film career. the singer has appeared in more under his stage name. >> also ahead dennis miller selected as the best weekend update guy ever on "saturday night live." tonight, we will ask miller all about that. >> god i do hate myself. >> caution, you are about to enter the no spin zone. the factor from los angeles. the factor begins right now. ♪ ♪ >> hi oil bill o'reilly, i'm reporting tonight from southern california, thanks for watching us, the v.a. scandal blows wide open. that is the subject of this evening's talking points memo. 26 facilities run by the veterans administration now being investigated for putting wounded warriors at risk. in phoenix, there are charges. the v.a. tried to cover up delays in service for as many as 1600 sick vets. 40 may have died while

waiting for care. the situation is so intense that president obama had to address it today. we all know that it offensive takes too long for veterans to get the care that they need. that's not a new development. it's been a problem for decades. and it's been compounded by more than a decade of war. that's why when i came into office i said we would work to systematically work to fix these problems and we have been working really hard to address them. >> the truth is the president has failed. failed to address the v.a. chaos effectively. six years ago, he said this: >> the true test of our patriotism is whether we will serve our returning heroes as as well as they have served us. that's why i have pledged to build a 21st century v.a. as president. >> that did not happen. in fact, things have gotten even worse at the v.a. on the president's watch.

so once again, the obama administration finds itsself facing a scandalous situation that it knew about and did little to improve. president obama is at the tipping point. it is one thing after another with his administration. the head of the v.a., general eric shinseki should be fired immediately it is lunancy to have shinseki, who is overseeing the v.a. debacle investigate anything lunancy. is he not competent to run a federal agency. he has got to go. just like kathleen sebelius was not competent to roll out obamacare. again, the truth, the truth is that the president gives power to incompetent people. and keeps them in place. when things fall apart. look, the president of the united states is in charge. are we all getting this? are you understanding that

nancy pelosi, harry reid and other powerful democrats? mr. obama is in charge. yet, we see a more aeconomy. foreign policy, scandal after scandal at home and constant refrains that the president is concerned. yet, little gets done. >> it is long past time to stop the political gamesmanship. both parties should be working together to solve intense problems like the v.a. this is personal for us. we here at the factor know the v.a. is incompetence and callus to boot. how do we know that? because factor viewers, you guys have donated an astounding $25 million to get high tech wheelchairs for vets severely wounded in iraq and afghanistan. not once did we hear have shinseki or the v.a.

not once did the general call to congratulate factor viewers on their unbelievable largess. just this week. in wisconsin donated a million dollars to the independence fund.org to get the track chairs to the wounded. is he a world war ii vet and obviously a patriot. the v.a. and shinseki should have been buying these life altering wheelchairs. but they totally ignored the situation. so good people like the this family and, again, you guys had to do it. that's not how the federal government should work to being fair president obama has helped us in getting the high tech wheelchairs and i believe he does care about the vets. but, again, it is all about competence. is it not? testimony and that's the memo. now for the top story

tonight. reaction, joining us from washington, ace reporters carl cameron and from denver, ed henry. all right, henry, am i being unfair to president obama here? >> you have got it largely right there. was one point where you suggested eric shin shreky was investigating himself. that's not true. veterans affairs doing independent probe. now whether or not the fix is in and people get cleared in that investigation, time will tell. i have a feeling with 40 deaths allegedly in phoenix, problems in at least 19 other states, it's going to be hard to white wash this one way or another. but what you are saying is this is an unmitigated disaster for this president. if there were deaths, if there was mismanagement and lying about records and everything, that's a stain on his legacy. secondly, how in the world from a public relations standpoint could the president go 23 days without addressing this, the last time he did, before today, was april 28th in manila a news conference in asia. i asked him a question about what happened in phoenix. he said we are investigating it he said nothing for 23

days. now, i don't doubt that behind the scenes he was yelling at people. they are urging something get done. it's shocking that the president didn't reassure the country and didn't reassure veterans that he was all over it. >> well, looking for some way out. i mean, that's the explanation. who does the inspector general answer to in the investigation? who? >> he is independent. these are -- there are inspector generals throughout every department and agency in the federal government. report to congress. >> who does he have to give his findings to? he has to give his findings to shinseki. >> he will of course give to shinseki. >> henry, wait wait wait wait. the inspector general has to give his findings to shinseki, okay? who is the problem? he is giving his findings to the problem shinseki booted it. >> no doubt about it. shinseki is a war hero from vowrm, a war veteran. we have to say that if he can't manage his department and can't get the benefits to his fellow veterans that

he loves, he has been a disaster as well. >> he is a disaster. >> but look at sebelius. she stayed on for six months after that one. and the president's communication staff let him go out before the healthcare rollout and say it was going to be like amazon.com. that didn't work out. this hasn't worked out. take one step back. now he wants immigration reform. it's going to be hard to make a sale on immigration reform after implementation of healthcare and v.a. scandal and brewer craft particular problems be pretty hard to sell another legacy problem. >> i think this is it for president obama. i don't think he comes back. approval ratings fall below 40%. people, even democrats, some democrats, not that that the particulars, are going to say, look, there is something wrong there. all right, ed, we appreciate it let's bring in cammeron. now, what's congress going to do about this, cammeron? >> well, frankly, probably not very much. they spent a good part of the day today debating a v.a. management bill if it ultimately passes give shinseki ability to fire 450 or so.

