zone can expect. but first a fox news alert on defense secretary chuck hagel. he's making an unexpected visit to afghanistan meeting with members of the navy s.e.a.l.s unit who played a role in bringing sergeant bowe bergdahl home to freedom after he spent five years as captive of the taliban. secretary hagel telling the s.e.a.l.s how proud he is for their daily sacrifice. the secretary saying, quote, this is a happy day. we got one of our own back. this is america's news headquarters. i'm arthel neville. >> and i'm eric shawn. in exchange the u.s. freed five top taliban detainees from the guantanamo bay and some lawmakers say it broke the law and it could set a dangerous press debt.

as you may know. sergeant bergdahl was the last unaccounted member and now his hometown in idaho awaiting his long return. hi, dan. >> reporter: yeah, hi, eric. i know that this is a controversial prisoner swap back in weese but here in bowe bergdahl's home state in idaho there's joy and relief he's finally coming home after nearly five long years. in haley, idaho, small town of 7,000 people near sun valley, bergdahl has been in the thoughts and prayers of everyone. yellow ribbons are tied all over the place. signed stayed up at a coffee shop where bowe used to work and now signs say prayers answered. they planted a treat on june 30th on the day he was captured back in 2009 and now they will point a fifth tree. the republican governor of idaho

said today idaho gives thanks and soon we'll celebrate bowe's freedom and homecoming. nobody knows when that will be. bergdahl did not look good in the propaganda videos put out by hit captors. he definitely lost weight and seemed disoriented. his father said he'll need an extensive recovery period and may have trouble speaking english because for five years he only been speaking pashtun. bob grew a beard and recorded a message for the taliban. they were often critical of the obama administration for not doing more but now it's about getting him back in idaho where some would wonder if it would ever happen. >> it was more of, yeah, it's about time.

they were at the celebration yesterday at the white house where obama made the announcement that bergdahl was in u.s. hands. they will be coming back here at 1:00 local time. they will be having a news conference and answer some reporter questions. it's really unknown whether they will be able to reunite with him. understand they have not been able to talk with him. in germany at landstuhl base and he'll then go from germany to an army hospital in san antonio, texas. we have no idea how long he'll be there before he's allowed to come back to idaho but we do know we're planning a june 28th party for bowe bergdahl. whether he's here or not to celebrate his homecoming. eric? >> there will be a big concert on that day. dan springer live in idaho. arthel? >> the exchange highly controversial since the department of defense in 2005 said the five guantanamo detainees posed a high risk to

the united states and should not be released. defense secretary chuck hagel citing bergdahl's poor health as the reason president obama used his executive authority to sign off on the swap. national correspondent steve centanni live with more. hi, steve. >> reporter: hi, arthel. some are questioning the move to release bergdahl. five ranking taliban fighters were freed from guantanamo prison. while expressing satisfaction that bergdahl is finally free senator john miccain, a former p.o.w. himself, has some big concerns. >> i think the big question is what's going to happen to these five individuals? if they re-enter the fight it will put american lives at risk and none of us want that to happen, not secretary hagel or anybody, but if they are able to

have after a year in qatar to do whatever they want to do, there's no doubt that they will re-enter the fight. >> bergdahl is getting medical treatment in germany before heading home. they did not consult closely with congress because of the urgency of the situation though key members were aware. the law requires congress to be notified 30 days before any prisoner exchange. and the white house said we did not negotiate with terrorists. >> we actually negotiated with the government of qatar to whom we owe a great debt. he was being held by the taliban. we had the opportunity to bring him back. had's back safely into the hands of the united states, and that's a great thing. >> reporter: and defense secretary chuck haig el who is visiting troops in afghanistan said this was part of a normal process of trying to free prisoners of war. arthel? >> steve centanni, thanks a lot. eric. >> for more about the high-risk detainees released from gitmo, the 2008 defense department memos, they re dicted the five would rejoin the taliban to

