♪ ♪ [ applause ] i want to welcome you to justice. this is a fox news alert. we're now going to a press conference in the state of washington on the mudslide that occurred a week ago. >> the access road opened, it connects the east and the west sides of the area. it's being used toy crews in the field and i want to emphasize this that is only open to emergency personnel and not to the general public. in terms of the weather today, the crews faced periods of extremely heavy rain. there are engineers who are posted keeping a lookout to watch for anything coming off the landslide area and that

person is constant contact with our teams in the field. the rain saturated a lot of the soil in the area and caused ponding in some of the search area which slowed down the searching as crews had to dewater the areas before they could access them and continue to search. the snohomish river -- due to the heavy rain and caused localized flooding on state route 30 on the darington side. as far as the broader operation, today marks one week since the slide occurred. at 10:37 a.m., we observed a moment of silence to remember and honor the communities shall the families and the victims of the slide. as we discussed last night, we've streamlined our process for identifying the number of victims and the medical examiner has given us an updated number. they have identified one more victim, bringing the total of confirmed fatalities to 18. and we also know that rescuers discovered one additional victim in the debris field.

that victim has not yet been identified. we want to make clear to due to the destructive nature of the slide, they're not making full recoveries. often, it's partial recoveries. that's a challenge to the m.e.'s office as they try to identify these victims. as for the list of unaccounted for, that number has fallen to 30. we expected the number to drop in part due to a combination of people registering as safe and well and cross referencing the list with confirmed identities of victims at the m.e.'s office. field crews are now collecting items and memorabilia from the debris field and transporting them to locations where they can be decontaminated. >> all right. we're going to have more on the mudslide at the bottom of the hour with dominick denatali. first to my open. sometimes the perception of

power is more important than power itself. as our president continues to fumble on the stage, he single-handedly is bringing out the decline of united states -- something that impacts you from your pocketbook to your safety. this decline is ongoing since barack obama took office. starting with the red lines, the finger wagging, removing economic sanctions against iran allowing it to continue its nuclear buildup relying on russian president putin to broker a deal for syria's removal of chemical weapons just to save face after announcing that the u.s. planned to attack syria. and not sending reinforcements to protect your men in benghazi. unilaterally removing the missile defense system that protects eastern europe from russia. all the while our president trumpeting the reduction of our military on the world stage. not only are we now perceived as

weak, our enemies emboldened. impacting your safety and mine. with this loss of power or the perception of that loss those manufacturing jobs, trade alliances and the allies standing with us, weakness encourages aggression. putin's progression of power is so strong, he took crimea with virtually no one hurt or killed. our president threatens cost, claiming to speak for the international community except the international community wasn't with the president. the u.n., nato, the e.u., no one with an initial was with him. revoked visas to disney world and withdraws mr. putin's invitation to tea former known as the g8. putin being the disinvited, odd man out. mr. president while you're moving teacups, putin is moving soldiers and tanks.

today 80,000 russian soldiers on the ukraine border. now, you come out and say there will be more cost if putin take more than crimea. since putin took crimea already, you didn't mean what you said and you didn't say what you meant so why should he worry now? while you've got a pen and a phone running around wagging your finger, putin is running around with tanks and 80,000 soldiers. you brag about reducing the united states military. he increases russia's military by almost 79%. putin's influence in europe and the middle east increases. russia is on its way to becoming the dominant world power and you say this? >> i think the strong condemnation that it's received from countries around the world indicates that the grade of which russia is on the wrong side of history on this. >> a regional power, weak, really? you engaged him to broker that

syria deal after you didn't have the fortitude to follow through on your threat, you're relying on russia, the kgb truth telling thaits going to stop chemical weapons. don't we rely on russia to get us into space now that we've shut down our own program? take a listen to this. >> russia is a regional power that is threatening some of its immediate neighbors not out of strength but out of weakness. >> you know, who is looking like they're on the wrong side of history? you're not listening to history. and he who doesn't learn from history is destined to repeat it. ronald reagan was a strong president. he trusted, but he verified. he ended the cold war. you come in and take down the missile defense system in eastern europe with nothing in

