hanging off a cruise ship. that seems safe? let's get to it. good wednesday afternoon to you, first from the fox ne newsdesk. democrats will take part into a new congressional investigation into the benghazi outpost in 2012 after house democrats criticized the benghazi investigation as nothing more than a political side show. nancy pelosi appointed five democrats to the select committee. she says that are needed now to balance the republican members and says the newly formed committee is just rehashing what the investigation already did. and blaming the islamic video for the attack, officials now say it was a pre-planned terror attack. four died including the united states ambassador and several have blamed the state department for weak security at the

more than two dozen veterans affairs hospitals turn out to be true. they include reports as many as 40 veterans died for waiting for treatment at a hospital in phoenix. >> when i hear allegations of misconduct, any misconduct, whether allegations of v.a. staff covering up long wait times or cooking the books, i will not stand for it. if these allegations prove to be true, it is dishonorable, it is disgraceful and i will not tolerate it period. >> the president there a short time ago. the house speaker, john boehner said it's time for the president to keep his promises to veterans. speaker boehner issued a statement part of which reads we all share the american people's outrage about the horrors at the v.a., outrage the president belatedly echoed today. what about accountability for treating our veterans like second and third rate citizens for deceiving them while their lives hang in the balance? speaker boehner. the house is expected to vote

later today on a bill that would give the v.a. secretary more power to fire and demote senior executives. speaker boehner says it shows house republicans are taking action and the president should convince democratic leaders to get behind it. ing republicans and some veterans groups have called for the secretary, a veteran himself, to resign. president obama today defended his secretary but added, and i quote, we are going to fix whatever is wrong. with us now the assistant managing editor of the "wall street journal" newspaper located in this building and part of our corporate family. took a while, republicans were getting after him for it. now, he's out there. what's the consensus for how it went? >> carol lee reporting in the paper for the journal. the consensus is still forming. his use of the word "allegati "allegations" is very intentional. what do we know about this so far? appears to have been delays in treatment and might have been these lists people put on as a

way of covering up the delays. there are claims of 40 deaths as a result of the delays. but the inspector from the government that has gone to look at this hasn't found any deaths related to the delays. i think what obama is saying, look, i will do something as soon as i know what exactly happened. so there's a battle right now between the substance of what happened and the politics of it. >> a battle for the narrative at the moment and the investigation. >> that's exactly right. this is an enormous health care system the biggest in the country, 1700 facilities around the country of varying sorts. you have hundreds of thousands of new clients, customers, people with needs coming into that health care system as a result of two wars. there is an immense burden on the system. whether or not it was prepared for that influx is a core question. >> we wondered about this when the last couple of wars began,

how in the world are we going to handle this if and when these wars ever end. now, they're ending and there's trouble. i still wonder if those now without all the facts claiming we need to shut down the v.a. and privatize the thing aren't really getting ahead of the story. >> or fire shen secky or deny bonuses, part of compensation. there are a couple of senators seeking to do that, deny the bonuses. figure out, i guess, first, what has happened and then surgically go in and fix it, i think, is what the obama administration is saying. remember also the army is wrestling with the same health care problems that the civilian population is. roughly two-thirds of their budget goes to compensation and health care related issues, including compensation. health care is an enormous part of that. the army and various armed forces are being asked to skinny down those costs as we try to get rid of the national debt. >> many observers on the

democratic side saying this could be a horrible situation for the president. he's trying to get out in front of it today and we'll follow it as the facts come in. thank you. dozens of people now dead after militants from the boko haram terror group launched overnight raids on villages in nigeria. one survivor said he and his neighbor hid in bushes as extremists opened fire and burned down their homes. one of those villages 20 miles from the town where members of this same terror group, boko haram abducted hundreds of school girls less than a mon a and threatens to sell them into slavery and says they have converted to islam and won't sell them to slavery and won't say what became of them. a bomb attack at a crowded station. a local television station captured the second blast on camera. look.

that justify, according to the government, the drone strikes. president obama nominated david barron to be a federal appeals court judge. with members of both parties threatening to block his confirmation. the obama administration said it would release parts of the memos to the government. significantly the document makes the legal case for droning an r anwar al awlaki in 2011. he was a united states citizen and accused al qaeda leader at the same time. last year, president obama said in his speech it was indeed legal and drone strikes have saved lives. some laurels demanded to see the legal justification for themselves before they put the man who wrote it on one of the nation's highest courts. one of the biggest critics is senator rand paul. he said a promise to release the memo is not the same as releasing the memo. >> they're releasing this memo under duress. my guess is they're releasing

pale. last month a federal appeals court in new york city ordered them to release the memos. actually about 11 of them. yesterday was the day the obama administration had to either agree to release or appeal this decision of the federal appeals court to the supreme court of the united states. in order to pry loose a few more votes for professor harvard law professor david barron's nomination to the bench today they said, we'll release them but not before we go through and cross out what we don't want you to see and have them for you in june. here's the thing. if there are genuine military or diplomatic or national security secrets in there no one would seriously suggest that should be released. these are legal memos. the deposit is entitled to know secrets but not entitled to a secret law. the laws are public. the opinions of the court interpreting the law is public. the government's rational should be made public as well. >> it seems to me after speaking to a number of people in the legal community for us to look directly at what's happening here and not be moved by things on the side.

