and washington. that's our show o for tonight.be see you next week. we begin with a fox news alert. we are right now awaiting remarks from president obama on the surprise release of captured army sergeant bowe bergdahl. new details are coming on the role that u.s. special forces played in ushering the only american soldier held captive in afghanistan to safety. and this amid new questions tonight about the administration negotiating with terrorists and releasing those accused gitmo terrorists to get sergeant bergdahl back. hello, everyone. welcome to brand-new hour of america's news headquarters. i'm eric shaun. >> i'm arthel neville. officials say bergdahl was turned over as part of a deal negotiated with officials from

qatar. in exchange were five afghan detain detainees held at guantanamo bay. jennifer griffin is live at the pentagon with the very latest. i understand you have some new details. >> reporter: bergdahl is right now being seen by a team of u.s. doctors at bagram air base. he will be flown to germany and then texas. that's the plan as of now. a team of several dozen u.s. navy seals received him at a meeting point chosen by the taliban. no shots were fired during the handover. according to a senior u.s. defense official, bergdahl was a bit disoriented and confused. he took a pen and wrote, writing instead of talking because on board the helicopter it was so loud, he wrote, sf, question mark. meaning, special forces? the operator sitting with bergdahl responded loudly over the noise of the rotor blades saying yes, we've been looking for you for a long time.

bergdahl then reportedly broke down crying. we first learned of the news when the president made the following statement this afternoon, quote, on behalf of the american people, i was honored to call his parents to express our joy that they can expect his safe return, mindful of their courage and sacrifice throughout this ordeal. the sergeant first class was captured in the first months of his first tour of afghanistan after wandering off base, which raised questions about whether he could face punishment from the u.s. military for his actions that day. chairman of the joint chiefs martin dempsey issued a brief statement saying it is the ethos never to leave a fallen soldier. his parents said we can not wait to wrap our arms around our only son. we thank the emir and we want to thank this opportunity to thank all those in the many u.s. government agencies who never gave up. today we are ecstatic. in exchange for his release, the

u.s. traded five senior taliban leaders imprisoned at guantanamo bay. they were flown on a u.s. air force c-17 to qatar earlier today. they will remain in custody for a year. we expect to hear from the president. he'll be making a statement from the rose garden shortly. >> jennifer griffin, thank you very much. eric, i understand you have background info on those five detainees. >> turns out in 2008, our government said that if these taliban detainees are ever released, they would pose a threat to the united states and they should remain locked up in gitmo. they happen to be some of the most senior afghans held there in the defense department memos from 2008 predicted if they were freed, they would rejoin the taliban to fight again against us. the five who were swapped were the taliban deputy minister of intelligence, who the u.s. says was a direct link to islamic groups and trained taliban

fighters. a senior taliban commander wanted by the united nations for possible war crimes, suspected of the murder of thousands of shiite muslim. deputy minister of taliban's defense and chief of staff of its army who our government said posed a high risk of threat against the united states. a former province head of taliban security with ties to al-qaeda who also directed attacks against our forces. and another official with ties to al-qaeda who was also wanted by the u.n. for war crimes. when a statement from house intelligence committee chairman congressman mike rogers, rogers said while he is pleased that bergdahl is free, he says, quote, i am extremely troubled, however, that the united states negotiated with terrorists and agreed to swap five senior taliban leaders who are responsible for the deaths of many americans. this fundamental shift in u.s. policy signals to terrorists around the world a greater incentive to take u.s. hostages. i believe this decision will threaten the lives of american

soldiers for years to come. as general reported, those five are on their way to qatar. they must stay there in that country for a year. arthel? >> very, very interesting. we're getting more on this from fox news military analyst lieutenant general tom who joins me on the phone. nice to talk to you this afternoon. >> thanks for having me. >> first up, was this trade with the taliban the right move to make? >> no. unfortunately, i have the same concerns that congressman and others have about us trading our prisoners for taliban leaders and the reason is because it's going to happen again. there is the incentive to capture more americans to do more trades and i believe the administration has got the wrong policy here. i'm absolutely delighted that we've got sergeant back in our hands.

