survivors, victims' relatives. the museum officially opens to the public next week. thanks so much for watching tonight. this is "the kelly file." and this is a fox news alert. the secretary of veterans affairs shinseki does grilled on capitol hill earlier today over the disturbing allegations that dozens of veterans died while waiting to receive care at a va facility in phoenix. for the very latest, we turn to ed henry. >> good evening, sean. as you noted, secretary shinseki took the heat today. they're wanting to know why president obama is not taking a more hands-on role in this

scandal. charging that this fits a pattern at the white house where cabinet secretaries take the responsibility and the blame. white house aids pushed back on that noting the president has appointed a top adviser to oversee this review of exactly what happened at the va, what went wrong, and how to fix it. republicans said today they want to see the president get more involved. he's only commenting publicly on this scandal once. >> we have asked the president of the united states to get personally involved. they have sent somebody over from the white house. i think it's more crisis mode, spin control, if you will. >> as commander in chief, what specifically will you pledge to fix that? >> if somebody has served our nation, they have to get the benefits and services that they have earned. and my budgets have consistency reflected that. >> except going back to his very

first year of office, the president has made dramatic promises to veterans. he said in addition to more money in the budget, he would also decrease wait times for veterans as they get their benefits. that clearly has not happened at some hospitals. that 2009 speech the president delivered was in phoenix. that was where this scandal started when allegedly 40 veterans died waiting to get care. >> what about that allegations that the va spent money on furniture, conference rooms, and make overs? did you get any response to that? >> it shows government waste and suggests some incompetence. he has that support because she's a dehe's a decorated army veteran. what you're going to see in a

hell. ainsley earhardt, she got on the plane. she met with the family members who lost loved ones and met with people still on this va waiting list. here are their emotional stories. >> what happened to him? >> september 28th he was showing signs of blood. he wasn't feeling well. >> what did the va hospital do? >> nothing. >> when he fell december 7th of last year and he broke his back, it's taken months to get the va to do anything. he needed a procedure where they inject surgical cement into the back to fuse the bones and the doctor told him if it was done within six months, it was tremendously successful. it is now april 26th. it hasn't happened. >> bring him back to the er and

what happens? >> wayne is out. i mean, totally out. and i was trying to wake him up. they were putting medication in his iv and that's when wayne opened his eyes and said to me, that he felt frozen. and i asked him, are you cold? he said, no. then he turned his head towards me and said, hon, get me out of here. i don't think i'm going to make it. >> do you agree there is a secret list and do you think your husband was on it? >> yes, i believe my husband was on the secret list and i believe there is a secret list. >> you believe your husband might have the last person on that list because he died a month ago. >> yep. he was probably the last person. >> here with reaction, we have bill cowen and alex nicholson and ainsley earhardt.

let me start with you, ainsley. i'm very frustrated because this is the only national show, our show and your show, you and i talked about this. you got on a plane. you met the families. 40 vets died in. there's this other waiting list that they're not telling people the truth. you met this people. >> yeah, i met them all. i just got off the phone with joe. she said that they went in this morning. it's now been five months and nine days. he got the iv this morning. they were getting ready to do this procedure. he said, you know what? this is not going to do any good. we should have caught this earlier. i feel like i've been sucker-punched. there are no more tears to cry

over this. now my husband is going to be on oxycotin for the rest of his life. >> the only reason he got in today was because of your report on this broadcast. three people have been put on administrative leave. >> i asked her what's the reaction in phoenix. she said, we're furious that they're on paid administrative leave. it is just another typical government dodge. those were her words. they're spending 500 million in furniture and pay raises. they need to hire more staff. >> one of the things that struck me as you were interviewing each one of these is that all of them are alone and that they were -- the promises that we as a country made to them and that we're not fulfilling and they're

dying literally. all i kept thinking was everyone who was promised obamacare and social security was going to be in a lock box, we're not even keeping a promise to our vets. why would anyone believe health care is going to be there for them? >> this was one of those stories that i walked away with such a heavy start. i still do. i pray for these individuals. i think about them every day. >> you stay in contact with them. >> i do. they have become my friends. your brother-in-law went with me. >> the last woman has no money. can we help her? >> we need to help her. if we can do anything for her. >> maybe we'll do something next week and bring it back. >> create a foundation for these individuals because they're all in that situation. >> where is the va? where is the government? >> these are americans. we love them.

