortunately in this country, even if we allow the u.n. to take over this system and incorporate these things, these other countries don't have the tax base we have and the money always ends upç coming from the united states taxpayer to fund basically these world programs, i guess you could say.

"the new york times" at around i think 9:00 eastern time published a story that they've gotten confirmation that the plane's turn that everybody has been covering trying to track was preprogrammed into -- by somebody in the cockpit. what does that mean to you? >> it could mean a couple things. rule taoepbl if a -- routinely if a flight is proceeding and there's bad weather or air traffic control advises, they may have to divert and they use way points which areç basically imaginary points to either get around bad weather or move around. >> that's not the case here. weather was not the issue and the diversion was the opposite direction.

formally recognizing crimea as a country. >> how about deciding to put missile defense back in that country? now the latest on how these sanctions are reverberating in that nation's capitol. hey, kitty. >> good morning. already we're waiting to hear this morning from russian president putin. he has already made the first steps to bring crimea to be part of russian territory. he's signed a draft bill. we're expecting him today to appeal to russian parliament to approve that bill. it needs to be also signed by constitutional court. but certainly russia is in a hurry now to solidify the results of sunday's referendum. we saw overwhelming majority of people there saying, apparently saying they wanted to join russia. that referendum has been condemned by many in the international community, also in britain. a statement was issued saying it was unconstitutional. it breached ukraine's rights of territory.

the ukraineian government seemingly powerless to stop the results today of that referendum. the consequences of it is expected that putin will ramp up fairly quickly bringing that territory o russia. we're hearing reports of crimea they intend to join russia's time zone by the end of the month and switch their local currency to the russian ruble. today we see joe biden in poland trying to put additional pressure on russia and saw sanctions put this place yesterday. will it stop putin from getting what he wants? presumably not. >> thank you very much. how are the sanctions and how stiff will they be and alter russia's behavior? so far not at all. the daily news and their lead editorial called them helpless, happenless and hopeless. essentially we have put sanctions on 11 individuals, four ukrainians and officials inside russia and said your assets here, no money allowed. there is no proof and evidence.

now believe came from the copilot? also the "new york times" is reporting that someone entered in that left turn into the flight management system. that is the left turn that laborrian radar picked up as this thing began to head to the west. as far as the search area is concerned, we're still talking about that big arc, so big that the northern boundary of it, that is being searched by china and kazakhstan and to the south, that part of the search is being carried out by australia. this goes deep into the indian ocean and malaysian officials say they need some help in that search. >> on air and surface access, i have spoken to almost all afghan leaders, including assets with deep ocean surveillance detection capabilities. >> reporter: they are racing against the clock for a number of reasons. not the least of which is the plane's black box. there is a locator beacon to

some know how about how that big airplane ran did the programming. >> that's right. we're going to keep you posted on the ever changing time line there. in the meantime, malaysian officials say the plane could be in pakistan and they say that pakistan -- pakistan is saying we'll check on it. we're not sure when that's going to happen. but they believe it avoided radar detection and landed in pakistan near the afghanistan border. certainly making everyone sort of tighten up security, particularly when it comes to israel. they are reported to be really drawing in and making sure that their airways are safe. >> lignet is the site which has got a lot of qualified people endorsing it. langley related a lot of these men and women were at one point serving in the c.i.a. they say flight 37 conceivably could be hidden inside the hangar in the country. they will check around. we did ask them to check around for bin laden. they came up with nothing. >> they're not good at finding things apparently.

>> it might be right in the driveway of the presidential building. >> you never know. pakistan does have a number of 75, 100-foot runway which is is what it would require to take that airplane off. where would they fly it? if they turned it into a flying bomb, they might fly it to the country of israel. they might have flown it to iran. we had a guest on earlier in the program and he said do you have to worry about iran regarding this. >> iranian involvement in terrorism and the way iran is located in between the area where the aircraft is supposedly present if it survived, that is something that could not be completely ignored. israel, living in a rather bad neighborhood, has always been very careful about watching its air space. >> yeah. they've got to.

also there is one other story that's been rush shaying around the inter-- ricocheting around the internet. we told you they turned off the communications device and the transponder. well, there are some who suggest that perhaps if this was hijacked, they can have flown it so close to singapore airlines flight 68 that it appeared as a single blip on the radar. apparently that particular flight was flying from singapore to spain, through indian and afghany air space. next thing you know, it could have wound up in pakistan or anywhere in that red zone if it were just trying to fly underneath it. and because the transponder went off, the guy flying the singapore plane would have no idea it was there. >> right. >> how could you preplan that? you couldn't have preplanned that. >> if you knew when that plane was taking off. coordinate it. there are a loft theories.

because the plane is missing, we don't know. >> right. day ten here. another fox news alert right now. vice president joe biden arriving in poland. the trip is designed to show u.s. resolve against russia's moves on ukraine. however, putin already responding to american sanctions by promising sanctions of his own against u.s. senators. >> wow. putin just finished speaking. kitty logan is live in kiev. what did putin say in russian? >> reporter: he gave a pretty tough talk. i can tell you that. certainly nothing stopping him when it comes to bringing crimea back to russia. he was greeted with applause, a standing ovation even as he addressed the russian parliament. he said that crimea had always been part of russia. it was historically important. he said the referendum showed clearly people in crimea wanted to join russia. he said it was perfectly legal and fair and he said he would not negotiate. he would not talk to ukraine over this because the government was not legitimate.

