8:00 pm
the personal story coming up on tomorrow night's show. go home, set your dvr. start your day with fox and friends 5:00 to 9:00. thanks for joining us. we'll see you back here. latest. good night from washington. the o'reilly factor is on. tonight: >> serve the united states with honor and distinction. >> he would be sergeant bowe bergdahl traded for five terrorists over the weekend. but there is compelling evidence the sergeant is a did i setterrer and -- deserter and drab brart. why is ambassador rice misleading the world again? we have a factor investigation. >> should be tried as a deserter and court martialled. i would personally like to see him in lebanon bon worth for the remainder of his days. >> some of sergeant bergdahl's fellow soldiers are bitter about his alleged dissession and at least six americans were killed searching for him. tonight, talk with the parents of one soldier who lost his life.
8:01 pm
>> we did half a billion dollars a year to operate this nut house. and they are absolute disgrace. >> also ahead, another possible v.a. scandal. this one in memphis. where more than a million dollars was paid to executives in bonus but a rehab pool for the vets closed down for lack of funds. is it legal on the case? caution, you are about to enter the nopsz, the factor begins right now. braff paragraph hi, i'm bill o'reilly. thanks for watching us tonight. more trouble for the obama administration because of the taliban negotiation. that is the subject of this evening's talking points memo. there is growing anger in america over president obama's swapping five taliban war criminals for sergeant bowe bergdahl who may have deserted his unit in afghanistan before being capture ited by the taliban in 2009.
8:02 pm
there is compelling evidence that the sergeant violated military law and may have even collaborated with the enemy. however, top obama security advisor susan rice is saying this about bergdahl. >> he is going to be safely reunited with his family. he served the united states with honor and distinction. >> another very dubious statement by ambassador rice how will remember is the person who mislead the world about benghazi. that's the administration's take that sergeant bergdahl is a honorable man. >> sergeant bergdahl put on the uniform of the united states voluntarily and went to war for the united states voluntarily. that takes honor and it is a mark of distinction. >> president obama himself a bit more cautious. >> regardless of the circumstances, whatever those circumstances may turn
8:03 pm
out to be we still get an american soldier back if he is held in captivity, period. full stop. >> but nobody be is stopping, mr. president. the controversy is growing. and your administration is, again, on the defensive. the president is currently in europe, perhaps he can hear the anger over here. it's that loud. nevertheless, his guys continue to protect him. >> the narrative is let's take this guy, this soldier that we got home, diminish him, turn him into some kind of a caricature. we don't know if is he a traitor, saying negative things about him. insult his family and then take the five that we are releasing build them up into mega threat against us the president of the united states is a traitor who traitor to let out our enemies. is this the type -- republicans? >> politics aside, the release of the five taliban war criminals, that's the troubles precedent and is almost indefensible in the face of sergeant bergdahl's status. five years ago, when the sergeant first left his
8:04 pm
unit, fox news strategic analyst colonel ralph peters said. this. >> my anger is that the media has been turning this guy, who is a probable -- an alleged deserter, certainly awol in combat zone. by does it make me angry? we know bergdahl'same. owe f us know the names of the marines fighting crippling in hospitals. >> at least sixth u.s. soldiers were killed searching for sergeant bergdahl creating deep resentment in the military. listen to some soldiers who served with bergdahl. >> he did not serve the united states with honor. we all took an oath. he violated his oath when he deserted us and put other americans in jeopardy. >> any of us would have died for him while he was with us and for us to leave him like that, it was a very big betrayal. >> if you had asked me three days ago, i would have said firing squad. i have had some time to think about it some time to
8:05 pm
get a little less emotional and detach myself that way and i think that he should be tried as deserter and court martialled. i would like to see him in leavenworth for the remainder of his days. >> the obama administration has brought it upon itself. these taliban killers are not soldiers, according to the u.n. in 2013 alone, 74% of all civilian casualties in afghanistan were caused by the taliban and al qaeda. at least 2300 civilians were killed. more than 4,000 injured. multiply that by 13 years. and you have the level of atrocity the taliban has committed. this is not a prisoner of war exchange. this is a political move. and it is back firing on the president, no question about it. so, then the question becomes what is going on
8:06 pm