return. why are you doing this? do you even know who our enemies are? do you know that your obligation is to protect us and protect our economy? and you say russia is a regional power? with all due respect, mr. president, putin is a pig. but he's been pitch slapping you since the edward snowden mess. peeking speaking of that, traveling with the secret service -- do you think putin's men would dare do something like that? i suspect that they probably can handle their stole i better. you draw lines, mr. president. putin crosses them. you play make believe war games, he sends in the troops. you sit around moving teacups, he moves the armored tanks. and you want to poke a tiger, this tiger in the eye, the perception of power, mr. president, is as strong as power

itself. and that's my opening statement. with me former adviser to the uk, defense ministry and retired military pilot, michael kay. all right, michael, all this talk about sanctions -- >> hi judge. >> how are you tonight? >> i'm good. how are you? >> all this talk about sanctions, are they going to make a difference as it relates to putin going into the ukraine to get to crimea? >> i think your opening statement was spot-on. perception of power. that's been driving putin's behavior over the last couple of months. very different. east ukraine is different to crimea in terms of putin's intended lan grab. why? this is the crimea region handed back by crew chief. it's all about the naval base allowing putin to protect naval power all over the world.

>> okay. >> as we know, he's got this back. however, what he needs to do now is supply crimea. he needs to make sure that crimea gets the energy resources, the utilities. >> that's what these are? these are the power lines, right? >> that's are the natural gas pipelines that we see. >> since russia -- because this is in front of the water here. russia can't -- is not connected to crimea. to use the land lines, he's got to take eastern ukraine? >> this is what the conversation at the moment is all about. we know that what he's done, positioned all the troops on that border. however, we also know yesterday the putin picked up the phone to obama. why did he do that? it's a short term strategy based on power to give him as much leverage as possible when he's picking up the phone to obama. he's trying to say -- >> he's trying to leverage. i'm with you. why put will 0,000 troops here.

it's not like he needs to scare anybody. he can get in. east ukraine can't fight with him? >> no. they don't have the forces to fight with obama. there's no military solution to this. what he's doing, judge, he's posturing, he's putting all of his power here. when he picks up the phone, he's going to talk to obama about these lines of communication. what he wants to do is he's going to have a conversation with obama on the line and say, look, i'll stand these guys down if you you protect my lines of communication. >> can he afford to take care of the 80,000 people? the russian economy is nowhere near the united states economy. >> that's a brilliant point. russia's economy is tanking at the moment. gdp in 2013 is 1.5% down from 3.2% in 2012. equities are tanking, bonds are soaring. the ruble's been sold off. he's invested in natural oil and gas and not doing economic reform. you're spot on. he cannot sustain this

economically. >> but he's got the perception of power, which is his leverage to get eastern ukraine, to get all of these lines into crimea, which then takes him into the sea? >> yes. all he's done, he's exploited a few loopholes. you you know about this, judge. he's exploited those and done it very well. he's done this through a referendum. >> was that a legitimate referendum? >> in the eyes of the international community, no. but the international community couldn't do anything about it. >> why didn't they? >> it's a different story. >> where is nato, the u.n.? >> let's go to the next map. okay. so this is all of the nato countries. this is russia. ukraine, moldova, bella reese. it's a part of russia. ukraine and moldova is the threat. the reason for that, they're having conversations with the e.u. about the economic side. what happens is that as those

♪ 80,000 well-armed troops at ukraine's border. my next guest says putin is holding the cards and president obama is really dumb or getting really dumb advice. steven cohen from princeton university joins me now. good evening, professor. >> i don't say obama is dumb. you already scared me so badly with your opening statement. >> do you agree or disagree with it? >> i agree with half of it. the reason i disagree with half of it is i was taught when i was a kid, there's two sides two every story. you gave one side. >> there's two sides. it's not always in the middle. >> that's true. but we are closer to war with russia, you're not old enough to remember this, than we've been since the cuban missile crisis in 1962. >> why? >> because we've got mobilization of troops on one side and we're moving nato

