>> elderberries. >> asparagus increases the blood flow down there. avocado, you're ready to go. sunday house call, thanks for joining us. see you next sunday. i'm shan nah breen this is a fox news alert. more than a week after a massive mudslide wiped out a community, the grim recovery effort goes on one shovel at a time. the death toll is at 18 and expected to rise. a small glimmer of good news, the number of missing has dramatically dropped from 90 to 30. the latest news conference is set to begin at any moment. we'll take you there live. first let's go to dominic live in arlington, washington. >> reporter: shannon, yes, we have services remembering the dead who were claimed just over a week ago at three services in

the communities affected here. also chapel holding main service for the people directly affected by the mudslide. here in arlington we have one service going on. over in darrington on the east side, the media are being asked to stay away. the rescue effort continue, however. they're calling it a rescue effort because people are holding out hope that they may still perhaps find someone alive. day by day that's looking less likely. people they're saying here, they're hoping for a miracle. >> these searchers, both professional and volunteer are performing herculean task right now, working beyond the point of exhaustion. we intend to exhaust every avenue looking for that miracle. >> reporter: at the moment we

are hearing that the body count -- sorry -- the death toll may rise again. there was one body found yesterday. that has not been identified. the number of bodies that have been uncovered is 28. we do know that 18 of those have been identified, but their idea case process is extremely difficult as officials have been explaining to us. in the press briefing due to take place over in darrington today, we may have some more idea just precisely what they may have uncovered either late yesterday or early this morning. that can come at any moment. we'll hopefully be able to bring that to you at some point. the job today will be slightly easier. less rain expected today. yesterday we have about an inof of rain, making it difficult for the rescuers to get across. not only is the mud very thick, hen the mud runs off the top, that's making it harder for the walkers to wade through and gain

points in the debris field they haven't reached yet. it's also giving the rescue workers hypothermia and making it all the more challenging to get through. the recovery continues, shannon, back to you. >> dominic, thank you very much. a new ship is joining the search for malaysia airlines flight 370. australian officials are sending out a warship with a black box detector. the battery of the locater beacon is expected to run out in about ten days. so far the search has not turned up anything, no debris connected directly to the missing general lighter. meanwhile distraught relatives of chinese passengers are demanding answers from malaysian officials. some of the relatives held a protest, accusing malaysian officials are bungling the investigation and holding back

key information. ahead of the obamacare enrollment deadline tomorrow, the white ing that more than 6 million people have signed up, but what does that really mean? what do those numbers really mean? steve san tan any is here with the latest. tomorrow's deadline will be a milestone for a troubled health care system and it's raising questions about how the administration is counting the enrollees. it was the president's biggest achievement in office, but the affordable care act triggered a firestorm of controversy. while the administration claims at least 6 million have signed up so far, those figures do not break down how many people were forced to change health care plans, how many have enrolled but not paid and how many are those crucial younger americans. sol suggest these figures are being withheld for political reasons. >> i think they're cooking the

books on this. people want to know the answers to that. we also want to know, once all this is said and done, what kind of insurance will those people actually have? will they be able to keep the doctor they want. how much more is it going to cost them. we know some of the best cancer hospitals in the country want very little to do with people that buy this insurance on the obamacare exchanges. >> the white house had a target of 7 million people to sign up by tomorrow's deadline, and one health care ally says the administration is getting very close to reaching that goal. >> i checked the numbers, it's 6,553,000, 6.5 million in the last few days. number two, the president of wellpointe said a couple weeks ago that the signups are getting younger by the day. in other words, younger people, not surprisingly, are the last people to sign up. >> in the meantime the white house says many who have begun the process of signing up but

couldn't finish for whatever reason will have extra time to do that. back to you. >> all right, steve. thank you very much. democrats call it a partisan investigation into the deadly benghazi attack. republicans are pressing forward promising to find out what military commanders did or did not tell forces to do during the chaotic hours after the initial attack. joining me georgia congressman republican doug collins. thank you for joining us today. >> glad to be with you. >> you know democrats on the committee are pushing back and doing it very loudly and voeblly because they think you've overstepped the lines. we'll have to hold one conference. the press conference at the mudslide in washington is about to begin.

