a veteran locked in mexico will get his day in court. that will be next wednesday. this, as we also learned authorities are stonewalling attempts to free him. the sergeant has been locked up for more than a month in that mexican jail. the 25-year-old made a wrong turn in mexico with three legal weapons in his car. authorities -- his lawyers rather say that authorities are making it difficult for them to gain access to that scene. secretary of state john kerry wrapping up his trip to mexico today. the big question is, will he ask for the marine's release? >> the state department has not pressed on it in part, i think, because there's a big dispute between mexico and the united states over the subject of guns, guns coming across the border. remember fast and furious. >> we'll keep you posted on the development of this story. there was wild weather overnight. we were talking about the rain here, but flights at denver international airport finally back on track this morning? what the heck is going on

seem very mad. he kept saying if it happened, if there was, if, if, if. there have been so many v.a. reports already. they have admitted there were gaming strategies going on for years. to wait for another inspector general report seems crazy. >> in days peter johnson jr. who has been here has been receiving e-mails from families of victims of the v.a.'s negligence here and about to send those off. if in years they're not aware this has been going on, in days they should well aware now. jeff miller of florida, chairman of the house veterans affairs committee, he sponsored this measure. he said v.a.'s the officials there are not doing what they are supposed to do, they are more inclined to get a bonus without this measure moving forward. undoubtedly why this bill was passed overwhelmingly. >> i couldn't care less if he was angry, yelling. certain guys are high octane. othe are hard to move. i wanted to see action. it's been three weeks.

we've got a plan. then you heard the word he's meeting with general shinseki prior. the president took two questions, the second was general shinseki, did he offer his resignation like general rums tkpeld like ghraib. the president wouldn't answer that. >> the inspector general for the v.a. last week said we have no information that would lead us to believe that any of the deaths had to do with these fake lists. that's what he said. here's the problem. you've got the government once again investigating the government. how is that going to turn out? even democrats aren't buying that one. here's david scott, a democrat from georgia. >> the first person we need to fire is the secretary of veterans affairs, mr. shinseki himself. under his watch, in my own hospital in atlanta, four of our soldiers committed suicide in the hospital. and the very inspector general of the v.a. laid

the blame directly at the foot of the v.a. administration for the lack of management. i listened to the president today and i was very disappointed with president obama today. there was no urgency. mr. president, we need urgency! we need you to roll up our sleeves and get into these hospitals! >> and that was a democrat talking to the commander in chief. >> i'm all for a four-star general giving the benefit of the doubt. i get that. he served the country, lost half a foot in war. i get it. however, why give the benefit of the doubt to general petraeus, why not give the benefit of the doubt to general mcchrystal? his staff gave an interview to the rolling stone. the president couldn't tolerate that. but six years of ineptness, the president doesn't even give a stern talking to, as i understand. also i thought to myself today i cannot remember a time when there's been more big stories. the democrats have come off the fence and decided to

against republicans who are trying to get to the truth. we hope their goals are straightforward. >> let's talk a little bit about this. the 9/11 museum opened up this week. somebody was tweeting out some pictures yesterday from it and was told by somebody there at the museum, you can't take pictures because it might offend somebody, and they included a picture of something that said "the world trade center case made us painfully aware there is this new realm they are bound by a jihad." who don't they want to offend? the people who killed us? is that it? on the cover of the daily news today, look at this. did you enjoy having drinks on top of my brother's grave last night? on tuesday night they closed down the museum even though it was supposed to be open for a party with the former new york mayor michael bloomberg. they had it for donors. keep in mind it was feet away from the unidentified remains of thousands -- well, what is it? 8,000 unidentified human

remains. people regard it as a cemetery. >> i get it. in regards to this, the donors, the donors already supported it. there's got to be some ethics. sit down with rules. a lot of people are maybe coming off with callous who don't mean to be, who support the 9/11 museum and say this is an event. you see event for museums in natural history, you see event for the smithsonian. this is an event. it is going to be a place in new york that everyone comes to visit. >> i think maybe what will soften the effect of that perhaps will be contributions. if these are donors, reap mind people of that -- remind people of that. anything sold there would soften the blow to families who still are just wrestling with emotion and loss at this time. and those in new york city who are still awfully sensitive. on the other hand, people say if we don't move on and have these parties, who wins? >> they're having a party next to 8,000 unidentified