troops around western ukraine, poland, romania. that's not good. putin into ukraine, nato troops into western ukraine, you've got the cuban missile crisis. where are we at? at a situation where the russians made a proposal. whether we're taking it seriously, what obama is saying isn't relevant to the situation. here's the funny thing and where you come in. at bottom there are legal issues involved here. we say to putin, you invaded crimea. i didn't. i had a contract that i could have 25,000 troops there. you say you had an illegal referendum. he says it's not illegal, you do it all the time. then you say you annexed crimea, you said you annexed kosovo. they both went to law school, settle this like this. is have them on your show, putin and obama, they don't need lawyers, you're the judge. but unlike your opening statement, you listen to both

sides. >> absolutely. here's the question. is the perception of power on putin's side and why did putin pick up the phone? >> because he thinks we are in a crisis -- the one thing you left out is you've got tails wagging the dog inside ukraine. what's going on in ukraine is scary. what's going on could provoke a war we don't want. so -- >> a third world war. >> a horrible war. >> if we get involved and europe has to get involved as well, i assume. >> yes. europe would be involved. here's the point. why did putin call? because he's alarmed at the crisis. it's reached the point where there's not a way out. here's your problem. you're the judge. putin thinks obama and europe created the crisis. obama and europe and the judge think putin created the crisis. but pu worried that it's getting out of control and he should be if you listen to what people are saying. >> but isn't putin the man who -- kgb, intel, doesn't he

understand that his country's economy is in the tank and that he absolutely needs all of this, i mean, if this was a long thought-out plan that -- if he were going to survive, he needed that. >> don't listen to that. do you remember the sochi olympics? do you remember how pleased he was that there was no terrorism. he was basking in the glory and suddenly this crisis. why would he want this crisis? it's spoiled everything he had spent five years and $50 billion achieving. this crisis was triggered by something else. that's another story. but he doesn't want this crisis and he wants it over now. >> okay. but you said that putin bashing in the media is an obstacle to our national security. >> well, listen to your opening statement. >> why is that? >> because you gave one side of the story. but the point is, we say there are going to be costs and he takes crimea anyway and there are no costs. the international community wasn't with us. >> i agree with that.

into the investigation on the investigation team so now you've got the people who built the airplane and know it best and they're on the scene. so this is all coming together and it's being refined. >> okay. well, i only -- i feel for the families and you know for the world. i mean at large. the concern is that how can this thing happen and we can't figure it out at this point? how does a plane disappear from the face of the earth? let's talk about the bottom of the ocean, captain. >> okay. >> i've heard it described in many ways that there's almost volcanic ridges and valleys. >> yeah. >> can the bottom of the ocean swallow up a plane? >> it can. the terrain can mask it and everything. here's the other thing, judge. this is a real fact. we know about the surface of mars than we do about what's under our own oceans. >> that's frightening enough. let's go to the black box now. i think this is day 22, i think. eight days left on the black box. then what? >> well, the battery is specked

for 30 days. we hope it's better than specked and maybe we get an extra five to ten days out of it. the battery could be worse than speck and it could be already dead. >> what about the fact, captain, i've heard it said that the tape might have been taped over because the plane just kept flying for another x number of hours. >> there are two recorders in the aircraft, judge. one is the cockpit voice recorder, which is on a two, two and a half hour loop and records over itself. the other is the flight data recorder with the pinger on it. that data recorder records for weeks. the cockpit voice recorder is an event recorder, the cockpit flight data recorder is the one that we're really after because that's going to tell us what the airplane was doing, where it was going and everything about the aircraft history. all right. i think it was maybe two weeks ago, captain, you were on the show and we had a commander, i

