>> christmas for easter. >> everyone ended up in fisticuf fisticuffs, talked out of the restaurant. only kidding. >> a lot of fun. >> it was good. i couldn't believe this news as i'm coming back on amtrak. >> broke last night at -- let me think, 6:45, the news came out of washington, in charge of the disastrous rollout, now after months of denying she was on the way out, kathleen sebelius is officially resigning later today. doug la sueder is watching the developments and 11:00 this morning the official word, right? >> that's when it comes down. the administration was waiting for brian to leave town before they made this announcement. >> that's what i thought. again. >> we suspected that as well. >> once you were safely on your train they felt it was safe to make the announcement. >> okay. >> not a huge surprise. the timing is difficult to predict but kathleen sebelius will be known for the flawed obama care website. she was the point person on that. and it not only didn't work, in fact they're still having trouble with it, but it costs

hundreds of millions of taxpayer dollars to develop it. we knew the writing was on the wall for sebelius because of what happened about a week and a half ago. president obama went to the rose garden for what was described as an obama care victory lap claiming 7 million people had, in fact, enrolled for health care plans through the websites. he thanked a number of people including nancy pelosi, others, did not mention kathleen sebelius, even though she was sitting in the audience right in front of him. now as far as what happens now, the president as you mentioned is going to make this announcement at 11:00 eastern. kathleen sebelius will be out but she will continue to serve, we think, until her replacement is actually confirmed. this is sylvia burwell, currently serves as the budget chief for the white house. the administration thinks she's a safe pick because she's gone through this process before. she's had decent republican support in the past. maybe it will be easy, but as judge napolitano reminds us, you

have to remember the mid term elections are coming. >> this is a bad time for the president to have to go through it. he has five to seven vulnerable democrats in the senate running for re-election. we're going to be tempted not necessarily to go along for the ride. and perhaps either to remain silent or neutral or at least be as curious and inquisitive as republicans would be of what miss burwell will do with the mess she's inheriting. their eyes are not going to be on the confirmation. their eyes will be on election day in november. >> and the other thing to remember is the way the senate works now after harry reid's nuclear option. it's broken down 53-45. democrats to republicans. used to be you needed 60 votes to do a confirmation process like this. now you just need 51. the judge's point is that a lot of these democrats on the blue side may begin to waffle a little bit during this confirmation process because of the upcoming election. back to you guys. >> absolutely. >> thanks. >> great point.

even got their numbers. >> how many have signed up thus far? >> fully enrolled? >> yes. >> i can't tell you because i don't know. >> there is absolutely no evidence and every economist will tell you this, that there is any job loss related to the affordable care act. >> at last check 64% of oklahomans aren't buying into the health care plan. they don't like obama care and they've been pretty vocal about it. now that's going to be -- still continue to be a tough sell but we'll see how that plays out over the coming months. >> all right. secretary sebelius, thank you so much for being with us this morning. i think we've probably lost sound here or something. >> i can hear you, but i -- thanks for having me. >> and if you think about it, she -- according to almost every report she never really met with the president. i don't know whose fault that is. even during the most perilous times, the summer leading up, the early fall to the actual

rollout there's an excellent chance the president had no idea it was bad or the president, as his management style would reflect, was not meeting with her on the most vital piece of legislation. in the end the timing when this thing got a little bit better is when this guy jeff zeits came by and kind of oversee what she was doing. >> or is that separation strategic so there was space between the mistakes of this rollout and the administration, specifically the president? >> sure. go ahead and watch for democrats to start saying, particularly the senate democrats who are vulnerable right now, for them to start saying, you know what, there was trouble with the rollout, but the person who was in charge of that is gone and now we got this new person. by the way, every time today you hear somebody describe the rollout for the affordable care act as troubled or rocky or problematic. >> bumpy. >> you're going to hear that a lot, it wasn't any of those. it was a disaster. and the only reason that the white house kept her around, they needed a scalp, they kept

