and you gave him just 30 days in jail. can you explain that please? >> also ahead, the supreme court of montana overturns outrageous sentence for a child rapist embarrassing the judge who gave it we will update you on that. caution, you are about to enter the no spin zone. the factor begins right now. hi, i'm bill o'reilly. thanks for watching us tonight. the benghazi story keeps getting bigger. that is the subject of this evening's talking points memo. today, retired brigadier general robert lovell testified before the house oversight committee about why the u.s. military did not respond at all to the terror attack in benghazi that killed four americans, including the u.s. ambassador to libya. general lovell was in germany awaiting orders to strike at the terrorists, orders that never came. >> what we did know quite early on is that this was a hostile action.

this was no demonstration gone terribly awry. to the point of what happened, the facts led to the conclusion of a terrorist attack. the afri-con j 2 was focused on attribution. the attacks became attributable very soon after the event. >> so that means the u.s. military, the cia on the ground in libya, and pretty much everyone else directly involved with the benghazi attack knew it was not a spontaneous demonstration within hours. yet, as we proved yesterday, the obama administration created a fiction that the attack was a reaction to an anti-muslim videotape. the cover was blown off that deception this week when a memo by white house advisor ben rhodes was released through the freedom of information act. the memo clearly says that ambassador susan rice was prepped to tell the world on

television that a videotape incited the murders in benghazi. incredibly, incredibly, even after the memo became public, white house spokesman jay carney denied it was even about benghazi. >> why did it take a court case for you to release this? >> john. i can say again and again and i know you can keep asking again and again, this document was not about benghazi. >> but that's not true. the freedom of information filing, which produced the memo finally, specifically cited correspondence about benghazi. the "wall street journal" editorialized today, quote: mr. carney still insisted ms. rice had relied on points about the benghazi attack that were produced by the cia. he must think the press core is stupid.

yarn may think the press corps is stupid. he knows the press corps doesn't care and that's why he says these outrageous things. he knows the coverage will be minimal, except on fox news. last night, cbs evening news didn't cover benghazi. nbc did a 30 second reader. abc did a report with jonathan karl, the man you saw there who gave carney a hard time, that was 10 minutes into the broadcast. abc should have led with it most newspapers ignored or manipulate mizeed the story, -- minimized same thing as yesterday. let me break it down again. the u.s. military made no attempt to defend the americans under siege because they were not asked to do so. >> what specifically did the state department, what have they done or what prevented you from doing that. >> well, it's not what they did in that particular situation, it's what they didn't do. they didn't come forward

with stronger requests for action. >> that means then secretary of state hillary clinton has some splaining to do. but so does president obama. remember, he is the commander and chief. the military cannot move without his order. and he obviously didn't give it. why? the general is as confused as i am. >> we didn't know how long this would last when we became aware of the distress nor did we completely understand what we had in front of us. >> so that means that the attack could have been larger. the military didn't know. and forces didn't mobilize to save the people under siege? that's shocking. see, that's what this story is all about. the failure of the u.s. government to protect americans under fire in benghazi. and then after the fact trying to say oh the killers weren't organized terrorists. are we all getting this. but, again, the national media won't cover it.

does it get any worse than that in our democracy? talking points is angry. the obama administration was completely derelict in the benghazi terror attack and was dishonest in the aftermath. and the national press doesn't give a damn? disgraceful. and that's the memo. now for the top story tonight, reaction. joining us from boston colonel david hunt and from washington lt. ralph peters analyst. the chairman of the house armed services committee, all right? buck mcken none, is he a republican, all right? republican congressman from california. he says that lovell, the man you just heard, the general over in europe in charge of the afri-con situation. didn't have reliable insight into operational options available during the benghazi attacks. plk ken none basically saying ignore this guy. what do you say colonel peters. >> i don't reads it that wait a minute general

lovell, who is a j 2, central intelligence in afri-con never claimed. i heard in his testimony. he said he did not know exactly what options were available militarily. but what he did know, what every man and woman in uniform, what every man and woman who ever wore a u.s. military uniform knew is you do all you can to rescue americans under fire. and, you know, you just can't blame this on the military, bill. as you know, our military cannot act independently against a sovereign state. >> i was going to ask you that the military in europe where the forces would have to come from, colonel hunt, they couldn't mobilize or do anything without orders from washington, correct? >> yeah, only the president of the united states could have given the order. we had our special forces unit in crow eight shah: the president never gave the order. don't know why yet. but, clearly the secretary of state is responsible up to this thing the fire fight

starts. then the president has to give the order. he doesn't. we have the best military in the world. been in comment combat for 11 years. never told people died because of it. >> defense secretary is panetta. he has been hiding from. this he has got to be held accountable too, colonel peter, right? >> well, you know, i think leon panetta was not -- he is probably asham he stood in all of this. >> that's why he is hiding because is he ashamed? >> well, i suspect so. let's ask pa leon panetta. >> you can't ask him because is he hiding. >> he is hiding, got it there is a bigger issue here. in that this administration despises the military. i can tell you from personal experience, bill, that at state there is a hard core lefty cadre who look thes at our military as bunch of a blue collar and dumbies. >> come on, bill, give me 15 seconds. >>, will are the, go.

