supporting mr. bundy are in his view domestic terrorists. >> senator reid yesterday you called mr. bundy and his supporters domestic terrorists. i thought we were trying to calm the situation down, so what did you mean by that? >> just what i said. >> talk to me a little bit more about that, senator, in the sense of what triggered the pullout? you're obviously privy to intelligence. what was it they were doing up there that would make you call them domestic terrorists? >> the cattle men association has a wonderful branch here in nevada. i met with them last week. they pay their taxes. they pay their fees, they follow the law. bundy doesn't believe that the american government is valid. he believes the united states is a foreign government. he doesn't pay his taxes. he doesn't follow the law.

he doesn't pay his fees. if anyone thinks by any figment of their imagination what happened up there last week was just people rallying to somebody that was oppressed, 600 people came in armed. they had practiced, maneuvered, they knew what they were doing. they set up snipers in strategic locations with sniper rifles. they had assault weapons. they had automatic weapons and boasted about the fact they put women and children, in fact, one retired sheriff from arizona posted he put women and children so that they would get hit first. so 600 people, if there were ever an example of people who were domestic violent terrorist wannabes, these are the guys. i think that we should call it that way. we have a situation where i think that it's really not

appropriate. would it be appropriate if the owner of this station got behind on the taxes or had a problem with the federal communications problem to station around here when people try to collect taxes or do something that was within keeping of the law and surround this place with armed people? of course not. remember, not only did bundy do what i've just said, there are two valid court orders, a permanent injunction, take the cattle off the land. pay the fees. >> senator heller, are they domestic terrorists? >> no. >> i call them patriots -- >> and i said, these people think they are patriots, they are not. i used that word. if they are patriots, we're in big trouble. >> well it's a pretty broad brush when you have boy scouts,

repeatedly called for peace. he told people, don't wear camouflage, leave your firearms at home. these individuals didn't come out with fully automatic weapons, if he wants to use that as a definition, look at the blm. these were grandmothers, kids, ranch hands. here is the contrast and optics, megyn. you had 200 agents, helicopters that showed up. you contrast that with a number of cowboys on horseback unarmed with the american flag waving in the wind as they bowed their head and said a prayer before they rounded up these cattle and took them back out to paste tore. for harry reid to do this is reckless. he's trying to insight something. i get the impression, megyn, he's unhappy with the peaceful resolution and outcome that took place and i have to question why in inner this era of new tone.

that they don't -- and honestly, there is no way she can say what she thinks in way to accept it but they would like it if she would say it differently. so please speak about your oppression in a way we find acceptable and i think that it's outrageous and when you think about the fact that how christianity, when people criticize christianity and i bring up ann rice who quit christianity. she called the catholic church i'm moral. it was broad brush condemnation of the catholic church, which is her right and i support that. i don't criticize ann rice for that. i wrote a column when it happened and i think she's a lovely and interesting person and has a right to say how she feels and express her frustrations. for some reason, a muslim woman is not afforded that same -- or former muslim. she's not a muslim anymore, is not afforded the same right.

rancher on one side and i would say the dubious or corrupt politician on the other and the question is, who is the real crook? who is fanning the flames. terrorism is when you target innocent civilians and when you call people domestic terrorists, you're almost saying they should be targeted and killed. i think this is irresponsible of harry reid and the people are angry about it. >> i understand they have a statement they are making particularly with respect to mr. reid. what is it? >> reporter: well, a whole bunch of people here have name tags and even little kids have them saying domestic terrorists. when you look at an all american kid with a domestic terrorist sign, you see what is really going on here. i think this is not really about whether mr. bundy paid taxes or not, this is really about the rule of law and whether this administration is enforcing it

even handily or whether or not the obama guys are enforcing the laws they want to enforce and enforce them against the citizens they are against. >> do you see similarities between this case and your own? i mentioned earlier targeted by the feds and you're facing prosecution for campaign donations which many legal analysts said is small potatoes and surprised the feds brought it. >> reporter: quite honestly, my case is going to trial in may and i'm preparing for it. it created in me a sense of vulnerability and sensitivity to these issues of justice, but of course, i didn't have swat teams on me. i wasn't in the sights of snipers, so i feel that these guys here have been facing some real domestic terror from their own government and that's a very scary idea in america. >> thank you. >> reporter: thank you. break tonight, the captain

rest of the air which was trapped would have escaped almost immediately. if you watched when the vessel was rolling over, the portholes were blowing water as much as 20 to 30 foot straight up. that would have happened as soon as you cut a hole in the top of the hull, air would be forced out and water would replace it and go down quickly. >> what conditions are the divers facing? >> diving there is difficult. the conditions have been very rough. they are running three to five-foot seas. the visibility is as little as three to four feet, but they also have a current and that current when you say moving water, they are saying the water is moving between two to four knots, that's 200 to 400 foot per unit. the human can't swim against that. top-graded navy seals would be forced like flags along the sides. >> what are the odds of any survivors in 55 degree water temperature? >> there are no survivors. the hull was not designed, the

joe, good to see you. let's start with the allegations against representative cummings who is on the house oversight committeeme committee. the suggestion is he was focused on true the vote down in texas and got looked at and the fbi and federal agencies, and that he asked the irs for publicly available information about true the vote, and at the same time, the irs was targeting them, the lawyer for true the vote smells a rat, and believes that the two were cooperating. was there anything wrong with mr. cummings seeking publicly available information? >> i don't think so. the key was he was asking all the documents and e-mails show he asked repeatedly or a few times for publicly available information and only publicly available information, and the

other thing that's interesting about this is that the irs was investigating true the vote way before comings ever asked for public information and only the public. he doesn't ask them where their investigation was or to investigate the group. he just said can you -- he asked, i think, if the tax returns were public information, could he get a copy or something -- >> now that important because he was accused by the lawyer for true the vote, by putting true the vote on the irs' radar screen and denied that and they said his denial spoke to more. in any event, it's important he put them on the i rrrs' radar screen. with the information, joe, what the try the typically when that is done, when the house minority would seek documents like that from the irs, they would let the majority know about it and claim this was done without such communication,