as the veterans affairs scandal unfolds, many are wondering if we should just give our vets health care vouchers and let them choose where they get treatment. former navy seal and lone survivor author marcus luttrell told us that would be a viable solution, in his estimation. >> a combat veteran that was in there and got messed up and needs the care that he needs, you hands him one of those cards, he walks in and then he gets it. >> a senior fellow at the manhattan institute, also provoucher for vets and believes privatizing health care would be better for the vets, and he joins us this morning. good morning. how would it work? >> you take the same pot of money we spend on a veterans health care and you give that to the veterans in the form of a

premium support payment or subsidy, voucher, whatever term you want to use, so they can buy private insurance. >> if they were able to do that, what would happen to the v.a. hospital? >> the v.a. hospitals could be opened up to compete with every other hospital in america. right now one of the biggest problems in america is that these hospital systems have become monopolies in certain parts of the country. they charge whatever they want to charge. they don't have to compete with other hospitals, so the price of health care goes up. if you let the v.a. in the hospital system and they compete, they can compete for veterans and prices will go down. >> i've heard some people suggest the v.a. is antiquated, it doesn't work these days. just let everybody find their own doctor. but you're suggesting instead of doing that, go ahead and continue the v.a. system as it is but give vets the option of either going to your own doctor -- here's your special hospital card where you get great treatment -- or go to the v.a. >> right and let civilians

go to the v.a. hospitals if they want. that will force the v.a. hospitals to get better because they will have to compete with other hospitals out there. >> it is interesting, mitt romney suggested it during the campaign and he got beat up for it. >> maybe at that time the appetite for change wasn't there but hopeful threu -- hopefully with the tragedy we're having now, people will see there are a lot of problems with the v.a. system. >> you called it a scandal. i call it a scandal. the president was out there yesterday despite the reports that came out said for years they have been using these gaming strategies. i don't think he seriously considers it a strategy at this point. he's waiting for another report from the inspector general who already said nobody died because of these stupid schedules. >> there is a reason for that. the v.a. system completely run by the government, so there are a lot of intellectuals on the left who say this is how you show socialized medicine works. if the president goes out and says the v.a. is messed up, the v.a. is broken, he's admitting government run, government controlled,

two stories and then i turn it over to elisabeth. headlines you must see. police arrested a 9 and 12-year-old boy in this school in brooklyn. they are accused of putting rat poison in their teacher's water. the 62-year-old drank it, she got sick but is doing okay this morning. and a substitute teacher fired for seeking love advice from her fourth graders. she reportedly asked the kids for help with two guys she was dating. she claims it was all g-rated. i'll find out more about that elisabeth. talk about something else. >> thanks brian. is the f.b.i. really going to go to pot? agency director james comey said he might loosen the

three year pot restriction saying i have to hire and some of those kids want smoke on their way to thent view. this morning he's taking it back. >> one of our challenges we face is getting a good workforce. at the same time when young people's attitudes about marijuana and our state's attitudes about marijuana are leading more and more of them to try it. >> the question remains should we loosen the standards overall? joining us is former stpheurl -- military staffer. steve, is pot a joking matter especially when it comes from the tkerbgt of -- director of the f.b.i.? >> i'm incensed at the fact that the f.b.i. director and administration would consider national security and drugs a joke. we're trying to convey a message to young people to

stay away from drugs. here we have federal government officers making jokes out of it. it's not a joke. >> pat, your response? >> well, okay. i think the director probably spoke a little too freely but i think he's got a reasonable point. i think the three-year period of time is too long because, okay, yes, it's not a great idea to smoke herb. we all probably think that's true. but we're talking about college students. the f.b.i. wants people coming out of college. and during college students do stuff. then they get responsible near the end of college and say i want to go into the f.b.i. but i smoked herb six months ago at a party and they can't join. i think it is reasonable to recognize that enough time has gone by, six months to a year where you're looking forward to the future, planning on your career, th*eub may -- thinking maybe the f.b.i. is the way i want to go i better stop my student ways. but to say three years you may be preventing yourself from getting good hires.

