ceo of chick-fil-a stand down. he apologized for speaking his views. promised he wouldn't speak out anymore. he wants to expand business to big cities. maybe he will. but his reversal of position and surrender to the very people who tried to put him out of business is agut punch to the millions who stood in line to keep him in business. i can tell you i hope that work out for him. we asked him to come out our show to explain this, he declined but the company did offer to send a pmple r. person to talk about a new sandwich that they have. no thanks, i'm fighting so that my grandchildren can keep their rights to free speech and religious freedom. not for a tasty new sandwich. compare that to the newly surrendered chick-fil-axt to

grateful 238 years ago there were those who founded this nation that put a greater value on our freems and freedoms and our liberties than they did seeking favors from government to open up a new store and i think it's going to take those that are willing to defend those freedoms today to preserve them or else they are going to go away as you said in your monolog monologue. >> when i think about some of the people on the left, ceos of places like am azan, starbucks, apple computer, i use their products but i don't buy their politics, and i don't necessarily want the people who work there to be put out of business or to be shut up. this is america. they are free to do that. but it seems like the left has decided it's not enough to have a different point of view. they want to shut down the view of others. why is it that businesses would capitulate to the pressure and demands to shut up and go away and not say anything when nobody is asking the left to do that? >> yeah.

i think that's a good point. i think america is really kind of seeing a whole new chapter being written here in the culture wars. as a result, you know, we were told a few years ago ago, this was all about -- two people who love each other. that's all it's about. being able to live together and marry. we're finding out it's a lot than that. tolerance is a one-way street for these individuals. what they want to do is force the rest of america is not just to tolerate, but celebrate what they do. they want to redefine america. they want to radical transform america. even conservative business owners who are fearful of these protests, of these attack, are simply going silent. they are going dark on these issues and they are capitulating, and this is allowing this group to roll

over. our freedoms and our liberties and the dangerous things about this, governor, and you understand this, is that this is what makes our system work, the ability to have an opinion, express that opinion freely, and come into the public space and wrestle through these issues. what they are wanting to do through this is literally silence the vast majority of americans who do not agree with them. that will be did he trit mental to our system of government. >> tony, i know this is a very personal issue to you because of the fact that your own organization targeted with violence in a way that very few have. you've seen what economic terrorism and outright physical terrorism looks like. i appreciate your being here to respond. it's dprat to have you and pleasure always to see you on the show. the truth is i think what's happening with chick-fil-a, perfect example of democracy at work. why did he retract his statement? he wanted to expand his business into the northeast. it's the all mighty dollar. >> why is it that conservatives like me, i buy products, i don't buy politics. i watch barbra streisand. why am i open minded and can still enjoy what people produce? >> there's a couple of examples that even theleft, i'm a huge george straight fan. let's talk about duck dynasty. a & he took him off the area and his viewers demanded he brought

back. so some of those viewers are the left. my mother watches it, and she's as liberal as they come. there are moments in which we as americans decide to vote with our feet, with our pocket books as well as with the ballot booth. that's what's happening here. >> let me ask you, emily. in this case, let's take the mozilla case. we've got the pressure was clearly to get rid of the ceo for something that he did six years ago that reflected the same view that barack obama and hillary clinton had. it was about shutting done the viewpoint of somebody else. >> yeah. it was the new ceo of mozilla gave money for proposition 8 which was for traditional family in california which passed, by the way. so it's his personal view. it's probably his religious view. they forced him out purely based on his first amendment right to express his right. obviously it's their right as a

public company to do that but is that american? is that what we do? is you lose your job over your political views? >> you would find some dpraemt from an interesting source is andrew sullivan who is very liberal and a pro gay rights activates. >> i don't want to bring this kind of political warfare into the workplace. we got to be able to get along with people we sincerely and passionately disagree with. >> why should we sit back and say it's okay if people push an executive out of positions because it is personal view? not that he's affecting their customers, not that he's showing discrimination or big to the tri on his job but don't people have a personal life in america and a personal viewpoint? >> i think you -- governor, i think you know perhaps better

than many what it's like when you enter into the public life, how you do lose a huge sense of privacy and while these gentlemen, these ceos and gentle william are not not rupg -- if you are going to put yourself as a ceo of a for tune 500 company, you will be attack for it. the why are they caving? why did the chairman of mozilla leave? he wasn't forced out by his board of directors. he simply said i don't want to do this any more. >> it was virtually impossible for him to stay. i think there's a feeling of sort of disappointment, i think, among conservatives and what chick fail lay has done by we're not going to talk about it anymore. i think, you, also i and i both as christian conservatives, our beliefs are important to us, i would never back down from them. even as confronted. >> why did he back down?

