scelestious. great word. not easy to say. don't be scelestious when writing to the factor. please remember, the spin stops here. we're definitely looking out for you. breaking tonight, we have uncovered high-level warnings that the five terrorists just released from gitmo present a serious threat to america and her citizens and wait until you see who those warnings are coming from. welcome to the "kelly file", everyone. i'm megyn kelly. throughout the day we have seen dramatic developments regarding the deal to trade terrorists for army sergeant bowe bergdahl. many within the intelligence community have outstanding concerns bergdahl may be an active collaborator with the enemy. there is much to go over tonight.

we will begin with an exclusive interview with the two that served in bergdahl's platoon that say he's a deserter. did the white house just negotiate with terrorists? james is here with the warning that the five released present a real threat to america and judge andrew napolitano looks at laws broken with the swat. bergdahl graduated infantry school in 2008 and soon appeared to grow disillusioned with the war. a ro"roling stone" magazine say i'm even ashamed to be american. the horror of the self-righteous aragain that they thrive in is all revolting. the title of a u.s. soldier is a lie of fools and the horror that is america is disgusting. in response bergdahl's father

says obey your conscience. he was captured by terrorists affiliated with the taliban. he said his fellow soldiers say he simply walked off post. the military devoted weeks for searching for him and some say at least six soldiers were killed during the missions although the pentagon tells fox news it's never that cut and dry. bergdahl's parents held out hope their son would one day return home. >> we support you and are easily awaiting your return home. >> have faith. do good works, and continue to tell the truth, but above all, have the patience that can only come from god. >> they got their wish when the white house announced on saturday that bergdahl had been released in exchange for five

infamous guantanamo bay prisoners. hours later, president obama appeared in the rose garden alongside bergdahl's parents. bergdahl's father took to the podium and gave thanks and praised praised ali in the language of the taliban. while everyone was happy an american was coming home. some in congress demanded to know why the president had not given the 30 day notification. then administration had to answer questions about encouraging future kidnappings. >> i don't think what we did in getting our prisoner of war released in any way would somehow encourage terrorists to take our american servicemen prisoner or hostage -- >> i think the terrorists are intent on doing what they are going to do. >> right now, those terrorists are celebrating.

we just got this homecoming video as the leader of the taliban issued a rare statement hailing this deal as a quote, great victory. joining me first tonight, former army specialist cody full and gerald sutton who are both afghanistan war veterans and platoon mates of bergdahl. thank you for being here and thank you for your service. cody, let me start with you, do you believe bowe bergdahl desert s ed? >> yes, i do without a doubt from my mind. >> you've been prohibited from talking about this since he captured. you had to sign non-disclosure documents while he was in captivity. tonight you're free to speak. why do you believe he deserted? >> some of the activities before he deserted made tale, tale signs of this, mailing his stuff home before then. the e-mails. him talking about the terrain

extensively. talking to the afghan national police in a way that was not about hearts and minds. there was an agenda there when he spoke to them. >> gerald, i know you were friends with bowe in your platoon. what do you think? >> i do think that it was premeditated and everything just like cody said. his true motives and everything, i really don't know. he never spoke about them, but yeah, pretty much what cody said, too. >> susan rice went on the sunday talk shows this week, yesterday and said the following. listen. >> he served the united states with honor and distinction and will have the opportunity eventually to learn what transpired in the past years. >> cody, do you believe that bowe bergdahl served the united states with honor and distinction as she said? >> he did not serve the united states with honor. we all took an oath. he violated his oath when he deserted us and put other

americans in jeopardy. >> why do you say that? because i know a former battalion mate has come out and said that he has much to answer for. he attributes the death to at least six service members to incidents in which they were searching for him and lost their lives. >> what i can say on that is i don't -- i can't prove that he caused deaths. what i can prove is those soldiers would not have been there at that location that they died or severely injured. there is a high probability they wouldn't be looking for him if he didn't desert because we wouldn't have a mission to find him. >> gerald, apart from that link, that the loss of lives that the soldiers who were looking for him, why do you think americans should be paying attention to whether bowe bergdahl was a deserter? >> well, i just don't want to see him hailed as a hero and i want him to face the

consequences of his own actions, and possibly face a court marshall for dessertion. >> president obama said we leave no service member behind and that's why we struck this deal. it is controversial for a number of reasons, some we'll get to later, including the character of these five taliban members. your thoughts on that, cody, as a service member yourself? >> i don't think we should -- i maybe, i'm glad he's home. he's an american. i can only judge him on his actions and i think he needs to be held accountable for his actions. anybody else that violates their oath or the military justice code gets a trial, and i believe he should have a trial for what he did. >> gentlemen, thank you both for being here and thank you for your service. >> thank you, megyn. today administration claimed it wasn't worried about releasing these detained people.

