sized. there are threats of murder and rain. >> a film trying to highlight the violence inflicted on muslim women. one day after a report suggestsed administration releases thousands of criminals who should have been reported, we're hearing about growing pressure on the president to do more, much more on the kelly file right now. breaking news now, this is the kelly file. an 8.0 magnitude earthquake hitting about 60 miles off the coast of chile tonight. what do we know? >> a couple updates. the earthquake has been upgraded to 8.2 which is a significant earthquake. if there's any good news, here it is. this thing was about 12 miles deep, and 60 miles off the coast of northern chile. that provides a good buffer

zone. some people say in the capital of chile, they did not feel this earthquake. they're still sending trues to try to figure out what happened. . the big concern with this earthquake is the tsunami and now noaa is telling us that there is sighting of at least a 5.8 foot wave that could be heading toward this region, that's a fairly strong wave. because these waves don't just crash on the beach like most of us realize this is a wave that sweeps inland. now we're being told in the heavily populated coastal areas, they are evacuating tens of thousands of people, telling them to get to higher ground. if you look at the region you worry about the west coast of this country. we're being told there's a tsunami watch issued up and down the west coast, from washington

state, oregon on down through california and mexico. a watch is different from a warning, a watch means we're on the lookout. what they'll do for the next several hours is look at these buoys, the pacific tsunami warning center has buoys, we will get our marching orders and warnings from there we'll keep you posted. right now they have sighted tsunami waves headed toward the northern coast of chile. >> we're in a watch situation, there's nothing for dpoeks to do other than pay attention? >> that's exactly right, pay attention. . >> all right. we're going to go back to trace as we get more updates. he's going to try to get more on the status of the watches and warnings as they come in. we'll be back to the breaking news momentarily. it's been a busy news day. fact checkers have screened president obama's new obama care

claims. president obama claimed his signature legislative achievement has skeeted expectations. >> 7.1 million americans have signed up for insurance plans through these marketplaces. 7.1. >> 7.1. but the white house is not saying how many of those people have paid for their coverage and no enrollment is complete until the first check is cashed. and then there's this. >> under this law the share of americans with insurance is up. >> is it really up? remember, 6 million people lost their coverage last fall, were issued cancellation notices. the white house also not saying how many of these signups were people kicked off of their plans thanks to this law. and then there's this.

people got the word out and our, we didn't make a hard sell. >> really? that claim is a real head scratcher, we've seen months of messages, like the infamous obama care ad feet touring a young man in his pajamas. and this parody video that went viral featuring president obama in a fake interview with zach galifianakis. it's projected to be $684 million for the advertisement. not a hard sell? i wish i could see a hard sell? >> a lot of money was spent and we have to note this is one of the best days the president's had in a long time. he could tout after an awful start, they were able to hit that initial goal of seven

million signups. the problem is going to be the fine print. you saw the president in the rose garden, he was giddy he met the initial roll. he was chastising reporters and republicans for continuing to push repeal of the law. and he said some shoutouts to people like dick durbin, nancy pelosi, saying they've stood for the law, and he suggested to them it's going to be a winner in the midterm elections, but as you suggest, the question is going to be moving forward, was this a premature victory lap. the questions that are going to be answered in the days ahead, a bigger decision day really is going to be that midterm election, not what we saw today with this initial goal. how many people have paid their premiums, we have insurance. also, can we believe the 7 million number, because you'll remember back in october and november, they were saying, oh, look, in order to get accurate numbers we have to give you monthly numbers, they're just trickling in. now they're giving us in

realtime how many people are signing up. it's an interesting change, when i asked jay carney about that today, he said it's because the technology has gotten better, the website has gotten better. we'll see. >> how can you turn around these numbers in 24 hours and tell us -- >> our systems have gotten a lot better which i think anyone can attest. >> they say the system is better. what is the net-net here, there were people who lost their plans, are they just being moved into the exchanges. how many of those people were people who lost their plans before. how many of those were people who were uninsured and now insured by this. >> that is the key point. ed, thank you. >> thank you. the goal of the law was to insure the uninsured, not to reinsure people who had insurance but got kicked off thanks to obama care. one of president obama's former top advisers suggested that those questioning these enrollment claims, they must be kind of crazy.

watch. >> i suggest that all the black helicopter crowd, people who are doubting the numbers and all that stuff, should talk to the insurance industry. because they seem to be bearing out the numbers that the government is reporting. >> but is there cause to doubt this administration when it comes to its claims about obama care? the administration has been repeatedly called up for falling short on the truth. >> if you like your doctor, you will be able to keep your doctor, period. if you like your health care plan, you will be able to keep your health care plan, period. >> that promise made represeeat, became the lie of the year. as we saw six million people receive cancellation notices and their doctors. then the washington post fact checker challenged the president pointing out he was repeatedly pumping up enrollment numbers by

counting medicaid enrollees who have to reenroll each year. and then there's the health secretary and her math challenge. >> what does success look like? >> well, i think success looks like at least 7 million people having signed up by the end of march 2014. >> first of all, 7 million was not the administration, it was a cbo congressional budget office prediction when the bill was first signed. i'm not quite sure where they got their numbers. there are numbers all over the board. >> those numbers came in part from you madam secretary and we have the video. by the way, when the administration announced last week it was extending the deadline for signups, we didn't bother to show you this. >> are you going to delay the open enrollment beyond march 31st in. >> no, sir.

