vehicles spotted traveling along the road. again, we could not independently vet this material, but it appears to support the intel about what is happening in the region, and the sheer number of troops, over 80,000 now far exceeds the number needed for any kind of drill. and the question is, is the russian bear waking from a two-decade slumber? ready to grab back portions of the soviet union and if so what are we to do about it. he wrote to the president voicing his concerns along with a number of other lawmakers. good of you to be here, congressman. in this letter, you say russia's war on ukraine has already started and that europe would unite behind the russian leadership if only we would demonstrate it. what would you have him do to

stop of this? >> well, we're very concerned because if you look at the number of troops that are amassing, this clearly is an invasion type force. what we have to be concerned about here is the american inaction can certainly make this a much more difficult situation. we should be telling the international community what the russians are doing, troop movements, what it looks like and also sharing the information with the ukraine. because obviously they need to prepare and their ability to with stand or even to you know, protect their people is you know, basically dependent upon our information that we have. >> we are getting disturbing language now from capitol hill. i mean, our reporter last night -- our capitol hill reporter came back with reports from those saying they cannot describe to people on capitol hill how awful this is getting. more concerned than our sources have ever seen. the lawmakers looking at the situation. i know you had a brief today

from the top nato official. and so the question is whether the united states is moving any closer now to actual boots on the ground. >> well, i think it is not really the issue of boots on the ground with respect to the ukraine. but it certainly is putting our military on high readiness, looking to the baltic states who are members of nato and subject to risk here. but also sharing the information with the ukraine -- >> i don't think anybody would have any objection to sharing information with ukraine. but it sounds like in this letter you're pushing the president to do something militarily, are you? >> well, in the letter we specifically say information-sharing. that actually would be military assistance to the ukraine. at this point they have no military advice, no ability to see over the hill. they don't know what is coming and we do. it is amazing to know there was no briefing from the pentagon to

what they're seeing is massive in russia. unfortunately, the administration is radio silent, we're left with members of congress to tell you what we're hearing as opposed to actions with this administration. >> are we going to war with russia? i don't think there is a lot of appetite for that. but is that where this is going, in your view? >> no one is predicting war with russia. but we certainly see russia at war and that needs to be acknowledged. the administration is basically ignoring it, continuing their soft narrative that they can use soft power to discuss the issue with russia instead of actually pulling together our nato allies, strengthening those with which we do have military advice, and when we go to war in iraq and afghanistan, there is a lot of discussion from our country as to where assets are,

here, no one is telling us anything with regard to russia and what they're doing. >> congressman, good to see you, thank you for joining us. we're also following the fallout tonight from a big political story. new jersey governor chris christie was cleared today of wrongdoing in the first of several investigations into studethe so-called bridgegate scandal. the report concludes that christie had no knowledge of the situation with regard to a political payback. >> what we found is that governor christie had no involvement in the decision to close these lanes and no prior knowledge of it. not a shred of evidence of it. >> critics say the fact that key players refused to cooperate with this particular investigation and the fact that it was conducted by a law office commissioned by the governor's office raises credibility questions about the report. ahead tonight in a kelly file exclusive, i'll ask the man

behind that report who you just heard there, the lawyer, for his response to the criticisms. and then, the big news. i will sit down with governor christie himself tomorrow to talk about his political plans, the possible presidential field and what is happening in the white house today. don't miss this cable news exclusive where i sit down with governor chris christie tomorrow on "the kelly file," set your dvr. and there is breaking news on the other side of the world in what we're told is the search for flight 370. two new satellite spottings, in the indian ocean, the first was back on march 16th when a u.s. commercial satellite found two large pieces about 1500 miles west of australia, two weeks later, a big piece in the southern indian ocean, and yesterday france announced its satellite snapped 122 objects floating in the area march 23rd.

