kelly file. breaking tonight moments ago, the wall street journal uncovering a new twist in the mystery of the missing plane, where it was and what it was doing. welcome to the kelly file, everyone, i'm megyn kelly. as the search teams head out again this hour on the other side of the world, the journalists breaking news on the last communications involving this jet. apparently there was something called a partial ping received just eight minutes after the last complete transmission between that jet and an orbiting satellite. a clue that could help investigators narrow down what happened to the jet and the 239 souls on board. one of our fox news aviation analysts is looking into this right now, he will be with us shortly on the breaking news and what it means. but first, we are also hearing malaysian police are focusing in now on four possible theorys. among them, a possible hijacking, sabotage, that's where the pilot takes over and does something bad. psychological issues by someone

on board or personal problems from the passengers and/or crew. the significance of this, they apparently are not taking seriously, at least according to a report from great britain the possibility of malfunction any longer. my next guest was briefed on the investigation earlier today. that is a report from the telegraph that based on conversations with those on the investigation team, mechanical malfunction they say, does not fit, given the way this aircraft flew. and the number of hours it flew after its last communication. your thoughts? >> well, i think that's consistent, we all along -- the lithium battery theory, that some sort of a fire in the cargo that caused the electronics to go down was a theory out there. the problem with that is, after the transponder is turned off and it reroutes the path, it flies for another seven hours. i don't think it could with

stand that kind of fire for seven hours and stay in the air. as we saw the ups flight out of dubai only lasted about 30 minutes. i think that's a pretty consistent theory there. >> they seem to be zeroing in on the theory that someone on board, perhaps the pilots. whoever did this would have had to control the airplane and would have had to know a lot about it, and would have had to be a sew twist indicated pilot. the focus is now more and more on the senior captain. how are we doing as far as you know, our fbi in trying to find the deleted files on this man's flight simulator. >> they are working on it. files can be deleted but can be retrieved later. i have every confidence they will be retrieved. i don't know how key that evidence will be in this particular case. the one thing i've said all along, i think this was an

intentional deliberate act because of where it took place, and that's after they went out of the malaysian airspace and before the vietnamese airspace which is a dead zone. the transponder was turned off, and the plane turned around back toward malaysia. which has all the indicators of the intentional act. what's the motive of this, i don't know. we'd like to see the fbi be involved with the malaysian government. they've been very limited in the scope of their investigation and that's really to the flight simulator. >> it's too coincidental. two minutes after signing off, the transponder gets turned off anded plane is never seen again. the malaysian authorities came out and said, it's done, it went down in the indian ocean, we're sorry, but that's what all the evidence is pointing us to. so far, not one piece of wreckage or debris has been proven to be attached to this aircraft. how concerned are we here in the

united states that we still basically have a missing plane? >> this is still a rescue operation, not recovery. that means they still have some thoughts that they still may be possibly alive, debris maybe found in the ocean. i think the malaysian government has handled this has really been abysmal. they texted the victim's families rather than contact them in person. if i could just backtrack. when we had these two flight bat earns, one to the north, one to the south, the malaysian government was given days after the plane was missing intelligence from satellite company, that it went southbound, not northbound. and yet the malaysian government chose to spend a week looking in the gulf of thailand up toward kazakhstan. we knew because of the radar detection capability in china, india, afghanistan, pakistan,

that there's no way this plane went northbound and we wasted a week of valuable critical pressure time on the northern route trying to find this plane instead of looking to where it went, that's the indian ocean. >> i have to run, we have breaking news, which you may find interesting. before i let you go, i know we have this breaking news, i have one final question. for those who believe the jet may be in pakistan, based on your last answer you say it's not so. >> i don't believe so, the intelligence i've been briefed on had every indication it went southbound into the indian ocean, which is i think where the aircraft is today. probably sank to the bottom. i -- this is an ongoing investigation, none connect all the dots at this time. >> thank you. i thought you may be interested in hearing the breaking news. this is literally just coming in

