their dream cabin for a fraction of what they paid for it. watch this. >> they offered $30,000 and we were able to get $115,000, but we had almost $80,000 in legal bills. >> $80,000 in legal bills but you paid $550,000 for the whole thing, right? >> we get to keep part of it, but the ten acre parcel that they are taking, we finally felt like we just had to -- when their price came up enough to cover the attorney fees, we had to take it. we have two kids in college. we couldn't keep fighting. >> all for open space. there is a situation in texas involving the burro of land management. this is about to get messy. the texas attorney general, greg abbott who will probably be the next governor wrote a letter that his agency could seize a 116-mile stretch of land along

the red river. abbott wrote as attorney general of texas, i'm deeply troubled by the reports from the blm field hearings that the federal government may claim for the first time that 90,000 acres of territory along the red river now belong to the federal government. provide land owners in texas have owned maintained and cultivated this land for generations, despite the long-settled expectations of these hard-working texans along the red river, the blm appears to be threatening their private property rights by claiming ownership over this territory. we've been exposing government over reach. for example, let's go to 2006 on this show. we introduced you to lu, a world war ii vet. he was being kicked out of his home after living in that home 46 years. take a look.

>> i lived in here since the first time i bought it. i renovated. i winterized it. i did everything, and i will bless this house -- [crying] -- because i'm able to be 89 years old. >> thank god. >> and my wife is 89. now the city decides that this is a nice place for someone else, so they are throwing us out. >> by the way, this is not for a road, school or hospital, either. we met a grand grandmother by norma fluke in 2005 who was also going through government gone wild in a similar situation. take a look. >> family has lived here 65 years. business has been here 56 years and now the town is come and

deemed us unfit to be in this town and wants to put us somewhere else. but we're located for our business and without this property, we would go out of business. >> just pathetic and then there was this heart-breaking story, a world war ii vet johnny stevens. in 2005 doctors told him he had lung cancer and given only two years to live and while he wanted to spend his last days peacefully in his home, the government wanted his house, why? to build luxury condos and townhouses, why? so they could get more tax revenue. look at this case. >> i don't have too much time left. i intended to live out the rest of my life in that little house i got. tend to my garden and be able to live in peace. as it stands right now, i don't know where i'm going or what i'm going to do. >> just sad and very pathetic. this is your government gone

wild. these are american citizens, some heroes and fighting their last days on this earth, fighting for the property they live in for decades. unfortunately, we could go on for hours with similar stories we've done but tonight, we're looking for a solution and here to do that, our friend judge andrew thnapolitano. >> nice to be with you. >> this couple i interviewed last night from colorado, cliven bundy, whether you agree he owes the money or doesn't, why is the government treating its citizens this way when there is a simple answer that you brought up on this very program in the cliven bundy case? >> the simple answer for the government against cliven bundy is to take the judgment that a federal judge has determined the bundys oh the government and file that in the local county courthouse and when mr. bundy

passes away before the property passes to his interiors. the government will get it plus interest. if he sells the property, the government will get its judgment plus interest. why won't the government do that? why instead of doing that have we seen this massive show of force with sharp shooters and snipers, with some guns aimed at mr. bundy, his family, innocent protesters and friends and the news media? because the government instead of using the least force necessary, which is what the rule of law is, is using the most force possible because they want to intimidate the bundys. i'm convinced he cannot be intimidated. they want to intimidate others and probably a little unsure of themselves, sean, and so they are compensating for that lack of surety of certainty with this massive like use of force. >> 200 plus armed agents, as you say, sharp shooters and snipers

here. dead cattle as a result of this. dogs were used and then we have people hit with stun guns by some of the blm officers there. i didn't want to see the officers hurt. i didn't want to see the protesters hurt and seemed all for nothing. this is not an isolated case. we did a whole series on imminent domain, some we highlighted tonight. the government is taking property for people in colorado because they want open space and property a world war ii vet lived in for 46 years to get more tax revenue for townhouses and condos. is that what the law says about imminent domain? i thought it was for schools and hospitals. >> the law has changed. let me take you back to the framing of the constitution. when the constitution was written, jefferson and madison argued the government should not have imminent domain powers, that the only moral legitimate