we understand he's approved a draft bill which would bring crimea back to russia. that is going to be submitted to parliament today. this could be wrapped up by the end of the week. meanwhile, joe biden arrived in poland in the region to put additional pressure on the russian government. putin doesn't seem to be listening to this, that despite sanctions which were imposed by the u.s. and e.u. over the last couple of days. putin said he will impose sanctions of his own. it seems like this is a done deal and putin is doing what he pleases, which is bring crimea back to russia, which is what he says where it belongs. >> all right. >> thanks. let's talk a little bit about what russia did yesterday. the president of the united states came out at 10:45 eastern time and said, i saw what happened with the referendum on sundays. i talked to putin on sunday. i'm very upset by this. so i'm going to sanction 11 different russian officials and say anything in the u.s., well,

wendell goler standing by with that story. hey, wendell. >> reporter: the president will honor two dozen veterans of world war ii, vietnam, korean war, who were overlooked for the medal of honor, the nation's highest military award because of racial prejudice. a study found actually no black soldiers in world war two had been awarded the medal of honor despite several recommendations. the army segregated then. actually the first black world war 1 medal of honor winner wasn't named until 1991. in 2002, congress called for a review of jewish american and hispanic american war records to insure that they, too, weren't denied the medal because of prejudice. the study found nonethnic soldiers who were also deserving. 21 of the medals will be awarded host humusly today. staff sergeant melvin morris will be here to receive his for courageous actions as a green beret in 1969. >> this is overwhelming. this is a special honor.

what's your reaction to these two new changes to our immigration policies? >> brian, my reaction is that aside from being horrible for the american workers who are going to have to compete against these illegal aliens who won't get deported, this is illegal. in 1996, congress passed a law that was supposed to end the catch and release policies of the clinton administration and that law orders ice agents that they must place most illegal aliens in deportation proceedings. what obama is doing is his administration is telling the ice agents to break federal law. so he's ordering the ice agents to break federal law and he's refusing to enforce the laws as the president is supposed to do. >> this could mean about 1 million people could be eligible for a two-year dwell of deportation. these are people that are here illegally. this is going to be significant. a lot of people at home are saying, don't understand, this president has deported more illegals than anybody else. back off. but in reality, he was using the wrong numbers in his calculus. >> he was cook the books. let's take for example the 2012 high water mark.

that's when the obama administration said that was the most deportations ever. they claimed 410,000. what they were doing is they were counting in that 410,000 turn arounds by the border patrol, where they catch them at the border, then release them at the same place or somewhere else. if you take those numbers out, it was only 324,000. one of the lowest numbers in the last two decades. so their numbers are at an all-time low. they're deporting fewer people and now announcing a policy where pretty much nobody gets deported unless you committed a violent felony. this is outrageous. >> don't worry. it's supervised release. we'll look after them. we'll keep an eye on them. >> nobody keeps an eye on them. there is no supervision. and one more thing, brian, remember how the house conservatives were saying we're not going to do this amnesty deal? they were absolutely right, we now know, because the obama administration, part of the agreement was we'll pass this with the amnesty. they're not going to enforce any parts of the law that they don't

the families of passengers on malaysia flight 370 are waiting for word on their loved ones. but if no cause is found and the plane's mysterious disappearance issues will those families be able to take legal action or be compensated in some way? joining us is peter johnson, jr. >> that's an interesting question. it hasn't been explored yet. in all this pain, in all this loss and all this confusion and question, will the loved ones be able to seek the redress of the court under the montreal convention in 1999 treaty between the countries of the world, there is about $150,000 that could be paid to family,

photo a survivor as a result of this crash. but that's kind of the bare minimum. potentially, other lawsuits could be brought. but there are problems with that. >> how? >> we don't know how and why and if this jet, this 777 boeing airliner actually crashed. we've heard from retired generals. we've heard from other people saying perhaps it's in pakistan. perhaps it's not in that 2 million square mile in the waters of the world. so usually people resort to the manufacturer for a lawsuit. they resort to a government entity or authority for their conduct with regard to how an airliner was operating. so there is a lot of potential defendants. but there is more questions than answers. and yes, it could affect the ability to get full and adequate compensation for people who are lost, although we don't have proof of life or death at this point in that tragedy.

>> and perhaps motive to not put forward -- >> you're absolutely right. the malaysian government has made so many statements as to what happened, when they were aware this airliner was at different times. now we know that it went on many, many hours in the air beyond what the malaysian authorities had told us. so the government authorities in malaysia, did they do what they were supposed to do in terms of interpol checks? is there manufacturing defect? there has been no proof of that. how can transponders be turned off so easily? is that a defect in this aircraft? malaysian airlines itself, what did they do wrong in terms of retaining that pilot? did they have an awareness that the pilot, the copilot, the crew or anyone else on that plane was a terrorist risk to those passengers? why didn't they tell those passengers? the lawyers will be feeding at this trough. obviously these people deserve
