another room yelling at god. >> he's here with his parents live. >> breaking tonight, new reaction after the u.s. supreme court refuses to hear a case. welcome to the kelly file. i'm megyn kelly. allowing a 2013 mexico supreme court ruling to stand. that decision finding that the christian owners of a photography company do not, do not have the right to refuse the commitment serm commitment ceremony same-sex couple. in refusing to hear this case, our next guest argues we may be seeing president that stretches far behind this one state. a lot of folks had been waiting to see whether the u.s. supreme court would take up this case today, tony. they said they would not, that allows this ruling to stand,

and, you know, by any standard this is a blow to those like yourself who have been fighting for sort of a religious freedom argument when it comes to discrimination against gays and lesbians or alleged discrimination against gays and lesbians. how do you see it? >> good evening megyn. what we seen today with the new mexico high court standing is that the price of citizen ship is to surrender you are your rights of conscious and religious freedom. that's what by sidestepping this, the court allowed to stay in place, and, you know, while marriage may not -- natural marriage may not be an issue, religious freedom may not happen. i would hope they care about the issue of freedom of speech. it was forced speech, forced expression that they were forced to participate in by the leverage of the government.

>> but the argument that the new mexico supreme court found persuasive and has been allowed to stand by the u.s. supreme court was that the photographers were not going to be forced into speech they didn't agree with because they could either not offer photography services at all, you know, in the public square or they could do it at this gay wedding, photograph the gay wedding and vocally say it's something we don't agree with. we don't favor gay marriage. >> let me ask, would it be right for a church that wants to do a documentary on the scientific evidence that proves god exists, would it be fair or right for them to go to a video producer who is an atheist and force them to put together this documentary? most would say no, why would you do is that? under the new mexico ruling, that could happen. i don't think a church would engage in such an effort but

that could occur. you should not have to surrenderer your religious conviction or rights of conscious to enter into the marketplace. that's why we have the freedom of religion. religious liberty to be able to order your life and live it according to the teachings of your faith and in this decision the court say s that they woul have to abandon and compromise their religious believes -- >> or abandon their business in the public square. >> but -- >> i want to move on to one other point before i let you go. this is playing out in two arenas, one the legal arena but the other is the public arena with the ceo of mozilla and basically got forced to resign, tony, because of a donation he made back in 2008 in support of proposition eight in california which defined marriage as

between a man and woman and did not recognize same-sex marriage. it was the same basic position as our president at the time. he's been forceed to resign because some pofolks were so outraged, anybody that made a $1,000 donation several weeks ago would be elevated to the position of ceo. your thoughts? >> this isn't isolated. we had sports casters, college professors, those involved with the olympics, all forced out by this rise of -- we got to go back to the 1930s to see this on the move where people are saying that look, you have to compile with this issue -- with our view point on this issue or you cannot participate in the public arena. you cannot hold public office. they are even saying that, you cannot be in business. look, this should frighten everyone who cares about the bedrock of our democratic republic and that's the ability to engage in dialogue discussion

and debate and make the case. what i think is behind this, megyn, they don't want to debate because the supporting documents, the facts, the reason does not bolster and back up their view point. >> that's certainly true of some. some like andrew sullivan came out and said this is no way to behave. you can't force people out of their jobs. tony, good to see you. >> thanks, megyn. we're joined by judge napolitano. let's jump to the new mexico case that's allowed to stand by the u.s. supreme court. this is from the new mexico supreme court decision and this is why they found against the photographers. this is a quote, okay? they say a holding at the first amendment mandates an exception for commercial photographers would license such photographers to freely discriminate against any protected class.

such a holding would undermine all of the protections provided by anti discrimination laws. >> well, the state of new mexico like new york, new jersey and other so-called progressive states has defined public accommodation to mean anybody that provides a good or service to a member of the public. once you do that in new jersey, new mexico and new york, you cannot refuse to do business with someone that comes in, as long as they can pay for your service. no matter what you think of a person, no matter how they use your services, you can say no. >> you can say i don't agree with this but you have to perform the service? >> it violates the ancient and natural and personal law to refuse to do business with whom you don't want to do business with without justifying it to the government. that's a right that's now gone. >> but do you believe that somebody has that right when it comes to, let's say, a black

patron? >> well, the law is very clear that they don't buzz the civil rights act of '64. >> yeah, but the gay and lesbian advocates say they don't have the right to do that to gays and lesbians, either. >> they do. when the courts force you to perform a service that's not food, shelter or clothing, they are really forcing you to engage an unvoluntary service. >> they are only forcing you because you put yourself out there to the public square. >> but they could go to another photographer. it's not like it's midnight and i want to stay here and i can't because my name ends in a foul. >> and that's like saying a black patron can't go to a diner. >> there there is a property rights argument there. the country is absolutely committed to being color blind with respect to public accommodations. >> and these states -- >> what is public accommodation -- >> these states are committed to not discriminating --

