>> caution, you are about to enter the no spin zone. the from southern california. the factor begins right now. ♪ ♪ >> hi, i'm bill o'reilly. reporting tonight from los angeles. thanks for watching us. is president obama losing his grip? that is the subject of this evening's talking points memo. according to the "washington times," the obama administration was told in 2008, that there were big problems with the v.a., that veterans who needed medical care were being put on waiting lists to their peril. obviously that was five and a half years ago. now the v.a. scandal is breaking big. >> when was the president made aware of fraudulent problems. waiting list to hide the weight times. >> specific allegations reported first by your network out of phoenix, i believe, we learned about

them through the reports. >> well, that's troubling. republican party put out an email today listing all the times the president learned of important events through the media. the associated press says mr. obama learned of the irs targeting conservative groups through news reports. jay carney himself said the president didn't know about fast and furious until he saw it in the media "u.s.a. today" reports mr. obama did not know the nsa was spying on german leader merkel until the story broke. and the president seemed to be caught by surprise about the obamacare web site problems. so there is a pattern here, is there not? seems the president of the united states and his advisors are the last to know about major problems. this v.a. thing is huge. we can't have w warriors dying from lack of medical care. my pal jon stewart put it this way. >> here's what discusses me, somehow, we as a country,

were able to shift 300,000 troops half way across the world in just a few months to fight a war that cost us $2 trillion. yet, for some reason, it takes longer than that to get someone hurt in that war needed medical care or reimbursement. all while we process undying love for their service. >> but mr. stuart makes a mistake. the problem is not we, it's with the obama administration which apparently did little to hold the v.a. accountable. so the question then becomes is the president even paying attention? surely he keeps incompetent administrators like kathleen sebelius and the present v.a. chief eric shinseki in their positions for far too long. surely he does that and surely the american people have not been given clear answers to things like benghazi, fast and furious and the irs deal. finally, all the polls show the same thing. there is an erosion of confidence in the federal

government. both the president and the congress are getting very low marks from the folks. the american people believe the competency of the federal government is underwhelming and it is. and that's the memo. now are to the top story tonight, reaction, joining us from washington, fox news analyst kirsten powers. where am i going wrong here, powers? >> i don't think you have anything wrong here, bill. i do think that there is obviously a real problem in terms of confidence in our government. which is, i think, a well founded lack of confidence and i don't think that obama is necessarily stepping up in these various crises that come up. i think the obamacare web site obviously inexclusive. i think in this situation the fact that they had information about this during the transition team given to their transition team in 2008, and that they -- that mrs. obama and mrs. biden made veterans their sort of signature issue. so, it seems like something that would have gotten the

attention of the president, who also, i think, has really said, at least talked the talk right on how important veterans are to him. >> these -- he has helped me help the veterans. and i think he is genuinely interested. this is a subjective question is it your opinion that the president is simply not paying attention? is he distracted? does he not like his job? is he bored? because, look, the evidence is overwhelming. they keep saying we didn't know about it we didn't know about it. we didn't know about it it. >> yeah. >> what's going on? what's really happening? >> well, i mean he seems disengaged i think would be fair toay. what the cause of it is whether is he bored or doesn't like his job, i have no idea. but it's clear that he is disengaged. and i think if you go back to the obamacare web site, what -- if he is not interested in that, then he is not interested in anything. this is his signature accomplishment, his legacy, and he really showed almost no curiosity about whether the web site was even going to function.

so, you know, i think that he is very disengaged and he doesn't seem to be a hands on of manager. and you know the fact that there was this information on the v.a., there was a letter that was sent to him. there were people raising red flags. there were people saying. >> good people. credible people. doctors. good people, credible doctors. they were blowing the whistle. blowing the whistle, blowing the whistle, blowing the whistle. and nothing nothing apparently done. i have two more questions. no matter what he does. it's not his fault. alan colmes is he in that camp. okay? so you have a discussion. it doesn't matter. and i'm not -- i don't want to poison the well with colmes, but if you ask colmes about obama, he will bring you back to herbert