>> do you anticipate more delays? >> no. >> many saying there are many reasons to question the latest numbers. >> you must be a black helicopter type if you have any doubt about these 7 million numbers. >> i can see why if they've got 7 million people signed up, which is a pretty loose standard for the reasons that you and ed have mentioned, you'd be relieved because it didn't look for a long time like the administration would even make that number. that's a number that as you showed, they announced themselves as what success would look like, i don't think it's time for the president or anybody else to be dancing in the end zone. for one thing these numbers, for reasons you pointed out are nothing to dance about, and this isn't the end zone. what will matter in the end is not only how many people sign up and pay and actually acquire insurance, but how satisfied they are with it, compared to what they had before.

there are going to be some winners. there are going to be people who have subsidies, enable them to provide insurance they couldn't previously afford. obviously there are going to be a great many millions of others who -- we've heard so much anecdotal evidence from people who talked about they lost their doctor, their hospital, they're paying higher deductibles. that is something the government did, the kind of thing that does drive voting. >> you mentioned subsidies, a lot of people were previously paying for their own insurance and happy doing just that. some of these numbers were forced on to government health. they didn't ask for and didn't want. it's one of the many questions people have about the numbers. the tone that the president struck today as he was touting his 7 million number. granted an achievement for the administration, but did he strike the right tone? >> it's sort of understandable.

i don't -- you know, i always think that when a president gets up and cites something, that for a myriad of reasons we know is only part of the story if that. that it reflects badly on the president, and it doesn't look credible and it looks sort of childish. and my sense about this is, what does this say to all the people who are sitting out there tonight who have either lost their insurance and not been able to get any under obama care or who have bought policies and had to pay for more policies and are worse than those they had before. how are they going to look at this? is this going to make them say, oh, boy, i want to vote democrat in the fall? i don't think so, megyn. >> good to see you. >> you too. new details on the earthquake and the tsunami that has been triggered when we come back. tonight an american held hostage in iran for more than a

after an 8.2 magnitude quake hitting off the coast of chile tonight. thousands of people rushing from the coast to higher ground. u.s. officials evaluating the threat to hawaii, alaska and the west coast. you heard trace mention there was a watch underway. right now, there's no imminent danger to that area, however, they do say a tsunami has been triggered. we will update you as we get more information. one day after we told you about a report that tens of thousands of immigrant criminals have been released instead of deported, there's pressure to get immigration reform done. perhaps asking president obama toll rewrite the rules. they went to mass laying a wreath in honor of those who have died attempting to cross

the border. michael lynch is a documentary filmmaker who has covered the issue extensively. including in his film they come to america. good to see you. what we found out from this report is that ice has targeted only 195,000 of 722,000 potentially deportable criminal -- illegal immigrants and that they have sort of released nearly 68,000 criminal aliens as they're discussed in this context. 68,000? >> i like a different number. i think it hits bigger. the amount of people who are in st stay, 99.92%. almost everybody is just getting de facto amnesty. no laws are being followed through on. i look at that picture, and the hands are through the fence. what about all the people who get murdered, raped, lose their

jobs, to the illegal aliens that are in this country every year. i witnessed 9/11. at the bottom of the trade center. i know what terror looks like. i've worked with the border patrol agents. i get the e-mails from the ice officers and the border patrol guys that say we can't do our job, we're so frustrated. we're taking people in and they're being put to the curb. just saying go ahead, go, bye. this is what he's doing. what's the sense, if you cannot protect the sovereignty of your country, do you have a country? >> the thing about this report, we knew the president was doing this, it's prosecutorial discretion basically, they say they don't have enough resources to deport everybody. even among those who have committed crimes, they prioritize. murderers, rapists, they go. what we're seeing in this report

is that the numbers are really big. we're talking almost 70,000 illegal immigrants who have committed crimes in this country who are in custody being told never mind, off you go, enjoy america. >> just go. there was a car wash in phoenix, this was just in a recent report from senator sessions. there was a car wash that was raided. most were illegal aliens. they were let go. one of the ice agents tried to give a ticket for not having a license. he was reprimanded by his higherup. you know, dhs is filled with lawyers who are pro amnesty lawyers. they come from pro amnesty groups. i have said this before on the show, i have said this on many different shows. sometimes it gets overlooked, it's going to come back to bite everybody in the butt. obama care is a disaster. but it is not going to be this plan's legacy. you do not change the country

