is traveling. >> back home we've learned 40 military veterans died while waiting for health care. a tragic situation. i know you don't run the phoenix office of veterans affairs but as commander in chief what will you pledge to fix that? >> the moment we heard about allegations around these 40 individuals, who have died, in phoenix, i immediately ordered the secretary of veterans affair to investigate we have an ig investigation taking place. so we take the allegations very seriously. >> that came as we learned new details of similar cases at at least four locations across the country. veterans dieing waiting for care. joining us now a man who knows firsthand challenges and responsibilities of running the va health care system, the largest in the world. he was the secretary of veterans affairs under president george w. bush from twun to 2005.

he is now vice chair of the board of directors for wounded warriors project. very good of you to be here, sir. thank you so much. how bad is? >> thank you. if allegations are proven to be prove then what happened in the phoenix va medical center is unacceptable and possibly criminal. >> why do you say criminal? our viewers should know have you a legal background as well. >> if files were manipulated that caused deaths of veterans, that is morally reprehensible, and criminal. >> so viewers we're talking about one facility. phoenix va. the administrator is accused of, she and others manufacturing, hellman, yes. manufacturing a system they'd diminish the way it looked for wait times for the vets. the whistle blower saying

they're waiting between six weeks and 20 weeks and only when you can get an appointment within two weeks do they put them on official books within two weeks when they have been langishing up to 5, 6 months waiting for one appointment to result whistle blowers and others allege it's up to 40 veterans dieing while they waiting for care. veterans administration has had a reputation not being the most top of the top medical center for vets. is that in your experience true? and do you think there has been a diminishing level of care since you've left? . >> i don't think it's true. i hi historically va provided high quality care. i think the vast majority of emmoi yeez want to do right by men and women that come to their for care they see their uncles and

fathers and affiliated with major medical schools i think we have a failure of leadership if allegations are true we don't know that until the inspector general issues a report but it needs to be done. people need to be held accountable. i think they will be >> when you say a failure of leadership, what do you mean? someone running the va, how? >> i just, you know, it's incomprehensible to me if files were manipulated, that people up the chain of command didn't know about it they should have known about it. then need to be held accountable for. that the secretary cannot go on a day-to-day basis everything going on in the largest health care system in the world we have to entrust his leadership to do that and report to him when human resources are not available. and that is where failure comes

in and people have to be held accountable. for system will be undermined. >> again, so viewers know this is not just one doctor coming out and alleging this. he's now retired but there are other top executives who are saying it's so. they produce e mails between this administrator and others within the administration, you know people lower down the totem poll from you know this is not right keeping them off the books with this other system and there are accounts of men dieing because they could not get in. so now, we're talking about the potential criminal allegations. if this proves true, what, you're talking accountability you're talking about -- >> i don't think every secretary should be held accountable. if i should be held accountable

for problems during my tenure but the secretary has to hold his senior leaders responsible whchlt i was secretary and came on board in 2001 i had a major similar situation in atlanta, involving embezzlement of tens of millions of dollars of taxpayer money. as soon as i found out about it, i relieved the director and assistant director and had them step down until the investigation was completed i told the inspector general to do a comprehensive investigation. at all 58 offices and get the answers. >> last question because i need to go. how long should this ig investigation take? we've got a lot to look into. >> quickly. inspector general called the

they could decide instead of a popular vote, election in new york. we the legislature will decide who get s new york's electoral votes. they could look -- >> like the national popular vote. >> right, that's going to determine -- >> it's happening. they have 165 electoral votes who have signed on to do this in 11 states -- >> 270 wins the presidency. >> so it's 6 1% there, four more states have pending propels. >> here is the constitutional problem. the whole purpose of the electoral vote was to give each state a significant say in who gets elected president. the whole purpose of the electoral vote was to allow some event within the state the popular vote of voters or the decision of the state legislature to decide how that state's electoral votes go, the national popular vote decide this is to destroy state

>> right, and i think this one facet of this story, megyn, isn't getting the attention it deserves and that is the good news, the good news about racism in america. and what i mean by that is this, first let's get out of the way that donald sterling is an old fool and an old fool to be more precise. look at the reaction. the universal condemnation, blacks are against it, whites are against it, latinos, ashens, gay, straights, everybody is against it. he's not proof as some would have us believe, he's not proof that racism is alive and well in america. he is proof of precisely the opposite. that racism is on its last leg. the american people have turned donald sterling into an out cast, look, are there some racist in a country, working in the sthhadows, yes, that's also good news because they are lurking in the shadows. not too long ago, not 100 years