i'm kelly wright. stay with fox news through tonight for results. marco rubio made controversial statements about climate change last sunday. >> i don't know of any era in world history where the climate has been stable. climate is always evolving and natural disasters have always existed. >> let me get this straight. do you not think that human activity the production of co 2 has caused warming to our planet. >> i do not believe that human activity is causing these dramatic changes to our climate the way the scientists are portraying it. >> the senator joins us now from washington. before we get to that, i'm going to ask you the same question i asked kirsten powers. do you believe president obama is bored? is he -- what is it that there is no urgency and that's these things, scandals whatever you keep call them keep happening and the white house doesn't seem to know anything about it? what is that. >> i would point to three things. they a systemic problem of governing. a campaign very good at

messaging but they have no competence in terms of governing. that's the first part of it the second part is any time an issue arises they are more concerned about what they are going to say than what they are going to do. to them it's an opportunity to message as opposed to an opportunity to solve it. and here's the third problem. any time the criticism arises from republicans, their first reaction is not to look at it and say let's see there is some credibility here. their first reaction is to label it and treat it as some sort of a partisan attack. for example, i have been in the senate now three and a half years. a significant amount of my constituent case work, are complaints about the v.a. we have been hearing that and reporting that as of other offices for a while. and the initial reaction is always that's just partisan republicans trying to embarrass us. those three things i think really explain why these things keep happening. >> do you believe that the president is incapable of admitting an amistake? i will point to sebelius who is in charge of the disastrous rollout for obamacare. now, shinseki, no doubt is

he a patriot. but he is an incompetent administrator. i think that's. when these bad things break. you know; clipper owner. when you have asking like that. the leadership has to change. but it doesn't. why do you think that is? protect our people this is a partisan attack. >> why protect incompetent people? >> that's a good question. let me give you an example of that. we have a bill that i have filed that allows the director to fire incompetent middle level managers. the administration does not support that they are more interested in protecting the sanctity of civil service than they are in being able to hold people accountable. even if you fired shinseki, you will still have a systemic problem in that agency. serious one now. >> at least you send a message. >> right. >> at least you send a message as the leader.

>> right. but my point is you still want to be able to fire the people that work there. >> right. but the president doesn't each send any messages. he doesn't seem to be that outraged about this stuff and it's one after the other after the other. all right. >> because, again, they always take these criticisms as a partisan thing when, in fact, this is a very valid and legitimate complaint people have. a very serious crisis. >> all right. it is. and they should be seeing the polls and the american people are turning against the administration. now, you said flat out bold and fresh statement. that you don't believe the scientists on global warming. you are going up against these people, okay. go ahead. >> no, here's the point. first of all i have never denied the climate is changing. that shouldn't surprise us. the climate is always changing. the second point on the science is, the left loves to go around saying there is a consensus. there is a consensus. there is a majority of scientists that say that global carbon emission by humans causes some changes in the climate. what there is no consensus on and they convenient ely

ignore it is there is consensus on the climate. how much is it changing and how much is it directly attributable to human carbon emission. there is no consensus on that which is why the models vary greatly. 17 years of dramatic increases in carbon production by humans surface temperatures in the earth have stabilized. which is the last point which is indisputable. none of the proposals that liberals would have us impose on ourselves would have us do anything about the problem. 35 gig a tons american americans only 6 of it china and india will produce 50 giga tons. the laws they would pass would destroy our economy and have zero impact on the issues they keep raising. that's the part they don't want to debate at all. >> i do believe that all people should work together. >> technology and innovation

impact segment tonight. a new survey reported by mtv it says young americans between the ages of 14 and 24 do not like affirmative anne action. mtv says 88% of mill lineals believe favoring one race over the other in the marketplace is unfair. joining us from washington ashley pratt, spokesperson for the young american leaning foundation. kennedy who used to work for mtv. first of all, kennedy, i

have to tell the audience mtv would not cooperate with us. wouldn't tell us methodology oon the survey. i think they don't like me because of my ties. >> they are jealous. >> are you surprised by this survey? >> i'm not surprised at all. no, considering some of the polling data we have seen from mill ledges on political preferences, things like their views of same sex marriage and drug legalization, it's not surprising that they don't see the same kind of differentiations in race among themselves that older generations do. >> so, you're tieing in the mill ledge people feel that we're all the same already they don't see big differences in themselves when it comes to race.