but the larger consequences that will have greater impacts against all americans as well as our military forces that are not good for the future. >> and general, because again, of course, no one is disputing this is good news about sergeant bergdahl, but what you're speaking of is perhaps the taliban could look at this and say this is good news for me, the trading odds are good for us. you're looking at each member of the american military could be worth five taliban prisoners. so this could perhaps encourage them to put our troops who are in afghanistan in harm's way and god forbid take any more prisoners of war. >> that's exactly what will encourages them to do that and that's what concerns me. again, we're all delighted that he's back in our hands, but it's the future consequences on our forces over there that we traded erotemed to trade and then we're trading them for very senior

leaders that. is a very dangerous precedent. as a matter of fact, it's against our law. >> very senior leaders and speak of what you're talking about there, the department of defense is issuing a statement about the ignoring the mandatory 30-day notice to congress about transfer and the quote is saying we notify key members of congress about the transfer, but due to the near term opportunity to save sergeant bergdahl, we moved as quickly as possible. to that you say what, sir? >> well, it's a violation of the law. i'm a progress mattic person. again, why is the administration violating the law and putting future military people in harm's way to do this in such an expeditious manner? i just do not understand it and i think that the congress ought to look at it. i'm delighted he's back, arthel. but the fact is it's just going to encourage more prisoners of american troops.

>> again, i would like for you to maybe share some words with the bergdahl family. i understand that you say you're delighted he's home. but if maybe you want to speak to them directly and explain to them, listen, we're happy for the release of your son, but here is why it's a slippery slope. >> well, they understand that and of course, they have their personal desires. he's their only son. they really shouldn't be asked to be put in this particular circumstance. that's for other people to make the hard decisions and that's what i'm talking about. again, i'm delighted for it. i'm delighted for the family. but i'm worried about future consequences on u.s. troops over there being captured so you can get more trades. and it's against our laws for very good reasons, arthel. >> general, thank you very much for your expertise on this story this afternoon. >> thank you. we'll have more on this. we're awaiting the president's remarks any moment now and we will also have a fair and balanced debate on whether this

was the right decision, what this means and what the consequences are for releasing those detainees from gitmo in order to get this release now underway. arthel? the republican leadership conference is now underway in new orleans. this is coming amid worries by some about divisions between the tea party and the gop establishment. big names are offering a ideas on regaining the senate and the white house. john roberts is live at the conference in new orleans with more. john? >> reporter: it's good to be in your home tonight, arthel. the big goal of the republican leadership conference here in new orleans is to get republicans on the same page. to do the things they need to do in order to win, both in november and 2016. warnings over the last couple of days, most coming from the republican establishment, to make sure that voters nominate a candidate who can win and not for sake of purity in a conservative candidate, throw away a potential victory to the other side. but it is clear that unity among

the party is going to be different because there are so many different opinions on exactly what those candidates should represent. for example, senator ted cruz, who as we know was voted into office in the strength of tea party support, took a swing at the establishment today when he was talking saying he's angry that all these washiton establishment republicans are trying to knock off tea party conservatives in the primaryies. >> look, of course there is a variety of views in the party. i do think it's a mistake when you have washington republicans attacking conservative grassroots republicans. that's a path to losing. if washington succeeds in a war against the tea party, harry reid remains the majority leader. no one is more excited about the attacks coming on the tea party than harry reid is and they need to stop that. >> cruz was the winner of the straw poll. also a lot of ideas on how to build the party. we'll see how they take those forward and then on into 2016. >> john roberts, good assignment there. yes, i'm jealous.

we are waiting president obama to speak any moment now on the release of sergeant bergdahl. there is joy and celebration and relief in his freedom after nearly five years of being held by the taliban in afghanistan. there is also controversy. the administration negotiating with terrorists to free five gitmo detainees. was it the right way to handle this? tammy bruce is radio talk show host who joins us now. tammy, we just heard the general say the administration broke the law by freeing five gitmo detainees. they have to stay in qatar for a year. the documents in the state department say these guys killed americans and they're going to come back and join the taliban and do it again. >> look, this is so many mixed emotions. it is thrill to go have one of our boys back. our troops are what is most important to us. at the same time, two of these guys that have been released are wanted as fox is reporting for war crimes by the united nations. and we've got -- >> we have to stop you because the president is about to speak.