>> yeah -- >> the legal debate continues. the second point we went over with tony, the mozilla case because is it legal, i mean, is it legal for these groups that were so opposed to this guy being elevateed to ceo. >> right. >> to interfere with his business relationship to the point they were threatening boycotts to mozilla because of a private view and donation. >> i say regrettably yes and i'm a defender of freedom of speech and you shouldn't suffer but this is not the government making him suffer. this is entirely different from the new mexico case. this is a corporation, a private entity though publicly traded making a decision about who they want as the ceo. in my opinion, he has every right to contribute to whatever cause he wants, especially when it doesn't affect the work of the ceo of that corporation. the first amendment restrains the government. it doesn't restrain private

entities from deciding what they want. >> and a contract l interference. >> if i want to say something on your show and people demonstrate and the boss says we better take him off the air for a couple weeks because the demonstrators are driving us crazy. that wouldn't happen here because we have different bosses here. would they be lawfully empowered to do that? yes. i'm not giving them ideas. >> judge, good to see you. >> pleasure. >> fascinating to see this unfolding in two different arenas. frank luntz focused on freedom, what to say and do and what the government is increasingly telling us what we can and cannot do. here say short clip. >> do you feel more or less free than tenness years ago? who feels more free? not one of you. who feels less free? >> i think it's an overall government power to get in

one-two punch, first, identify the source of the pings and second, send in sonar to physically identify the location. earlier today the australians heading operation ocean shield describing the plan and strategy. >> if they gain another acoustic event that will be the trigger at the moment to launch the under water vehicle with a more accurate sonar and potentially camera for mapping and visually looking at the ocean floor. >> at this hour the ntsb lab here in washington dc are standing by ready to handle the black boxes if recovered and under the malaysia authorities who lead the investigation. 1/3 of the world's black boxes are brought here because of the capabilities, though mh-370 presents challenges. >> the depth and the salt is corrosive and although these are in a watertight, they get

water infiltration especially at the depths. >> and we're told because of recent upgrades, investigators are seeing more and more cases where the batteries last well beyond the 30-daytime period, megyn. >> thank you. we'll look at a more troubling new theory emerging, the possibility it could have been deliberately flown out of the reach of radars and the confusion over the continued hope for survivors as outlined today. well ten muslim groups are teaming up now to have a bigger impact on american politics and they say to better protect their civil rights but the makeup is making some question the organization. a speech writer and american enterprise institute. this group is going to be called the u.s. counsel of muslim organizations and one of the names that jumped out at me of these groups is care.

one of the ten is care. there are other groups in these ten. why do people need to be paying attention to this? >> well, these grown ups are rebranding themselves because many of them have ties to terror. care, which you know well with your talk about the film that they are trying to get people not to watch, care is a group, that's right, care is a group that the fbi said is a front group for hamas to support terrorist and the american people. another group is the muslim american society which the u.s. government says is the overed article of the muslim brotherhood of the united states. there are organizations with ties to terrorist groups that support radical islam and trying to rebrand themselves through this organization. >> now, they have come out and said basically what they are trying to do is provide muslim civil rights, it's about giving muslims a greater voice in the upcoming elections and making them a more persuasive and meaningful block. one thing they want to do is look at muslim complaints and

counter the false fier seeking to mislead. with care at the helm, what does that tell you? >> the funny thing is care is completely out of step with the muslim american community. i mean, for example care is a front group for hamas. hamas december stricts israel. 81% of muslim americans support a regular louisolution. muslim americans are the least likely group in the country to support military attacks on civilians. 89% say are not justified. what they are doing, which is interesting, while muslim americans are against terrorism, they lean left politically. their path is to tap into that. 80% of muslim americans support barack obama. that's like double the percentage of the rest of the americans of the country, but they have one of lowest voter participation rates in the

