from the los angeles area, huge wildfire prompting officials to evacuate schools and homes. you can see they're shutting down roads there because of the smoke and the flames of which there is a lot. this is happening in rancho cucamonga 40 miles east of l.a. officials say the fire started earlier today and started quickly because the wind is so strong. 80 miles an hour. will clark is live there at the scene east of l.a. with more. wil. >> reporter: hey, bill. we're in an area that just had a police officer come through and say there were now mandatory evacuations in this part of the community for rancho cucamonga because the fire is relativelily close by. the winds are very strong, like you said, gusts up to 80 miles an hour. the visibility is very poor at times and why i'm wearing goggles. it's raining ash as well. the fire started this morning. it ran through this path a short time ago.

at first it was 20 acres and then ballooned to 200 acres because it's a red flag warning today. today, it's also a red flag warning day tomorrow. as you mentioned, bill, two schools have been evacuated. two schools told none are in immediate danger right now but in the potential path of this fire. they're not taking any chances. as we pulled up, we saw some people running to their homes. even though they told us they had the mandatory evacuation, they told us they weren't taking any chances and going to load up all their valuables and get their family and get out right now. >> thank you. what a scene it is out in southern california. the southern california supreme court overturned a one month sentence a judge gave a man for raping a high school student. that student killed herself in 2010 before the trial began. critics blasted the judge's sentence as far too lenient and

suggested the student was partly responsible for the rape and older than her chronological age. he since apologized for that but not the sentence. now, the california court is going to have another judge sentence the man. california law says he must serve a two year minimum sentence. he's been free since serving the one month sentence last fall. what did the supreme court say about the judge? >> will, not surprisingly, the court came down very hard on the judge saying his statement at the trial was erroneous and showed bias against the victim in addition to saying the 14-year-old high school freshman was older than her chronological age, the judge also said the victim probably had as much control of the situation as the defendant. that, plus a 30 day sentence for a man 49 years old when he repeatedly had sex with his

student sparked plenty of outrage. in throwing out the sentence, the justices wrote quote the idea the victim could have had control of the situation is directly at odds with the law which holds a youth is incapable of consent and therefore lacks any control over the situation whatsoever. the judge has sense apologized for his comments but never backed down from that 30 day sentence. >> what is next for this convicted rapist, then, dan? >> we tried to reach stacy ramble and his attorney today. he is looking at the very possibility of at least two more years in prison. state law says the minimum sentence for sexual assault without consent is four years. a judge is only allowed to suspend two of those years. the resentsing will be heard by a different judge in yellowstone county. the supreme court took the judge -- the case away from the judge. the 72-year-old is retiring the end of this month and has not

been available for comment. >> thank you. now in the deep south powerful storms have dumped close to 2 feet of rain and triggered deadly flooding in parts of alabama and the florida panhandle. roads there are flowing like rivers and some people climbing up into the attics to wait for help. the national weather service reports more rain fell in pensacola in one hour last night than the entire total amount of rainfall during hurricane ivan 10 years ago. weather officials saying some 22 inches of rain have fallen in parts of florida roughly a third of what that region will get in an entire year. the wet weather even collapsed part of a highway. check out the picture here of the wall washing away concrete and soil and so many of these images came in to us throughout the day, not far from where some of those homes stand as well. two cars plunging 40 feet into a ravine. luckily no reports of injuries there. officials did confirm at least

one death outside pensacola. they said a woman drove into a flooded area and was trapped. in southern alabama, widespread flooding opened up sinkholes in some roads large enough to swallow a car. according to local reports one emergency director is calling this historical flooding. in mobile, crews saved a woman late last night from her flooded car, one of dozens of reported rescues throughout that area. this storm is part of the same system that brought deadly tornadoes to parts of alabama and mississippi and other state s earlier in the week. watching that in the fox weather center, first i want go live in tuscaloosa, alabama, where people are recovering from those deadly twisters there. jonathan, how bad is this damage where you are now? >> reporter: bill, the damage is extensive. right here, perhaps a textbook example why officials try to

evacuate mobile home parks when a tornado is approaching. right now i'm standing in what used to be a bedroom. a dresser here, baby's crib and double bed here. look, a tree came crashing through the roof onto the bed and the exterior wall. look over there panning to the left, you can see the window on what used to be the wall, it's now become part of the floor. over there, a tree crushi crushing -- partially crushing the car behind it. fortunately, the family that lived in this mobile home heeded the tornado warnings and they sought shelter at a nearby hospital. they've lost most of their property but they still have their lives. bill. >> man oh man. jonathan, thank you, live on that. i want to get the latest on the storm wrecking havoc across the south. right now, live in the weather center, rick is live. you've had a busy week, rick. the storm is still posing a threat to whom today? >> yeah. moving out across parts of the