resume the fight against us and they should not be freed. here are the five who were swapped. the taliban deputy minister of intelligence who the u.s. said would pose a direct threat to the u.s. if ever released. the government said he was a direct link to al qaeda and trained islamic terrorists. a senior taliban commander wanted by the u.n. for possible war crimes, suspected of murdering thousands of shiite muslims, deputy minister of the taliban's defense and chief of staff of its army, and the government said he also posed a high risk of threat against our country and had direct ties to osama bin laden, a former province head of taliban security also with ties to al qaeda who directed attacks against our troops, and another official with ties to al qaeda also wanted by the united nations for war crimes. and as steve mentioned under the deal the five must stay in qatar for one year. is that enough? joining us now here is former u.s. ambassador to the united nations, john bolton, a fox news contributor and senior fellow at

the american enterprise institute. ambassador, good morning, good afternoon. there's understandable joy, celebration and relief with the sergeant's release but was this swap in, your view, a wise move in. >> personally you can understand the family's reaction but the swap's a very bad move at several levels. first, it demonstrates that the president is clearing the decks in afghanistan. i think this is a signal to the taliban he wants out. he wants out before the end of 2016, and he's not going to let anything like the prohibition or the paradigm against negotiating with terrorists stand in his way. second, this -- this is a real example of moral equivalency, that five terrorists are exchanged for an american soldier. it's as if the taliban are the same as an american service member and since nothing could be farther from the truth there it gives the taliban a signal that sends the wrong message

around the world. >> we just heard susan rites this morning on one of the news shows saying that the administration did not negotiate with terrorists. >> well, one of reagan's biggest mistakes, something that almost cost him the presidency, was the iran-contra hostage negotiations which were negotiations effectively with terrorists and for susan rice saying we were negotiating with qatar rather than taliban or al qaeda, really, how can you say that with a straight face and not be completely embarrassed? that's the sort of thing that undercuts the administration and american credibility when you don't fess up to the obvious. >> what the five? what should we have done? the israelis swap prisoners all the time. >> and the israelis makes a mistake every time they do that. when you swap prisoners, however you want to characterize them, and us a point out these are five high-level taliban, bergdahl is a sergeant, a low rank. these are high-ranking taliban, high-ranking hostage. every time you are doing that you're putting price on other americans' heads, not just in

the military, foreign service offices, business people, missionaries, tourists all around the world who are now vulnerable. >> do you worry that a precedent has been set, go, hey, snatch an american, grab them and get your way? >> i think it's exactly that and that's why the risk here is not simple police to other american service members, that risk is there. it's a risk for all americans, and we can see that americans are vulnerable. we saw it in benghazi on september the 11th, 2012. when you reinforce the argument that taking americans hostage, kidnapping them gives you leverage with america, it's an incentive to do exactly that. >> do you remember think there are plans now by some terrorist groups to try to snatch some of us? >> i think they are beginning to think about it. when they see a weak administration, it's clear what the president is trying to do is just get everything out of the way of getting out of afghanistan. they will try others as well would be my guess. >> some on capitol hill have been very controversial about this and we'll be discussing

this. ambassador bolton, good to see you and good to see you in person. arthel? >> thanks, eric. thanks, ambassador. right now a fox news alert. a man hunt, active manhunt, is under way in the san francisco area. the fbi is looking for a man who lives in the building that we're looking at right now where haz-mat crews, they are believing to have found a large stash of a deadly poison. more live from our west coast newsroom with more. what did they find? >> reporter: they appear to have found what's a large stash of ricin, a very toxic poison. they are very worried because they believe the man who lives in that apartment is now on the loose and considered armed and dangerous. they are asking the public to stay away from this man described as being white, 6'3", in his late 30s driving a nissan ultima which they believe could be rigged with some form of improvised explosive device or a

biochemical weapon. agents in haz-mat suits spent the day containing the scene. they are still doing that today and they are still collecting quantities of the suspected white powder and poison. of course, there's naturally alarm amongst residents in the neighborhood and the fbi actually issuing this reassurance. >> there's no threat to public safety. there are precautionary measures being taken for agent safety. >> well, we are waiting on official confirmation of the man's identity, but a man who has been identified online describes himself as a political junkie and opposite and has a history of minor misdemeanors. more as we have it. back to you, arthel. >> thank you for that report. >> for you adult climbers and two guides are feared dead after a massive avalanche on