and today we learned a thai satellite spotted items, and japan seeing a dozen as well. all in the same general area. that is hundreds of possible pieces they believe perhaps linked to this plane in one area. so why hasn't anything been found in the water? lieutenant colonel michael kay is a retired air force pilot and a defense adviser, good to see you michael. >> good to see you. >> so far, not a piece of actual anything, why? >> yeah, satellites, megyn, are not the silver bullet. they're an incredibly valuable tool in solving the puzzle but they're not the silver bullet. the satellite is used by the intelligence community and used by homeland security. this is probably one of the most well suited satellites to this search. it is high resolution, about 70

centimeters per pixel. however, it is not the silver bullets, there are limitations to the technology, it takes a 2d picture, not a 3-d picture, so you're only getting a sort of an over view of what you're seeing. an iceberg, we can see the tip, we know there is a lot more underneath the surface, but the weather is a nightmare for satellites. if you have any form of cloud cover, we know the weather has been inclement. we must not forget we're still looking for the hay stack, even if you have a high resolution satellite you can't look at a picture of the south indian ocean and spot potential debris. you have to zoom in to a level of detail where they can just get enough evidence to make it worthwhile. sending the poseidons, the p-3s,

we know the satellite imagery is a couple of days old. they have to do it for processing and be 100% sure the images are correct. >> what is the better solution for it? it feels like a wild goose chase, by the time we get out there if something was there before it is not gone. what is the solution, aircraft carrier? >> i mean, an aircraft carrier would be a solution in terms of endur endurance, it has two hours on top and then it has to fly back, something with the re-fuelling capability would be great. the poseidon won't get a re-fuelling capability until 2015. the p-c 3 orion, that doesn't have it, the australians does. an aircraft carrier would be

better to have a search that is enduring. but it is huge, mammoth. >> what is the solution here? the families are watching, we report it as analyst, news analysts, but hundreds of families watching it thinking oh, my god, when they say debris what are they talking about? are they talking about a loved one, a plane, items? they don't understand why a satellite can't zero in, and why the jets can't get there fast enough or the boats can't get there fast enough. >> megyn, it is a painful situation, and unfortunately no answer. if you look at the hay stack early on, it took two years to find the black boxes. and it was two years until we actually knew what really went on. at the moment we're just looking for the hay stack. it will take months and months and months. >> one other question, many people still doubt that this jet is actually in the ocean.

why didn't the emergency locater transponder going off as it was supposed to. if they say the triple 7 would be equipped with from anyone between two and ten of those, it should have gone off when it hit water. >> it is a great question, i'm so pleased you asked me that. there is a myth, they are not black boxes, honeywell who made the lt came out and stated they are not supposed to work deep under the water. they also break, if the aircraft hits the surface of the water with any sort of g-loading the y antennas break. >> that is an important answer to an important clue. mikey, good to see you. >> thank you so much. and we may get news any moment now on what the fbi found on the pilot's flight simulator. remember, the director said earlier this week that they

a subaru. . there is just absolutely no reason why anyone would be carrying a military-style weapon. and so that is the reason why i would argue that there ought to be a ban on that particular type of weapon. >> well, if there can't be a ban maybe i'll be the one to bring those weapons into the country. listen to this story. that was democratic state senator leland yee of san francisco, in just one of his moves to push for stricter gun control laws in the country, something he feels very strongly about. now, mr. yee faces up to 20 years in prison, because of charges including firearms smuggling and rocket launchers, yee was caught in an fbi sting

along with 20 others, including a gangster by the name of shrimp boy chow. if you listen to no other story, listen to this. >> and megyn, they referred to the state senator saying he was more than willing to help traffic illegal exchanges, to help with his failed run and his current run for secretary of state, a race he has now dropped out of. yee offered to help fbi agents posing as gangsters, to smuggle arms to the philippines, along with missile launchers, with yee telling the agents, people want to get whatever they want to get. do i care? no, i don't care, people need certain things. but now listen to his public stance on guns, play this.

>> whatever i can do to prevent the availability of these particular kinds of weapons, you know, i want to do that. >> yeah, the democratic state senator also sponsored gun control legislation and today the citizens committee for the right to keep and bear arms said quoting here, if these allegations are true senator yee is easily the biggest hypocrite to walk the halls of gun control, if not the united states, the nra simply called him a "scumbag." yee's attorney says he will plead not guilty, if he is found guilty he could spend 20 years in prison. >> uncle leland, that is what they call him. he is just one of several democrats caught in scandals this week.