that's not what they said in 2012 about the same five guys. here is national intelligence director james clapper. >> i don't think anybody harbors any illusions about these five taliban members and what they might do if they were transferred. >> no one harbors any illusions about them. when asked to explain that reversal in two year's time, here is what a deputy national security advisor today told cnn. >> as a result of the agreement we reached with the government of cutter, with the personal assurances, we have the assurances that they will not pose a threat to the united states or to americans. >> joining me now, oklahoma senator james, he's ranking member of the senate armed services committee. sir, they assured us cutter has assured us they will watch them for a total of one year, and

when asked what exactly they will be doing in watching them, jay carney said i don't know and when asked what happens after that one year, the national security spokesman said very little. your thoughts on it? >> first of all, when you stop and think about what they can do, megyn, in a period of a year, they can go back, organize, plan actions knowing that we're going to be leaving the troops drawn down. here we have, this is -- you know, you've done a great job in characterizing this guy, bergdahl but even if bergdahl was not a bad guy and didn't desert, still it wouldn't make any difference. you can't negotiate with a terrorists, and these five guys, just by their titles, megyn, they are the five arguably the most dangerous of the 149 left in gitmo. my personal feeling because i'm challenging keeping the cause of keeping gitmo open for longer than six years.

this is one more step -- i think if the president believes he can take the five most dangerous people in gitmo and turn them loose, turn them back to the fight, then he can get rid of anyone and that's his obsession to close gitmo. that factors into this. as far as says, they will go back and start working and they have already killed americans, they will kill more. >> these five guys were specifically asked for by the taliban. we didn't pick them. the taliban picked them and you have been talking about them and their possibility release for a long time because they have been wanted by the taliban for sometime in a prisoner swap. the president came to congress a couple years ago and was told no, this isn't a good idea. now he says he had to do it because of circumstances. there were urgency that bowe bergdahl's health and circumstance stantss demanded it and he didn't have time to notify congress like the law requires. your response? >> my response is the president

knew fell and well that these are the highest ranking taliban people in captivity. and that's the issue. it wouldn't make any difference who bergdahl was. you don't swap out and turn back to the fight people who have killed americans, people who are the brain power of taliban and they are clearly, by their own title, megyn, the minister of intelligence and all these different titles. they are the top guys. they are the ones they have been wanting to get back and they are getting back at a time right after the president will have drawn our numbers down to a very low number. >> but administration says, senator, look, this is how wars end. the war is ending and this is what you do, you exchange prisoners at the end of the war and it's always happened this way. >> so they should have turned hitler loose and that would have been the end of the war. it didn't pass the smell test. this isn't right, and i just -- it's hard for me and people i talk to a lot of people in

oklahoma, just this morning about this, they can't figure out why in the world would we turn loose the five most dangerous people who hate america, who want to kill americans, who have the equipment and following to revive the taliban and that's what they are doing. >> i know there is a senate armed services committee that will take place next tuesday. it's closed. >> it's closed. here is the problem. i don't like the closed hearings because the american people need to know. today i requested an open hearing, and whether we can do that by following the closed hearing, i don't know. we need to have an open hearing. >> we need to hear it. >> so everyone know what is is going on. >> i need to turn the page quickly before we get to vice president cheney. there was big news made on the epa and the president has cap and trade proposal essentially. the same one it looks very much alike, the one that failed to get through congress but the president is doing it himself and says it's going to help the environment and saves money. >> well, you know, they have lost the battle. first of all, if you look at

what happened since this fight started, the earth has not increased. in fact, it's levelled off for the last 12 years. they declare now it's going to be the hottest year of the -- in the last maybe even in history, but the polling, the american people have caught on and you look at the polls, the gallop poll, megyn, last week had global warming as number 14 out of 15 issued. i can remember when it was number one or two. you can ask the question, why is the president doing this at this time? is the answer right now, and his name is tom steyer, tom steyer is a multi billionaire out in california who stated in writing and he agreed to it, he hasn't denied it, he's putting $50 million of husband money in campaigns to elect a senate that will go back to the global warming hoax. i wrote a book about this called

