tv   Justice With Judge Jeanine  FOX News  May 18, 2014 1:00am-2:01am PDT

1:00 am
to come. happy anniversary. that's it for now. this is mike huckabee from new york. good night and god bless. and stay tuned for "justice with judge jeanine." hello and welcome to "justice." i'm jeanine pirro. tonight, the obama administration opens jail cells, releasi releasing inmates, many of them seasoned criminals. but first, my open. imagine a son or daughter. you raise them, you love them and protect them. they fight for us, but when they
1:01 am
come home, they're left to die by the country to which they give so much. president obama's veterans administration is not only ineffective, it's broken, and a hotbed of corruption. and so goes another obama scandal. not a potential scandal, a full-blown scandal. they are shunted aside, veterans left to die waiting for doctors, while officials pocket bonuses alleging that they reduce wait times. the budget has increased
1:02 am
disproportiona disproportionately. and veterans, seeking help which never comes. for the last five years, official reports show that schedulers are not following policy. the names of at least 17 and up to 40 veterans who died were put on a fake list in phoenix. and whistle blowers world wide connect the deaths to appointments that weren't even scheduled. and the v.a. administration secretary told senators he was told not to release information
1:03 am
that might compromise yet another inquiry. how many inquiries do we need before you do something? forget oversight. why not just take the fifth? and in case you didn't catch this one -- >> any adverse incident like this makes me as -- makes me mad as hell. >> really looks mad, doesn't he? an adverse incident? veterans facing certain death, and personnel create false records to pocket a bonus, that's not an incident. it's homicide.
1:04 am
criminally negligent homicide and oh, that political preparation. >> we will take action. >> i don't believe you. you've known for years. you don't take actions. the ieg reports the you signed off on reports. the press told you, the veterans told you, everyone told you what was going on. so, who's been fired or demoted after more than 50 inspector general reports? why aren't you asking the hard questions? why are you still even there? or is this another page from the obama playbook? general, you don't apologize. you don't share the anguish and
1:05 am
anxiety of veterans and their families, literally on a death watch because your staffers literally hid their names? and general, you call yourself a war hero? war heroes don't leave men to die. i don't care if you're the most decorated man in military history, you're leaving men and women to die. general douglas mcarthur stated, old soldiers never die. they just fade away. it's time for you to fade away. and you're not the only one. our chief law enforcement officer, in over his head. eric holder has no plans to
1:06 am
investigate the secret wait lists. no surprise there. so, how about we bring in james comey and the fbi? this is criminal. reports are some hospitals are shredding documents. the evidence needs to be preserved. witnesses need to be spoken to. time is of the essence. they're gaming the system, cooking the books. there's an on going seem to defraud the american people. this is an organized criminal enterprise.
1:07 am
with criminally negligent homicide. am i the only one fed up with the politicking? >> is it possible that unrealistic expectations have created the system where some are cooking the books? >> mr. president, your secretary said this before the senate. >> if any allegations are true, they're completely unacceptable. >> where have i heard that one before? >> as i said last night, it's simply unacceptable. the suffering and bloodshed is outrageous and unacceptable. >> obviously, these reports, if
1:08 am
they're true are unacceptable. >> i have an idea, you're all unacceptable. and for a little window dressing, mr. president, you sent out michelle and dr. jill biden. they made it their priority to support military families. they were listening to their concerns. really? maybe they should stop listening and start acting. or maybe they just weren't listening at all. and by the way, mr. president, wasn't michelle a hospital administrator in chicago? your administration is the most lawless in american history. after five years, nothing surprises me. i'm not shocked, but i am heart
1:09 am
broken. our veterans have already suffered, and i take it personally. my dad and granddad are veterans. you reduced veterans benefits, and refused burial benefits during the sequester. thank god for people like the fishers. and i don't want to hear about lessons learned and a wakeup call. this alarm has been ringing throughout your administration. they answered your call. it's time, mr. president, that you answered theirs. and that's my open.