>> our state department prior to this had actually pushed u.s. marines and soldiers out of libya. preferring to trust the security of our personnel on the ground to local libyan militias. rather than to our troops. >> okay. and on top of that. on september 11th. september 11th of all all's of the year. there is no heightened security. blame this on state and obama. but don't blame our military. >> it's even worse than that even if what you say is true, colonel and i think most people believe what you tell them. even if that's true. when the shooting starts and the brigadier general in germany says we don't know how bad this could get. i mean, then you have to mobilize right then and there. colonel hunt. correct? >> yes. what i'm telling you is we had forces close enough to effect the battle. first of all -- i'm sure if

panetta can be called back to testament the other person testifying is the martin dempsey who also is covering this up by using -- the point is the military is capable of doing this. they weren't ordered to do it. now playing catch up time and people still continue to lie about this. >> let's just go over the key questions now. the key questions is. i didn't believe they are anybody, from the evidence we have seen, said don't do anything. but there wasn't anybody who said do something. that had to come from president obama through leon panetta. you know, the chain of command is very small. it's the president, panetta, to the guys in europe. it didn't happen. >> bill, in a case like this. the white house -- the military would have wanted to go. the white house would have said stand down. >> now that would be huge. >> that will still come out the rule is this, bill. even if you do not think there is chance in hell you

story. growing benghazi scandal. chief white house correspondent ed henry had this to say jay carney smoking gun memo. >> not about benghazi, why turn it over in a benghazi suit? >> you would have to ask state department about their process for responding to foia requests. again, -- you you can just read it and then decide for yourself as many people have now said and written like this is a conspiracy theory -- >> group comes in and says we want benghazi documents. the administration says this is not a benghazi document so we are not turning it over. >> i don't know. like this is a state department foia requests. >> on 9/12 you were asked about benghazi and whether it's premeditated you said it's quote too early for us to make that judgment. i know this is being investigated. we are working with the libyan government to investigate the incident. you were being cautious, investigation here. that's 9/12. enwoo why then on 9/14 is ben rhodes writing email that is making judgments this was inspired by a video

why is it that we just don't know we. >> do you need a copy of the cia talking points? read them out. >> only thing that refers to benghazi is the cut and paste from the talking points which much to your disappointment and your boss' disappointment turned out to be produced by the cia. joining us from washington is ed henry. the white house is trying to say the memo does not directly pertain to benghazi and still falling back on the cia told us it might have been a spontaneous demonstration. they are going to stick to that story no matter what, right? >> right. >> meanwhile you heard in jay carney's own answer he said the part of the email that does mention benghazi says. this it does mention benghazi. maybe the vast majority is not about benghazi but part of this email was about benghazi and it was turned over by the state department which jay carney sort of sloughed off and said i don't know the state department procedure. the state department is part of this president's administration. they are not going to move forward without some sort of agreement on that.

so they are not some rogue agency and so for them to respond to a lawsuit on benghazi by releasing this eye mail suggests that this is the president's own state department. not some republican thought this was about benghazi, so bottom line is they are pushing back on this but it raises sharp questions why there was a congressional subpoena out there for many many months about benghazi documents and the president, secretary of state kerry and others osaid we have turned over all the documents, maybe they didn't. >> they didn't obviously because judicial watch had to get this one when you you guys are having lunch in the white house little commissary or whatever you do. is it a topic of discussion how many in the national press simply don't want to cover this story? >> it comes up. and other reporters will, you know, kind of tease me about the idea that this is a fox story and what about benghazi that we're going to just shout that at the president randomly, it becomes a back and forth.

>> do they really believe it though? do they believe it's a fox story? >> there are many people in the press corps who believe it is a fox story. >> really? >> it's not important that the u.s. military didn't mobilize to save an american ambassador that it's it not important that the obama administration mislead the world and they still haven't said that we made a mistake? >> people are going to have to defend their own questions or lack of questions in the briefing room, but i would note the last two days, john karl of abc news, major garrett of cbs news. jim accosta asking similar questions to the ones you just plays that i asked. what did jay carney do. he went after me and fox and said you and your bosses haven't been able to prove a conspiracy theory as if i'm personally pushing this which i take offense at because i'm not. you are saying that has traction inside. >> that is my point if you are attacking one of the folks and saying this is some crazy conspiracy

thomas for whom i clerked, he doesn't make sense to them and so rather than take him on on the issues and i would submit, bill, they don't really know much about justice thomas' jurisprudence. they don't know how he was ruled on sixth amendment confrontation. liberal justices they don't know what he thinks about the fourth amendment or had very positive reviews from unlikely liberal sources. so they don't know that but, they do know that the man himself represents a rejection of much of what they believe and they don't want to debate him. they can't debate him because his life stands in contrast to many of the things that they espouse. i would say the fact that he doesn't think you should use racial preferences in hiring or education, that's an anathema to them. if someone is going to attack them like tom did. worse than uncle tom. doesn't like black people or doesn't like blacks. horrible thing to say.

right, bill. the supreme court sending it back to a totally different judge for new sentencing, clearly we are going to see something done here in the sentencing that fits the crime. i mean he wasn't legally authorized to allow so much in the way of time served. that was completely counter to the way the sentencing law runs in montana. i think the supreme court was also obviously under a lot of pressure from a variety of victims' groups, women's groups. and i think particularly disgusting about this is when the -- lower court judge said something like well, the girl she wasn't totally cull panel but she had some level of understanding of what was going on. >> this judge was just despicable and we are glad we could expose him. we are glad we did it. he could get this rapist could get 100 years. >> 100. a similar case where the judges need to be judged and monitored is happening down in texas it where another judge just today the story
