see you next time. a fox news alert, the official death toll rising to 36 people in the ferry boat disaster off south korea. welcome to "america's news headquarters," everyone. i we're now getting word that divers have spotted bodies inside the doomed vessel. the captain of the ship is under arrest, charged with suspicion of negligence and abandoning his passengers. two crew members also taken into custody. david piper is streaming live now from bangkok, that i would. david, what's the latest there? >> reporter: search teams are

still struggling to get inside that sunken ferry. we do understand that some of the dive teams getting to the passenger jet today, they suggest they saw three bodies but they weren't able to retrieve them. rescue teams haven't given up hope of finding survivors trapped possibly in some air pockets. the ferry's captain and two of his crew were taken into police custody overnight, charged with negligence and failing to secure the safety of passengers in violation of maritime law. survivors have said they weren't told to evacuate until 40 minutes after the ship began to capsize. the ferry's captain has been defending why he didn't order passengers to abandon ship immediately. >> translator: at the time, the current was very strong, temperature of the ocean water was cold and i thought that if people left the ferry without proper judgment, if they were not wearing a life jacket and even if they were, they would drift away and face many other difficulties.

>> the captain also confirmed he wasn't on the bridge at the time of the accident but instead in a cabin. a prosecutor has said the third mate, a 25-year-old woman, was steering the ferry at the time of the accident and was navigating the area where it sank for the first time, tracking data from the maritime ministry has revealed the vessel made a sharp turn just before sending its first distress signal and divers have reported no sign that it hit any underwater rocks. back to you. >> david piper, thank you very much. search teams now recovering a 13th body on mt. everest following a massive avalanche yesterday. three people are still missing in what is being called the deadliest disaster on the world's highest peak. dominic has the story for us. >> the avalanche clearing at

6:30 local time there on the nepalese side of mst everest. this is one of the worst tragedies in the history of mountain climbing. on the south side of everest, what actually happened was a group of 20 sherpas, the ethnic nepalese guides that climbers use to get their equipment up and down the mountain, they were coming down between -- if we look at the map. between camp 2 back down to camp 1, they were on their way down when a large chunk of ice and rock and snow above them suddenly broke off and engulfed around 30 of them. extraordinary dramatic stuff. early in the morning it happened. so it was time for rescuers to actually get in there. we spoke to one american climber who was at base camp preparing to go up. listen to how he described it.

>> so far they've flown down over 13 bodies, both in body bags and just handling them off down the line to a helicopter. base camp is kind of scrambling and all the teams are pitching in and trying to help get the bodies off the mountain and get attention and medical treatment to those that they got off there. >> everest is disputed as to whether it really is the world's most deadliest mountain. there are other peaks around the world where we hear of many other accidents amongst climbers. the sherpa community very shaken by this.'re a small community o professional sherpas that take climbers up. the families of the victim say perhaps the routes for this season should be closed and get rid of people on the mountain. take a listen. >> translator: there's been a loss of 15, 20 lives or manpower. it would be in respect for them if all the climbing sherpas were to do this. it would solve the problem. plus the nepal government should

try to convince the expedition team and trekking teams as well. >> unfortunately those expeditions are the backbone of the company there. an average sherpa earns about $125 per expedition. the community very torn about what happens next. >> dominic, thank you very much. there is more frustration in the search for the missing malaysian jetliner. the robotic submarine, bluefin 21 searching deep into the indian ocean and coming up empty after making its seventh dive. the u.s. navy sub has covered around 51 square miles since it began diving on monday. the plane vanished from radar six weeks ago. today, up to 11 airplanes and 12

ships taking part in the search, scanning the ocean's surface for debris. new developments on the stand-off in ukraine. officials in kiev calling for an easter truce, promising to suspend military operations against pro-russian separatists, this while the insurgents defy an agreement to disarm and refuse to give up control of several occupied buildings. leland is streaming live from ukraine with more. leland? >> this is really a cold war-esque stand-off with eastern ukraine caught in the middle. the u.s. and much of western europe is supporting the weak government in kiev. on the other side, you have moscow behind the pro-russian separatists that have taken over many of the government buildings here in donetsk. they are well-armed. the russian military is now acknowledging the tens of

thousands of troops it has near the ukrainian border are there because of the unrest inside of ukraine, not for some military exercise as they had suggested in the past. and there's a real fear that the russian government will use their military to come in and invade ukraine, much in the same way they took over crimea earlier this year. many here believe there are already russian special forces troops and also members of the russian intelligence services here inside eastern ukraine organizing and supporting these pro-russian separatists that have taken over a number of these buildings, flying the russian flag, demanding referendum here. the ukrainian military for its part badly outgunned, outnumbered by the russian military. they have called an easter true to what they call anti-terror operations against these separatists. but it's unclear if they wanted to kick them out of these buildings, if they possess either the tactical ability or

the military equipment needed to do that. both sides right now here in eastern ukraine realize that their fates are much more in the hands of washington and moscow than it is up to themselves. the united states for its part said it is considering tougher sanctions against russia if there's not more progress made here on the ground by the middle of next week, which means that there is a definite darkening in the shadows as the war clouds loom here on this easter weekend. back to you. >> that is for sure. leland, thank you very much for that report. meanwhile, a u.s. drone strike in yemen killing at least nine suspected al qaeda militants. the attack targeting a car in the southwest part of that country. the al qaeda affiliate in yemen considered the terror group's most dangerous in the world suspected of plotting attacks against the united states. the strike also killing three civilians who were driving by in another car. no comment yet from u.s.