carolinas. look how impressive this is. it's been a really slow season overall for tornadoes. normally we had 405. we had 237 this year. look at this. almost half of those just from this one storm system in the last few days. we still have one more day to get through here. tornado watch across eastern parts of north carolina, southeastern parts of virginia in effect until 7:00 p.m. tonight. at this point, none of these storms are tornadic, no big rotation causing concerns. i think we will see some of that later on and one severe thunderstorm at the line where you approach kingston and jacksonville, seeing winds maybe 50, 60 miles an hour and maybe hail. look at this area. panhandle of florida, 20 plus inches of rain in less than 24 hours. we have flashflooding there and more concerns in the mid-atlantic and northeast. some of these areas will see another 3-5 inches of rain

extending to parts of the northeast. that's not out of here until tomorrow afternoon. if there's any bright news by friday we're done with this storm and have a good couple of days. it's been a long one. >> what you're seeing, the system on the east coast does that pack the same potential as the southeast or not? >> great question. no, it doesn't. it's not the same kind of tornado threat we saw in arkansas, alabama, mississippi and tennessee. we could see smaller tornadoes the rest of the afternoon. we have to watch it. any tornado that hits your place can do a lot of damage but not talking about the same threat n there. >> thanks. we are hearing moscow is pumping more money into its military even though the ukrainians say they can't do a thing to stop the russians from causing trouble in their country. what is next for a region in crisis? hi, i'm terry and i have diabetic nerve pain. it's hard to describe, because you have a numbness,

proce process. all this coming as they see eastern ukraine and some militants have said they're in fact elite russian troops conducting a secret invasion. >> today, say iing the elite security forces are helpless from keeping the crisis from spreading. you look at the wall and saying the pro russians have taken control of tmore than a dozen towns in eastern ukraine and we marked a few of them in western parts of the country and shown russia has shown no sign it plans to make good on its promise to pull back tens of thousands of troops across ukraine's border indicated by the red line. and analysts say in recent years russia boosted its defense spending by 30%. they say moscow has been building a more flexible military to quickly respond to regional conflicts like this one

today. stewart holiday, a former ambassador of affairs with the united nations. how are you? >> good to be with you, bill. >> what is your sense of moscow's intention based on what we think we know now? >> i think they have de facto seized control of the eastern ukraine. i think the government of kev is expressing a certain amount of resignation to that. obviously, we don't want that to happen. what i think he's playing for is this may referendum and a victory there by his supporters without having to use military forces to cross the border. of course, he will if he feels that the ukrainian government is moving out there with a significant military force. >> president obama announced today he's going to go to poland in the first part of june. i want to get your sense of that. when you think about the level of patience on behalf of the government in kiev, the one

question that always seems essential, how patient will that government be before it makes a move on the pro russian militants occupying their own buildings? >> they've got to be very careful not to cross that line that's going to result in a sel fulfilling prophesy of having the russians roll their tanks over the border like they did in georgia in 2008. it's patience but also frankly, it's really waiting for this to play out, hoping for more support from the west. we appear to have drawn a red line at nato members, which, of course, does not in cloclude ukraine. we're obviously looking for ways to shore up support for the central government in kiev, announcing assistance, looking at economic and energy assistance. our military red line is really that line of countries along the eastern part of western europe that includes the baltics and, of course, poland and moving

down into the balkans. >> what do you think of the way we're handling this so far? do you believe it's sufficient? >> i think that dr. kissinger pointed out the fact that ukraine is sort of a, you know, critical part of the russian historical narrative. i think that for us, what we needed to be doing is working more aggressively to support those forces in ukraine who effectively look to europe and look to the west and not get to this point. now that we're at this point, i think our options are fairly limited within ukraine, per se. we need to keep the pressure on. we need to look for -- if these economic sanctions, particularly if they move into the energy sector, they could boomerang back, as mr. putin said on some of our energy sectors over there. those can really bite. there's a huge portion of the

romantic relationship and she worked for sterling as an archivist. meanwhile, hours after the nba handed down a lifetime ban, clippers won a huge playoff game. hats off to that team for winning last night. the head coach say this team was mentally drained but fought through it. the big question remains whether or not the league can force sterling to sell the team. that's where we bring in our senior judicial analyst, andrew napolitano to talk about this. how are you sir? i should mention oprah has talked to a couple of folks to buy this team in l.a. and have expressed an interest to buy this team. before we even get there, sterling told our jim gray today he has no interest in selling the clippers. >> the agreement sterling signed when he bought the team back when he bought them in buffalo before he moved them to san diego and surreptitiously took them to l.a. per portedly s says -- i say per portedly says because this is not a public

document, i have had people read it to me but i haven't seen it. purportedly says if three-quarters of the owners agree there is a substantial case that the offending owner, here, sterling, engaged in conduct unbe coming an owner and conduct detrimental to the game, they can force him to sell the team either to the rest of them or to another party. if it does say that and he refuses to sell, then the league would have to go to court. if they do do to court they'd have a lot of obstacles to overcome. some of those obstacles are, what about the other person who owns the team? that would be mrs. sterling, who under california law, owns 50% of the stock in the team. she has done nothing offensive by nba standards. how could she be forced to sell the team? >> all very intriguing. let me back you up a little bit. mark cuban the dallas owner said this is a slippery slope. i don't know they could get 75% of the owners to agree to that.