1:10 am
with me now is sally breen. her father died waiting for treatment. thank you for being here, and condolences to your family. you brought your father in to the hospital in late september of last year. can you tell us what happened? >> yes. my pop wasn't feeling good. and i was going to bring him in to the hospital but he cherished the v.a. he couldn't stand up, and had chest pains. i gave him a jug to use so he didn't have to get up to go to the bathroom. i saw tissue fragments and a lot
1:11 am
of blood. so, i took him to the v.a. it was a long, long wait. i was very upset, me and my husband. his son. the jug was full of pure blood. it was so sad. i'm a medical assistant so i know. they were ready, they took a chief complaint, and called him. i brought in the bottle of blood, and they told me, could you get rid of this? it's unsanitary. i said, i would like to speak to a nurse. he had a past history of cancer. >> what happened? was he treated then? >> no. no. they told him to step out, and
1:12 am
we had to wait for a nurse. then the nurse asked him, why are you here. he said, i'm bleeding. i brought the jug in and they told me to remove it. it's insunsanitary. >> did they treat him? >> they were more concerned about his arthritis in his hands. but they dismissed him like an animal, like a dog. >> when they did that, did you say, he needs an appointment for that? >> they said at 71 years old, he's old-looking, and he's normal in his condition. that's what they said.
1:13 am
>> peeing blood and tissue is normal? >> i said i don't want my pop leaving. there's something wrong. he used to have cancer. to the eye, any medical professional would know, the cancer is right there. you can see the blood. don't discharge him, i begged them. >> did they give you a time to come back? what happened to your father-in-law? what happened after that? >> they gave me a cart, primary was going to ca but it didn't happen. >> i'm sorry, we have to go but i'm so sorry. >> can i say something?
1:14 am
they treat veterans better in the jail than -- that's right. he died november 30th. >> coming up, he
1:15 am
1:16 am
1:17 am
would you explain to me, after knowing all this information, why you should not resign? >> i came here to make things better for veterans. this is not a job. >> outrage tonight. many of our nation's heroes demanding that eric shinseki
1:18 am
step down. as many as 40 veterans died in one city. meanwhi meanwhile, one official did step down, but he was going to retire anyway. and jessie duff. your first reaction to shinseki in the sound we just heard? >> he's mad as hell because he was exposed. otherwise, he would have reacted last year. 45,000 veterans waiting for appointments. we've got legionnaire's disease.
1:19 am
why hasn't he investigated these problems? it's systemic. >> and there were reports from all over the country, and this man sees and has to sign off on these inspector general reports. how do they feel about this guy? >> well, they feel like the v.a. is just waiting for them to die. maybe 1 out of 50 feels like they're getting good care. they have deleted their own records. >> they deleted them, and the allegation that some of them were in side drawers, where they couldn't get appointments. you heard sally, they told her
1:20 am
father-in-law to go home. >> and they had to go in three times to get positive cancer ratings to get treatments. by then, it's too late. 40 dead veterans? i say it's thousands. we don't know if they got care. this is throughout the nation. secretary shinseki knows about it. >> why is he still there? is he stupid? corrupt? what is it? >> well, the organization is leading him. they're rewarded for having low appointments and -- >> thanks so much for being with us.
1:21 am
and coming up, the
1:22 am
1:23 am
1:24 am
the v.a. scandal, and possible coverup has shocked the nation. our veterans turned away, dying for lack of care. the fisher foundation comes to the rescue of veterans every day. with me, the ceo of the fisher foundati foundation, ken fisher. what's your reaction? >> well, the death of one veteran is tragic.
1:25 am
but the situation we see right now, it's completely unacceptable. they raised their right hand, went into battle to preserve our way of life. we need to come to their aid now. >> and you've been dealing with the veterans, the military families. we're hearing it's systemic, nationwide. federal employees are getting b bonuses. why is this happening? >> well, the problem isn't funding. the problem in the v.a. case seems to be administrative. the doctors and nurses do a f
1:26 am
fantastic job. it's a matter of getting to them. >> and you have an incredible reputation for what you've done in this country. you stood up where the government fell down. but what can we say to the veterans to bring the morale back up, to let them know that we care? >> we need to do a better job taking care of them. it's simple. coming down to the veterans, their families, and the care they need. the age of the veteran today, 20, 22, 23, they're going to need the system for 50 years. we need to get the system moving. clear up the backlog. but it's up to us as a nation to
1:27 am
ensure that this happens. >> when you say they've cleared up the backlog, something like $1.7 million was appropriated for cabinets when they were supposed to go to e-fails. and benefits, letting military families visit the sick and stay and house them. do you think that the private sector should be more involved that could do better than government? >> that's a great point. there are so many unmet needs, both in the department of defense and in the v.a. it's worked well for us. we enjoy a good partnership with the v.a. in terms of what we do.