if those beliefs were so crucial to him, why did he come out in the papers and say i'm being forced out for this? if his conviction were that strong for him and if they were, i respect that, but he did nothing but just vanish into the night -- >> but, liz, is it because -- let's be fair, the media controls the way this is going to be presented. he's going to be presented as a homophobic hating bigot. maybe that's why he wants to get out of the public square. there are a lot of people who identify as christian. would it appropriate if i call them let's boycott every business that's friendly to s e same-sex marriage. i believe in the marketplace. i think that's what makes america a great country, let people who disagree with my view, i'm okay with that.

a question of -- a freshman is trying to provide -- start a pro life club at her school. it's not the only school where students pro life has had trouble. joining me now is the president for students for life america, kristen hawkins. great having you here today. let's talk about the kind of resistance that this young lady in virginia has specifically faced in trying to start a students for life organization. >> sure. well, mattie went to her principal this february asking how to start a pro life group. he said find a teacher adviser.

he said why don't you look at the christian group. i think you should join the christian group instead of starting a pro life group. mattie said abortion isn't a christian issue. it's a pro life issue. she's gone back to her principal for a third time, asking her again to allow her to start her students pro life group. he's said it's controversial. >> controversial. are there some other groups on the campus that some might find controversial. >> sure. there's a republicans group. there's a democrats group. they are able to have free discussion on her college campus, but this is what we're seeing -- >> high school. >> but this is what we're seeing all across the country in high school and college campuses, that administration officials say it's just too controversial or too offensive, we don't want to talk about abortion and that's not right, because we're not asking for special rights or special treatment. we're just asking for equal

treatment. because this is an issue that affects high school and college girls. planned parenthood sets up shop, the nation's largest abortion vendor is five miles from the college campus. we've former planned parenthood workers come out and say this is their business cycle. they run sex education programs. come back to us when you are in trouble. she comes back for the abortion and repeat, repeat, repeat, for the rest of her life. >> you have trouble getting these clubs started on campuses all over the country. >> yes. >> is the excuse typically you are too controversial? are some of those honest and just say we don't want that point of view on our campus? >> this is a human rights issue just like water in africa.

this is the core issue of the right to be born. pro life has a right to talk about it. this is an issue they are going to deal with all their life. do you as a human being have the right to be born? >> do you think this case in virginia, will it get reversed? is there going to be an opportunity, maybe the principal will look at it, you know what, it's a point of view, this is how kids are supposed to learn, how to take a stand for what they believe? >> i think they will. we've always been victorious. we've had to get lawyers involved in some campuses, we've had to invoke public pressure. >> great to have you here. well, she was taken from her family by the commonwealth of massachusetts, but justinea's

live from america's news headquarters, i'm harris faulkner. three people are dead tonight after shootings at two jewish-related facilities in suburban kansas city. police have arrested a suspect. you see a man in the middle of screen. all they are saying is he's in his 70s and not from the immediate area. two victims killed in the parking lot at the jcc the third victim killed at a retirement community a short distance away. federal investigators have said they have found no physical evidence the truck was on fire when it crashed into a charter

bus. the accident happened last thursday. the students were on their way tie college tour in northern kal cam. ten people died in that. including students, shaper roens and the drivers of both vehicles. now back to huckabee. >> over the last two weeks, we've told you this story of justina peltier, the 15-year-old girl who has been taken away from her family and by the department of massachusetts. lou informed us of some shocking developments. >> we had our weekly one-hour visit with justina. what we found out was disgusting. we went that she went to see her doctor, that same doctor is not allowed to speak to us, not allowed to give us any ideas what happens. that tough doctor is the same ones that justina's parents have

been getting her back to for treatment after they disagreed with boston's doctors claimed her problem was mental. >> she's obviously in severe physical distress. they are now back to the doctor we wanted to be 14 months ago. >> after hearing the story on huckabee, constitutional attorney alan dershowitz agreed to consult on this case. >> the state has committed a crime against his family. she went to boston children's for one reason only. was meant to be a gi admission to see her doctor. she was taken without any notice and brought up to the neurology floor and as far as i know and based on fbi involvement, that is kidnapping. >> well, since their last appearance on this show,

justina's lawyer matt staber has highland a habeas corpus against the state. there was been bill introduced to return justina to her family. she's not been allowed to attend mass. june in a remains separated from her family and custody of the state. the massachusetts dcs is under fire for many other cases as well. earlier, i spoke to michael levinson. he's done extensive reporting on the problems. >> you've done a lot of reporting on the bigger problems going on in massachusetts dcs, tell us what you have discovered as you've look at this agency, and is the justin nah peltier case not only thing that is controversial at dcs? >> that's right. the agency has been under intense scrutiny for several