>> i'm the lead pio on the east side of the slide. i do have a couple of updates for you today. from an operational perspective we have a service road officially open connecting the east and west side of the slide and that's used only for emergency personnel. as you know, we have had quite a bit of rain over the last two days. and that has created a very wet environment for search efforts. we do have engineers watching for any material that is sluffing off of the landslide area and they're coordinating with teams in the feel. the stillaguamish river has risen, causing flooding of sr 530 on the darrington side. many of you had the opportunity to go to the slide field yesterday and see some of those conditions firsthand.

we have around 125 volunteers and search and rescue out today. in total, as of march 30th we have roughly 620 people working on this incident from local, state and federal agencies on both sides of the slide. that includes washington army and air guard members. >> that's the total figure for today? >> the total figure for the entire slide area, 620 as of march 30th. >> [ inaudible ]. >> let me answer questions after. we also have a number of volunteers that are on the slide field as memento collection crews. that is a very important thing to this community, to collect the personal belong innings and mementos of families impacted by

the slide. those mementos go through a decontamination process and are securely stored so families can be reunited with some of their belongings. i also wanted to note a number of you were able to join us yesterday at bluegrass grounds to meet one of the canine dog teams. >> we've been listening for any updates, any news out of that mudslide in washington. 18 confirmed deaths so far. we've heard the number of missing has been dialed way back as they've identified and found people who were on that list potentially. 90 were reported missing. now they're down to 30. if we get more news and updates on what they're doing there. as you heard, some 620 people have been working that site since the first signs of the mudslide and they continue to search for any possible survivors. we'll keep you updated as we know more there. now back to our congressman doug collins. thank you for sticking around with us.

we appreciate your time today. we're talking benghazi. i want to read a bit of a letter that says to date the committee's investigation has been characterized by wild and unsubstantiated political accusations. he's basically said republicans are using this as a part san witch hunt. some thing it's being used to damage hillary clinton's 2016 prospects. what say you about what the committee will do or not do moving forward on benghazi? >> i think one of the -- first of all, our prayers are with those in washington state. i want to read what you read of elijah cummings. if they're tied of doing oversight, it's time to turn in their card. it's exactly what we're supposed to be doing. it's not about partisan politics or about the witch hunt. this is about people. there are four dead americans, especially in my district and in across the country are wanting

answers. the partisanship is coming from them making wild accusations on who is being attacked. whoever had a part in this, needs to answer for what happened in benghazi. that's what this investigation is about. if the democrats on the oversight and government reform committee are tired of doing their job, they need to turn in their voting cards and let someone else do it. we need to continue to investigate about four dead americans and what the future looks like for our folks serving overseas. >> we know the senate is going to have a hearing this week that will involve former acting cia direct mike morrell. we know there are numerous different investigations proceeding. what's next for you on the house oversight committee regarding bengha benghazi? >> we're still looking for information. and the investigation from our committee staff and members are looking to still interview more of the witnesses who were on the ground or involved in that, some have not been ready fourth coming and the administration has been dragging their feet in doing so.

we want to make sure this investigation is properly done. the only way we can do that is have the information given to our committees. and we'll continue to bring forth people to talk about that and making sure this is what needs to happen. this is about people and they never can take that away from this investigation. it's about congress doing what it's supposed to be doing. >> another very active investigation that you've had going on for quite some time and into the irs, questions about it targeting tax-exempt groups. l lois lerner has taken the fifth. there are questions about whether the committee may hold her in contempt. ranking member congressman elijah cummings says errors have been made procedurally and it's not possible for the committee to hold her in contempt. are you going to get the answers you're seeking from lois lerner? >> it's time for her to be held in contempt. the legislative council has said

we can move forward. they need to make this is a priority. when you have an agency that is supposed to do their job and they've been found looking into groups that they shouldn't be looking into. we found this overall and from their own admission, it's time we found that out. it's time for ms. learner's e-mails to be released. there was a discussion of all subpoenas and there seemed to be a question on what does all mean? it means give us everything we've asked for. for lois lerner to plead the fifth and come in and say she's done nothing wrong and gone on to say there's nothing she has done, that's not being honest. she wants to have her cake and eat it, too. that's not allowable when we're looking into an investigation in which people are been targeted. >> we know the irs issue and benghazi are far from completed. we appreciate your time. >> thank you so much. we developed the infrastructure. now many say president obama is giving up control of the internet to an international

body. a majority of americans are against that, 66% saying it's a bad idea. some going further calling it dangerous. >> the obama administration argues that this is necessary because the internet now exists under the control of one government and that's dangerous. there's some logic to that, isn't there? >> i don't trust any other government, the chinas of the world, the russias of the world to control that which they seek to not have available even to their own populations. i don't want america subject to others who are not as free and open as we are. >> you can learn more about the president's plan on a fox news special called "surrendering america" hosted by bret baier. a federal judge has barred commissioners from prayers in their meetings. one commissioner is pushing back saying she's willing to go to jail for her beliefs.

