we have a ton of feedback on james mcinerney, theory, let me know what you think, thank you for joining us, this is "the kelly file," i'm megyn kelly see you tomorrow night. and this is a fox news alert, it is now day 12 of the greatest aviation history. flights were fleeted on the pilot's home simulator. standing by in washington, d.c. with the very latest, with fox's own catherine herridge, the mystery grows wider. >> reporter: it certainly does, the fbi is doing a study of the simulator and the hard drive recovered from the pilot and
7:01 pm
co-pilots' homes, being examined for premeditation. is there evidence that the rehearsed dramatic changes in the flight, or deliberate acts by a third party on the aircraft. a former senior fbi investigator said the techs will look for e-mail traffic for evidence of a conspiracy. >> you will look for indicators of influence from the outside. now, if the flight crew is guilty of a crime there is something external to them. they have them thinking about this in the first place. it could have been something as simple as greed. >> a second intense review of the satellite and radar data by the ntsb and faa is apparently bearing results with the pentagon releasing information that the u.s. is now focused firmly in the south. this is an area of thousands of square miles and it includes a search box ands significantly a
7:02 pm
predicted drift box. >> thank you, catherine, we appreciate it. yesterday we learned that israel has heightened security measures in light of this plane's disappearance. and earlier today the president was asked about the missing jet. here is what he said. >> we have put every resource available at the disposal of the search process. there is close cooperation with the malaysian government. and so not just ntsb. but the fbi. you know, anybody who typically deals with anything related to our aviation system is available. and so our thoughts and prayers are with the families but i want them to be assured that we consider this a top priority and we'll continue to work with the international community to get to the bottom of it. >> all right, joining me now, former new york city mayor rudy
7:03 pm
giuliani. thank you for joining us. >> thank you, sean. >> we do know that the simulator, reportedly he practiced takeoffs and landings at five asian airports using the flight simulator and deleted the data. and to look at tsri lanka, and more data, what do you make of it? >> it becomes clearer that this was a deliberate act. looks like the pilot could be involved. can't be sure, you have to believe there was a deliberate plan to take this plane somewhere to do something with it. the problem is we still don't know what the plan is, what purpose they had in mind. obviously it was a nefarious purpose, obviously done by experts, people who knew the plane intimately. >> all the communications didn't just get cut off by accident. that had to be done on purpose. the turn was pre-programmed. the ceo pilot gave that good
7:04 pm
night signal after the turn that already happened. i mean, these are all facts that point to some type of a deliberate plan. >> and we have several hours of pings which would not have occurred had in fact something terrible or catastrophic happened. >> right, had it gone done or been destroyed or blown up, let's say it was blown up. >> are you confident that the fbi will be able to recover the deleted data from the flight simulator? i would think it is very difficult to delete anything these days. >> i have a lot more confidence they will do that than if we would find this plane. it is getting tougher and tougher. if it did go down in the indian ocean or any ocean it would be hard to find. i would think the fbi could do a complete reconstruction of what was in the simulators, what was in the computers, at least you would get a complete picture of what they were thinking. the frustration is clearly they took this plane, clearly they had a nefarious purpose. but we still are not any closer
7:05 pm
in figuring that out. >> what do you think about the plan that the flight was altered. the fact the transponder and other communications, navigation also was turned off. but yet, the navigation that was built into the plane -- >> when i first heard that, i thought maybe one pilot was involved not the other, so he wanted to make the switch without the other pilot knowing that. you can't be sure either. could be there was a third person involved either working with the pilots. but that person would have to have very, very deep knowledge of the airplane. it is hard to believe, like these two iranians, that would have had this kind of knowledge. >> what do you glean from the fact that this opposition leader who was recently sentenced to five years in jail, apparently the trial ended several hours after this flight took off, anwar ibrahim, we'll play some of his comments later in the
7:06 pm
program tonight. but does that raise a red flag for you whether his cause was just or not? that is not at issue here. >> it raises a red flag that it could have created an emotional impact in somebody that is not exactly all there. but with all the prior planning, it sounds like this was not just decided on three, four, five hours, six hours before they did this. sounds like something like that had to have been planned for a while in advance. they had -- there was too much in it. too many thing that s that were off and changed. hard to believe they just changed -- >> we had general mcinerney on the show, we'll play some of that coming up. but he is really convinced that this plan was purposely, landed in pakistan. he has some intelligence -- why wouldn't boeing be able to track this plane? >> i would think they would be able to -- >> and they haven't said
7:07 pm
anything. >> well, you know, there is a lot of this i imagine that we don't know. there is a lot of this that is being hidden. a lot of this on purpose to not hurt the investigation. so the facts that we're working with, it would be hard to understand you know just exactly how it got to pakistan, what it is doing there, why it wouldn't track there. or the israelis, there is a concern that maybe it is either in iran or under control or some of the groups that iran contr controls. i will say this. the israeli government, even if it is a 1% chance that is a possibility is doing the right thing to prepare for it. >> they usually do the right thing, we can learn a lot from them. >> we should do the right thing to prepare. it is not wasted because some day something will happen and we'll be better prepared for it. >> let's run through the different scenarios we're talking about here. hijacking by the pilot or the crew. terrorism from the pilot, they wanted to plow this thing into the indian ocean, perhaps. terrorism from the co-pilot, hijacking from a passenger, less
7:08 pm
likely because what we know about the data -- >> go out on a limb and say if it was a passenger, they acted in concert with at least one of the pilots to accomplish what was accomplished. could be that it was one of the pilots and then one or two of the passengers. but i think you would need one of them to accomplish -- >> i think i'm leaning where you are here. i don't think this is a mechanical failure or a fire in the cockpit. the one thing that interested me is the federal register report that there might have been a flaw in this particular airplane that would have allowed some type of cyber-hijacking where somebody could literally turn off the transponder from within the plane. way out there but -- >> but then they also would have to cut off the other communications. they also would have to -- well, if you could have done it you also have to pre-program the plane to make that turn. you would have to have a range with the pilot to give that strange message after the plane turned. as i remember -- the good night message took place after the plane turned.