months now, particularly over a case of a five-year-old boy who was under their care who they completely lost track of and is now feared dead and it's sort of led to a whole host of investigations and a whole host of problems that have been turn up there. overwhelmed social workers. lack of technology, lack of coordination, and the whole agency is sort of under a lot of pressure right now. >> how do you lose a five-year-old boy? how does that happen? how can a state just simply not know where a child is and i find that just stunning? >> yeah. it's really an unbelievable case. this was a boy that was in a very volatile family with history of violence and drug abuse, and the state social worker was supposed to be checking in on him regularly and just simply wasn't doing that and perhaps even more egregio egregiously her superior was lying about on some forms she was filling out. both of those people have been fired but the tragic outcome is

the boy has not been seen since september and is presumed dead. >> since september. so we're talking many months and the state who has responsibility for overseeing this child, they have no idea. i mean, it does not give one a great deal of confidence in the other cases that the dcs is working with. what does the state didn't or what are they doing, michael, to try to get to the bottom of what is clearly a serious problem in their agency? >> well, the child welfare league of america is doing a review. several legislative committees are investigating the agency. this was an agency cut very deeply in the recession. right now they are trying to hire many more social workers and caseworkers who are overwhelmed so they are not juggling as many families as a time and they can send some time

with the families. they are giving them things that they can run more smoothly. >> mike, i'm sympathetic of what an overwhelming challenges that an agency like this faces. i'm not owe blifious to that. but neither am i owe blifious am i to their responsibility. my understanding is the commissioner has offered to resign and the governor did not accept her resignation. why not? >> that's right. she's been in the agency first as a front line social worker. worked her way up, there have been some intense calls for her step down. she actually knows the inner workings of the agency and she's best positioned to try to put in

these changes. the governor is on his way out in january. rather than bring somebody in new now, the understanding is that when the new governor takes over, she or he will install their own person. >> i can understand that except when you've got cases like the one you've described, the five-year-old, missing since september, presumed dead. you would think that somebody would have a little better sense of urgency. let me ask a specific question about the case of justina peltier. last friday a bill was filed to return custody of justina to her family. where does that bill stand? does it have any chance of passing in the massachusetts legislation tour? >> i think it's a facing a very steep climb. there's a small vocal group of supporters of that bill, mostly republicans in the house, but the leadership and the governor have not shown any interest in it. the governor said he doesn't feel this is an issue he should step into. he feels it's been a decision made by the courts, and it would

be violating the separation of powers, so unless something dramatic shifts, i don't see that gaining much traction in the legislature. >> it's a very interesting case. you've taken a great deal of time of getting the in-depth story. we appreciate your being with us today. thank you. >> thank you, governor. >> well, i'll continue to update you on the justina peltier story. this past friday, the peltiers met with their daughter. they were able to secretly record video that they were passing along to us exclusively. in the video, you can see that justina clearly wapts to be home with her family and does not want to be in custody of the state. >> i want to go home now. >> it's a very quick piece of tape. i want to play it one more time for you. >> i want to go home now. >> she wants to go home now. and justina i want you to go home now too.

i started playing at tootsies. i gained notarity there. i played there for one year. a nice cap off to that was back in the fall, i played the tour for the first time for the grand ole on -- onry. it's five feet away from door to door. that was a pretty surreal moment for me. it was a validation. i spent a lot of my nights in the backseat of the car trying to make something happen. to pull into the same alley i slept in and go in the mecca of country music. world wide music, nowadays. >> that's a short five feet. but it takes a long time and a lot of effort and a lot of people never make all five feet from one door to the other. >> let's take it to the bank. >> let's take it to the bank.

criticizing me for attitudes about women she imaged she heard. i say image since her perceptions were so off the mark it was to be laughable. i realize she probably wasn't able to read my actual comments and had someone read to her from reliable and objective sources like the huffington post, salon or slate. yup, those are the voices one can count on to deliver the news and news of a conservative lick me accurately. it is easier to makeup stuff than engage in an honest discussion of an issue. that's why president obama took to the streets this week as did so many senate democrats just like mckaskill. they were out championing equal pay for women in equal jobs. for the record i support equal pay for equal jobs. honest studies show there is equal pay in some cases equal job equal meaning working the same hours and having the same

responsibilities. maybe a nickel apart at worse. it would be incredible if the white house paid its own staff equal to the men which it doesn't. or if some of the democrats up for reelection would pay their men which they don't. the average pay for democrats in the senate $0.79 on the dollar for women verse the men. i hired more women in ex secuti positions than any governor in my state's history including bill clinton. if senator mckaskill -- if senator mckaskill wants to get on men about treatment to women she should read up on the democratic colleagues in if the senate or if necessary i will read it to her. by the way i will charge her the same as i would a man.