united states. so these groups figured out their path to legit si is bringing muslim americans who support barack obama in high numbers out to the 2016 elections and if they bring out that support, these politicians will be less likely to criticize them publicly. >> very interesting. care would have you believe that it's basically the aclu of the muslim world and yet, they view certain issues very, very differently than, you know, a lot of muslim americans. mark, good to see you. >> thanks, megyn. well, developing tonight, u.s. officials confirming two heavily armed mexican officials crossed the u.s. boarder in january. they drew their guns and engaged in a stand off with border patrol agents and it's not the first time this happened. trace gallagher has the kelly file investigation. >> megyn this was a 35-minute

stand off in broad daylight. the mexican soldiers confronting one single border patrol agents and all weapons drawn. a lot of disturbing questions remain. the soldiers gave names to the agent but they didn't match the names on their uniform and then why did the soldiers flee when backup boarder patrol agents arrived? the government says they were chasing drug smugglers but it's no secret the mexican military is highly corrupt, which is why tom coburn wrote a letter to the head of customs and boarder protection asking if the soldiers may have been in choots with the cartels. the new chief finally responded to coburn calling it crossing quote a significant incident but that no further action was necessary. and keep in mind, over the past four years, there have been 23 incursions across the united

this as we get reports that the plane may have changed its course to avoid indonesia recar. president of boyd group international, mike, let's start with the pings. i'm focused on the australian pings, you know, discovered, not the chinese ones because those seem to be dismissed as probably not being the black boxes but more and more experts saying the ones picked up by the aussies may be the boxes. what do you make? >> the past four weeks, the plane, the plane but no answers. the reality, this could be something if those batteries stay alive, we may have a find. >> what else could it be that would emit a ping like a black box? >> well, i don't think it's willy the whale or flipper. i think it would have to be something mechanical, i think. that's the heartening news, if you want to call it that. again, we had hopeful events

over and over again -- >> i know. the audience knows that. they take everything with a grain of salt with this story as they should. you have the vessel that detects the pings that may be from black boxes and now for the layperson you wonder why don't they go back, send a submarine down into that spot and take a look? >> well, they have to find it. there say ping in the water. they are not sure where it's coming from exactly. they will go back and forth and t triangulate that. until we get hard data off that box, we're going to be in the dark. >> what do you make of the suggestions that the plane may have intentionally tried to skirt indonesia radar? >> it's more from the government of malaysia that doesn't know what they are talking about. it may have happened. if they did that, once it started to head south it could have gone somewhere else if it's being piloted. the whole thing here is this gets stranger and stranger and

committee and the government reform and over sight committee, both have jurisdiction over it. they aretogether. i understand the weighs and means committee will go into executive session wednesday where they will go over a letter they put together, out lying names of taxpayers who have been harmed and aggrieved and layout a case for how ms. learner mislead the committee. >> is it just going to be ms. lois learner or others at the irs? >> we'll have to wait until wednesday to see. >> really? is your information not just ms. learner? >> we'll wait and see. >> leaving the door open, interesting. if they hold her in contempt and that's supposed to happen i think thursday. >> thursday. >> she doesn't get held in contempt unless the full house supports that. is that going to happen? >> i think after the easter district work period, they will take up that contempt resolution. i made clear lois learner was going to tell us the truth or we were going to hold her in

contempt. if she's not going to tell us the truth, we'll hold her in contempt. the house will vote. >> do you think it will be more than lois learner there? john could face contempt because he suggested the documents won't be produced for years. >> for years. i think it's premature but we know ms. learner gave up her right to plead the fifth, she refused to testify and she testified and spoke with the prosecutors of the justice department. i don't know why she wouldn't talk to the congress and american people. >> she said it's a partisan winch hunt and the doj is straightforward. listen, that's what her defenders said. a couple years ago you guys went over eric holder, he wasn't producing information with the fast and furious, this gun running thing. that still held up in the courts. when you refer these things out

to the courts, what confidence do the american have that there will be an end, resolution? >> the american people have a right to know what happened with regard to fast and furious. what happened at the irs. what happened at benghazi and there is no one more serious about getting to the bottom of it than i am. >> if you're so serious, why not appoint a select committee where it's one clearing house for information because you've got 190 members in the house who are in favor of a select committee and yet, you are over ruling or ignoring the will of your own majority. >> there are four committees investigating benghazi. four americans were killed. their family haves a right to know what happened. there is nobody, nobody more determined to get to the truth than i am. they all have superpower. at this point in time, there is no reason to break up all the work that's been done and to take months and months and