and we came outside and everything was already on fire, in flames. there was a bunch of screams and there was a man that ran out and his back was like on fire. >> both drivers of those vehicles along with seven passengers on that bus died. the fedex truck, they believe, crossed into oncoming traffic. investigators are now trying to figure out why. hum bolt state university sent that bus to southern california to bring perspective students on tour. our hearts and prayers out to those families this morning. a night of prayers in detroit. hundreds attending a vigil for the driver who had been brutally beaten bay mob after he tried to save a boy that he accidentally hit with his car. and this morning, we have learned that one of the suspects, a 16-year-old, has been charged with a hate crime. the victim steve utash remains in a medically induced coma this morning. he was punched and kicked and robbed while he was trying to help the 10-year-old boy. also new overnight, satellite images revealing that

russian forces are now within striking distance of these images and they fly in the face of russia's claim they have no plans for further military action after annexing cry mea last month. this as russian threatens to hike gas prices in the ukraine, pushing tensions really to a breaking point. and we talked about this one before, letterman is out and colbert is now in. >> late night debuted my first year in college. i learned more from watching dave than i did from going to my classes. and i got to tell you, i do to the envy whoever they try to put in that chair. >> well, colbert will now take over at the late show some time next year. he signed a five-year deal. the 49-year-old has been the host of "the colbert report" since 2005 where he really likes picking on fox news. >> a little bit of concern about colbert. he took a ham, decorated it to

here to discuss. >> good morning. >> thanks for being with us. one of the complaints about kathleen sebelius of the many in terms of the disastrous obama care rollout was a lack of management skill, but also lack of having experience in the medical field. you say? >> well she was an insurance commissioner before she became governor kansas, but i think that health care is becoming very, very complicated right now from a medical point of view. clearly from a numbers crunching point of view and sylvia burwell coming in, if she gets appointmented, will have that advantage that she's running a budget. but what's going on from a health care point of view? patients come to the office and they say hey, we got a policy under the state exchange now and it says you're listed, dr. segal, under blue cross but not taking the state exchange blue cross or wait a minute, what's this $5,000 deductible i have? is my service actually going to be covered? can i get that cat scan? the actual practice of medicine is getting so complicated now that i can't imagine someone running hhs that doesn't have

that kind of familiarity. remember the case last year that peter johnson jr. brought to light, 11-year-old needing a lung transplant, got an adult lung. kathleen sebelius blocked it. she didn't understand the technology was changing. right now, elisabeth, we have a problem because things like mammograms are covered, birth control is covered under obama care, but we can't get the cancer care we need. sometimes something works for one person, not for another. it's called personalized medicine. we're going in that direction. someone who doesn't understand the technology of medicine is not going to know how to deal with that. >> sure. protecting the patient's privacy rights. you made an interesting separation there. kathleen sebelius who did have a background in insurance industry, but is that -- you say, not a medical background in terms of the treatment and the patient's desire. sylvia burwell, she's been credited with having outstanding business skills, worked on both sides of the aisle with people in business, private sector and in government.

do you think that can override her lack of expertise medically? >> i don't. because look, she may explain better than sebelius did this idea of whether 7 million are now covered under the state exchanges but 5 million are losing their policies elsewhere. maybe she can sugar coat that and the dog and pony show will look better than it's looked. that doesn't answer what's happening to the doctor/patient relationship. dr. john barasoo who is an ortho peedist wrote a brilliant article in "investment business daily" that said obama care interferes with the delicate balance between the doctor and the patient. that's the issue. someone without a medical background, maybe she'll surprise me. i think that with obama care in place, we need physicians involved with this. >> why are they not? >> because they're not politicians. she got where she is because she worked with clinton, you know, with ruben under the clinton administration. she worked with the gates foundation. with the gates foundation,

granted, she was the head of global development, but i don't really think she dealt with basic medical issues. with the walmart foundation she wasn't dealing with the pharmacies in walmart, i guarantee you that. she's a brilliant woman. i think she could be successful from a financial angle. again, the health care system itself is a mess and that's about patients going to doctors and seeing whether they can get the care they need. she says by the way to atlantic that access is improving. i don't see any evidence of that. >> you raise an important question there. he even bet $100,000 on it believe it or not. we will get ready to pay up. white mom is here and she's angry. did you miss a second this week? you missed a lot. why brian and steve went brian t wedding dress shopping? i wonder what they picked.

