>> a jury is debating the fate of a man who killed two teenagers after they broke into his home. closing arguments wrapped up today. byron smith claims he shot the two cousins in his home in 2012 because he feared for his life. prosecutors say he went elsewhere beyond protecting himself, in fact he murdered the two teenagers in cold blood and he waited a day before he called police because, as he put it, it was thanksgiving and i didn't want to bother the police. last week the jury heard audio recordings that the suspect made himself on the day of the killings. they provided what investigators call a timeline of exactly what happened. courtroom reporters say smith shot and killed the first teen. told him, you're dead. then wrapped the body in a tarp and ten minutes later you hear the gunman reloading his weapon,
12:33 pm
and the second teenager calling for her cousin. prosecutors say smith then shot her several times and said, quote, you're dying. then he called her a betch and fired what he told investigators was a good, clean, finishing shot. smith later told investigators he was doing his civic duty and he refused to live in fear. he also said of the tee teenagers, quote, don't see them as human. i see them at vermin. we're outside the cruise. -- courthouse. what happened? >> the defense made the point that byron smith never left the house. the intruders pursued him and he made the appoint that had the teenagers never broken into this house they would still be alive today. the defense also played an speaker vue with police in which smith said he had no idea if the home invaders were armed. he wasn't about to ask them or search them. prosecutors liken smith to a deer hunter who set up a blind
12:34 pm
and they used the audio in which you hear the breaking and shots and here hailey kifer suffer. >> did the defense in its closing discuss this one clean finishing shot and the implications of that? >> the defense not so much. the prosecution leaped heavy on it and the audio surveillance played and also a photograph put up of the handgun, the second weapon used, showing blood on the sight of the weapon, indicating that it had to be moved in close for that good, clean finishing shot which occurred right under her chin. >> the case has gone to the jury. we'll have updates. let's bring in=jhlxbj ash, criminal defense attorney. how are you? gunner how are you? >> i'm most interested in the period between the time when he had shot multiple times the teenage girl, and said, you're

threat is over. in other words you can shoot somebody as many time as you want in rapid succession but when you have a moment to think about and it process, that's the time they would want to hear from him about. >> exactly. that's the crucial question here. the jury has to determine whether or not it was reasonable for him to think he was still in fear. so what the jury is left with is the statements that he made to the police, which were not good for him. the one clean finishing shot and the statements that made it sound like he knew what he was doing and the fear hat left. these people -- when they were down on the ground and moving the fear wasn't probably there in his mind anymore. show needed to take the stand and make the jury feel that fear and make them understand the fear he is saying that he had, and i think it was a -- probably a very risky move for him not to have taken the stand. of reasons why he might not have, and the fact that cynic might say if what he really
12:37 pm
wanted to do was shoot the kids who kept coming into his basement, that might be a reason not to testify. but anything short of that doesn't make much sense. >> exactly. as a defense attorney, i many times have to evaluate whether or not my client is going to be sympathetic on the stand, and i think these attorneys did not think he would be believable or was really in fear or could portray that fear to the jury, then it was probably the best choice not to put him on the stand. >> you think this is going to good long? the deliberations sneer a lot 0 consider. >> i actually do i think there's a lot to consider, and i think it's a very diverse jury and they're going to have some issues deciding whether or not he was still in fear, because we have to remember, these kids broke into his house. they started this. so it's hard to have a ton of sympathy for someone who a burglarized someone's home. >> nice points, thank you. verdict watch is on. the jury has the case. should there be developments we'll bring it to you right away. we don't expect anything today.