uncle leland while railing against the guns was alleging promising to help undercover agents help obtain the guns from an international arms dealer, obtain guns, saying he could source guns from russia, i think we can get the goods but doing business with armed dealers is not for the faint of heart, he warned. is it just mr. leland, or other democrats? >> i do like the way he sounds like a mild mannered person, he is just saying people need what they need. yes, we have had not just that, which this is sort of a mind-blowing epic story outside of the politics of it. this is an amazing story, like american hustle. >> shrimp boy. >> any time you get shrimp boy you got something. but then flip over to the east coast, you get the mayor in

charlotte, gets stung by the fbi. they say that he was more than happy to take bribes from what he thought were real estate developers, you go up into rhode island, a state that has quite a history of corruption. the democratic speaker of the house has to step down because there is an investigation going on there. in pennsylvania, it is democrat on democrat violence where you have got the d.a. going after the attorney general -- >> does this mean anything? the 2014 local politics? >> it is interesting you would ask, you have kay hagen running for re-election, and the fbi gets smoked out. that is not helpful. and in pennsylvania, the embattled republican governor maybe gets a boost if there are corruption allegations on the other side.

freedom issues. and former gop senator, also a devout roman catholic. good to see you. >> thank you. >> our own white house correspondent, ed henry, talked about it was like they were not in the same meeting. >> i don't think the vatican has political aspirations. the pope is not running for anything and doesn't have any elections he is worried about. you would think the tenure was more adequately discussed than a president who went there and tried to piggyback on the popularity of the pope in america. >> that is what i wanted to ask you. what do you think the benefit was of the president asking for such a meeting and getting a meeting. >> this pope francis is more popular than any pope in recent memory. you have john the second, who was incredibly popular, but pope francis, because of his humility

and the way he lives his life, he is just really different than any previous pope. the americans really like that, i think. they like the authenticity, the hone honesty, i think it is very popular. and president obama's ratings continue to dive. and i think he saw this as an opportunity on areas that in fact the president and the church and pope francis agree on to try to get some of that popularity in his direction. >> but does that work? i mean, when you have new stories here in the united states showing the little sisters of the poor who don't want their insurer to have to cover birth control for their employee employees. i mean, they're nuns, and this is the president's legal team in court challenging them is this a means of distracting from that narrative with the roman catholics here in the united states? >> well, it is clearly what the president and his -- the report about what the meeting was about. is trying to do. it is trying to say there is

solidarity between the president and the pope on these important issues. when in fact, you know, the vatican is saying something quite different. i have to believe that the president knew that the pope was going to mention religious liberty liberty. he was going to mention the issues that are very important, life, liberty, to the pope and the president was hoping he could use his spin machine here in america to dominate the air waves. >> yeah, because some have suggested the pope is somehow progressive on the issues. >> no, no, i think you know well, because i know you read this very carefully. pope francis has not changed any doctrines of the church, what he has done and very effectively, is talk about the doctrines that divide us. what is important in the church is that god loves you. that is the answer to making your life better, having a deeper and richer faith.

no offense to the president. that is not his agenda, his agenda is trying to take some of the things the pope has said with respect to income inequality, with respect to capitalism and try to tie into that. it looks to me like the vatican was having none of it. >> now, speaking of the presidency, that was a job you sought not so long ago and was the leader in the pack. 2016 is just around the corner, any thought about throwing your hat in the ring? >> well, i'm focused on 2014, we have a chance to pick up senate seats and solidify the majority in the house. i was in iowa, maybe that will give you some idea of what i was doing. >> are you in or not? >> there was a 2014 election, number two, this is a very personal decision and i'm not going to make any decision about this until frankly i have to. and a lot of things will go into

breaking tonight, a congressional source telling "the kelly file" that the fbi has hit a dead end in its search of the simulator taken from the pilot of flight 370. the "the new york times" reported the same thing earlier today. we made some calls and at least one congressional source confirmed that news. there is new debate among the aviation analysts about the report that this plane had contact with another jetliner after its last transmission to air traffic control. mike boyd is a fox news aviation analyst, and kathleen banks is a commercial pilot and fox news analyst. let me ask you about this, it came out last week or earlier and it was basically another airplane that i think was asked to make contact with flight 370.