>> i guess it depends whether it's a preexisting condition or not. either way, kathleen sebelius is out. this announcement came yesterday. not terribly shocking, although the timing of it is always difficult to predict. democrats are praising her for her efforts. republicans have long blamed her for the implementation of obamacare. either way, it's going to be pretty tough for her to disentangle herself from the obamacare web site which cost millions of dollars to this day. it's still not completely functional. as far as reaction is concerned from house majority leader eric cantor, he tweeted this, i thank secretary sebelius for her service. she had an impossible task. nobody can make obamacare work. and that really may be the theme that we hear from republicans now moving forward as we transition to a post-sebelius period. her successor is expected to be this woman, sylvia burwell, currently serves as the house budget director. the white house thinks they may have a relatively easy confirmation process.

we'll see. it's important to remember the rules of the senate changed thanks to harry reid's nuclearing on. you no longer need 60 votes to confirm someone in this job. only 51. that does not mean that there won't be a fight over this. >> even in the post-nuclear option senate where an executive branch nominee can get through with only 51 votes, there will still be a lot of tough questions to ask. there will still be a lot of concerns, i suspect even from some of my democratic colleagues who are themselves facing some of the heat of this unpopular law. >> and the other thing to consider here is the upcoming midterm election. yes, democrats have 53 seats in the senate. they have enough to do this on their own. some of them may be reluctant to go along with the president, especially those that mitt romney carried. for them, this will be a tough reelection fight and a lot of it may come down to obamacare. steve, brian and elisabeth. >> all right. doug live in the dc bureau,

trying to figure out why this happened. humble state university in northern california sent that bus to bring prospective students to the school for a tour. our prayers go out to those families this morning. such a tough day. it was a night of prayers in detroit. hundreds attending a vigil for that driver who was brutally beaten by a mob after he tried to help a boy that he accidental low hit with his car. this morning we have just learned that one of those suspects, a 16-year-old, has now been charged with a hate crime. the victim remains in a medically induced coma this morning. he was punched, kicked and also robbed as he tried to help that ten-year-old boy. then listen to this story coming out of nevada this morning. nevada's top elected leaders are riding to the rescue of a rancher who is at war with the federal government. the bureau of land management surrounded the ranch with armed officers and also helicopters and last week they began seizing

his cattle. this is all about the cattle that were grazing on neighboring federal lands and this is a battle to protect a endangered desert tortoise. ranchers now have to pay a fee. bundy refused to do so. he said this on the record last night. >> you think we're in america, but maybe not. it seemed like the united states government is operating with unlimited power over we the people of the state of nevada. >> nevada's governor is weigh not guilty this morning and said, quote, no cow justifies the atmosphere of intimidation which currently exists, nor the limitation of constitutional rights that are sacred to all nevadans. we'll keep you posted. finally, letterman is out, colbert is in. >> late night debuted my first year in college. i learned more from watching dave than i did from going to my classes. and i got to tell you, i do not

representative's comments there and what did you do? >> well, i was just kind of blown away 'cause i know that statement is not true and it just had to sit with me for a few weeks and then i decided to post our family's photo on his web site and let him know there are families like ours in montgomery and all over our state because i have many other families that i've connected with whose families look like mine. we said if he wanted to meet us, we'd love to meet him. i was blown away by how much support i got, how many shares that i never expected it to get so many likes. it was amazing. the families that i got to connect with. i knew of many families in alabama. but now i know of many more. his statement just isn't true. and i agree, we have a long way to go, but instead of of focusing on the negative, i want to focus on the positive and look at how far we've come and the beautiful families in our state and all over the world and just take this opportunity to bring awareness to adoption and

teaming up with congressman sean duffy to help veterans get treatment for hearing loss. think about it, loud noises, fire fights, the hearing is susceptible. welcome. >> thanks. >> and first off, how did you get alerted to matt's situation? >> matt came into my office and was talking about hearing aid issues with our veterans. and i had been hearing stories from back at home of just the backlog of veterans who wanted to go in with hearing issues, meet audiologists, get hearing aids and get them tweaked and it wasn't working. the backlog was huge. he has hearing issues as well. >> it really started with you in "black hawk down" in somalia? >> it did. it's an unfortunate result in exposure to loud noises, which as you can imagine, battlefield is a really, really loud, loud place. my hearing loss started on the afternoon of october 3, 1993 and it hasn't gotten any better since. >> you have a ringing in your ear as well? >> i do. both ears.