a tsunami warning was issued but is still not clear if any big waves were created. in wyoming, a landslide broke an entire home in half. an evacuation order is in effect in hopes of avoiding any injuries. and in california, police raiding the "l.a. times" building following reports of a shooting threat. the paper reporting that a man in his 20s was taken into custody friday night. one woman in the office says a co-worker had shown her a bag of bullets and said he was depressed. a dramatic back-and-forth between cliven bundy's family and senate majority leader harry reid over last weekend's stand-off involving hundreds of self-described militia groups coming to bundy's aid to protect federal action and help him defend his grazing ability. here's part of the comments between the nevada lawmaker and

for reid to say this is domestic terrorism when not a shot has been fired is beyond the pale. >> cut to the chase for me, john, as you see it, explain the politics behind all of this. >> i think the democratic party is in trouble. obamacare isn't doing well. the economy is very sluggish. foreign policy isn't going well. so in the midterm election when voter turnout is down, there's an active effort to ramp up the base, rile up the base. you see that in all the calls about the war on women. you see that in all the calls about the environmental issues. ramping up the base and, of course, the president making a speech about voter id laws and said a lot of things that simply weren't true, this is part of that. >> you took a lot of pieces of a puzzle, i need you to connect it for me -- >> if you energize your active supporters, get them riled up,

they're more likely to go to the polls. >> how does this apply to all the other things you mentioned? >> the tea party is very unpopular among democratic voters. the tea party and many of these people supporting bundy are part of the tea party, they have been called extremists and racists for so long. if harry reid stirs up people and says, these are domestic terrorists, if you get people angry at their supposed enemies, you get them more likely to vote. >> we showed a picture there of mr. bundy. talk to me about this. you mentioned the tea party and many of those being the supporters of mr. bundy and his efforts out there. is it the chicken before the egg? because of course we see many people who showed up with guns, automatic weapons. >> sure. >> so i ask you, did the s.w.a.t. team show up first? >> yes, of course. >> and then the folks -- you're saying the s.w.a.t. team showed up first and then the so-called tea partiers who were armed, you say they showed up after that?

>> i would prefer that no one show up with guns. >> of course not. it's very dangerous. >> exactly. anything can happen. now bundy is in the wrong, if you believe in the rule of law, he has to pay his fees, even if it's an unjust system. having said that, the way we do that, we haul people into court, we get ripped and the sheriff does that -- there shouldn't be militarized forces coming out with full military hardware. i suspect that bundy would respect the sheriff where he wouldn't have respected these people. >> you say the sheriff hasn't stepped in here -- we're talking about bundy saying he did not pay his grazing fees for what is supposedly deemed as public land. and so you're saying this has been going on for a long time now and you would think the sheriff did show up and say -- >> no. if you have debts, eventually you have to give up your property and pay it.

so i think this was handled in the wrong way. even though this is federal land, this should not have been handled by the feds. my brother's a former deputy chief of police in tucson. he says the last thing you want is federal involvement in something that is primarily a local responsibility. >> why didn't the sheriff show up if that's -- >> because the feds pull rank. the feds show up. >> so the bureau of land management showed up along with the s.w.a.t. team -- >> yes. >> with arms, you're saying and the bureau of land management is there to manage the land, bundy says, listen, i'm not paying these fees because they're supposed to manage my land but they ran my land into the ground. i want to play a sound bite. this is between senator harry reid and the sister of mr. bundy, margaret houston. listen. >> cliven bundy has not recognized the united states. he says the united states is a foreign government. he hasn't paid his taxes. he doesn't pay his fees, unlike

the rest of nevada ranchers. and he doesn't follow the law. >> harry reid doesn't even know my brother. he doesn't even know my family. he doesn't know what we do. we pay our taxes. cliven's always paid his taxes. >> you hear the sister saying, these are two separate issues. my brother paid taxes. senator reid said not only did he not pay the grazing fees, that mr. bundy did not pay taxes either. what's really going on here? >> if bundy didn't pay his taxes for 20 years, i suspect something would have happened to him. i don't think that's likely. you have to handle it in the courts and you can attach property. you can attach bank accounts. you don't have to get his cattle. there are ways of doing this without sending armed s.w.a.t. teams in from the federal government. it can be handled quietly. >> those were scary from the f government.