>> would you hire somebody who smoked the herb? >> absolutely not. i worked on national security issues. when we're dealing with the security of this nation, we need people who can stay focused, who can zero in on the problems we're facing. marijuana is a problem. there have been a lot of studies one side or the other but it does degrade one's attention and ability to focus. there are thousands, perhaps millions of young college students who have obeyed the law, who have done the best they could to get ahead. why not focus in on them? we don't need anyone addicted to drugs or taking drugs dealing with national security issues. we should higher our standards, not lower them. >> that's not exactly what's been happening lately. president obama compared pot to alcohol. he said, quote, i smoked pot as a kid and view it as a bad habit or vice, not different from the cigarettes i smoked for a good part of my adult life. >> we have veered away from responsibility. we're telling young people don't worry about it, do your thing. you'll still get a job like

anyone else. we've got to turn aside if this country is going to be secure in many years to go. >> pat, the final word. >> i think there is a big difference between going to a few parties as a teen and smoking weed and being a pot head. we don't want somebody who is a pot head, that is true, somebody involved in pot on a daily basis. that's why each individual for hire, they go through a process and if they go through a long time since they smoked pot, we used to say three years, but i say they smoked at a party, we want to prevent them from getting a job? we want to set an example that young people shouldn't be using drugs, but pot is legal in colorado and it will probably be spread to other states. unless we do something about that, i think we can't blame college students from imbibing a little bit. >> thank you both for being here, pat brown, steve rogers. would love to get into this debate again but we have to

won't talk but maybe money will. $1 million up for grabs this morning to the first tkpwhroft -- government employee who comes forward to help expose the i.r.s. two target groups of the i.r.s. are coming up with a bounty. they are looking for smoking gun evidence. >> it is to encourage people to tell more about what is happening. stories i hear all the time, and not just the i.r.s. osha, bureau of alcohol, tobacco and firearms, bureau of land management, the e.p.a., targeting citizens, targeting small businesses. this is happening on a level that i think would stun the average american citizen. >> in order to collect the bounty, the information would have to lead to an arrest or conviction. >> another bailout this morning, this one from the white house to insurance companies. listen to this one. buried under hundreds of pages of regulations coming out of d.c., it was released late last week, there is a new provision

how to grill, fundamentals. for example, move your meat? >> what you do first is you want to obviously season your meat. i bring this out for about ten minutes out of the cooler. simple salt and pepper on your rib eye and maybe famous dave's on your double chop pork here. we have our butts and our brisket and our ribs. over on this green egg here, open that baby up, we have nice, beautiful rib eyes going right here and some double chops. what i'm going to do, i made a little brush out of some herbs. this is garlic butter. >> it looks like something from early america. >> you can impress your family, impress your friends doing this. >> you don't have to clean the brush. you toss it out. you also say throw wood by the grill, by the coals; correct? >> you can throw some of the wood right on those coals. now we've got to brighten it up a bit with some lemon. don't be afraid of the

the u.s.a. freedom act being voted on today, a bill to fix government surveillance programs like the n.s.a. does this sound good to you? many people say yes. joining us is judge napolitano. judge, a happy day for you? >> i thought it would be, and the original legislation that was proposed by congressman jim sensenbrenner of the house judiciary committee would have required the n.s.a. to tell a judge whose telephone they wanted to listen to and why they wanted to listen to it. that has been so watered down that the changes the house will vote on today will effectively expand the n.s.a. power rather than contract it. and they've done it by using terms that are so flexible, so malleable that

one judge will interpret them one way and another judge will interpret them another way. when a judge interprets words in this statute, it's a secret court, so we don't know what the judge says or why he says it. one judge on the court doesn't even know what the other judge on the court says. they're kept secret from each other. >> robert goodlatte said in his op-ed, we do not have to sacrifice one from the other as we seek to reform our intelligence-gathering programs. we like the founding fathers can protect our cherished liberties while protecting against attacks on our nation's citizens. >> he's talking about some other piece of legislation, because this piece of legislation -- >> he's not, but you think he is. >> i think he knows what he's doing. what he's doing is making it look like the n.s.a. is being pulled back, but in reality giving it more authority. here's what the country needs. the country needs an open public debate by people