100 after shocks following friday's 5.1 magnitude quake in the los angeles area. it broke gas mains and drove dozens of people from their homes, biggest after shock has been a 4.1 about 2:30 saturday afternoon. now back to justice with judge jeanine. faulkner. now, justice. new developments in the massive and deadly mudslide in washington state. dominick denatali has the latest in washington. >> good evening. why haven't they released the names of the missing? >> reporter: you know, this is a persistent problem all week, judge. there's one reason for it. one of the superior court judges was telling me that the authorities have decided to go with the hip a act prevents them or they believe does from giving them personal details with regard to anybody's medical

conditions as a way really of shielding the families from any major intrusion. it's a very close community here and they don't want the -- also a few miles from where i stand. from being actually haranged by the media. the media are trying to cooperate very much with the local authorities. but it's a close community and they're suffering very badly. very difficult conditions at the site of the mudslide today. we had an update from the media. you heard at the top of the show, one body has been found today. one other has been formally identified. it's a very rigorous process. they actually go through you it before they formally identify these people being found at the site there. had just some clarification, 90 people still missing. people stated it was unknown. there's now 30 people who is unknown. very different from those actually missing. because the 9 o missing were

residents in the town of oso, which accounts for about half the people in the community. tough heavy going. the rainmaking things very awkward, judge. what it's done is actually loosened up a lot of slurry on top of the mud which is already difficult for the rescue workers to get through. so it's been a danger to those workers and at one point, some of the workers had to be brought out because they were worried it would put them at danger. very difficult. tomorrow, more rain expected much it's going to be challenging conditions yet again. the authorities do expect to give us a substantial rise in the number of confirmed dead. but so far probably due to the conditions and actually processing the bodies that they have -- that they bring out is proving to be, challenging and once they're able to catch up with that, they'll have better numbers. >> dominic di natali.

such a hindrance to the investigation. thank you. companies like hobby lobby have to provide contraception despite religious beliefs? with me chief counsel, jay snek low. good evening, jay. >> hey, judge. >> a lot at stake here. although this court has affirmed the original mandate, the justices at this time seemed more skeptical. your thoughts? >> well, i think they were skeptical for a good reason. the central portion of the argument is going to be whether a corporation has the right to exercise a freedom of religion issue. the courts recognize that corporations have free speech right. can the owners of a privately owned company put forward their particular viewpoints in their employment policies? and i think the answer to that, unless absent and compelling governmental interest, the answer should be yes. it looked like the court -- it's hard to -- i've argued enough of

these to know. it's very hard to predict where the court is going to be. based on what we heard in the oral arguments and the way most of the lower courts have gone, including the courts of appeal, they have recognized the corporation's right to do this. they're only opting out of covering for contraceptive devices or medications. they provide for literally a hundred others. some are catholic companies, other companies that have particular views. that's the position they're taking. this should not be a really closed case, quite frankly, judge. >> before the decision, jay, came down on the individual mandate, we started hearing and reading about how political the supreme court was. my take, i thought it was a threat to intimidate the justices and, in fact, justice roberts changed his position on the individual mandate and so the vote was 5-4 to sustain that. what's your take on that? >> like, i disagree with john

roberts, the chief justice on that. g time. i'm a friend of his. i disagree with his opinion. but i don't think it was political pressure. i think he calls it -- he said he was going to be an umpire. that's the way he saw it. i thought it was incorrect. i would have gone the other way as justice kennedy did. the reality is best served by a supreme court in the united states that's not politically-based. that's why the founders gave life tenure. when the court rules against the position of advocating, i still respect the institution and i know you do. >> we do. >> even when they get it wrong -- >> that's not the issue, jay. the issue is for the first time i was reading in the newspaper and this buzz about it's really political and the supreme court as an institution couldn't afford to be labelled as political. you know, i almost thought that there was an intimidation factor. one quick question before i go. is in about the first amendment right of religious freedom

being -- by the obama administration? >> that's really -- at the end of the day, that's what the case is about. can the administration through its laws and policies discriminate against, in this case, the free exercise rights of these privately held businesses. you said it right. it really -- contraceptives, abortion, whatever you take your position on that, the idea is can the administration compel a viewpoint that the owners of the business disagree with. i don't think they can. but that's what this is. >> hope afully decision in june. thanks for being with us. >> yep. >> pope francis and vatican officials told president obama they were concerned about religious freedom in the united states. was this the pope's way of criticizing obamacare? with me now, father gerald murray. thanks for being with us, father. you know, the meeting between the president and pope francis, i mean, we're hearing two different versions. one from the vatican and one from the white house. which do you believe? >> well, i believe that the