>> does it give him power to fire himself? >> that's the thing. there is a long line of lawmakers who say the one who should be fired is him and all this stuff is way too little too late. the chairman jeff miller wrote shinseki today and pointed out that the v.a. has been really slow and frankly unresponsive to a whole bunch of investigative subpoenas and said that it looks like the v.a. has something to hide in that letter. >> this is a joke. this is such a joke. you know, and it's not a funny joke. it's a tragic joke. because we all know shin shreky booted it number one. we all know the president didn't pay attention to it, number two. we all know that shin shreky should be fired number three and he is still sitting there. i expect him to be fired soon. i have got to ask you, pelosi today did appoint some democrats to the benghazi committee. just till me 20 seconds what happened there. >> sure. five democrats, they are all loyal, reliable liberals who have accuse the g.o.p. of a witch-hunt with all of this. initially pelosi said she was going to boycott the committee. but they ultimately decided the democrats did after a

continuing now with lead story the v.a. scandal. joining us from texas karl rove. in 2005 under bush a billion-dollar short fall in funding the veterans healthcare and a variety of other problems at the v.a. under the bush administration. so, what is the essential problem here? why can't the government fix this? >> yeah, well, look, fix this. we have got to be care of what we describe as this. when bush came into office, the problem facing the veterans administration was an unbelievably long period of time needed between the time that somebody applied for coverage from the veterans administration to when the determination was made. on average it took 230 days from the time that you applied for disability benefits to the time that a determination was made it was also, when we came into office, we looked at the

v.a., and found it to be horribly under funded. bush in his term in office doubled the size of the budget. nearly doubled the size of the budget of the veterans administration and put $6 billion into upgrading and modernizing and building new facilities and created a billion-dollar new fund in order to deal with traumatic brain injuries and with post-traumatic stress. but, our problem was different than the problem that the obama administration faces. ours was simply the issue of taking hundreds of thousands of people who had been waiting on average 230 days to get a determination whether or not they were eligible and covered by the v.a. and trying to reduce it. by spending all this money, by improving systems, it got down to an average of about 161 days by the time that bush left office. by 2012, it was back up above the 230 that we inherited when we came into office to 260. that's different than what we have got here. >> okay. let me make two comments.

because president bush involved the nation in two very intense wars, he had to upgrade the v.a. facilities. everybody knows that this is what i want an answer to. i want you to step out of your partisan shoes for a moment. when president bush left office after 8 years, the v.a.self made a report to the incoming obama people. all right? in the report it said, i'm quoting: the problems and causes associated with scheduling, waiting times and waiting lists at the v.a. are systemic. so the problems exist on the day president bush left office. >> no, no, no. no. no. >> that's what the report says. >> no, no, no. first of all, it is not a v.a. report. it a report from people assigned by the obama campaign to their transition planning. these were probably democrats in washington. >> mr. rove. >> let me finish. >> quote. >> previous involvement. >> you are wrong. >> bill, let me describe what it is. no, no, no. let me describe what the problem was, bill.

you are conflating again. >> i have to go on the record, mr. rove. i have to go on the record. nope. let me quote where this came from so the audience knows. this came from v.a. officials, all right? it was plurekd by cbs news. that's where it came from. now, you can explain yourself. >> but it was not the leadership of the v.a. it was past current v.a. officials serving on the obama transition committee. this involves a dispute between the inspector general and veterans health administration, which had gone on for years over what they called a data integrity issue. that is to say how do you count people's waiting times once they get scheduled for deployment. >> all right. >> let's say you have a colonoscopy scheduled and we offer you the date of june 20th. and you say i'm going to be in california during that kay give me the later date. the question was how does that count against the wait time standards inside the

vha? i don't want to diminish how important this issue is. but it's entirely different than we have a secret list and slow plan people so even if their health is at risk we are not going to deal with them. >> look. you just heard me scorch. >> that's my point. >> you just heard me scorch president obama. scorch him. all right? and there is no doubt that in his five and a half years in office, things have gotten worse. now, you say in bush's 8 years things got better. i will take you at your word. but the bottom line is that veterans in this country for 12 years. >> are not well treated. >> that's right. >> no, no. for 20 or 30 years. for 20 or 30 years. this issue of a backlog was something we got when we came in. we also had something like, for example, you couldn't get both your v.a. disability and your military retirement pay. had you to decide between one or the other. bush changed that you are required to file within two

years to get disability coverage in the military. we extended that to five years. cut the number of homeless people in the half. a lot of the homeless veterans are people who had serious mental issues and falling between the cracks and not being served by the system. look, we have a broken v.a. we he have had it broken for decades. more broken today though than it has been in the past. >> all right, mr. rove. we appreciate you taking the fire. thank you. we have more analysis on the v.a. from charles krauthammer. later in the broadcast. but next, town here in southern california tries to pass a law against bullying. then a rapper mocks jews. why is the media silent? upcoming. honestly, the off-season isn't really off for me. i've got a lot to do. that's why i got my surface. it's great for watching game film and drawing up plays. it's got onenote, so i can stay on top of my to-do list, which has been absolutely absurd since the big game. with skype, it's just really easy to stay in touch with the kids i work with.