why do you have renewed interest in this? >> well, i've always had interest in this, it is interesting it only came out one day after the disappearance of the malaysian airliner. and it could be key, the last transmission we had from the co-pilot was at 1:19 a.m. and the last communication they had from a triple 7, they were about 30 minutes ahead via japan. they were asked if they could try to reach the flight. here is the interesting part, what they said is they heard a carrier signal back. that means that somebody in the cockpit pressed a microphone. they also said they heard voices but couldn't understand what they were hearing, there was noise and mumbling. that means 11 minutes after the last known transmission that we actually have a transmission, somebody in the cockpit tried to do something.

they believe there was some type of communication. if the pilot worked with malaysian air and we think he did, he would have known the captain for many, many years, and so maybe he was able to say it was not his voice, ergo, it probably was the co-pilot. >> and all eyes are on the pilots as investigators continue to tell us they don't believe anybody on board based on the investigations that they have done had the flying ability that those two men did. and it would have to be considerable ability, would it not, mike boyd? >> absolutely, there was a stor done it. of course they both could have done it. it was not somebody who broke in the cockpit door, i don't think. so whatever happened took place in the cockpit by one of the two gentlemen in the cockpit. >> okay, but now that the fbi is reportedly coming up empty on the search of the captain's flight simulator, i mean, where do we go from here, john,

because he was the one everybody was looking at. you know, the captain. there had been reports he was getting a divorce. he was having problems with his girlfriend. well, so what? that means with a lot of people. that doesn't mean you wind up killing 238 people and winding up with a stolen jet. >> absolutely, megyn, just because they're done with the simulator part of it doesn't mean they're done with the computer. in fact, i read a report that said they still have work to be done on the computer. they could be looking at websites, e-mails, a lot of things. in addition to that, early on they thought it was the co-pilot early on saying good night. what they were allowed to do was take known samples of each of the pilots and plot those, the plots on a spectograph and

actually see where the pilots could be included or excluded as a speaker. >> let me ask you this, the son of the pilot came out and said i read all the speculation on line. i knew him better. and basically providing a personal character reference for his father. in the end it comes down to large part about the people who knew these men best, and their assessments, they were not capable of it. >> keep in mind, the guy worked for them for over 30 years, i can see why the family would come out and say this is nonsense, i understand that. it doesn't mean that people can't change. we don't want to rule that out. everything moving forward, knowing what we know now from the simulator, that moves us forward. the family would naturally say that, i can understand that. it is not necessarily hard information we can go forward with. >> and there is one report that

the captain had become increasingly disillusioned with malaysia airlines. he was not as happy as he once was. >> megyn i have to say that if every airline pilot was unhappy with the company policies, and things that happen with the airlines, there wouldn't be too many pilots that would be safe to fly with. >> thank you. also tonight, a kelly file investigation on the wealthy minnesota couple who was accused of collecting over 160,000 bucks in welfare benefits all while living in a $1.2 million yacht in florida. well, that is an interesting deal. >> well, yes, very interesting, the story takes us to hennepin county, minnesota, where prosecutor mark freeman has charged this couple of defrauding the government, they are accused of stealing

160,000-plus in welfare dollars, while they lived in florida on this yacht. and i should say that the yacht was eventually taken away by the coast guard due to a lack of payment. the prosecutor is calling this couple con men of the best kind, he called them film-flamers during a press conference. this all comes from them submitting repeatedly fraudulent documents to the system and getting away with it. >> how do they get away with having a $1.2 million yacht with recove welfare benefits. >> well, that is the key point, they have not filed tax returns for the past couple of years, it is very difficult to see where their income is coming from. and as the prosecutor described these people seem to be

counseliconning people out of their money, and living here in florida, they were able to defraud the minnesota government out of welfare payments but also gathered payments in florida, all of their medical payments were paid for through the minnesota medical system supposed to be reserved for the poor. and yet here we are later with the couple who was living a very luxurious life-style on the run. a warrant has been put out for his arrest, and they believe the couple has left the country to a warmer place, the prosecutor said. >> they're on the lam, they have been posing as scottish aristocrats, which i suppose is not hard to do if you're on a yacht, thank you. and coming up, which headlines do you think got more attention in the mainstream