vatican made it very clear, the pope himself and then his secretary of state, cardinal per lien. they were concerned about conscience rights and the right to life. the idea that president obama, as he said, he admires the pope and says he's like to continue his dialog, discussion with the u.s. bishops. well, if he admires the pope, he should go to court. which is precisely what we have. >> do you think it's hypocritical for the president to meet with the pope the same weakest fighting hobby lobby in the united states supreme court? >> well, let's just say it's inconsistent to go to rome and say i admire you, but the things you you teach, i'm going to try to suppress. which are the things the lawyer just said. this is about religion being suppressed by government. >> what about the fact that the president was all smiles with the pope and yet, i understand there was a meeting with

cardinal dolan and there was a promisor a claim that religious freedom wouldn't be affected by obama care? >> this is exactly what it gets back to. when cardinal dolan was the head of the bishop's conference, he met with the president, there was a meeting in the white house and told him you have nothing to worry about, religious concerns will be dealt with. he didn't do t he changed it like your policy, you can keep it. apparently if you like your religion, i'm going to try and stop you and you have to go to court to protect yourself. inconsist ten is i is the word i'd use. it's troubling. religious freedom is not a minor issues. it's a foundational principle of the country. they did not come here so a president could stand up and sape you believe this, you can't do that. no. we believe what we believe and we do it accordingly because that's our right. >> what do you think the supreme court will do? >> as an observer, i say they will decide on religious freedom. this is fundamental.

we're in -- where they can hand you a script and say you can only do what we tell you, we're not in the same country that was founded. >> clearly. parishioners, what are they saying about their religious freedom in jeopardy? do you recognize this as a huge issue for the catholic church. >> we pray for it almost every sunday in our petitions. certainly they recognize cardinal dolan, our bishop in new york had to go to court. cardinal dolan didn't want to go to court. he wanted the administration to back off. that's the interesting thing. president obama can call up the secretary of health and human services and say eliminate that provision. this isn't in the law. this is a regulation making the nuns. why would you go against catholic nuns? catholic nuns are trying to serve christ. >> what is he thinking? i mean, the little sisters of the poor, dragging them to the united states supreme court. >> it's not a good idea. unfortunately, it reveals a

vision for the country which religion isn't something that has to be controlled by the government. really, behind this is an idea, catholic teaching about abortion and contraception is irrational. i would dispute that. i think it's rational. i'll explain it if you want to hear it sometime. to take someone and say the beliefs don't hold, you have to go to court if you want us to stop. no, this is not american. this is not how this country was founded. >> we'll learn by hopefully june. always good to have you here, father murray. >> thank you, judge. >> thank you, judge. there's 6 million enroll ♪ ♪

6 million people signed up for obamacare. did a miracle happen when the president was at the vatican? >> numbers don't lie, right? they do when they come from this crowd. hear a breakdown, fact from fiction, the author of beating obamacare. betsy mccoy. do you believe the 6 million number? >> there's a big difference between selected, the administration said 6 million people selected a plan. big difference between selecting and paying. and although the secretary of broken promises, kathleen sebelius, won't tell us how many people have actually paid, the data we have from state exchanges indicates that in some of those states, a third haven't

paid. and on the federal exchange as many as 20% haven't paid. >> we don't know how many of these alleged 6 million had insurance or how many were forced into obamacare. >> well, in fact, only a very small portion were uninsured. mckinzy and company suggest the that 23% were uninsured. what do we have bottom line, judge. net net. we have absolutely no increase in the number of people with private health insurance. it appears from all this data that the hardship millions have gone through and the billions, many billions spent on the stra startup and there's no net improvement. it's a wash between who has gained insurance. >> can you prove that, betsy? >> i'm just looking at the numbers. the fact is somewhere between 5 and 6 million people have lost their plans, right? many have been forced on to the exchange to sign up for plans they really don't want, but they have no alternative. we know that 6 million have