>> that's because the slippery slope mr. cuban is talking about commenced in a private conversation unlawfully recorded. cuban is probably thinking, hey, sometimes we all say crazy things, this could happen to any of us. >> on the wife, they've been married how long? >> more than 50 years. >> under california law you have to be married how many years? >> 10 years before each spouse acquires a 50% interest in what the other spouse brought to the wedding. so after -- to the marriage. after 10 years, there she is, with the blond hair, mrs. sterling acquired a 50% interest in the stock of this team and she still owns it. she's not -- she is subject to the nba regulations but there's no offensive behavior that we know of on her part. >> you're even suggesting legally they may not be able to do anything -- >> yes. >> so long as the sterling silver as a couple or even as an valued as a wife said, no, we're keeping our team?

>> correct. correct. without a willing seller. without the sterling silver willing to sell the nba would have to go to court. if they go to court, the first obstacle is mrs. sterling. the other obstacles are all antitrust obstacles in a nutshell say the economic impact of the forced sale of this team might violate certain federal laws and those might be absolute obstacles of the sale of the team to the nba. >> what i hear you saying this is a tough legal fight. >> yes. >> if that's the case that's wine the logic the commissioner said i will force you in the corner and make you uncomfortable. >> guess who likes tough legal fights and fought the nba several times? >> don't sterling. police say a fight that started on facebook led to a teenager's murder. now, it's reigniting calls on stricter gun laws on one major u.s. city. a jury was quick to find a homeowner guilty of murder after he shot and killed two teenagers

a facebook fight between two girls over a boy ending in murder, according to police. they say it never would have happened if a 14-year-old could not easily get a gun, the latest bloodshed to rock the city of chicago and fueling new calls from that city's police chief for stricter gun laws. two 14-year-old girls were trading insults on facebook over a simple teenager spat over a boy. prosecutors say it took a deadly turn when one of the girls hunted down her rival. police say she tried to open fire on a group of people standing on this porch but the gun jammed. they say a friend fixed it and handed the gun back to the teenage shooter? ment cops say she then shot this victim in the back and another

friend ran away. this type of violence in chicago is nothing new. >> tired of losing my friends. tir sad she had to leave like that. yesterday she had a friend on her face, happy, she's a playful person, always had a smile on her face. >> chicago police are trying to find out how the young suspect got a deadly weapon in the first place. garrett has covered many of these shootings live in chicago. who do we know and what do we know about the gun? >> reporter: bill, police say she got the gun from her uncle, who was also there when 14-year-old endia martin was shot and killed. that gun was stolen just a few weeks ago from an owner's vehicle, where it was being stored. police superintendent garry mccarthy says this is a perfect example how stricter gun laws on a state level, particularly regarding the storage of weap s weapons, could have prevented

this death. >> garrett, also, we've been told about strict gun laws in chicago and some are saying they're not strict enough. chicago has a lot of laws on the books when it comes to guns. how does that shake down? >> reporter: police superintendent say that chicago's gun laws are working but the guns are coming in from other places outside of the city and that's where most of the troubles are coming from, especially laws regarding the storage of guns. for instance in this incident, that gun was stowed, a legal gun stowed in the owner's car and when stolen from that car it then led to this crime. if these laws were enacted on a state and federal level they would have fewer incidents like this. >> garrett tenney

meeting with lawyers and justifying what he did. >> cleaning up a mess. a not like spilled food, not like vomit. not even like not even like diarrhea. it was the worst mess possible and i was stuck with i have not yet called the sheriff. they weren't human. i don't see them as human. i see them as vermin. >> it took a jury just three hours to find him guilty across the board. the sentence they handed down was two life sentences to run concurrently. smith is 64 years old, so it's unlikely even with parole he could ever get out of prison. >> it's a haunting message to listen to.