"the greatest hoax". the senator raised one of the most contentious issues in this prisoner swap deal, america doesn't normally negotiate with terrorists. did we just do that? back in 2008, president bush was speaking in israel when he shared this powerful history lesson on the danger of dealing with the devil. >> some seem to believe we should negotiate with the terrorists and radicals as if some ingenious argument will persuade them they have been wrong all along. we've heard this foolish delusion before. an american senator declared lord, if i could have only talked to hitler, all this might have been avoided. we have an obligation to call this what it is.

it's been repeatedly discredited by history. >> moments before we came to air, i spoke with former vice president dick cheney and asked him whether president bush was right and whether president obama just negotiated with terroris terrorists. >> i do on both counts, i think president bush was right on. i think they have in fact negotiated with terrorists and i don't think they got a good deal. when we look what transpired here, it's part and parcel of a larger policy that we're in the mist of withdrawal with iraq without leaving stay behind forces there, no u.s. forces there today. we're getting ready to withdrawal completely from afghanistan. we're retreating from the area, and this so-called trade with -- for bergdahl with five of the top taliban terrorists that strikes me as part and parcel of that same unwise policy. >> why?

because for the folks sitting at home, they think it's an american. he was a prisoner or hostage. whatever you want to call it. he was under their control. why not do what we need to do to get him home? >> apparently, i don't know the whole story. i'm just following the news reports of this for him, that he left voluntarily, he left his post, post, that there were lives of american troops put at risk in their search for him after he was taken and now we're in a situation where we have released five of the top terrorists that we held at guantanamo in order to bring him home. now i'm glad for his family. everybody is obviously pleased that's transpireding here. if we analyze the situation, we violated in negotiating with terrorists and releasing five of the most deadly terrorists that

we had at guantanamo. >> do you believe the president endangered the country? >> i think there is a distinct possibility that these five will in fact go back into the battle. when you have people this highly motivated, the taliban commander for the fans, deputy intelligence burro, these are the people most likely to go back and once again launch strikes or attacks against americans against our friends and allies in the region. i think the odds are that they will in fact do that and we'll end up paying another kind of price because of the transaction that's been negotiated here. >> is this likely to be use in your experience as a propaganda tool? we've already seen video of these, you know, terrorists sympathizers celebrating at this deal. >> i think it will. i think we got to remember what osama bin laden's objective was when we got into this and he launched his attack on 9/11 on the united states and killed

3,000 americans, it was to get us out of the middle east. that's occurring. obama is acting like the war is over but it's over without us having won it. in afghanistan there are significant problems. but it looks like obama is leading without any training element or arrangement that will allow us to aid the new afghan government. indeed he's releasing enemies of whatever government is in power in afghanistan and making the situation more difficult for them, not less difficult. >> talk about the optics of this for someone that worked in the white house for so many years. the white house came under criticism because bowe bergdahl's story has questions. he sent out anti american messages prior to being held captive, and hen his father sent out some interesting tweets on his twitter feed and this may be a man distressed trying to get his son back but they caught the

attention of many including i am still working to free all guantanamo prisoners. god will repay for the death of every afghan child, ameen he writes. that's been dellated. that man stood next to our president in the rose garden at the announcement of this deal and spoke in arabic. here is a clip of that for the viewers that missed it. [speaking foreign language]. >> moments later, he and the president are shaking hands and hugging. some are expressing disbelief that the white house put the president in a position like this. is there any problem with that as far as you see? do you see this as a distressed father and a president appropriately embracing him? >> i think there is a certain extent to which you've got to understand the pressures that are on a parent to try to help their child who is in captivity, but i think the whole transaction represents really