1:28 am
we build the houses, and give them to the v.a. they've been good partners in that sense, maintaining them in perpetuity. it's a means to an end, to take care of the growing unmet needs. family support is usually the one that takes the biggest hit after budget cuts. and the v.a. is something that we look to maintain. >> the fisher family, incredibly generous. you stepped in and we thank you. i want to thank you personally. fisher house, thank you. take care. coming up, a special celebrity edition of fast justice. and vote in with judge
1:29 am
1:30 am
1:31 am
1:32 am
1:33 am
jeanine. >> now, it's time for fast justice, tonight, two celebrity cases first, the case of who leaked jay-z-solange elevator fight video the incident occurred in new york city at standard hotel. you can see beyonce's sister attacking her brother-in-law, jay-z as beyonce does nothing the family reportedly made up but the question remains how did video get out? apparently a worker thought it was okay to sell the surveillance video for a quarter million dollars. the hotel requested authorities conduct a criminal investigation my take? solange shouldn't be upset it's the first hit video she's had in years. in the second case, alec baldwin
1:34 am
riding the wrong way down manhattan streets. apparently he flipped out on cops who stopped him when asked for his id. his outburst earned him a disorderly conduct charge. he says cops targeted him because of celebrity status my rule something i love nypd. but don't turn him into a martyr you've got bigger fish to fry. do you know how many people ride the wrong way on the street in new york city? how did you know it was him? he looked like hell 36,000 convicted criminals are now free thanks to obama administration. we're talking about murderers, rapists, rapists, drunk drivers all back on streets. and in 2013, obama administration directed ice detention centers to allow criminals to walk out of the
1:35 am
doors. so what could this administration be thinking? with me now, maricopa county sheriff and immigration attorney. so good evening, gentlemen. sheriff, what is going on here? >> maybe smoke and mirrors or politics i just did a survey of jails we have 8500 people in jail average every day. and 2000 were there not illegal, but there for other crimes they were, also, here illegally they returned over into ice. and guess what? about 35% to 0% have come back to jails many times. sometimes, 10, 15 times. so what is this? are they letting the illegals out the back door? are they being deported? they keep coming back? so that is a question. wrote to the secretary of homeland security. i just wrote another letter to
1:36 am
ice. i'm not getting any answers they're violating their own policy i'm not deporting these vicious criminals. >> let me ask ryed. you don't seem to have a problem with this. how do you respond to this sheriff? >> well, i think all of you fell for the stunt of mr. elliott and miss, what was it? and mr. aaron klein with the book "impeerable defenses" >> no. ryed, i'm not here to -- woah, i'm not here to promote a book. we're having a discussion. >> well, apparently you fell for it this, is what it is. it's a publicity stunt. this group, center for immigration studies we know what they are. it's a quasi, nonprofit organization behind bush's failed attempt -- >> i can tell i'm going to have to pull in reigns here. answer this question.
1:37 am
if you've got someone in this country illegally who commits a violent crime should have person, after serving time here not be deported back to their country? >> yes or no? >> of course they are. they're being deported all the time. this report is misleading. >> the ice report is misleading? immigration and customs enforcement? numbers are a lie? >> judge, judge, interpretation is wrong the people that are being released, we cannot hold them forever. half of them for minor traffic offenses. >> no. no. no, no, ryed i don't want to fight with you. i want to hear from the sheriff. you're saying if they serve their time, if they're illegal, that they should be allowed to walk out on the streets and irrespective of their convictions? >> judge, judge, we need to see
1:38 am
each case individually. >> i give you a guy murderer. >> what if they're married to a u.s. citizen? they have u.s. citizen children? what happens with those cases? >> those are sad cases. a agree. >> these are the type that meet criteria. is you deport them for these serious crimes they shouldn't be here to begin with. >> administration policy is not for. that >> this is the law. it's the law. >> you know that a lot of the people can become legal permanent residents because they're married to us us citizens and visas are available to them. they don't have to be deported it's ridiculous. >> all right, ryed. >> we know you want to deporlt everybody. we know. >> ryed, come on, calm down the sheriff is. >> i'm trying. with the sheriff it's hard. >> it isn't hard he has an opinion, you do, i do.
