now, his crimes led investigators to crack another case. good wednesday afternoon to you. a man who shot and wounded a screaming teenage girl said sorry ab that and then he killed her. he said he fired that last shot because he didn't want her to suffer. we're now getting chilling details of an audio recording the shooter himself made when he killed these two unarmed teenagers. they're cousins. it happened in minnesota on thanksgiving day in 2012. prosecutors played the audio for the jury in his murder trial. the prosecutor said it was self-defense that he was terrified when they broke into his home. under minnesota state law people are allowed to use deadly force to save their own lives or stop felonies in their own homes. cae shooter planned the killings in advance and waited with books and snacks to ambush the teens

in his basement. court documents show one of them had broken into the home at least two other times. cameras are not allowed in the courtroom. we can't hear the recordings ourselves when the prosecutors played it for the jury but that jury heard it and reporters in the courtroom are describing its for all of us. it starts with the sound of glass shattering when the teen breaks in, then we hear gunshots followed by a groan. one of the two teenagers falls down the stairs to the basement. the shooter then tells him, you're dead. several minutes go by before the 18-year-old cousin calls for her cousin. then, the sound of more gunshots and a body tumbling down the stairs. the injured teen screams and says, oh, my god! that's when the gun plan says, sorry about that. then he says, you're dying. and then he called her a bitch, before the final gunfire. what he later told investigators was a good clean finishing shot.

let's get to garrett. what's happening in court today? >> reporter: prosecutors are continuing to build their case byron smith was a vigilante out for justice on his own terms, not someone simply trying to defend himself in his own home. smith is facing life in prison and charged with two counts of first degree premeditated murder and two counts of second degree murder. added to those chilling recordings, today, the jury listened to a forensic scientist say based on ballistic the 65-year-old veteran fired two shots at the second teen's head from less than 6 inches away. another shot less than a foot away. >> how is the defense countering that evidence? >> reporter: well, their point is that this man was living in fear. his home had been burglarized at least 12 times, they say, as recently as a month prior to these shootings. he had several thousand dollars

stolen as well as several of his guns. after that, they say smith was so worried it would happen again he installed audio and video recording devices and started carrying a handgun with him around the house. after the shooting smith told police he didn't have time to ask questions to see if the intruders were armed. said, i have a choice of being the shooter or getting shot. the defense has also pointed out the two teens had been linked to several other area robberies and a special agent even testified 18-year-old haley texted a 10 earlier that same day saying that the two teams were a team for burglaries. we're told this afternoon the jury will see the video from those security cameras and see right then when the teens were breaking there into his home. >> garrett tenney. thanks. he said either shot or be shot. of course, the two teens were not armed at all. the judge said he didn't know that after all he had just broken into his home.

this is a tough one. we know of two things that work against the defense. one of them is that he told the authorities the last one was one clean kill shot. >> right. >> secondly, he took the gun, got it 6 inches from the head according to ballistics in the testimony in court and fired not one but two shots. what you're supposed to do is try to disable them, right, >> correct. you're supposed to keep them from shooting you which obviously could have been done with one shot and didn't require two. the law understands because human nature understands in the stress of the moment if you really believe this person is an intruder who could kill you you're not even going to count the shots, you're not going to think or speak in the niceties with which we speak and think in polite society. for him to say, that's a clean shot or you're dead, a jury might very well understand in the stress of the fear of death one might speak that way. just to take a step back here, this defendant, under minnesota law, does not have to prove he

was in fear. the government has to prove he was not in fear, stated differently, the self-defense defense he doesn't have to come forward with evidence for it, the government has to disprove it. that's a very heavy burden on the part of the government, particularly when i believe, you and i talked about this before the show, he's been overindicted, indicted for a charge the government can't possibly prove. >> murder one. >> right. murder one requires sufficient planning and plotting and preparation for a particular identified target. for him to put things in his house that allows him to exercise his right to self-defense, should he be assaulted, is not murder one in any state in the union. >> you told us here before the planning of a murder, to go from some lesser included charge to murder in the first degree, the planning can take days or month. the planning can also take a second or two. for instance when you say, all right, i shoot you, and then you

think, all right, you're disabled, i'm now going to shoot you again to kill you, is it that period of time the prosecution is resting to say that's the reason we want murder one? >> yes. the prosecution is also resting on something silly like food that he left out in the house. >> sort of entraps them. >> as if that was going to draw them in. there is no evidence they broke into that house because they were hungry and wanted to eat his food. if the government is realistically resting its case on the split second between the first trigger pull and the second, shep, in 40 years of this, i have never heard of sufficient planning and plotting for murder one occurring in a split second between two trigger pulls. >> that castle law in minnesota is on the side of the defendant in this case, you have a right to protect yourself and right to kill if somebody gets in your house if

order offender with no gang ties and no rap sheets. they have to be serving a longer sentence than they would get for the same crime today, all of that. officials say it is aimed mainly at drug offenders especially those serving sentences under the old mandatory guidelines. the teenager who spent hours in a jet wheel well spent hours inside without anybody spotting him. that's what the officials are telling the "associated press." this happened at the airport. this 15-year-old boy scaled a fence and climbed up into the plane's landing gear. and airlines flight took off for maui, 5 1/2 hours the trip took. keep in mind the wheel well is a pretty cramped hiding spot. here's what it's like with the landing gear down, unlike a plane's cabin, this area is not protected from the freezing high altitude temperatures and not