>> how do you respond to that in light of this new report? the va is spending $500 million on furniture in conference rooms. joe is saying he didn't get the care he needed six months ago. veterans are dying. how are we supposed to react to this? >> sean, it's almost too outrageous to be able to talk about without getting extremely anger. first of all, kudos to you and ainsley for getting this story out there. it's good to see it was a bipartisan criticism of the secretary. but the fact of the matter is, there's a leadership problem at the very top. it goes all the way to the president. this president is a man who sent many of our men and women to iraq and afghanistan. certainly some of them are the ones getting this shoddy treatment from the va. there are thousands upon thousands of people working in

the va that do a good job every day. the other people doing these kinds of things, we can't hammer them enough. >> even nbc news reported earlier today that there are internal memos that have been revealed that va has been using scheduling tricks to hide substantial delays that exist in the va health system. one memo april 26th, 2012. the va under secretary, said it's come to my attention in order to approve scores, certainly facilities have adopted the use of inappropriate scheduling practices sometimes referred to as gaming strategies. this memo came out in 2010, for crying out loud. >> you've had not only us, but

you guys here at fox, the coverage you guys have done of this has been fantastic, especially with humanizing it. the house veterans affairs committee in particular has been sounding the alarm and raising the flag about this for years. this is nothing new. it's all of a sudden now that we have started to report on the physical and fatal manifestat n manifestations that the va has. our members are outraged. we get calls on the all time with benefits claims. we don't normally get a lot of calls of outrage. we are getti inting flooded. that's one of the reasons we launched our project with government oversight today. >> $500 million in furniture and you have vets dying. we're going to stay on the story. when we come back on this busy news night, new reports

i want to clarify exactly what sharia is and what some of the punishments are for some of their so-called crimes. homosexuality is punishable by death. honor killings are allowed. murder is permissible if someone is deemed to dishonor their family, husband, et cetera. if someone steals something, their hand is cut off. beheadings, women beaten, stoned to death. here are my guests. good to see you. you grew up in cairo. you grew up under sharia. is that an accurate description? >> absolutely. the problem with sharia is it is not necessarily enforced by

i hopefully am helping the nebraska economy. >> we appreciate it. >> a lot of people talk about the battle between the establishment and the tea party. you were supported by conservatives. is there a schism? is there a divide? >> you know, in nebraska what we find is that everybody's -- we're all conservatives worried about the future of the country that we're leaving our kids. when you're talking about a constitutional recovery, it's a winning message across our whole electorate. doesn't feel like much of a divi divide. >> the week before, the headline was the establishment is beating tea party candidates all around the country. you way outperformed the polls. you had many big names supporting you. but there is a divide here? there is a difference, no? >> in d.c. there are all sorts of crazy games going on.

there are some that are intent on trying to silence a lot of those that are most passionate and energetic about the meaning of america. when you tell that story to nebraskians, everybody got on board. >> let me ask you this. i think there are five things that would unite and bring together the tea party and the establishment. five items. i think every candidate should reason on this. balance the budget. i like the penny plan. an alternative to obamacare. drilling, energy independence. controlling our borders and doing it first and then choice in education. would those five items would be an inspiring, i guess, vision forthe, quote, republican opposition party? >> i think absolutely. you think back to 94 and the

>> let me ask you about the debate process. you want to change it. you want penalties for candidates that accept debate opportunities that the party doesn't sanction. >> first of all, it's a circus. we're not going to have 23 debates. we're going to have a reasonable number of debates. this time around we're going to pick the moderators and the frequency and the timing. not the other way around. this is something that's really important to our party. i just don't think we ought to have debates anymore in front of people who are in the business of trying to destroy our party deposing our candidates. >> i have always felt george stephanopoulos, he's connecting with his friends in the democratic party with set-up questions.