1:39 am
the sheriff's question is someone served his time, let's assume that that person is a murderer serving 15 years. because they're married does that mean they shouldn't be deported? >> no. there is no pardon for murderers . >> i'm not asking a pardon. it's a legal term. >> they're going to be deported through country that's accept them. if you have someone from north korea or cuba, their countries don't accept them, the supreme court said you cannot hold them forever. you cannot blame the obama administration for this. you cannot blame -- >> the numbers have never been like this. go head, sheriff. >> this guy doesn't understand the law. it's in the law. first of all you can't commit something illegally. >> i'm going to pull your mic, quiet. sheriff, go ahead . >> i can't hear what this guy is saying. he's mentioning my name.
1:40 am
>> doesn't matter. go ahead >> it's against the law to come into the country the second time. you're supposed to be deported and go to jail. but when you're released from jail and you have serious crimes, why do they keep coming back? they keep offenses. they keep doing violations of the law. >> because the system is broken. they have family deported. they have children in the u.s. they have houses in the u.s. they go out they have to wait 20 years to come back. we have to fix the people. >> the problem is that we are more and more becoming victims of people who don't and shouldn't be in this country. i don't care if they're married you forfeit your right to live among us and give up the opportunity to be a part of this great country when you not only violate our laws but violated our laws to get in here.
1:41 am
i'm going to thank you. >> provide for relief for some of them. the laws provide for relief. >> they should go back to their country and let them give them relief, thank you very much. >> sheriff i'm going to give you the last word. >> well, last word is that you come into this country illegal, you pay consequences go to jail, you're releaseed and should be deported not let out of the back door for political reasons it's a facade. the american people should know the truth and i've proved it. >> let me just say this. numbers have been released that are astronomical now. thank you, sheriff arpaio and mr. gonzales coming up, new irse mails show coming up, new irse mails show targeting scandal

1:46 am
and carl leaven requested the irs -- with me now, the chief counsel -- jay seculo. >> well, the two rogue agencies in cincinnati. and these documents that judicial watch got, we amended the complaint. the irs, washington, d.c., national office. chief counsel's office, not only involved in the process, but took the cases over from the office in cincinnati.
1:47 am
it was referred to d.c., and what the e-mail shows, nothing was happening out of the regional offices. everything was controlled out of washington, d.c. and the defendants in our lawsuit include the chief counsels of the u.s. >> and i can't help but think that, it's almost like a charade. it's as though the checks and balances, congressional oversight, ignore those. what can be done about these scandals? >> well, congress had their
1:48 am
oversight hearings. but they took the fifth amendment. when we take a deposition, and she takes the fifth, you can't use the facts against her in a criminal case. but in a civil case, it's deemed admitted. she can take the fifth amendment, the fact she's taking it proves our case. when we amended our complaint, from the time the president made a state of the union statement, all the way through the mutt lte meets we had, we put together a chronological list that the government is involved at the

1:54 am
am i wrong? that was inappropriate, dang if i know. >> obviously, she shouldn't have responded that way. a serious issue when four americans died. i understand it. she's gone through about a year and a half of investigations from six different congressional subcommittees, she's answered every question, her staff answered every question. secretary clinton appeared in two different subcommittee hearings. >> let me ask you this, when you say they have answered every question, you know it's almost like it's politicians coming out and filibuster and then go on, but do you know why susan rice was selected instead of secretary of state hillary clinton? did anybody answer that question? why her? >> i mean, i think she was such a loyal campaigner for president obama and so they had such an acrimonious primary. she was a real trooper. i don't know if i could have been so grace shows. >> are you talking about susan rice? >> secretary clinton.
1:55 am
>> i'm asking why susan rice was picked. >> i don't know the answer to that question. >> it could be because she was a loyal campaigner. what are the dems afraid of? why don't they want to be part of this? >> i'm not afraid of anything. what i'm looking towards, as a radio show, i'll be on top of the republicans during this and reporting on the fact that they will ask the same questions, get the same answers to the same questions and they will waste money doing it. >> if you know the answers and you think there is silly, you want to say they ordered to military assets to go there? >> yes or no? did the president allow military assets? >> the chairman had an investigation on the military aspect and said nothing could have been done. >> let me ask you a question, if an attack lasts for eight hours, how could you say nothing could be done when we got all kinds of