t house and senate have passed similar measures to provide aid to ukraine in the wake of russia's annexation of crimea. while there was bipartisan agreement ton bottom line, there was partisan wrangling in the senate over using the bill to reform the international monetary fund. republicans including senator ted cruz pushed back and were able to get those reforms they believed would weaken the u.s. on the international stage stripped out of the bill. i spoke with him about that and much more. >> it's an extraordinary challenge and very, very

dangerous. putin's aggressiveness is a direct result of president obama's weakness and the withdraw of american leadership from the world. for five years america has led from behind. and when america steps back from leadership in the world into that vacuum, we've seen nations like russia, iran, china step in and that makes the world a much more dangerous place. this past week was an important victory for conservatives. it was an important victory for americans. unfortunately in the response to ukraine, the obama administration decided to use that as an excuse to force through legislation on the imf, the international monetary fund, that was completely unrelated to ukraine. what it would have done is three weeks, it would have number one substantially increased the exposure of u.s. taxpayers by billions to the imf. number two it would have increased russia's influence at

the imf. if we're responding to putin's act of war, it doesn't make any sense for our response to be giving russia what it wants, expanding influence at the imf, and that's exactly hat the obama administration wanted to do. i along with several other senators objected a week and a half ago and said, look, we support standing with the people of ukraine, responding with strength to russia, but we shouldn't be weakening america at the imf. the democrats threw a fit. harry reid plas ted us on the floor of the senate. a lot of observers said there's no way to get anything done. this week harry reid dropped it. they couldn't defend it. that's an important victory and allowed congress now to speak with a unified bipartisan voice against russian aggression and standing with the people of ukraine. i want to turn to domestic issues. a big case at the supreme court,

pitting for-profit companies against the contraceptive mandate. specific methods they believe could cause abortions. the supreme court had heated arguments about that this week. we await their decision. what's their take. what do you say to critic whose say those who are saying this is a big fight over religious freedom, that's not what it'sab against women and providing health care benefits. >> this case is fundamentally a case about religious liberty. it has nothing to do with access to contraceptives. everyone who is allowed to use contraceptives, there's nothing preventing that. the issue is very different. it's whether the federal government can force someone to violate their religious beliefs and pay for the contraceptives of others. i think there's another case very similar to this that illustrates the principles perfectly. it considers the little sisters

of the poor. little sisters of the poor are a catholic convent of nun whose have taken a vow of poverty and devote their lives to caring for the poor, caring for the elderly. the obama administration is litigating against them trying to extract millions of dollars of fines from these cath lynn nuns because they are not willing to pay for contracept e contraceptives of others that violate their faith. the idea that our federal government would be going after catholic nuns trying to force people to violate their religious faith, it goes continue trar to the first amendment, it goes contrary to centuries of tradition in our country. we were formed by people fleeing religious oppression coming to america to see out the freedom to worship god almighty with our hearts, minds and souls. i'm cautiously optimistic. i believe the supreme court is going to strike down this contraceptive mandate because the federal government shouldn't

be in the business of trying to force people to violate their religious beliefs. >> we'll await that decision, probably late june. in the meantime predictions this week that the gop has a better chance at retaking the senate. there's been a lot of pushback by republicans who say it's not business as usual. obviously the rules were blown up last fall with regard to nominations. how would it be different if your party retakes the senate? >> i believe november is going to be a good election year. i believe republicans, we are going to retake the senate and retire harry reid as majority leader. i hope and i believe it will be different in a number of ways. number one, the senate can begin to do real oversight. one of the deeply troubling aspects is the pattern of lawlessness. this consistent unwillingness to abide by the law and picking and choosing which to follow, which to ignore and unilaterally change the law as he's done with

obamacare. harry reid prevents the senate from doing any oversight whatsoever. with republicans in charge we should and i believe we will go forward with significant oversight as to the lawlessness of the obama administration. >> by the way, this was a big one for gop presidential speculation. several potential contenders spoke to the republican jewish coalition. one of the men, former florida governor jeb bush is reportedly getting the hard press from donors to run in 2016. "the washington post" quotes one major donor as saying the vast majority of the party's top 100 donors to romney in 2012 would back bush in a nomination battle. next weekend is the 25th anniversary of george herbert walker bush's presidency. there's a big texas-style celebration planned. we'll be broadcasting our show

a week after a mudslide destroyed a mountain side community north of seattle, searchers observed a moment of silence. authorities say the number of people believed missing has dropped dramatically, down from 90 to just 30. the official death toll stands at 18 and is expected to rise. another day of searching in

the indian ocean has ended with no shrine of malaysian airlines flight 370. australian officials say the only objects scooped up have been fishing equipment and other debris not connected to the jetliner. more than 100 aftershocks have rattled southern california since friday night's quake. meanwhile several earthquakes jolting people in oklahoma. the largest one there, 4.3 magnitude. no injuries have been reported in either state. that's a look at some of your top stories. out of respect for my colleagues, i'm not sure how strongly they feel about it. i'm willing to go to jail over it. >> that is commissioner robin bartlett frazier declaring she is willing to go to jail for violating the judge's orders that the commission stop delivering sectarian prayers. some are suing saying prayers specific to any religion have no place at public meetings. commissioner bartlett frazier and her attorney, david gibbs join us live.