bowe bergdahl. president obama and his team may have committed federal crimes when they okayed the swap. judge andrew thnapolitano. the president attached to the law that required that he notified congress but with 30 days as he intended on such a swap. it was just a notification that would be required, that proved to be too burden some. he decided to skip it. >> congress should not be surprised that the president did not compile with his obligations to notify them because the president has a regular consistent pattern of deciding which laws to compile with and which not to compile with. >> he offer add signing statement saying maybe i'll compile, maybe i won't, which they didn't like when president bush did. >> correct. which is a signing statement, he signed into existence changes the law. megyn, this is the lesser of the two laws that he violated. he and his team violated the

federal statute which makes criminal providing material assistance to a terrorist organization. this includes money, this includes ceramic mugs. this includes maps. this includes professional services, and this includes releasing human assets back to a terrorist organization. president obama's justice department successfully prosecuted people for providing material assistance to terrorist organizations and now he himself has done so -- >> all right. >> by letting these five guys loose. >> to convict providing material support to terrorist, not only do you have to prove the defendant did that but he knew or intended the support would be used in -- to carry out a terrorist attack. that's not here, judge. >> the president is not going to be prosecuted -- >> he's not because he didn't violate the law. >> he violated the law by allowing assets to go back to a terrorist organization. you can't erect the telephone pole. you can't repair a laptop.

getting ready for a closed door briefing tomorrow on this deal to free sar ga-- sargent bowe bergdahl. >> there is a precautionary measure going to be looking into just what he did while he was in captivity, what sergeant bergdahl was up to. also, look for any clues as to whether there is a very important distinction between being a deserter, which is a very serious crime, and being a collaborator which would be actively assisting the enemy for propaganda or other purposes. those are two very distinct thinks. we're looking into the possibility of collaboration but there is much less evidence to suggest that than the

e-mails that have been sent between him and his family and the tweets that the father put out and wonder how they could be unaware of the message this sends. this is just the ocbama administration despite for a win. it was a joke. you're six of eight. now you tell us what your foreign policy is? i think the urgency that they told us about and susan rice yesterday, national security advisor said there is tremendous urgency because of his health. there was a political urgency as well. they made a misstick and error and brought this individual back fine and to treat him like a hero, they will be vulnerable to the criticism that they are trying to stem with this. >> they had the rose garden ceremony with his father and asked jay carney today are you aware of the father's tweets, what he wrote in his twitter account? those are officially unconfirmed but nobody said those are not his and been deleted in the wake of the controversy over them.

we showed them to the audience earlier and jay carney didn't know about the communications. how do you have somebody in the white house, let him stand next to the president of the united states and not check the twitter feeds, see what he said? >> once again, the white house learns from the press like we do. they learn from press reports. they didn't do due diligence -- >> how will they investigate this family, this, you know, bowe bergdahl and with all due respect to him and his service. we owe it to the country to understand what situation we're in now. you used to work for an agency that did that. >> there are classified files on basically everything we used to joke around and say that. it's not necessarily an indicator of very much they may have been looking into what is going on. >> that's normal due diligence. >> there is possibility of a collaborator, whether we talk about that publicly or not and if you have somebody that may have been collaborating, very

mark jacobson is a senior advisor of the trueman national security advisory. mark, thank you for being here. so we tried to layout the facts in an impartial manner what we know about bowe bergdahl and the audience can make decisions. it's discomforting to talk about, negatively, in any way about an american serviceman who has been returned to american soil, but do you as somebody who has defending him and defending administration see why that is taking place? >> megyn, thanks for having me. i do understand why the discussion is taking place. i think it's one that will continue. my concern is the level of things that have come out in the last 48 hours where people are trying to turn bergdahl into an enemy, before the debriefers have spoken to him and the

the suspect ryan chamber land was spotted at a san francisco bar today. the area was surrounded and he is now in custody. it was also a tip that led police to swarm on chamber land's san francisco apartment this weekend where not only did police find explosives and bomb making material but evidence showing that he knew how to build a bomb. police say there were no biological or chemical weapons inside the apartment but there reportedly was a chemical often used in suicide. authorities did not have specific targets or threats but assumed he was armed and dangerous. he was clearly paying attention to the media coverage, as well, because today in the san francisco examiner he posted what appeared to be a suicide note reading betrayal, abandonment, isolation and loneliness, i couldn't take it this time. times up, thank you, i'm sorry, i love you. then this appeared on ryan chamber land's twitter account about an hour and a half later quoting a panicked update to my