cabins and hallways in the dark ld waters. we're getting our first undercoverry view. divers say now pulled more than 150 bodies from that ship. the ferry was carrying more than 470 passengers, most high school students. most of the media report many of the recovered bodies have broken fingers which indicate to them the victims were trying to fight their way out of that ship as it was sinking last week. more than 150 people are still listed as missing. they put two giant buoys into the water, i have a picture, they are right above where the ship is. divers are using ropes tied to small rafts to help guide them back to the surface. here, you can see the relatives of some of the missing passengers are praying at a nearby port. here's a memorial area set up, impressive one, a gym near the capital of seoul. the ship was carrying three times the recommended cargo load

when it went down and the captain and three others are charged with abandoning ship and were among the first to evacuate. the more of an honors student when their car crashed when hit by a fedex truck filed a lawsuit more than $300 million in damages and says the company knew there was a problem. it killed 10 people. happened in southern california nearly two weeks ago now. the california highway patrol have not yet determined the cause of this crash. some witnesses say they saw the fedex truck on fire before the crash. they say they don't have any reason to know if that's true. five students and both adult chaperones died that day.

a 17-year-old, jennifer, job just earned a scholarship. the more filed the lawsuit and said her daughter would have been the first to go to college. >> fedex released a statement saying we remain focused on providing support for those affected and authorities as they continue the investigation. this is not the time to discuss potential litigation. this woman says fedex knew their trucks were in trouble. >> exactly. this is something they have to prove when this case goes to trial or gathering evidence. let me tell you something, this is not going to be the only lawsuit. you will see many more come out and sue fedex in the situation. >> not only fedex but the bus company as well, something about emergency exits. snow they did not have emergency exit doors. that's very serious. >> you wonder, the burden of proof on something like this, that fedex had fire problems

with its trucks and knew it had them, that's tough. >> it's really tough, you're absolutely right. what will happen, right now we don't have the results of an investigation. you will see this plaintiff hire experts that will reconstruct the accident. they will want to bring in those witnesses who did see what occurred, to have their statements called into court. what's interesting this is $100 milli million. by california standards, that's a lot of money. why? because they're asking for punitive damages. the reason they're asking for punitive damages, saying, look, fedex, if you knew you had this situation and were aware of it you deserve to be punished and you need to pay this amount of money because we need to make sure it's public policy other people in this situation don't do the same thing and overlook these types of defects and not cure them. >> they said fedex recklessly disregarded the warning signs. knew about it. saw the signs and did nothing. >> exactly. did nothing.

ukraine gets worse everyday for everybody. russia now says it will respond firmly if any of its citizens or quote interests come under attack in ukraine. that's the warning today from its foreign minister. russia is calling for ukraine's army to immediately withdraw from the eastern part of its own country where pro russian forces have captured at least 10 towns. the russians are demanding their own government to pull out of its country. this comes after ukraine's own president announced it's renewing an anti-terror campaign against the forces in the east.

he says it's because this ukraine politician turned up dead in a river in an eastern town. they said somebody brutally tortured the lawmaker. and russia could use more violence as a pretext to send troops in the ukraine border in the east. some u.s. troops arrived in poland today. pentagon officials say they're sending 600 soldiers to several different countries along or near russia's eastern border. meanwhile, pro russian militants say they've retained an american journalist covering the news and say they suspect him of spying and other bad activities. they claim they're not holding him hostage or trying to exchange him for anybody. british officials say they scrambled jets to intercept two russian planes and long range bomber and surveillance plane off the northern part of scotland and say the jet stayed in the space and similar flybys

here's australia. it washed up six miles east of augusta in western australia, south of perth here, on a sandbar over here they tell us. 200 miles south of perth, at the search headquarters. they tell us, it's probably not from the jet. trace gallagher has more, live from the west coast news hub. every new sign is more, we don't have it, we can't find it. >> it's also important to note, shep, they can't rule this piece of metal out because they haven't physically examined this thing yet. all they've done is look at pictures thought to be 8-10 feet long. it also has fiberglass coating with jagged edges. they should have this thing physically in hand by tomorrow morning and give us a statement then. there were reports other potential pieces of debris might have also been found in that area. we have not been able to confirm that. we can tell uma lyou malaysia h

ditch. say iing john wayne gass gar up a murder that happened 40 years ago. at the time, he lived a few miles from john way in gacy, the man who lured more than 30 young boys to his home during the 1960s and '70s. police say he raped, strangled and murdered his victims. gacy was executed in 1994. dna evidence shows he did not kill this 22-year-old man. now, investigators say they know who did it. mike tobin with the news live for us in chicago. explain what brought this case to a close. >> reporter: you know, shep, only the gacy case cut through decades of ineffective work by the police and medical examiners. he con ffessed and took police the forest where he dumped the body but never found the body and he went free.