a more in california is now under arrest, suspected of stabbing to death her three children. the victims from toddler to brand new, 2-month-old. all this happened yesterday at the family's home near the city of torrance outside los angeles. investigators say the victim's grandmother apparently discovered what happened and called the detectives. inside the house they found the girls in a pool of blood, on a bed with their more. they say the more was naked and holding a knife. one neighbor reportedly said the suspect also tried to slit her own wrists and that the more had blood all over her face and arms, presumably her children's blood. according to that neighbor, the grandmother claims the daughter called earlier in the day to say she was going crazy. the neighbor said the girl's father was across the street when the grandmother got there.

conduct. you think the prosecutor has the burden to prove someone is guilty. in not guilty by reason of insanity case, it's actually the other way around. the defense has the burden to prove by a preponderance of the evidence the defendant was legally insane at the time of the hurdle. it's a very difficult hurdle. nationally speaking, this defense is only used 1% of the time. >> we don't know much about this woman at all and don't know if she has an is her of ment mental -- if she has a history of mental illness. >> that's right. that's crucial in these type of cases. what's crucial is a history of mon mental illness. if she doesn't have a history of mental illness, a juror could be scratching his head, wait, she doesn't have a history of mental illness and, wait, she is saying she was insane and they will look whether she had suicidal ideations or delusions in the past. >> nice to see you.

fox report, first stop new york, police arrested two boys age 9 and 12 who apparently slipped rat poison into their teacher's water bottle. the cops say it happened monday at an elementary school in brooklyn. the teacher got 6 the next day and doing better now. texas, video shows from a police an officer jumping off a 20 to 30 footbridge during a traffic stop. it happened last week. cops say another driver rammed her car into the police cruiser sending it towards the officer. that drivers faces assault charges and the officer in the hospital with a broken pelvis. colorado, a pet store says two people stole a puppy by hiding it in the child's stroller. the dog's price tag, 999 bucks.

just in time for this. our crew flew out to u.s. oak hill yesterday afternoon and rode her into port in new york this morning. there were about 600 sailors and u.s. marines and we were third in that line of ships. it was a very special morning for those in charge of the parade. as "uss oak hill" makes her way into new york harbor, a new york native commands from the bridge. >> it's an opportunity to show new yorkers and all those in the tri-state area what their navy is all about. >> reporter: today, it's all about navigating these busy waters as cold john leads the parade of ships, brings back memories. >> i remember my father taking me to fort hamilton and seeing these ships in new york harbor, i was amazed. it was just beautiful. >> the first fleet week was in san diego in 1935 and been a new york tradition for the past three decades. >> ready to do it? >> yes, sir. >> all right, let's go.

hostages in a bunker three times large as yellowstone and full of poison o poisonous snakes. this is nigeria, a very serious thing going on here. about 300 girls kidnapped and you can imagine the parents very worried. this is chad. this is the general area the forest is three times the size of yell lo stone where they believe the girls are and haven't found them and don't have clues yet and military sending additional personnel to chad. a teen says he plans to walk for miles and miles and miles to raise awareness for his younger brother's medical condition, all while carrying him on his back. the 14-year-old carrying the 7-year-old 40 miles. he says it's nothing compared to what his brother has to endure everyday. we'll talk to that teen live next. okay, listen up! i'm re-workin' the menu.

a cherry picker thing called the north star. extends over the ocean giving folks a 360 degree view over the ship, 350 feet above the waterline. almost within a feat oot or sho the statute of liberty. the north star can hold about a dozen people and the ship is something else, with bumper cars and bungee jumping. it will take you all the way to china on a 50 day trip. a wildfire has burned more than 1,000 acres and now threatening dozens of homes and businesses in then northern part of that state. the so-called slide fire as they're calling it is raging in oak creek canyon just outside

cedoniasedoe sedonia's slide rock park. crews are using several helicopters and at least one air tanker. another fire charred 100 miles north of phoenix and this broke yesterday afternoon. an rv somehow sparked the thing and authorities shut down the 17 freeway in both directions as winds fanned the flames. much of that state is now facing severe drought conditions as temperatures heat up heading into summer. trace gallagher is live. this fire in oak creek canyon looks like it's exploding, trace. >> it is. it already doubled in size today and could double in size before night fall and a type 1 incident which means all hands on deck and in the process of moving more firefighters and equipment in that area. it's burning in such a steep and narrow canyon, it is extremely

ride from his older brother. that's what they plan to do next month. a 40-mile piggyback ride. they say they'll walk from bedford junior high to the university of michigan in just two days stopping to spend the night. the teen says he knows it's going to be hard but that it's nothing compared to the challenges his younger brother faces every day. hunter says his little brother sits front and center at every match and is his biggest fan. he calls his little brother his inspiration. hunter is live with us now. hunter, what made you think of this? >> really it was just an idea. my mom actually had a dream. we were thinking of different ways to raise awareness for cerebral palsy and she had a dream i was carrying my brother up to mackinac.

we just kind of went from there. we had ties with michigan. just kind of fit. >> i hear you that you carry your little brother around a lot. i wonder if you ever walked that far. it's not like he's a baby. he's 7 years old. >> yeah. he's about 50 pounds. i've never carried him anywhere quite this distance. i've carried him, yeah, several miles here and there. we went up to acadia national park earlier this summer and i was carrying him up and down mountains there. >> you called your little brother your inspiration. tell me about your little brother and what it is that inspires you so? >> he has to work ridiculously hard every day to live as normal a life as possible. a lot of people, i think, would