washington's mt. rainier. helicopters searching the area detected pings from avalanche beacons buried deeply in the snow, but recovery teams spotted the hikers' climbing gear thousands of feet below the group's last known location. searchers believe the slide swept that group some 3,300 feet down the face of that mountain. air and ground teams are unable at the moment to try and resume that search because of the danger of continued falling rocks and ice. the missing group includes two guides from alpine group international, the group that led that expedition. >> today marks the first day of the atlantic hurricane season, so how many storms can we be in for over the next six month, and how bad are they expected to get? meteorologist janis dean live in the weather center. how is it looking j.d.? >> below average, we think but take the seasonal forecasts with a grain of salt because it takes one hurricane going back to

andrew of 1992. that was late in the season. a category five so take these seasonal forecasts so the season runs from now to november 30th. el neenah, heard us talk about that before? what is it it? disrupts hurricane activity. it's a warming that cuts the tops off the hurricanes before they get their act together. however, again, go back to 2004. that was an el nino year and we got slammed with hurricanes so taking a look at it. there use our atlantic forecast. looking around average name of storms, three to six named storms. major hurricanes, one to two, categories 3 or higher. below average, but, you know what? just takes one. your tropical activity for june, typically we see it around the bay of campeche and the caribbean and looking for the possibility of developments later on this week in the gulf of mexico. stay tuned. arthel, back to you. >> federal investigators are looking into the cause of a

we're now joined by republican senator bob portman of ohio. senator, thank you for joining us today. this is raising some concerns among lawmakers. >> well, it certainly should, eric. one of the reasons 309-day notice is in place is so that the administration can come to the congress and talk about why they want to release a particular detainee at guantanamo, justify that, but also explain to congress under what conditions that detainee will be released. in other words, how do you keep that detainee off the battlefield. in this case as we've seen, five guys are getting out, all of whom have ties to terrorist groups, two of whom are military commanders. what i've heard in the media, because we haven't been notified yet in congress nor have the american people been told is they are likely to be in qatar for one year. we weren't told under what conditions that will be. access to the internet and will they be able to reconnect to the taliban and to the terrorist groups that are affiliated with the taliban. does this pose a continued danger to our forces left in afghanistan and to americans around the world so this is not

just, you know, a procedure that they should have followed because it's part of the law. am very concerned about it. i do think this sets a bad precedent. the exchange of these detainees for bowe bergdahl, but beyond that i'm very concerned that the administration once again seems to be going around the law and around congress to do something that's going to be harmful to our national security interests. >> and can congress do anything about that, or should they? >> well, you know, congress passed a law, in the defense authorization bill requiring it. congressmen always pass another law but if the administration insists on going to the justice department and getting an opinion saying they don't have to follow the law, then it's difficult. again, i think what we're asking for is totally reasonable. we're saying let's provide to congress the information about why a particular detainee should be released and under what conditions will that detainee be released? in other words, will he be back in the battlefield again. you know, all five of these men from what i understand are

foreign service, americans who might be traveling to dangerous parts of the world so i think we need to re-establish this principle and do it quickly. we need to be clear about what's going on. i listened to susan rice on another network, not yours, but another one and when pressed by someone, a reporter about why they released these individuals, she kind of said we want to shut down guantanamo anyway, and if this is how think going to shut down guantanamo, to release folks without going through the proper notice and making sure they don't go back in the battlefield against americans, we need to have a serious conversation. this concerns me a lot. >> senator, i don't mean to interrupt you, 30 seconds left. you said shinseki's resignation won't get rite of the rot. that's pretty strong. >> we need a fresh set of eyes and just removing him from the top won't change the season. the gao and the inspector generals made it clear this is a much deeper problem. our veterans need to be first in line for the best care.

they have been, unfortunately, last in line and far often mediocre care. there needs to be a change throughout the institution, not just at the top. >> can it be done? >> there is legislation pending in congress called the v.a. accountability act which would permit the new secretary to hire and fire people more readily, hold people accountable and that's a start. has to be deeper than that. we need to ensure that our veterans are getting best care. it's not a matter of funding in the sense that funding has increased, more than double since 9/11. average increases more than 7%. so it is a matter of changing the culture and ensuring that our veterans are getting the best care, not just care. >> up against the clock. >> okay, thank you. you told us your number one olive garden dishes. now they're part of our 2 for $25 guest favorites!