high frequency hearing loss. degenerative affliction that makes normal living and daily life and social things miserable. >> right. so congressman, you had him pick up the process. it means you got to get diagnosed and then go back and get it adjusted. with the way the v.a. goes, this could take way too long. >> the problem is they only use audiologists. we don't use them for the serious problems. but once you get the hearing aids, you have to go back to the audiologist and it creates this huge backlog. you can use hearing aid specialist, tweak them, and get them back out on the streets to hear. it's wrong you have american heros like matt who have hearing issues and they can't get it addressed in the v.a. it's absolutely wrong. >> your piece of legislation doesn't say go hire a private contractor. it says hire more audiologists and put them in the v.a. system. are you concerned that's going to get back logged? >> what we do is say audiologists, we can hire more. but let's take the workload off

them and hire hearing aid specialists so they can do some of the tweaks and fittings on the hearing aids so we can free up this time line so you can hire them in the v.a. or contract with them. you're not mandated, but you're allowed to do this. >> this happens to more than just you? >> it does. you do the numbers of servicemen and women have deployed in the last 13 years, close to 2 million. you figure it's got to be half at least that have some kind of hearing loss. it's a sizable demographic that really needs to be addressed. >> all right. let your congressman know and support your legislation t. should be democrats and republicans getting behind you. >> it's wrong and we should have it backlog address addressed. >> matt, you were not done correctly. >> 15-year-olds hearts break when they meet me. thanks for your service and you,

have drugs for pulmonary fibrosis, the disease that my father died of, but not in this country. what are we doing about alzheimer's? is there a life ethos? are we trying to cure? is there a political imperative or moral imperative to extend people's lives? would we rather hire more people to populate the irs to go after people to sign up under penalty of law or do we want to hire advocates to say, why isn't this insurance company doing what they're doing? why isn't this government doing what they're doing? so that's the legacy of kathleen sebelius' lack of empathy, lack of understanding, lack of connection to american people and their lives. >> sure. plus, part of her legacy has got to be that there are millions and millions of americans now who are paying more for health insurance than they were before because they've got to have health insurance for things that don't apply to them. they might be in their 60s and got to play for pediatrics. >> that's the point going forward. i think you're absolutely right.

it's about cost. it's about coverage. it's about the scope of treatment that people will be afforded. it's about job reduction. it's about what it will do to the deficit in this country, to growth in this country. have we paralyzed our self by setting up this huge infrastructure that cares more about, well, we're going to sign millions up, but how are we going to deliver it and how are you going to deliver it in a way that's cheap and effective and extends lives? health and human services should be about americans' health and providing service to americans. we haven't seen either in the last five years. we've seen political promises. we've seen the government go into the examination room. the challenge going forward is extending life and making people feel that life is important. not death. >> well put. have a good weekend. >> have a good weekend everybody. speaking of this weekend, what about going to the movies? the movie "draft day" takes us

they win. a lot. >> will it score big with the audience? kevin mccarthy, founder of nerdtears.com joining us now with his review. hey. >> good morning. thank you for having me on of the this is directed by ivan writeman, made with the full cooperation of the nfl. so you're dealing with real nfl teams, cleveland brown, buffalo bills, and the problem with this movie, you're dealing with kevin costner, trying to rebuild his team. they shot some of the wednesdays at the 2013 nfl draft. on a negative note, the movie is a little bit cliche and very predictable. the first half is overall just didn't feel like it worked and blended well together. but you're dealing with the nfl. so it feels a little disconnected because you're dealing with fictional players. the second half really does