at this moment. we are getting reports that the white house has just announced a new extension for health care sign zwr signups. how about that. it is march 25th. our white house team has reached out to the white house for confirmation, no word yet. chris, what specifically does the report say. the end of march is supposed to be it. they were supposed to be very happy with the number of signups, p was all going great. the website was working perfectly. now we get a report tonight, we're going to have another extension. >> i am here to tell you, this is probably the first of many. the washington post is reporting tonight, if you click a simple box, there will be a new box added, if you click on it and say, i want it, but i'm not quite ready yet, that you will buy yourself automatically two weeks before the imposition of the penalty. the central piece of this law,

the most important part of this law is that you must under penalty purchase health insurance. you have to be covered or you will pay a fine of 1% of your income. but very few people, relatively speaking of the uninsured in america have signed up for this law. this is the first nod to a political reality that says that this administration knows that in an election year, it cannot find people large sums of money or begin to find people large sums of money for a product that either they can't get to, because the website was so bad, but then that they can't afford once they get inside. they have real problems and this is the first nod to a dire situation. >> are you telling me the health care.gov website and signing up for health care, it's all been converted to a promise ring? you don't have to walk down the aisle and get married. you don't even have to get the engagement, just a promise ring. i promise i'll be back -- >> engaged to be engaged.

the supreme court with the justices peppering the lawyers with questions and at times others. justice kagan saying, congress has made a judgment and congress has given a statutory entitlement. that entitlement is to women that includes contraceptive coverage. when the employer says no, i don't want to give that, that woman is harmed. but the owners of the two companies, hobby lobby and conestoga wood are challenging the contraceptive mandate, they're not opposed to contraception or anyone's right to access it, but they are against being forced to provide what can result in an abortion.

corporations themselves can't have religious beliefs, the companies must comply with the law. well, that didn't seem to sit well with justice anthony kennedy, often the swing vote in these questions, later in the case, under your view, a profit corporation could be forced in principle to pay for abortions, when he objected to that characterization. kennedy responded, but your reasoning would permit that. several justices also asked why, since the administration has made decisions impacting millions of americans, why not so here? we'll have a decision in late june. senior counsel for the becket fund for religious liberty. that fund is representing hobby lobby. >> good to see you again. what a day at the supreme court. it was a tight argument, the court watchers predict ed.

justice kennedy asked, what rights would women have if you get your way, the exemption from having to provide certain kinds of contraceptions to their employees. what rights would women have if their employer forced them to wear burkas? >> i don't think justice kennedy was bushing in that direction, he said, that's not this case. and the truth is, the law, the religious freedom restoration act calls for a balance. the government's problem here is that it doesn't have a strong interest in forcing the green family or the hahn family to pay for these drugs when previous correspondence have said the government has made exceptions

so tens of millions of people aren't in exemptions. there are plenty of other ways to get people drugs without dragging these people into it. >> this is outrageous, what is happening, hobby lobby doesn't want to provide female workers with any birth control. your thoughts? >> it's not true, first of all. hobby lobby provides all sorts of standard birth control, it's a small handful of drugs and devices that can cause early abortions that hobby lobby doesn't want to provide. >> it's 4 contraceptions out of 20. they object to 4. 16 they're fine with providing that to the female workers? >> that's right. hobby lobby is a company that does a wonderful job taking care of its employees. it provides starting salaries almost twice minimum wage.

there's a small sliver of things this family does not want to do. they should either be crushed with fines or kick all their workers off insurance. >> the government seemed to be arguing that today. kick them off the insurance, lets them pay the fine, and that will be the end of it. >> a few years after this law is passed, that's the government's position, okay, go ahead kick everybody off shurngs and that will be good for people. it's really a silly argument the government's presenting. it's not good for companies to kick everybody off insurance. offering good insurance is part of attracting and retaining workers. hobby lobby's workers have a religious belief they need to take care of their employees. the government shouldn't be trying to say just because they earn money they give up their religious freedom. even justice kagan and breyer, justices who may be thought of to side with the administration. just because you make money you

can't exercise religion. >> they did press your side on whether this was a slippery slope. if hobby lobby can say no to those drugs. who's next, can someone come out and say, well, i have an objection to medical vaccinations, so i'm not going to pay for those. well, i have an objection to blood transfusions, i'm not going to allow those. can we run the law this way, with employers choosing piece mail i like this one, i don't like that one. >> for all of american history, until 2012, any employer who didn't want to cover vaccines could have objected. you never heard of any cases like that, i never heard of any cases like that. that's not a real religious objection. if somebody does, this law has a balancing test. i assume the government would be able to come in and show it's got a compelling interest in getting everybody vaccinated. the government's problem is they created so many exceptions for