months to create some select committee. >> but your own people want it. you got 190 thousand republican whose say they need it. >> i understand that. at some point that may -- that may be required. at this point it's not. >> let me ask you about immigration. because the reason, you me, the president didn't get through immigration reform in part is what, you know, the house wasn't in favor. he couldn't get it through the house. our own shannon was speaking with bush the former governor of florida, the 2016 presidential contender and he had this to say about the issue. >> someone who comes to our country because they couldn't come legally, yes, they broke the law but it's not a felony. it's kind -- it's an act of love. it's an act of commitment to your family. i honestly think that's a different kind of crime. >> they did it for love, your thoughts? >> listen, to most people around the world, the united states is

utopis. we're also a nation of laws. those here without documents, they have to face the law at some point. >> uh-huh. do you think this will be a deal breaker for jed bush for president? >> i do not. the american people want us to deal with immigration for reform. it's a political football. i've tried to get the house to move on this for the last 15 or 16 months. but every time the president ignores the law like the 38 times he has on obamacare, our members look up and go wait a minute, you can't have immigration reform without strong boarder security and internal enforcement? how can we trust the president? >> he's under more pressure by executive order by legal immigration for deportations, to use his pen and a phone and get

around a congress standing in the way of reform. if he does that, pursues that, what if anything do you do? >> that will make it almost impossible to ever do immigration reform because he will spoil the well to the point where no one will trust him by giving him a new law that he will implement the way the congress intended. >> you got into a weird online argument with matt drudge of the drudge report this weekend where he suggested that the house republicans expanded obamacare with a voice vote last week and a voice vote is controversial because it doesn't really require anyone to go on record, i gather. you came out and said we didn't expand obamacare. i trust chris of fox news. he said conservatives are mad over this house-passed fix because it mitigates obamacare's damage to small businesses and in essence what you've done is allowed democrats to and i quote crow they have finally broken the gop blockade. did you give on something you shouldn't have given on. >> our goal through this is to

protect the american people from the awful affects of this law and continue to work to try to repeal it. so over the last three years, this probably has been eight or nine changes in the president signed into law. this is one of them f. you're a small employer and have a die detectable and high co-pay plan that there are caps under obamacare that would get rid of almost all these plans. what this did was take the cap away -- >> you think it's good. you would think it's good. >> small employers can keep their plans and health savings accounts. >> good or not you broke the blockade of standing firm against change. >> there is already eight or nine changes. >> let me move on because i have two other subjects i want to ask about before we go. number one, gop looking more and more likely to possibly take the senate, these political prognosticators suggesting it may happen. if you get your way, the house and gop, what goodwill it do for

the republicans? >> give us an opportunity on capitol hill to put things on the president's desk and him choose, veto or sign it. up until now, harry reid protected the president from these difficult issues because he doesn't bring it up in the senate. it gives us an opportunity to force the president's hand more often. we won't win as many as we like but win some of them. >> do you think the gop will take the senate? >> i do. we have a good opportunity and pick up seats in the house. am i concerned about the house especially is the democrats continued to out rise us month after month after month and even though we're setting record for fundraising, we're being out raised by the democrats. so the only way they have a chance of getting the house back is to buy it. we can't let that happen. >> some are suggesting that you are not going to be the speaker, even if the gop retains control in 2014. >> i heard those rumors before.

my members know me. we don't disagree on big issues or big strategy. we had disagreements over tactical issues. but i've got a good relationship with my members and feel confident i'll earn their support. >> last question, there is such a riff within the republican party which is not uncommon but the tea party, more conservat e conservative, versus main stream, do you sense that narrowing at all, that gap? >> i think there is a greater understanding. as i said earlier, there is no issue, there is no differences in terms of obamacare, the economy, jobs. we're all on same page. where we get into disagreements is over tactical moves we make where some washington groups will stir up the tea party, frankly, i think unfairly and unnecessarily and cause divisions just for the sake of raising money for their own organizations. >> do you watch "house of cards". >> never seen it but everybody asks me about it. i'm going to have to watch it.