it wasn't just that audio, was it, mike, in the basement that seemed to convince this jury? >> no. smith spoke extensively with the morris county sheriff's investigators and he talked very calmly that he felt terrorized by a series of break-ins and worried the intruders had guns and calmly explained first shooting the teenagers and then shooting them again at point-blank range. >> after she was on the tarp she was still gasping, okay, as much as i hate someone i don't believe they deserve pain. so i gave her a shot under the chin up into the cranium. >> his attorney immediately appealed the verdict saying the judge kept a lot of evidence from the injury that showed nick brady had robbed that house before and he believed nick brady had guns. according to the attorney, nick brady worked for mr. smith for a while on his property doing yard work. according to the attorney he believes nick brady was casing

the house the whole time and that was kept from the jury. mike tobin, thanks, little falls, minnesota there. president obama made his case for a minimum wage hike a few minutes ago at the white house speaking after senate republicans block a bill that would gradually increase the minimum wage from $7.25 an hour to $10.10 an hour over a period of 30 months and provide annual increases to account for inflation. the republicans argue the proposal was too expensive for employers and will cost jobs, a lot of them. sarah murray is live on this. thanks for coming in. i will take a seat in the small little confines we have here. politically speak, is the will there to get this minimum wage act passed? >> i think right now politically, this looks dead on arrival. you saw today, it couldn't get out of the democratically controlled senate. republicans in the house have no inclination to take this up. i don't think you will see the united states congress passing a

minimum wage bill. >> there's a midterm in november. do democrats see advantage to pushing for this? >> i think if you listen to president obama's comments today he's already looking ahead to the midterms in november for his party saying if your congressman isn't voting for this, maybe you need to send someone new to washington. they know the majority of the american public supports a minimum wage increase and they know it's to their advantage. >> republicans say it will cost jobs. they put the figure at a million in america? >> they put it at a million. the congressional budget office puts it at 500,000 jobs lost. yes. that is another possibility jobs will be lost. you will see a messaging war. democrats say this is about closing the income equality gap and lifting the middle class and republicans say this is a job killer. >> who wins that battle? in a year where things are like right now? >> that is the million dollar question, isn't it?

who can make the better argument on that front. i think democrats have a sillient message and republicans have to work it out. tim po lenity came out and said he doesn't support it in the senate and they need to see how they can powerfully bring it home. >> do they have the authority to say this is price and this is what we're going with? >> the short answer it depends what state and locality you live in. we already have seen some states and president obama called them out thanking them today who have gone on their own raised the minimum wage. hawaii is one and minnesota something like that. that is a possibility. we haven't seen states do anything like that in the last 75 years and wait for the feds to take the lead. >> is this doa for now? >> i think it is at least on the congressional level. >> sara, thank you. good to see you the "wall street journal."

now we know what's in taco bell's beef besides the beef. a few years back, folks from the fast-food giant admitted their seasoned taco meat is only 88% beef. what's her to 12%? on their website, taco bell posted a list of the rest of the ingredients. taco bell tells us they've actually had this list up for a while but it's getting a lot of attention now. the site says some of the items have weird names but don't worry because it's all safe and all good and the feds have approved it. for example, cocoa powder and caramel color help the beef maintain its rich color. meanwhile, this is just a type

communities in rancho cucamonga. this is right where the fire has been racing through. there's been a lot of hotspots. there's firefighters on the scene. the latest numbers, 1100 residents have been evacuated in this area, two communities and also two schools that have evacuated. this fire is evidently racing towards those communities and we're told right now is not an intermediate threat for anybody in the area. some people have told me they're not taking any chances and already getting out of the area in case this fire does overtake any of the homes here. once again, not any intermediate threat but firefighters not taking chances. >> thank you. we'll be in touch, rancho cucamonga. a citizen reportedly behind bars overseas supposedly for offensive behavior insulting islam. he claims it's all a giant misunderstanding. that story, next.

overseas for when he drank too much on a flight and put on a show at the airport. not the good kind of show either. here's the said drummer. you may not remember him or the band but odds are you know their anthem rock you like a hurricane and either way apparently he was a hurricane in dubai this month. according to newspapers the drunken drummer got angry and started cussing. he was also shouting about, quote, noneducated muslims and flipped the bird at passengers. police say he also exposed his backside and asked passengers to touch it. the drummer reportedly admitted to drinking. denied the other stuff he never dropped trow. not once. trace gallagher with more in our news hub. trace, how much did he drink? >> well, he had five glasses of wine on his flight from moscow to dubai and he said he didn't drop his pants but said he raised his shirt to show

everybody his tattoo. there were apparently a lot of witnesses who heard him insult muslims including a customer service agent who said and i'm quoting here, when he saw the pakistani and afghanistan passengers he covered his nose and said that there was no way that he will travel with them. by the way, he was arrested back on april 3rd. he just made his first appearance yesterday and was sentenced to 30 days. so with time served he gets out tomorrow or the next day but the scorpions notified all of their pans they'll be replacing him on the german portion of their world tour. >> what are the alcohol laws we know of there, trace? >> well, you're allowed to drink when you fly planes that come into the united arab imrants but you can apply for a license to drink inside your home and hotels but you cannot be drunk anywhere in public. that's against the law. his attorney in dubai says the law needs to be amended to take