look at the video showing how quick a mudslide like this can happen. look at that. knocking freight cars off the tracks in 2014. mudslides are caused by heavy rain that soaks the soil. then loosens boulders. the victims in an unimaginable scenes trying to find their loved ones. >> went through police barricades under threat of arrest started searching and digging. they found several bodies. >> it's a war zone. >> dan springer live tonight about 55 miles north of seattle with the latest.

dan? >> this is a tragic story. it continues to unfold we're anticipating more bad news as officials have said they find more bodies we should learn how many, we do know one new victim is a 49-year-old john. his brothers found his body this morning according to his father they're still searching for his wife, chris. john served in the navy 32 years, the couple has five grown children but amid devastation we cannot for get efforts saturday that saved lives. a 6-month-old baby rescued listed in critical condition. a spokesman tells me his condition is improving and a shot of the helicopter rescue of a 4-year-old boy stuck in waist-high mud. his siblings and father are among the missing. a neighbor tried to comfort him. >> so they brought him to us in the ambulance.

i took his clothes off because he was freezing and wrapped up and held him told him i was a grandma. >> thankfully the mother was in the home at the time they will wait together. we've got a better look at devastation, we can see efforts just to clear trees and debris off the streets. officials admitting there may be victim bodies they never find. they've not completely given up hope. 176 people listed as missing. there is no telling how high the death toll can go. >> miracles happen. when the houses went down if someone was in the right spot, and didn't get injured severely, could be in a pocket. you know? you hear stories about that with earthquakes. >> and for those people who have seen the devastation they're comparing it to this state's most infamous natural disaster

news involving the missing malaysian airlines flight. the flight sent a bar shall ping that could help investigators figure out what happened to this plane and potentially where it was when we last had contact with it. trace gallagher reports from our west coast newsroom. trace? >> we talked about this, how these planes send out these satellite pings to say, i'm still here. what the satellite does, it measures those pings, in other words the closer the airplane, the louder the ping, just like a police siren coming toward you. we were told there were six pings from flight 370. and what inmarsat did, they measured those to chart this path, saying the plane flew a similar path for the first few pings. then you can see it got closer to the satellite, it got a little further away and closer again. we thought the final ping was at 8:11. now we're being told there was a partial ping, a slight ping that happened down here at 8:19.

they do not know what that means, but they do know that at 9:15 when the plane was scheduled to ping again, it did not. listen to authorities. >> sometime between 00: 11 utc and 00:50 utc, the satellite was no longer able to communicate with the aircraft. >> the plane likely hit the water between 8:19 local time and 9:15 when they did not get that final ping, megyn. that's a very wide gap for a plane traveling that fast. did the plane plunge into the water or did it glide into the water? a 777 can glide up to 100 miles with no fuel. you have to keep that in mind. they could figure out if maybe

it was very close to the water when they got that final slight ping at 8:19. >> trace, thank you. for more on this, we want to bring in mike boyd. let me start with that, whether this ping could be helpful in determining the last known location of this aircraft. do you buy that? >> it could, but again, it's more half information, and it doesn't really move the needle a lot. if it's in that area, i'm not really sure what that means. and again, if it was six pings on a flight that long. remember two nights ago, there was breaking news that the airplane at one time was at 12,000 feet. analysts were saying, what a break that was to find out about the aircraft. we find out that probably wasn't true. it doesn't help us find the plane any more than we had before. >> the ping was going off once every hour. if that's true, and this came

eight minutes after the last ping, that would be unusual and against pattern. what on board the aircraft could cause that ping eight minutes after the last ping? >> we're not really sure, and i'm not sure about the ping. all these things have come up, we have this partial information, bits and pieces of information. let's say it's in that area. again, we're not -- i don't think it narrows it down a great deal even if it was. maybe something broke, maybe it wasn't a ping, maybe it was an echo. this whole thing from day one has been breakthrough after breakthrough that wasn't a breakthrough. >> very true. mike, thank you. if the plane did go down in the indian ocean, what kind of clues will investigators be looking for. dr. michael boden was the forensic biologist in charge of the twa 800 capture. supervised diving operations for

