she lands a big job. a busy night on the "kelly file" starts now. the showdown in the west is growing as tensions build so-called militia members mobilized and armed government rangers look to enforce the law. welcome to the "kelly file." i'm megyn kelly. we have live pictures from the bundy ranch. it's become ground zero between frustrated land owners and the burro of land management. there is a growing number of supporters for rancher cliven bundy vowing to stand behind a man that's become their hero with a face-off with armed government officers. the feds view bundy as an out law of sorts who is refusing to obey the law of the land and pay grazing fees. earlier this week the confrontation turned ugly.

[ bleep ]. >> back up! >> bundy's son was tasered and sister knocked to the ground. as the story gets attention, other ranchers, farmers and self-described militia groups are rallying to bundy's cause at meetings like this one held on wednesday. >> so you imagine what happened to those calfs out there right now? we give a dang about these turtles and mustangs. did god not create the cow? they got some less right than any other animal and then, and then, this is where it really gets rough, okay? this is where it goes way beyond. they control an army of men down there with sniper rifles on guys just like you are, people just like you, men, women and

children just like you are, okay? they believe they have a right to be there. okay? maybe you believe in some other place and you believe you could be there. and some day they are going to throw that army of men around you and then, and then, somehow they feel like they got the right thing to drop the tripod in the ground and set a sniper on the lawn so if you cross the line they can put a bullet in you? >> not in our country? >> who is the man behind that chair? i want to know. i want to know the blm. who in the -- which one of you guys gives that guy the authority to throw that rifle down? and when he does, which one of us is he going to shoot? god died for this country. are we going to give it up? this is a lot bigger than bundy,

all right? they are sitting on precedence, all right, precedence. >> wow, trace gallagher is monitoring this. >> reporter: megyn, there are at least a thousand people out there supporting the bundy family and not leaving. they are sleeping in cars and creating tent cities and clearly digging in for what could be, what they believe could be a long stand off and you have to remember, many of these people, if not most of them are from armed militia from nevada and the rest of the country. the concern here is they may provoke an armed confrontation. remember, the bundy family came out again today asking people to remain peaceful and leave guns at home. some are listening, many are not. 67-year-old bundy believes his life is in danger.

he has armed security guards protecting his property. bundy lost his right to graze cattle on this land in 1994 when they designated this area a tortoise has been tate ftor tortoise habit. they say this is about the over reach and abuse of power of government, and today, clivan bundy says he doesn't recognize his own country, listen. >> with the armed soldiers in there, and then i'm wondering, well, where am i? i'm not in afghanistan. i think i'm in nevada but i'm not sure right now. why would these people be here after me? >> reporter: now the burro of land management is holding a conference call right now. we're listening in, megyn. they have been trying to resolve this now for the better part of 20 years but that the bundy family simply will not follow

court orders. listen to moments ago how they responde responded, play this. >> before answering questions, let me reiterate we're engaged in this because a single individual refuses to obey court orders and abide by the law of the land. his actions do disservice to thousands of ranchers in the west who legally graze their cattle on public land and pay their grazing fees. >> the bundys have called for a bigger protest tomorrow, megyn and by all accounts, it appears they will get it. megyn? >> tracen as you learn more tell us what you're hearing. thank you very much. we bring in kevin wall who hosts a local afternoon radio show out in nevada and he's been covering the rancher stand off and talking with clivan bundy. help us understand. the feds have been saying look,

we have sympathy for him. we understand his position but have court orders here, repeated court orders. he's lost in the course of every turn on his challenge to our, the federal government's right to have this land and his responsibility to pay the grazing fees and therefore, he is flouting the low. how did he have a right to graze there and pay nevada and not the federal government? >> clivan bundy told me the other day he would be more than happy to pay all of the permit money to clark county, to the state of nevada. his issue is that the federal government has no business controlling 86% of the land in nevada. that's his beef, and he says he'll gladly pay clark county. i'll gladly pay the state but he's not about to pay the federal government. >> it's a protest move the. it sounds like what you're