welcome. good to have you. >> thank you. >> david, we'll check in with you remotely in just a second. as this lawsuit is playing out, you have an injunction in place, a federal judge who says none of these prayers can take place until the underlying dispute is resolved. why did you feel it was worth the risk to say, if they want to throw me in jail, i'm going to pray? >> i just had one evening to determine what i was going to do. we heard the injunction was going to come in. it's not that we couldn't pray. it was we couldn't say the words "jesus christ our savior." i was the next person up to pray. we rotate. we've been fighting for our citizens over this, that we have inalienable rights that come from god, life, liberty and pursuit of happiness. it infringed on speech and religion to say we couldn't say certain words in our prayer. i felt it was something very important to our country, where our country is going and that i

needed to stand up for that. >> we know the attorneys on the other side of this case have said they're not going to push for contempt. but if you do it again, they will go to the judge and press for contempt charges. i want to talk to your attorney, david gibbs. you and i were at the supreme court when they heard a similar case. we're still awaiting that opinion. it could come as early as this week. how do you think that could factor into what's happening here with the commissioner? >> shannon, i think the supreme court is going to hand down a decision shortly that will exonerate what commissioner frazier has done and protect other government officials across the country. i believe as the ncll, national center for life and liberty defending carroll county, that we're on the right side of history. our founders prayed in jesus' name. that was protected historically. they're on the right side of the first amendment. people are troubled that judges will be making a determination where something is too religious or not religious.

i remind your viewers that a no jesus religion is a religion. we're forcing atheism down the majority's throat. that's wrong according to the first amendment. that is an establishment of religion. i also point out that i believe carroll county is right on the separation of powers. i'm very concerned when courts are forced to tell commissioners, elected officials what they can or cannot say. hypothetically, could a judge issue an order to president obama and say do not say god bless the usa, do not say god bless america? people will be offended at that. here you have an elected person, you have the president, a county commissioner, robin frazier. what she's trying to do is what she believes in her legislative discretion is best. our courts have three spheres of government. for the judiciary to step over and tell elected officials what they can or cannot say is very troubling for all elected

officials across our nation. >> commissioner, i understand there are five of ye as commissioners who decided this is something you wanted to dorks to pray for each other and pray for the business you were going to do. i understand you rotate. you each take a turn praying. would you be willing to pray without using the name jesus if someone said that's not my religion, i don't want to hear that, i'm here for business? is there a compromise there or do you feel a compromise is unacceptable? >> we have had that discussion and i say i pray in jesus name because that's how the baseball instructs us to pray. john 16:24 says hither to, have you ask nothing in my name, ask and your joy shall be full. that's jesus speaking. that's how i pray. the other group says sometimes we say in jesus name or in his name, but we don't have to.

tomorrow is supposed to be deadline day for signing up for obamacare. there's a little wiggle room in there. we'll talk about that. that's when the first enrollment plan ends for most americans. another delay announced this week. now democrats are proposing election year changes to better the law. here for a fair and balanced debate, angela mcgrou want and krit stay set zer. christie, i want to start with this latest fox poll, others that reflect similar opinions. the popularity of obamacare, whether folks oppose or approve it, 56% approve it -- 56% oppose, 40% support it.

clearly in the public sphere, still not very popular. >> well, the law as it stands is not very popular. most people say they want to make little fixes to it which as you saw is what a lot of democratic senators are saying as well. they do say it's an improvement over the old system where insurance companies could kick you off for pretty much any reason or deny you for any reason. but they do think it's still a work in progress. >> there have been a number of measures passed on the hill. some of them have made it to the president's desk. he signed some of them. there are others that have been a tad more controversial and they may have made it through the house but haven't gone any further than that. angela, do you think there will be any real change, now we have some willing to step forward saying maybe we'll make major changes. >> karma is something in washington, d.c. i think we'll see the democrats go through what the republicans

went through in talking against obamacare. we have a lame duck president, people on the hill playing politics. will we have changes made? i don't know. i think the reason you have the democrats promoting that, they want to win re-election. >> very popular on capitol hill as we see across the party spectrum. christ christy, now we're hearing from the administration after several promises it would never go beyond this date that there is some wiggle room there. what do you make of that and is it only going to give skeptics more ammunition? >> absolutely. it does. one way to look at this, we've already seen a number of delays and here is another one. i think that's a fair one. it makes the administration look sloppy. on the other hand, what the administration is saying, this is like election day. if you're in line at the polls at 8:00, we'll let you vote because you've shown a good faith effort. these are people who want to