parents, but let's listen. >> good amp, everybody. this morning i called bob and janet bergdahl and told them that after nearly five years in captivity, their son, bowe, is coming home. sergeant bergdahl has missed birthdays and holidays and the simple moments with family and friends which all of us take for granted. but while bowe was gone, he was never forgotten. his parents thought about him and prayed for him every single day, as did his sister, sky, who prayed for his safe return. he wasn't forgotten by his community in idaho or the military, which rallied to support the bergdahls through thick and thin. and he wasn't forgotten by his country because the united states of america does not ever leave our men and women in

uniform behind. as commander in chief, i am proud of the service members who recovered sergeant bergdahl and brought him safely out of harm's way. as usual, they performed with extraordinary courage and professionalism and they made their nation proud. right now our top priority is making sure that bowe gets the care and support that he needs and that he can be reunited with his family as soon as possible. i'm also grateful for the tireless work of our diplomats and for the cooperation of the government of qatar in helping to secure bowe's release. we worked for several years to achieve this goal and earlier this week i was able to thank the emir of qatar in helping us get it done. as part of this effort, the united states is transferring five detainees from the prison in guantanamo bay to qatar. the qatari government has given us assurances that it will put in place measures to protect our national security. i also want to express gratitude

to the afghan government which is always supported our efforts to secure bowe's release. going forward, the united states will continue to support an afghan led process of reconciliation which could help secure a hard earned peace within a sovereign and unified afghanistan. as i said earlier this week, we're committed to winding down the war in afghanistan and we are committed to closing gitmo. we also made an ironclad commitment to bring our men in uniform home. it's a profound obligation in our military and today at least in this instance, it's a promise we've been able to keep. i am mindful, though, that there are many troops who remain missing in the past. that's why we're never going to forget. we're never going to give up our search for service members who remain unaccounted for. we also remain deeply committed

to maintaining the release of american citizens unjustly detained abroad. bob and janet, today families across america share in the joy that i know you feel. as a parent i can't imagine the hardship that you guys have gone through. as president i know that i speak for all americans when i say we can not wait for the moment when you're reuniteed and your son, bowe is back in your arms. so with that, i'd like bob to have an opportunity to say something and jan if she'd like as well. >> i just want to say thank you to everyone who has supported bowe. he's had a wonderful team everywhere. we will continue to stay strong for bowe while he recovers.

>> can you imagine getting a call from the president of the united states when you're home, that your son who has been held captive by the taliban for almost five years, and the president gets on the phone and calls you up and says, he's going to be free? tammy bruce is a radio talk show host and jewel israeli a former political advisor, both are fox news contributors. it is absolutely a moment of american triumph in spite of controversy, your thoughts on what those grateful, grateful parents hugging the commander in chief. >> i was trying not to tear up and have mascara running down my face. as a mom, but as any human being can attest, i cannot imagine what they've gone through over the past five years, what they have yet to go through when bowe gets back to the states and obviously putting politics aside, just from a human perspective, i'm so glad for

them. i think this entire nation shares our joy that he will be finally reunited with his family and i hope the media and everybody else does give them the privacy that they need to reintegrate him because i cannot imagine -- his father mentioned he hasn't heard english for five years. i can't imagine the psychological and physical trauma he's gone through and i hope he gets the care that he needs going forward. >> we absolutely all do. his father started to grow that beard when bow he work was first taken. i guess he may shave it off within a week or so when they're united. but there is controversy. over the way this deal was negotiated, five gitmo detainees, the defense department in 2008 said posed a threat to the u.s., would rejoin the taliban. they get to be freed. they're on an airplane now. they're going to qatar to stay there for a year. i asked this earlier, do you think that's proper? we're hearing from capitol hill, committee,, chairman of the saying he's very troubled by this. this is going to cause more