7:09 pm
so that pilot had to know that plane made the turn. what is he giving a message like that for? >> what should the united states, what should the president be doing? maybe he is doing more and we don't know it. >> i hope he does, i believe he does, i hope he does -- >> he is filling out his brackets and michelle is getting ready to fly to china on our dime, no reporters allowed. >> i think on this one, they're doing everything they can do to help. look, we're at risk here, as long as we don't know what happened on this plane we're all at risk that something terrible could have happened. you have to take it very, very seriously. it is enormously frustrating because you have so little to go on. but every country should be on alert because god knows what could be the plan. >> thank you, mayor, your experience in obviously what happened in 9/11 plays a part here. and we'll get deep into mcinerney's theory, and also on
7:10 pm
"hannity"? >> the only thing that is starting to be verified is the lignet report from boeing saying they believe the plane is in pakista pakistan? >> could general mcinerney be correct on this possibility? also, we'll have news on the families and that chilling video. stay with us. the world of luxury has been pulled over your eyes, to blind you from the truth. we just want to get our car... take the blue key, you go back to the luxury you know. you take the red key, and you'll never look at luxury the same again. they're looking in a larger area. i want to play for you what lieutenant -- what general mcinerney who was on the program last night. his theory, in fact this plane may have very well landed in pakistan, watch what he says. the only thing i have seen is the lignet report that they believe -- when the israeli defense forces, they must know something, with boeing, as well as the u.s. government. >> it could have been altered by computer plans, not manually, that tells us, the transmitters would have been activated, which automatically notifies a satelli satellite, the satellite system -- so the landing in the water is a little unlikely because of the southwest of australia, if it were to have been landed on an air field on terra firma, then that would explain why there was no elt. yeah, it is very possible. >> dan, let me ask you, same question, when the computer -- when the flight path is altered had to be done from cockpit because they changed the computer. it was not done manually, so that raises a lot of questions, transponder turned off, that is something that can happen manually. and the plane, obviously according to the pings was so off course, by design, the electronics as they were today
7:17 pm
it can hit the automatic pilot. it will take you right to where your destination is, right? >> that is all correct. and i don't want to discount anything yet because we don't have any proof to the contrary. but the pilot doesn't need the flight control computer to fly. so all of this stuff about having to change way points and reprogramming, that is nice, not necessary. >> it is not necessary, but information we have was telling us it was altered on the computer. so that means it was done by somebody who has aviation knowledge, right? >> absolutely, not just aviation knowledge, but knowledge of that airplane. now, there is one point here i need to clarify. i said this yesterday. the elts go off under normal circumstances. but the pilot can disable the one that is in the tail with the switch in the overhead panel above him. because frequently pilots land hard and don't want to set off the beacon. the ones in the back have to be manually turned on by the flight attendants when you ditch at

sea. they're activated by salt water but they have to manually turn them on, they don't want to run on them because the batteries will run down. >> what about the transmission of data? the engines we know, the boeing triple 7 transmit data as to the other functions and the mechanical devices that are inside of the plane. now, we also know that they tried to do this for up to seven hours afterwards, at least tried to connect satellite-wise. so doesn't that give us some information. doesn't boeing have the ability to monitor such things? >> yeah, they do. but this is the rolls royce engine so it goes through great britain. and it is a good system but it doesn't do unless you specifically sign up for the service it doesn't do geo-location. it just basically gives a hand shake and says we're awake and transmitting. >> but that is important, isn't it? because that is saying that the jet is flying.
7:19 pm
>> well, or the engines are running. and like i said if i want to disappear an airplane i would take it out into the south indian ocean because i don't think you would ever really find it. >> okay, but if the engines are running and that data confirms that in fact this was done by design, captain nash, would you agree with that? >> i would, because if something disappears, it could be a catastrophic event. but then, if it were a catastrophic event it would have stopped transmitting almost immediately. not continued to try to connect to the satellite for the next several hours. and as far as if you wanted to create the amelia earhardt story of the 20th century and whatever happened, you take it in nowhere-near ocean land and ditch it. because we only have 18 days