saying and what i've read as a lawyer, legally he doesn't have a leg to stand on but trying to raise a point as you point out, over 80% of nevada of the lands are owned by the feds, something to which he objects because his family has been there for generations. >> well and clivan bundy says this is not about cows, the desert tortoise but essentially state's rights, and his big beef with the blm could be avoided. i'm very worried and a lot of my listers very worried that this thing is escalating. i had one listener yesterday by the name of joe said that he's going on saturday going tomorrow. he's going to take a tub of ice, a bunch of water and his weapons. when that happens, i get scared. >> i worry about law enforcement officers on the scene, too. they are there doing their job. this is a fight between the federal government and ranch owners. those who go to enforce the court orders are doing what we pay them to do and we're a nation of laws and they should

know more be raising firearms against the bundys than the bundys and their supporters should be threatening harm against them. what is being done at this point, kevin, to deescalate tempers and get this back under control? >> not much. i talked to the clark county commission chairman. he told me just a couple hours ago that he sees no role for the clark county commission in any of this evening though he's been asked by clivan bundy to get involved. the governor issued a couple statements and did behind the scenes negotiating but his statements have been somewhat tepid at best. someone has to stop this. it has to be on the federal side or clark county or it's going to have to be the state of nevada. >> clivan bundy has done one thing well and that's call attention in the issue. he's gotten the attention of the national news media and others. >> thank you, megyn.

well, developing tonight another fire storm of anger on the part of some on the left trying to drive someone from a high-profile job. we reported on brendan ike and he was forced to resign as the ceo mozilla. over a donation he gave back in 2008 to an anti gay marriage initiative in california. well, tonight conrice is the ne target. you know the clouds you use when you upload things on the internet? this is one of those companies. the online protest started calling for users to stop using this company called drop box. co-host of fox and friends weekend and so, another head is on the chopping block because they are upset about rice's

pact. someone is in danger of losing their position because of their politics. >> so the people who object to her appointment, object to her support for the were on iraq and the bush administration's nsa spying program. both of these are hard to understand. it's legitimate to be concerned about both of these things. many people supported the war in iraq including hillary clinton and barack obama. they are not the target of this. the idea crice is going spy because of her position at drop box is not going to happen. it's a campaign designed to make her be quiet and go away. >> do you think this is inspired by what happened -- >> of course -- >> to ike at mozilla. >> it happened before most people were aware it was taking place. they were remarkably successful

are considered fair game for the tax man. you got to explain this. jay christian adams with me, a former justice department attorney and legal editor of pj media. it's not -- it's one thing if they find out when i'm in college i missed a payment, right? i didn't pay what i owed the feds. it's not that. it could be my mom, my dad, my grandpa, they are coming after children, like the distant relatives of people who may or may not have paid their bills and taking it out of our refunds? >> imagine it, megyn, sitting at home wondering where your tax refund is and go to the mailbox and get a letter saying 40 years ago, your parents got a disability payment that we happen to over pay. so this is all the government's fault in the first place. we paid your parents too much, so now we're taking it out of your tax refund. so this is a crazy situation where the government messed up, now they are abusing taxpayers

who had nothing to do with it for something that was 40 years old. the government doesn't even have the original records. they have a line item that says they owe us some money so we are taking it. they can't even produce the records. >> so how are you supposed to defend yourself and prove they didn't over pay your mom or dad? >> the deck is stacked against you. first of all, it's the government and second, you can't defend yourself. you have no way of proving it because you didn't know it happened. you were a child. some debts are from the early 1970s, 1960s, you didn't even know that your parents got a disability check and suddenly, you get a bill. you don't get your tax refund. so there is no way to defend it. it's a classic abuse by washington d.c. of regular americans who don't know how to do anything about it. >> right, and then the people this happened to so far are complaining and suing saying this is not legal and complaining and now there is retaliation against them. can you imagine if you start a fight with the feds over where

your refund is and claiming how long it will take you to get it and how many legal fees you're going to have to pay to fight the fight? >> and some of these dollar amounts are a couple hundreds of dollars. so we're not talking about earth-shattering figures, and we don't even know why this law got repealed. that's a really interesting story -- >> because there used to be a ten-year cut off but whoops, got rid of that. >> that's why you have ten-year cut offs because you lose records, can't prove anything. congress says it wasn't us, it was the obama administration. the obama administration says it wasn't us, it was congress. what it does mean is the people aren't getting the refunds because of an abusive stupid government that doesn't know how to do business. >> at this point, let's find out who was responsible and continue pursuing that. that's no excuse. administration should say, okay, we don't know who did it. maybe it was us, maybe it was congress. we're going to stop it. we're not going to make -- there