work. the second half is where the movie really blossoms. kevin costner deliver has fantastic performance in the second half and the movie becomes a movie that you become engaged in. overall, i gave it a three out of five. it's a decent matinee. mediocre. but i expected more. it feels more like an advertisement for the nfl versus a movie that you really want to see. >> it sounds like your message is skip the first 45 minutes. walk in about halfway through. you did talk to kevin costner would a lot of people who watch this show do love. >> right. i want to ask you guys this. i asked mr. costner if there was some type of hypothetical movie draft and they were to draft all of your movies, which do you think would be the number one. and i was very surprised about his answers. i want to ask you out of all the movies he has done, which one do you think he considers to be the number one draft pick? >> i would say "body guard." >> okay. elisabeth? >> "field of dreams," because i

character was hung an effigy. they wanted to take that out because they didn't think it flowed well with the movie. to me, that's where it steps in and the art form of the movie is taken out completely. it becomes an advertisement for the nfl versus the vision that the film maker had. >> you're saying the nfl took it out? >> yeah. the nfl apparently -- according to kevin costner in an interview, he said the nfl actually wanted a scene removed from the movie. i don't know if they actually ever shot the scene, but it was in the script and they had to remove it because they thought it was too much. they didn't think fans should react that way in the movie. they were upset -- >> they're only upset when fans turn over cars. >> exactly. >> i gave it three out of five. i realized this is a situation where art should have won and the nfl kind of took a scene out. it made it too advertisey to me. >> all right. >> kevin mccarthy, thank you very much. >> straight ahead.

functioning correctly. there has been a steady drum beat to hold someone responsible. >> lots of push by the critics for president obama to hold somebody accountable for what happened in those first two months. today you have now 7.5 million. it's been a success. this is a wonderful opportunity for her to step aside without it seeming as if she's being blamed. >> and the other good news for sebelius is that she's getting out before the next big thing hits, which could be big rate hikes heading into next year. that will be a headache for her successor. we believe that's going to be this woman, "silver linings playbook," who currently -- sylvia burwell. the administration thinks they'll have an easy time getting her confirmed. we'll see. republicans are saying that this is about more than just the person in charge of hhs. >> this ultimately isn't about the person. it's about the policy and secretary sebelius was in charge of implementing a very unpopular

that's the way the story goes. >> so they're going to make the cut later today and try to start anew, if that's possible. 6 minutes after the top of the hour. heather future has a breaking story. >> we're following breaking news out of staten island. a massive fire is raging now in a residence. brand-new video coming in from our local fox affiliate. you can see that this fire has gutted this two to three-story home in staten island. you can see that in the middle of your screen. it's starting to affect those surrounding houses nearby. we are getting word that no injuries reported at this point. but we are hearing that this fire broke out just 20 minutes ago and it's already spread this quickly. firefighters, you can't quite see them there, but they are on the roof there trying to get a handle on that fire. no reports of injuries at this time. we'll keep you posted on the developments that happen. just about 20 minutes ago this happened. also some really tragic news coming in overnight. these young children and some

other people were on track to really go on with the rest of their lives and then the unthinkable happened. there was a fed-ex truck that slammed into a tour bus that was filled with high school students and just now we have learned that ten people have died. five students, three chaperones and two drivers were killed. dozens more have also been hurt and are hospitalized this morning. the teen-agers on board this tour bus were on their way to tour colleges in california. listen to what these bistanders said. >> heard an explosion and came outside and everything was on fire. >> there was a bunch of screams and there was a man that ran out and his back was like on fire. >> here is what happened so far, they believe the fed-ex truck crossed to oncoming traffic. investigators trying to figure out why. humble university had sent the bus to southern california to pick up prospective students to bring them on a college tour.

ten now dead. five people behind bars. this is a bizarre story coming out of the south. the f.b.i. storming into an atlanta apartment complex to rescue this man, frank januaryson, he was kidnapped nearly a week ago. agents say that the kidnapping was retaliation. januaryson's daughter is a prosecutor and put a man behind bars, this man. agents were able to track him down by listening in on milton's phone calls from jail to the suspects who then kidnapped him. but he's okay. and then letterman is out and colbert is in. >> late night debuted my first year in college. i learned more from watching dave than i did from going to my classes. and i got to tell you, i do not envy whoever they try to put in that chair! >> all right. so here is what we're hearing