transfer of real estate was that which was voluntary on both sides, a willing buyer and a willing seller. when the government takes your property against your will, no matter what they pay you for it, it is not a willing seller, it's just a a willing buyer, the government and often the government gets the property at a bargain basement rate. >> that's outrageous. >> before the decision of about ten years ago, sean, the government more or less, not exclusively used property it took for roads or schools or hospitals. legitimate public purposes where every human being could enjoy the new purpose of the land. >> and they were duly complicated in those cases. they got fair market value or maybe a little above fair market value. wasn't that the standard back then. >> yes. >> we have the case now in texas, we're going to get into it in the next segment where the blm is claiming this property on

the red river. they are going to take that ache rage? >> the blm made the mistake of going on the wrong side of that river. you and i know greg abbott. even if he were not about to become the republican nominee for governor of texas, and he'll make a terrific governor. >> agree. >> he's the tenacious defender of personal liberty and property rights as the sitting attorney general of texas, you will see a vastly different reaction in texas than you saw in nevada. in nevada you saw lip service from a governor who sided with bundy. in texas, you will see legal action and maybe even force from a state government that simply will not permit the feds to peel the private property of it's citizens. >> texas will not give up the fight. last question, let me put up on the screen, judge, if you look at the latest percentage of land that is owned by the federal

government as of 2010 and the congressional research service, look at the percentage they own in nevada. 81%, utah 66, idaho 61, oregon 53 and right on down the list. why does the government own all of this land anyway? >> sean, i'm going to make a statement that the government will consider outrageous. everybody watching us now will understand it and i expect you'll appreciate it. the constitution simply does not authorize the federal government to own any of this land. all of it is being held unconstitutionally and all of it should be returned to the private property owners from which it was taken or to the states in which whose boarders exists, period. >> i agree with you. not only that, they can't afford to manage it anyway. when you think of the bundy situation, it's about cliven bundy's cattle eating government glass and not paying for it and snipers and sharp shooters surround the ranch. good to see you.

welcome back to "hannity." as we told you, there is major concern the government could be eyeing another massive land grab. this time it's texas. greg abbott is warning the blm wants to seize over 90,000 acres of land near the red river close to the border of oklahoma. texas governor rick perry addressed the controversy on "your world." watch this. >> i don't think americans want to see another exhibition from the federal government of them coming in with armed troops over an issue that ought to be taken care of with a little common sense. it's not a dare. it's a promise we'll stand up for private property rights in the state of texas and i don't have a problem in the world with attorney general abbott's words. the key from my standpoint is the federal government owns too much land. are we going to relitigate every

piece of private property because we have a federal government out of control? >> here fox news political analyst ron williams. let's start with the cliven bundy situation. maybe he owes grazing fees and sure surrounded by sharp shooters and dogs and 200 agents. is that the way to handle it? >> no, nor do you have the leader of the government call them domestic terror rests. it elevates this and pours dpas lean on it. time to lower the temperature regarding the bundy ranching operation and find a way to settle this. >> as a texan, what do you make of what the lieutenant governor and governor said today? i'm in agreement with them. they are not going to back down, either. >> look, texas is a different situation than nevada. texas, they are virtually no federal lands in texas. when we joined the union, we kept control of the public land.

what the government is talking about doing, along the red river that separates texas and oklahoma, the river moves back and forth and that new land is created sometimes south of the river and sometimes new land is created north of the river. they are talking about laying claim to the land being created south of the river during some period of time. this would be absolutely, i think, governor perry had it right. this ought to be settled by common sense. there is no reason the federal government said we should try to establish a ram of federal land that may consist of several hundred feet of land or several hundred yards of land south of the river just because its been created by the natural forces of nature sometime in the last god knows how many decades. this is -- if the federal government does this, the texas farm burro, texas southwestern cattle raisers, texas cattle feeders, a bunch of organizations that will step up and fight this tooth and nail and be back by the state of