from the world headquarters of fox news, it's the "kelly file" with megyn kelly. a troubling story developing out of kansas city tonight as police announce a dozen appar t apparently random shootings may,

in fact, be connected. they don't say how or who may be to blame. trace gallagher has that story. >> it could be up to 20 cars, maybe less. they are trying to get an exact number now but the common denominator is they were either getting off the highway or getting on. they say the shootings may have been linked and won't say how many and if the caliber weapon was the same. one woman says she was fired at by a passing car where the driver was wearing a ski mask. it does not appear to be a sniper type situation like in d.c. another victim says she was with her kids and it sounded like a big rock hit her car. listen. >> we just continued talking like what was that? and then went on about our time until my husband saw the hole in our car and realized that it was a bullet. >> reporter: you have local police, atf, fbi involved trying

what's in your wallet? back now to our top story, breaking news in the bundy showdown in nevada. tensions have been building there as more than a thousand protesters have traveled to this area to lend support to rancher cliven bundy. he's in a face-off with armed agents from the burro of land management. they say and several courts have said that he is breaking federal law. he has challenged the feds. he's brought his case to court, and he has lost every time, and yet, he refuses to compile with the court order and he is standing on principle at this point. he believes the feds are -- have stepped over the line and finished a conference call with reporters announcing they rounded up about 300 cattle and

say they are stress patrespassi. we are there live and update you as things unfold. >> tonight, new reaction to a startling climb from a u.s. senator that the white house is dismantling the nation's laws. critics of the obama administration says the administration is intentionally sidestepping the rule of law in pursuit of an agenda and that is setting a dangerous president for the entire legal system. here is jeff sessionens. >> our law enforcement system is in a state of collapse. it's a deliberate plan by the president of the united states and it's wrong and people need to be aware of it and stand up to it and i think the american people are beginning to do so. >> joining me now, republican south carolina congressman trey gouty. congressman, good to see you tonight.

so the sessions were focused on illegal immigration and talking about how 2/3rds of the numbers of deportation and removal is basically people who just crossed that get turned back by our agents on the boarder and that they are over stating their numbers and believes we are now at a point where it's complete lawlessness. he points to this statement by our own vice president in march. listen here. >> 11 million undocumented aliens are already americans in my view. >> already americans he says. >> i discount what vice president biden says. i'm happy when his comments don't start a world war or invade a solar system -- >> it's eric holder, too. >> no, it's the attorney general. it's the attorney general and i take that much more seriously. when he says you have a civil right to violate the law.

for electoral success or just a world view? because we had a lot of discussions about what happened under the president obama, eric holder civil rights division and their choices when it comes to enforcing those laws. is it motivated by getting voting blocks shored up or they just view that the population of illegal immigrants, they view the civil rights laws and voting laws differently? >> well, how about the drug laws? i mean, he trumped a congressional statute with a memo. you know, i think it's about electoral success. go with contrast, the statements by senator obama with the statements by president obama. he was concerned with executive over reach but not anymore. i think the motivation is two-fold. number one, they want to win elections and frankly, megyn, they are doing a great job. they won the popular vote in five out of the six national elections. there is other motivation that

we are getting a few more details now about the rally at the bundy ranch in nevada. as the sun sets in the live picture, as we mentioned more than a thousand protesters have joined rancher cliven bundy in the showdown with the burro of land management who has won repeatedly in court, the feds have. we are learning some of them, some of the folks joining cliven bundy has driven as far as new hampshire. one group went to nevada to protect the protesters and an issue of free speech as the

i think that in front of a jury, the emotions of the defendant, his stature would all have some effect on jurors causing them to say do i really want to run the risk of sending this guy to prison for the rest of his life knowing who he is and seeing how he behaves? you have a judge there. judges are seasoned and seen every trick in the book played. it's a strong circumstantial case and making it stronger by picking apart his story. >> no way of predicting and so many things the police did no botching the investigation that are not helping the prosecution. we'll wait and see how it plays out. osc osc oscar pistorius didn't do himself a favor. in a moment, a final thought plus, "hannity" at the top of the hour.