a powerful 8.2 magnitude earthquake has hit off of chile's northern coast. officials ordered an evacuation of coastal areas. keep in mind an 8.0 or greater is considered a great earthquake that can totally destroy communities near the epicenter. we are told that this area has been rocked by numerous quakes over the past two weeks and also

that waves measuring almost two meters or 6.5 feet already were striking cities on the coast. this season the just a wave that comes up and recedes, they're talking about a possible tsunami that could come ashore later tonight. they were saying that could be up to 6 feet. local tv images showed residents rushing inland. u.s. officials are saying they're monitoring, they see no threat to the west coast or hawaii at this point. there's a watch underway, but no threat is imminent according to our authorities, more on this as we get it. a just released poll asks iraq and afghanistan war vets if they think president obama and george w. bush made good commander in chiefs. the poll says president obama is a good commander in chief. a much greater number of military vets give a thumbs up to president bush, 65% giving him a high rating. pete is in iraq and afghanistan.

he's ceo of concerned veterans of america and a fox news contributor. what do you make of that? why would there be such a disparity? >> the general public might be surprised by those numbers, but iraq and afghanistan veterans, folks who have served in those places, look at a commander in chief and say, does this person support not only the troops but their mission. and with george w. bush, despite mistakes in iraq and afghanistan, there was never a doubt about where his heart and gut were. >> let me ask you this. his detractors would say, he got the united states into two wars and sent troops into harm's way. we had thousands of them die. barack obama took office and got them out of iraq. that's what they'd say. >> who better to respond to this question than those who were asked to fight those battles. those who are pulling the triggers and paying that

sacrifice feel like he was the commander in chief, they would want to serve under despite mistakes -- what they see in barack obama is a commander in chief who said i want to end the war in iraq, consequences be dammed. and in afghanistan, claims that was the good war, the place where we needed to double down. as we talked about in bob gates' book, it was later exposed, it was a gut check that a lot of us felt, he didn't believe in that mission from the beginning. if you're serving there, you want to know the guys sending you there has got your back to finish it properly, that was always in doubt, i think it's more a gut reflection than an indictment of the policies of either commander. >> it's amazing, they say, only 44% of the veterans believe the war in iraq was worth fighting. 50% believe that about afghanistan. 89% of the veterans said they would join the military again. it's incredible how patriotic they are and how they don't complain. the vast majority of veterans

back to our breaking news, a 6.2 aftershock has rattled the coast of chile. it happened about an hour ago. however, we just heard from chill a an officials saying no reports of any damage so far and no reports of any victims so far, it's still early. however, they are worried about tsunami waves later on. chilean authorities have evacuated certain coastal areas. more on this as it comes in. a film that is trying to bring attention to the so called honor violence inflicted on muslim around the world. it's called honor diaries. it's been shown a number of times on college campuses. several u.s. universities have postponed or cancelled screenings of the film. after groups like the counsel of

slap in the face. chuck scott was a u.s. diplomat in the embassy during the crisis. i know you're an army veteran, then you became a diplomat, found yourself involved in this situation. they put you four months in solitary confinement, three and a half weeks of interrogation. so severe you needed spinal surgery when you were released. they tortured you, they tried to make you talk, you didn't. you see this guy come into the united states as iran's u.n. ambassad ambassador. your thoughts? >> i don't him at all. but it reminds me of the same insult as when najib was elected president and he was one of the hostage takers. it's like we're being slapped in the face again.

and it makes me cry for my country. we have been so naive in terms of understanding iran. when the iranian hostage crisis was over, and i keep in touch with people who are still in iran, the primary thesis in iran was, ha-ha, we have violated customary international law for a period of 444 days against the great satan, the united states of america. and now we have walked away from that experience with no expense to us whatsoever, in blood or in treasure. and that persists to this day. there is a reproachment between the u.s. and iran. one of the things that should have happened before that was allowed to progress at all should have been some form of apology from iran and possibly even restitution for what we

went through in iran. they still consider that a win-win situation. and for the united states of america it's disgusting in a we're considering allowing anyone who participated in this, to come to the united states in such an exhausted position as the islamic republic of iran's ambassador to the united nations. >> he was just a negotiator, just a translator and they say, typically these types of visas are granted to a imagine in his position. although it hasn't been granted yet. >> if he was a member of that group and if iran accompanied the request for him to come to the united states with some sort of apology, i may be able to bend a little bit. as long as they want us to forget the whole thing without

filmmaker asking for donations to help him make a documentary on dr. kermit gaznell. he was convicted in 2013 corn victimed of the murder of three newborns. he was accused of killing many, many more. a lot of people have never heard his name. kirstin powers has been covering his case. he decided to make a documentary on it, and the site he was seeking those donations on, had some objections to the way he was characterizing the doctor's behavior? >> yes, this couple came to kick starter which is a website a lot of people have heard of. they have used kick starter in the past to raise funds, they were told if they wanted to use kick starter for this movie, who was accused of kill iing hundre of babies, they said they could