americans to be captured and more terrorists to try to capture americans because of this. >> of course it is troubling and the israelis are actually the people that have experienced this over and over again. when one of their people was taken by hamas in gaza and the trauma that the israelis went through and ultimately they exchanged him for hamas fighters, terrorists because they did not want to leave a man on the field. i think that's right at the end of the day. i understand where congressman rogers is coming from. but we're americans. we do not leave our men and women on the field. and at the end of the day, i think we had no choice. we could have made a political point and said we don't negotiate and exchange hostages, but this is a real human being. you saw the bergdahls' reaction. we had a man in captivity for five years. we could not leave our men on the field. at the end of the day, the president made the right call. >> tammy, your sense, do you think the president made the right call or could they have done something else because there is some criticism now coming in. >> look, the problem started

from years ago with the fact that the taliban even still exist. we obviously all are united in the joy of this young man coming home. but the fact that he was held by the taliban, that we were negotiating with terrorists, that the taliban are still a factor in afghanistan was an issue starting with george w. bush. so it is about leadership and about choices. yes, we would want all our troops home. but usually it would be about killing the enemy to bring them home and rescue them. because of the end result of this, separate from the joy of that family, is that now we will have to also grieve the additional young men and women and americans who will be captured, kidnapped or killed. so this is its very tempered and we will have to be dealing with certainly this on a day-to-day basis as we move forward. >> so how do we stop that? how do we put that back in the bottle? the israelis have done this in the past. what should we do? >> well, this is a problem now. this genie is out of the bottle.

now the conversation, again, separate from the joy of getting our troops back, every family that's had a troop go to war, of course, understands the joys of having them come home. thousands will never return, of course, because they've been killed. what we need to do is have a policy about the enemy that really is about defeating them and not leaving anyone on the field and making sure our enemy is defeated. this nation is going to have to be dealing with that now because we're going to have to reverse that policy and perhaps at some point in the future show the enemies of this nation and the free world that we are going to not continue this dynamic. but we'll have problems now coming up. >> julie, quickly, final word? >> well, tammy raises a good point. we spent a lot of time fighting the taliban. high ranking military official told me once was the taliban knows two things. eventually we will go and they will still be there. and we can continue to invest in trying to kill the taliban, but

time for check of the headlines now. cleveland police officer facing two counts of manslaughter. that after standing on the hood of this car and police say firing more than a dozen shots at the suspects inside that vehicle who allegedly shot at the officers. five other officers are facing misdemeanor charges. this all comes after a car chase two years ago involving more than 50 squad cars. secretary of defense chuck hagel accusing china of destabilizing actions. saying as it pursues territorial ambition, they're trying to expand and claim those japanese islands. meanwhile, china calls those charges groundless. new unrest in eastern ukraine. more than 1,000 protesters gathering in an eastern city calling on russia to protect them from the ukrainian military. this coming less than a week after ukraine held a

presidential election. greg palkot has more on this ongoing crisis there. >> reporter: arthel, there was more turmoil here in eastern ukraine as both sides in this conflict appear to be digging in. some 2,000 pro-russia separatist supporters rallied today. a few miles away where we witnessed full on fighting earlier this week, there were new clashes between crane onmilitary. six fighters were killed there. in western ukraine, there was a funeral for a general, one of 14 ukrainian military killed when their helicopter was shot down by rebels thursday near the militant hotbed town. kiev has said it would avenge those deaths and continue its efforts to regain control in the east. there is more fighting today in that town. new indications of militants building offenses around this city as a faction of rebels dominated by fighters from the russian federation, including chechnya, increasingly are taking control. there are new reports of

problems of border crossings with russia as fighters and arms flow in. russian troops might be pulling back from that border, but the conflict here inside ukraine gaining a more and more russian accent. arthel? >> greg, thank you very much for that report. the obama administration is getting set to unveil what's being touted as an historic proposal to reduce carbon emissions. the new rules specifically target existing power plants and could accelerate the nation's shift from coal to natural gas and renewable energy. is this a good idea? what does it mean for electric bill? scott, good to see you. so if these new rules go into effect and they start cutting coal, what does that mean for the generation of our electricity and what it could mean for the nation's future? >> here is the thing, the coal industry has been struggling, the percentage of electricity generated by coal stood at 52% in 2000. that's down to 37% as of 2012.