texas. you heard it from the attorney -- >> i think he'll be the next governor. >> i'm sorry, the attorney general -- >> abbott, sorry about that. juan, i would think this is something you and i agree on. the issue maybe in the case of bundy, he owes some grazing rights, his cattle ate government grass. okay. do you surround his ranch with the 200 agents, snipers, dogs? does that bother you? >> yeah, i think it's over reaction, sean. we agree on that point. i think he was clearly breaking the law. i think it clearly was government land. >> there is a better way to handle it, right? >> i agree with you on that point. i also don't like the fact that then it became a magnet for people who thought it's world war iii -- >> people tazered, dogs and snipers surrounding his ranch. i mean, over grazing fees. it seems -- look, if every

american that owes the government money, including irs that got bonuses that didn't pay their taxes, there would be a lot of agents out there surrounding property. >> it's a matter of somebody breaking the law in a city or anywhere, i think it should be applied equally and clearly if mr. bundy lost in court, i believe three courts. i don't think there is a doubt law enforcement had right to act. >> so what do we do, carl, when we're highlighting these cases. i had a couple on from colorado. they bought property. they owned the property. the government surrounding literally millions of acres the government had. the government went in and insisted on their little cabin. they lost money because they couldn't afford the legal deals and world war ii vets that they want to take their homes on the water, prime property, 46 years live there had because they want to build condos. this isn't for a hospital, a road, a school. this seems to be government

abuse to me, government -- >> yeah. >> the government bullying people. >> we seen this before. we had a very important imminent domain case that rose up through the courts that originated in connecticut. >> kilo. >> where the federal government -- excuse me, local authorities said we'll take people's property because we want to enter a public private partner thip ship to make money. the privaivate domain can be a d abused. >> juan, if they offer people a great value for their land, market value, a little above market value, pay for moving costs and need a hospital or school or road and it's going to benefit the community, i understand imminent domain. i don't understand when they take a world war ii vet's property, so they can build condos and get more tax money. >> well, you just explained it. what it is is in the public

benefit because it's a source of public revenue and of course, we don't want to pay for taxes. i know sean hannity doesn't want to pay more taxes. >> sean hannity pays 60 cents of every dollar i work in taxes. >> i set the bomb off. >> yes, you did. >> you get my point. if this is in the best interest of the american people or local government, remember, in the cases we're all talking about here, city counsel, state legislature or somebody had to approve it on a democratic basis, it's not as if you have storm troops coming in and grabbing them and taking them out. >> may i disagree strongly about this? this is a question of degree, and if a local community, if the leaders in a local community want to seize someone's private land to create a hotel or build condominiums or engage in a private venture, that's an abuse. if you say we need to have that because we need to put a road there, fine. if you say there is no other

possible location for this school but here, maybe i'd understand it but the idea that somebody can job control of the government of the locality and then use the power of imminent domain to engage in the basis form of capitalism is deeply offensive. if you -- >> it's not grabbing -- carl, anybody grabbing, this is a democratic process. >> no, there is no grabbing. >> there is no grabbing. >> no, no, wait a minute. there is no vote by the people to allow that to happen. it is somebody inside government often decided the regulatory apparatus and if it is the city counsel, i don't want them to come and say we like juan william's house because we think it would be a great place to put condos. he has to move out because we the city counsel decided in our greater wisdom, we can make more tax money. >> carl, you need to very sales -- >> elect -- >> you need to have faith in elected officials in this country and in this government

and in the wisdom of vot ers an select people -- >> why are you bailing at the alter of the right of a government to steal somebody's property? >> nobody is stealing. >> they want more tax revenue. >> you're talking about stealing, sean is talking about grabbing. i'm talking about a democratic process. if you don't like it -- >> all right. carl, last word. >> look, look, look, most of these instances are not where somebody runs for office saying if you elect me, i'm going to declare the world war ii veterans property is subject to imminent do main so we can build condos. most of these things are done by political insiders. if you -- most instances where they come up with imminent domain and go in and the public learns about them. >> we got to roll, guys. guys, good to see you. >> that's why in texas the attorney general is writing letters.