people can smear others and remain anonymous. children have even committed suicide after being bull idea. here in southern california, the city of carson tried to pass a law against bullying but it was voted down 3 to 2 by the city council. the law would have prosecuted anyone bullying children or even adults up to age 25. joining us now from newberry port massachusetts, psychiatrist and fox news analyst dr. keith ablow. it's gotten to the point now where some people feel that bullying you should be hauled into court. what say you? >> listen, massive problem, bill. i treat people in adulthood and substantial people, sometimes ceos, lawyers, politicians who were bullied as children and who still bear the scars. so i know what a significant problem this is. however, i don't think the answer is to criminalize as this ordinance would have done the activities even of kindergartners or first or second graders for bullying in a very broad sense someone made to feel fearful. this is like taking a hot

potato where the schools will not grapple with this and say maybe give it to the courts. how about having the schools actually deal with this and that. >> well, let me raise -- look, i understand you can't criminalize 7-year-olds from calling people. >> it's sad. >> yeah. but i think there has to come a point in our society where the civil law, not criminal law, the civil law has to kick in if you are defaming someone to the point where their life is affected and you can can prove it let me get back to the original thing. you basically say that bully something epidemic. >> it is. >> is it worse than it was when you and i were kids in the stone age? is it worse now and if so why? feeling unsafe or trying to

puff up their chests or being stronger than they really are however, it's worse now because of the internet. there is an app. called yick yack that allows people in a single building to anonymously assault the characters of others in that building. can't trace who they're and have a group of 100 people talking about sara b. what she did last night or did not do last night. >> yeah, i know. it's horrible. so, you are basically saying that there isn't any solution to this problem? >> no. there is a solution. schools can create programs that will, number one, sense advertise kids. number two, draw a very hard line. you can't be in the school if you are identified as a bully. >> but the schools say that it doesn't -- they don't have jurisdiction if you are bullying from your home. and it has nothing to do with the school. even though you might be bullying somebody in the school. once you leave school grounds, the power of the school is nonexistent.

>> well, number one, i don't know if i accept that if you are spending your days in the school where they are interacting with you and if another student is affected. but, legally. >> i think you would have a hard time. if you expelled somebody for conduct they didn't do on school grounds or even suspended them, you know you would have lawsuits all over the place. you know that. >> there aren't enough lawsuits. that's the problem. most bullies don't drop their bullying briefcases at the door of the school. they keep it up in the classroom or in the hallways. and. >> if it's in the school they have to do it it right, i agree. outside of the school, on the internet, go ahead. >> the internet maybe not. but, listen, i tell parents, you may have to resort to bringing a lawyer into this. the civil case is against the school district. it's not rocket science, bill. private schools do. this there isn't as much bullying in private school. why? >> no. but i send my kids to private school and i will tell you why there isn't much. because the private school can expel you for conduct unbecoming. if they don't like how you

whatsoever with any jewish stereotype when he put this costume on. some people said he looked like abe lincoln and ring co-star. he claims that he had absolutely no intention to be in any way negative towards jewish culture. >> why is he apologizing? >> because is he sorry that he offended people because there was a certain amount of outrage. there was one segment on cnn. the five did something on it. major outlets did not cover this story. there was enough out there and on blogs, huffington post and the like so he felt like he had to respond. >> i'm going to give mac lamore the benefit of the doubt here because i don't know the guy and -- >> -- from everything he said, bill, i believe him, too. but what it proves to me is that is he clueless about sort of cultural stereotypes and history. he says he didn't know there was any such thing as antidefamation league there are other questions raised by this. >> i don't think that's the first rapper to be clueless. >> i don't either. you should see the lyric ares of his songs.

they are absolutely appalling. >> 9/11 museum there is a controversy already it centers around the gift shop selling stuff at that museum. >> they are looking to make money. how are they going to make money by selling things. i think it's a disgrace because we have human remains that they put down there against our wishes. we were told they would not be put in a museum or visitor's center and they put them in there anyway and now we have them selling art facts, all kinds of art facts on the wall where miewm remains are down there in the basement. no -- selling bracelets with thane cryption on it like making money over my son's dead body. i think it's horrible. >> so, the gift shop proceeds though go to upkeep the museum, right? >> they do. and they need to raise money to run this museum. it's a 63-million-dollar venture. but i think that what he touched on is the crux of the matter for these families, bill. they wanted the 8 to 10,000 remains that still exist