but at least it's not stonecalling. at least the president came out yesterday and said he's mad. >> here is what i think it is. when you have tammy duckworth, female congresswoman who served in the military, has been hurt in battle, when she came out and said it's time for the president to speak, that's one thing. then john barrow and david scott was beside himself, out of florida. this is the first time i've seen bipartisan outrage in an extremely long time. when i heard he was meeting with -- the president was meeting with general shinseki and they cleared it on his schedule yesterday and then he's going to have just a statement at 10:45, i thought clearly that's the way it goes. he's going to resign and at 10:45 he'll name his replacement. he goes no, he's not going to resign. and he said by the way, i'm going to take two questions. one was, did he offer his resignation? so the president could say no, he didn't. but instead, he talked about something else. why even take a question if you haven't answered the question? not even a tough one. >> maybe you're afraid of the

news conference. he said he's really mad, although he didn't seem that mad. he kept saying well, if i find problems, if there are these phony lists. the federal government has given the administration all sorts of reports from the v.a. themselves that say yeah, we've got these gaming strategies. so they know. yet what the president says was, i've got to wait for the inspector general of the v.a. to come out with a report. they're investigating themselves. how do you think that's going to turn out? >> it means two things. the president said in 2007 he's going to be monitoring this. he's going to change it around. make me president and don't leave me senator. so we made him president and now he's saying he still has to investigate six years later whether the ball was dropped. the fact that he doesn't know shows he dropped the ball because he should have been asking if it was a priority all along the way. is this correct? are we on track? what are the obstacles? if it is true that there is 85 million appointments a year, if it is true that 6.5 million patients are treated a year, if it is true that 750,000 need to

the floor of the new york stock exchange with the information. give it to us. >> good morning. not good news this week. we don't want to see claims on the rise and that's exactly what we saw. claims increased by 28,000 for the latest week to 326,000. so obviously more weakness in the labor market. that is not good news ultimately. you want to see those claims going to the down side. as far as what we've been seeing on wall street this week, lots of m and a activity, merges acquisitions, from the drug category, at & t, direct tv. we've also seen others such as reynolds american, as well as camel and newport. we've had a long of activity. marathon oil jumping in. we've had a lot of news on the retailers, such as urban outfitters and dirk's sporting goods. and tiffany's. we've had a lot of action this week. >> plus we understand that when you look at surveys, apparently the people who are unemployed,

especially the long-term unemployed, they're getting used to or becoming more content with not having a job. >> you know, it's unbelievable when you see these surveys and you find out that it turns out that people who are out of work find the freedom not to look for work for a while, take time for myself. let's take look at some of the numbers here as far as the statistics. we have those out of work -- fewer people find the incentive. they rely on all the programs and payouts that they get instead of getting up off the couch and going there to take a job and go look for that. yesterday on varney we talked about 47% of the people just basically sitting back and completely giving up looking for work. this is terrible. get out there and continue to go look for those jobs 'cause we need them and we need to you get on working. it's throwback thursday. i saw you with your pets. >> yes. >> all right. here is my guy. here is my guy. this is the early 1970s. this is me.

when our vets come home after they fight for their country, they oftentimes face a new battle. finding a job. >> yep. the latest labor department report shows the unemployment rate among veterans is 5.6%. it's even higher for 9-11 vets. 6.9%. >> this morning we are hoping to change that number here with a career fair that is just for them. cheryl casone from the "fox business" network is live outside our world headquarters with the companies that want to hire our heros. great work, cheryl. >> all right. good morning. there is still so much work to do with 90,000 vets coming home this year, they will all need jobs. i want to bring in somebody who has been all over this cause for the last three years, that's kevin o'brien. 71,000 vets have gotten jobs through you over the last two years. amazing. >> with our employer partners, 71,000 confirmed hires since september 2011. >> a lot of veterans reaching out to virtual career fairs.