a new face behind obamacare. >> yeah. i think it is a pretty smart time. i've been thinking about it this morning and in a sense -- hear me out -- it's a little like gwyneth paltrow and chris martin. i think there was a conscious uncoupling by the white house and kathleen sebelius. the point is that after the disastrous rollout, i think she lost trust of the president and the white house staff and she knew she was frozen out so the question is when does she leave? if she leaves at the depths of it, then that is really a sign, this is a woman trying to put this together for four years. it's a mess. they fire her in the middle and only adds to the perception that these are the keystone cops. now relatively speaking, it's a fairly good time for obamacare. they hit the 7 million number. better to fire her at a time of relative strength than at a time of relative weakness. >> we have sylvia burwell the

expected heir of the position here, choice of president obama. what's the word on the street? >> well, i think she'll almost certainly get through. i don't think they're going to decide in the last year that she suddenly has become completely incompetent. i think you'll see republicans use the hearing -- we're going to be talking to two members of the committee that will be having to hold those hearings and voting whether or not to confirm sylvia burwell. i think they'll use the hearings to first of all as leverage to try to get a lot of documents and a lot of information and to really go through everything that went wrong in the past and everything that could -- the continuing problems with obamacare now and in the future. >> sure. all right. chris, last sunday while you were doing your show, on another channel senator angus king, an independent from maine, he said

essentially that dick cheney should be water boarded and this is curious because now senator king says -- even though he's been caucusing with the democrats in the past, he might start caucusing with the republicans. here is that sound bite i alluded to. >> frankly, i was stunned to hear that quote from vice president cheney just now. if he doesn't think that was torture, i would invite him anywhere in the united states to sit in a water board and go through what those people went through. one of them 100 plus-outside times. that's ridiculous to make that claim. this was torture by anybody's definition. >> okay. >> not by the justice department. >> will the republican caucus accept him with open arms after that? >> let's put it this way, he's an independent and he really is an independent and prides himself on the fact he's not a republican or democrat. but as you say, he votes with the democrats. if he were the vote that put the republicans for the minority into the majority in 2017, or

rather 2015, you bet they would welcome him with open arms because suddenly all those ranking members become the chairman of their committee. yes, they would be happy to have angus king and let dick cheney worry about himself. >> what's the significance about the other major story yesterday and that's lois lerner being charged with contempt of congress? >> well, i think it's a combination of things because you had that by the house oversight committee yesterday and the day before you had the house ways and means committee do a criminal referral where they took all the information they've gotten in their investigation and referred it to the justice department. now, in a practical sense, is the justice department going to put her in jail? no. it isn't. first of all, you've seen the justice department has already been investigating this supposedly, criminal investigation for over a year, although the president told bill o'reilly in a super bowl interview there is not a smidgen of corruption in the whole irs thing. but it keeps the heat on and we're going to be talking about that on sunday with two members of ways and means committee. is there anything there or not?

is the president right, that it's case closed or does there continue to be? and does it -- i think is the key -- does it end with a mid level bureaucrat, lois lerner, or does it go -- there you see, sandra levin and the head of the house oversight subcommittee on ways and means. does it end with lois lerner or go up into the treasury department of the white house? that has been the allegation by some republicans and they sure haven't been able to prove it so far. >> those e-mails showed lois lerner with an agenda that have been revealed. do you mind if we watch your show on sunday? >> no. listen, we do it for a very select group and i'd like more people to watch. >> absolutely. chris wallace joining us from washington, d.c. >> and may i say that we had a delicious lunch and i was shocked, brian actually picked up the check of his own lunch. >> i had to fight you for it.

confiscating refund checks over decades old debts of some family members. some of the debtors have been dead for years and years, but the government still going after the ancestors. the feds have collected nearly $2 million so far this year. and it all started three years ago under the farm bill and that lifted a ten-year statute of limitations on old debt to the irs. so you may get stuck with a bill for something grandma didn't pay. public schools in denver are hiring illegal immigrants to teach our children. it is all part of a program with the organization, teach for america. keep in mind, the individuals teaching they're not licensed teachers, but they do have a college education. they're illegal immigrants who graduated from college and that's causing a bit of controversy in denver this morning. there are lots of american teachers who are look for jobs and say why give it to an illegal? >> right. you made a good point. i think i misspoke earlier. do you have to have a college degree to move through that