if you have got people who have a lot of black, hispanic, minority friends, they are going to see themselves as the same thing, cut from the same cloth. >> that's what i'm saying. they don't feel that the certain groups need the boost. however, i'm a little suspect, ms. pratt, of the survey because a 14-year-old apparently surveyed some of them is not really sophisticated enough to understand the history of affirmative action or why it is even there. so, i wanted to talk to mtv but, of course, they won't talk to us. but why do you think that almost 90% of young americans don't want affirmative action now? >> yeah, will. i actually agree with you 100%. i think this is a huge shift from where this used to be with young people. i think a lot of that has to do with what kennedy was speaking to whole equality movement. at the same time, i think it's important that while the mtv poll may have been a little bit skewed gallup

shows 67% of young people actually are against race based affirmative action. now, when you look at what eric holder said the other day at a commencement ceremony in baltimore, he had said that we need to work active ely against policies that unfairly harm minorities. and that's exact ely what affirmative action does. i think young people are waking up to that and seeing that liberal policies are, in fact, hurting young people. they won't tolerate it anymore. so i think that while mtv is showing 88% of young people.r-me

stossel matters segment tonight. our pal john says that i, your humble correspondent do not report enough good news, even on things like poverty. stossel joins us now from new york. so what are you talking about now, stossel? >> you are always saying everything is terrible but there is lots of good news, like the fact that only 5% of the world now is living on a dollar or a little more a day. and it used to be much more. millions of people have listed themselves out of poverty. we are living longer. you are trashing the kids for texting too much. we have google and email free wonderful new things. our lives are better. >> you believe that in the u.s.a. our lives are better in what the last 8 years, 20 years, 50 years, what?

brutalize our black leaders, rape our women and destroy our black community. >> and joining us now from new york city kimberly guilfoyle and lis wiehl. what happened in this jace situation, wiehl shnchts the neighbors called the politician and say they heard a jace called 911 and said, "i shot my wife." the police arrived there april jace was dead. gunshots gone. and there was nobody else in the house except for the two -- the couple's two young sons. we don't know their names but they were under 10 years old. he has been arrested and charged on the suspicion of homicide and being held on 1-million-dollar bail. >> anything else guilfoyle? we understand that the wife april jace came home, according to the police and shortly after that she was shot to death. >> she is second wife. right now he is 40 years of age. we don't know if domestic dispute situation. police are investigating that mr. jace has been cooperative and that like we told you, they had the two

children. they are now in protective custody. really a tragic situation. there is some information we are learning at this hour that in fact he had some financial difficulties. as you noticed he hasn't had a new show in a while because the ones we have referenced are from a time ago. >> he filed for bankruptcy in 2011 for about 500 to a million dollars. apparently he was behind. he made a payment plan and was apparently behind on that payment plan as of december of last year. in among, aaron hernandez, former star football player for the patriots now charged with two more murders. tell us about that guilfoyle. >> two individuals. apparently a chance encounter they are still investigating the motive one daniel -- 28 yeerlts old and a 29-year-old both brutally murdered. shot in heir car essentially in kind of a drive by shooting. mr. hernandez has now been connected to that homicide and apparently some the forensic ballistic reports are what are tied to the two

cases together. keep in mind, the double homicide that he is now being charged with is from july 2012. it was that outside of a theater district nightclub that he met these two men. again, no idea in terms of what they might have discussed or what happened he did follow them from the club. >> now that's on top, wiehl, of the murder rap he is now facing. trial is going to start fairly soon. >> in june, exactly. >> are these two incidents intertwined? >> we don't know that. >> it doesn't appear so. >> we scant say that we don't know. it doesn't appear that the second one was a chance random kind of thing. we can't connect them together. i'm sure the police are working on that gllt one he is incarcerated under, an individual, oden in fact dating his fiance's sister. that was the situation