natural gas is becoming the new source for energy. it's a lot cheaper and essentially this regulation could kill 800,000 jobs, especially in the states where coal production is huge, like west virginia and in terms of how it will impact consumers, if you have -- there will push up the price of energy and when you talk to consumers, they'll tell you that they're feeling the pinch, especially at the grocery store, whether it's wheat prices increasing or meat prices increasing. so now you have this higher cost of energy. it's another blow to the consumer. >> we're not even like china. what are they doing in terms of coal production? they're spewing it out and spewing it out f. this isn't changed, we've got an environmental problem if you don't deal with it. the fracking is back and big in pennsylvania. but governor cuomo in new york hasn't agreed to start that here. >> there is a trade-off and certainly in his address

yesterday morning, president obama said this regulation should prevent over 2,000 heart attacks over time and certainly people with asthma, this is going to be a huge issue for them. but our economy is not doing well right now. we just got the gdp numbers the other day for the first quarter of 2014. the economy shrunk by 1%. labor participation rate is at its lowest level since the 1970s. and now we're adding regulation back thank could kill jobs and slow growth, raising a lot of eyebrows. >> how do is they balance this? man, you go down to west virginia, we were down there for a story a couple years ago and they have been hit hard. >> yeah. it's true. it ultimately comes down to jobs and trying to balance some of the newer technology out there that favors natural gas rather than the jobs that have been out there for generations. these people, coal is their livelihood and here we are regulating essentially the power plants that produce this coal because 40% of greenhouse gasses out there come from power

plants. so the coal miners are going to be the hardest hit by this regulation. >> finally, the u.n., this is supposedly kicking in next year, you think they'll get anything done? >> there will be more climate talks in paris next year. so if the united states is taking measures to regulate power plants, the rest of the world is going to be watching and this, of course, might ensue a huge legal battle from the coal miners themselves. a lot of legality whether it comes to this. and this could extend well beyond president obama's second term in office. >> probably will. thanks so much. >> thanks so much. >> eric, another controversial proposition out of the golden state. some california primary voters could get free pot if they vote in tuesday's primary. and the buzz word companies are using that could be giving awe false sense of well-being when you're buying their product.

hillary clinton is devoting an entire chapter on the deadly terrorist attack on benghazi in her book choices." she's also taking aim at republican critics who accuse her as being misleading on the accounts of the terrorist attack. but is this the final word on benghazi or will it have the opposite effect of raising more questions? joining me now, susan estridge, professor of law, political science at usc and a fox news contributor. good to see you. >> great to see you, art. >> thank you. so listen, mrs. clinton's book is coming out next month. you've advised a major presidential campaign before. although we're not sure if hillary clinton is going to run yet, is this the right strategy? >> yes. the right strategy politics 101 is always figure out what your

problems are well in advance and get them out on the table in excruciating detail if you have before the campaign starts. so it's absolutely the right strategy. it's going to stimulate a lot of talk. it's going to stimulate a lot of back and forth. but the truth is, it's 2014, which is the ideal time to have all that talk talked out so that by the time hillary is running and i think she will be running -- in 2016, it's sort of old news. >> so if this is an offensive move, what's the best way for republicans to play it and avoid getting sacked, meaning so as not to turn off their potential voters? >> well, i think republicans who are running in the midterm elections, i don't think this is really their issue. i don't think the midterm elections are about benghazi at all. if i were a republican run not guilty a midterm election, i'd be talking about the economy and health care. not benghazi.

but i think the republicans as a whole, i think you're going to see lots of conservative critics pushing hard at hillary, saying, look, were you responsible? were you not responsible? what about this misleading talks points? what about what susan rice said? so they're going to hit her pretty hard. but i think that the reality is after you've heard someone answer the same question two or three times, a lot of people stop listening. so while katherine marriage and others at fox have done a phenomenal job on this story and my hat is off to katherine for her reporting, i think for most people, the immediate concerns of your health care, your family, education just count for more than benghazi. >> thank you very much for that. i want to talk to you about something else for a second. that is an unusual way, is what i'll call it, to get the folks to the polls. as you know, there is --