the uss cole recovery. it was your team that brought in dr. boden. much evidence is retrievable if a flight goes down in the water. how much? >> well, a great deal of the evidence is retrievable on twa flight 800. we were able to collect not only the black boxes, but almost 97, 98% of the aircraft from twa flight 800 and bring it back to the investigators in order to determine the cause of that crash as well as the victims of that tragedy that we brought back to dr. boden to help him determine the cause of the crash that that was critical to the investigation. >> so our viewers know, the twa 800, people who had family

members on board the flight, brought dental records to the coroner in the area at 3:00 in the morning he said call back tomorrow. they said this is now a criminal investigation. and if this is a criminal investigation, they're going to need somebody like you to help analyze the evidence should they find it. what clues could be gleaned. >> there's a lot to be gathered from the structure at the bottom of the water, and also from everybody. all 230 bodies were recovered in twa, from shallower water. the bodies themselves will tell us -- and they're in good condition, they stay in good condition because of the coldness at the bottom of the ocean floor. 34, 35 degrees, so the bacteria can't function and decompose the bodies. we'll be able to tell even two years from now, whether they

breathed in soot from a fire, there was a fire on board. we'll be able to tell how long they were dead before they crashed by the stomach contents. they were fed something as soon as they take off. it takes time to digest it, were they -- >> even weeks after the fact? >> even months after the fact? >> we find stomach contents in people mys, the last things they ate. we can also tell that -- whether they were alive when they hit, when they landed in the water, by looking at whether they breathed in any water. >> could youone of the theorys e is that potentially there was depressurization and they were killed either intentionally or accidentally by depressurization of the plane. >> no, we can't tell that.

but if they inhaled a gas, we can tell that by the tissues. >> bobby, let me ask this, they are trying to zero in on an area they believe may be the crash site. finding the boxes that may or may not have the clues as to what happened here, is a whole different effort. what is your confidence that they will retrieve them? >> i'm actually very enthusiastic about this latest finding, because -- >> the ping, the partial ping? >> the partial ping, i have no expertise in aviation, but the fact that the experts are going back and looking over all this huge mountain of data that we have from electricians and finding more information every day, and providing it to help us try to shrink the size of this search area, we have to shrink the search area, before we can ever start the underwater search

for the aircraft. >> it's too vast now. >> it's absolutely too big, and we need to shrink it before we can go in the water, if the plane did go beneath the water. >> dr. boden, what about this theory, more and more they seem to be looking at the pilots potentially, or somebody on board the aircraft. >> yep. >> they're going to start with the pilots. what evidence might you uncover on that? >> important evidence. if the -- one pilot did this, committing suicide, for example. he had to disable the other pilot, who could have interfered. if the other pilot was bludgeoned or shot, we could find that even two years later in the remains of the body. and also, most important for the families, dna is going to be preserved. the teeth and the bones, preserved dna even years and decades from now if they're

underwater there, so that the identification of the bodies is what the families are so upset about right now, their loved ones. can still be done even years later, as it was done with air france after two years, they picked up the bodies, they got 101 bodies from air france two years later. >> that's an important piece for the families to be able to, if the jet did go down in the indian ocean, to have proof of it. and to know, and to have some piece of their relatives to say good-bye to and honor in that way, their physical beings. thank you both so much. >> thank you. the president yesterday started a controversy with some remarks in europe about our military. today some new drama, and that's coming up. plus, dr. murphy was supposed to be our next surgeon general, the nra has led a fierce fight to stop that. fierce fight to stop that. the gun my journey across amer,

breaking tonight, officials now say 24 people are confirmed dead after the devastating mudslide northeast of seattle. they have just increased the numbers by about 10. at least 170 people are reportedly still missing, there have been reports of 176 people missing, they say many of those may be duplicates. this is an area where there were 49 structures within the affected area at least 25 of those were believed to be full time residences. so far now, we have 24 confirmed dead. many, many people including many children still unaccounted for. they're holding a news conference right now. let's listen. >> we are going full steam ahead, even if we just said it's a recovery operation, we're