private health care plans through healthcare.gov. although no word still on how many of those people actually paid nor how many had insurance prior to this law going into effect in the first place, while this so-called milestone is getting play in the media, the administration announced yet another delay in its program. and some people in the mainstream media seem to have missed this fact. brent, what did you find? >> we're getting good numbers here. megyn, listen to this. obamacare, one could argue when you nationalize 1/6 of the american economy, you're talking about the biggest policy since possibly the new deal. so what kind of coverage did they give this domestic policy issue in our lifetime? between january 1st and march 24th, we looked at every single

story on abc and cbs, believe it or not, the total amount of time devoted to abc, nbc, and cbs to this story was .72% of their air time, less than 3/4 of the percent of air time reporting on the news was the result of obamacare. >> they were probably busy reporting on the power grabs that had become so controversial. >> exactly, they were too busy reporting on benghazi. the numbers just get even better. we looked at between january and march 24th. that is 83 nights. in 82 night's time, cbs gave that story 19 minutes. abc gave the story seven minutes, nbc news has given coverage of obamacare and all the fiascos five minutes air time since january 1st, out of 83 nights in coverage. this is what you call a cover-up

when you don't want to report it. >> it sounds like abc news fears the worst. do you have an opinion of the three networks which one you feel is the most fair and which one you feel is the least fair? >> well, i don't think any of them are being fair at all. cbs is the least awful, but they're still awful. nbc is clearly the worst, it is their little hit parade on msnbc. you put these two together and they're just awful. think about this, february 8th. cbs news did something just awful, they did a story about a family hurt by obamacare, now, megyn, there are a reported 5 million people hurt by losing their insurance because of obamacare. and by the way, that is not any of the people reported in the 6 million figure, but the 5 million people have lost their story. on february 8th, cbs did a story about a family who had lost

critics, joining me now in a kelly file discussion, the attorney who led the investigatio investigation. good to see you. >> good to be here. >> the legislative panel said that the lawyers hired to investigate the governor's office will not be the final word on this. they questioned your obje objectivity. your thoughts on this. >> we produced more than 2,000 documents and produced to the legislative committee over 50,000 pages of documents. there is not a shred of evidence that governor christie knew anything about this lane realignment decision before it happened. not a shred. >> and yet, one of the criticisms against you was that you and your law firm were tied in with the governor and had a

bias. a pre conceived notion. how long have you known him? >> i met governor chris christie the day he hired me. >> but you were friends with rudy giuliani, did he ever talk to you about this? >> rudy giuliani and i have not had extended conversations about this. i was honored to serve on his administration, but as rudy knows, i'm a registered democrat. >> did you go into this with an open mind? >> completely, you have to understand it. it serves no one's interest, not my office, the governor's office or the people of the state of new jersey to do anything other than to try to get to the truth. where are the other investigations coming? we believe we've gotten to the truth.e judged by whether we got it right. we believe we got it right. >> you say besides bridget anne

kelly, the one who sent the e-mail saying "time for traffic problems in fort lee," you found no evidence that anybody else in the governor's office knew about this idea. but that is not the same way of saying no one knew about it in advance. you found no evidence of it. but the critics say that doesn't mean anything because you couldn't talk to david wildstein, or bridget anne kelly. >> here is the rub, certain people who are the focus of the investigation like kelly, like wildstein, they have taken their fifth amendment. they're not talking to me or the legislator or the u.s. attorney. >> did you get to see their e-mails? >> but, we saw many of their e-mails and we saw the private e-mails and texts of the governor. lieutenant governor, his current -- >> did he hand over his iphone to you? >> absolutely. and let me tell you this, megyn, the fact of the matter is we look at the hard evidence. we look to see what the documents show. and the hard evidence shows

studethe governor had no role in this whatsoever, and knew nothing about it. >> the other thing i want fto gt to, the one piece of the report that is not good for governor christie, his aide, david wildstein claims he did inform the governor about the lane closures at a september 11th memorial. and i know the governor says he doesn't remember it, but one of the criticisms is they did tell the governor biabout it. >> i understand that is both questionable and not significant. that is what wildstein claimed at a time when he knew he was going to have to resign. and wildstein claiming he mentioned a traffic issue would not have been the meaningful event to the governor. it is about the ulterior motive. there is no allegation that anybody said anything about an