inside the oval office? why are so many mistakes being made? big mistakes. the vai scandal -- now just a few days later we have this. it's almost beyond belief that an administration could be this dense. so, last night i talked with someone who knows the inside story of the obama white house. i have to keep the person's identity secret but he told me that the president has come to the conclusion that his administration is not, not going to accomplish its goals. he knows the economy is not going it turn around. he no knows obamacare is not going to be popular. and he understands that his job approval rating will likely remain below 50%. therefore, according to this guy, the president has concluded that public opinion really doesn't matter anymore. thus, mr. obama is going to do what he wants to do. and the consequences be damned. i believe that assessment is
8:07 pm
accurate. just think about it. why would you swap one alleged deserter because surely president obama knows the guy left his unit voluntarily for five, five notorious war criminals? why would anyone do that it simply doesn't make sense. these taliban guys will continue killing people. even ardent pro-obama supporters have got to be confused. yes, the zealots will always support mr. obama no matter what he does. if you are a thinking person, all the chaos in washington is embarrassing. and the explanations just plain incredible. susan rice saying to the world that sergeant bergdahl served his country with honor? are you kidding me? and that's on top of the benghazi stuff? is the ambassador rice a moron? why would she say that? with all -- when all the
8:08 pm
facts point to the opposite. especially when she herself got hammered over the benghazi deception. again, what is wrong with these people? talking points cannot answer that question. it's beyond comprehension. the white house press core better start asking about ms. rice and the other crazy stuff over and over again. one final thing. president obama knows that at least half, half of the american public is totally disengaged from political reality. they don't know anything. and they don't care to know. many live in a high tech bubble, lost in cyberspace. caught up in their own selfish pursuits. therefore, he knows the president does, that he can razzle dazzle, make speeches and survive. that's a big change in this country when you have half of the folks not caring a whit about what our leadership does.

i'm glad you came on the program tonight. because you have seen, as a journalist, administrations going all the way back to i think u.s. grant. weren't you with u.s. grant there? i mean, you are an old guy. >> almost. >> seriously, you were deeply involved with the nixon administration and from then on you covered it. i can't explain this crazy stuff that's going on in washington right now. do you have any perspective for me? >> well, i have some ideas about it. first of all, i served in the navy in the 1960 and if you are captured, no matter what the circumstances are, if you know they are going to try to get you back that is a very good thing. i would be hard pressed to criticize this except from a management point of view.
8:15 pm
what happened is gee, we are going to be able to get somebody released and then they failed to manage it. a couple of examples. dianne feinstein, the democratic chairman of the senate intelligence committee has said well, she remed and she got a late call from the white house about this. and then she said that, you know, they kind of go out on their own and do things. and i think that summarizes what happens here. they should sit down. they should sound people out. they should talk to her, they should talk to republicans. it's a well-known fact that john mccain was a pow for years. the president could call him and say look, i'm thinking of doing. this what do you think -- what are the downsides when you do that kind of interrogation, particularly of the political opposition, then you may say well, let's
8:16 pm
count to it 10 before we do this or let's do this in a different way. and so, you see that there is that unfortunate bubble in the white house where they they are tour often isolated on something like this. for instance, suppose somebody in the national security counsel called you, bill, and said in confidence, we're thinking of doing this what do you think? you would have given your point of view. >> i would have said don't do it as i said last night. i think you are absolutely right that it's a management problem. however, it's been going on almost six years is it arrogance or ignorance? it's not simple. i have done two books on obama and got to know him in the operation and i know you won't like to hear this. i think there are some strengths there. i think there. >> why wouldn't i want to hear that? i want to hear the honest story. look, bob, it's got to be one of two things. arrogance or ignorance.
8:17 pm
because this is now whipping back on the president. it's hitting him right in the forehead. and is he going to take a tremendous hit. he himself is going to take this hit. so is it arrogance or ignorance? >> i think it's isolation. i think it is oh,x÷ gee, this is humanitarian gesture, let's do it, and no one sits and thinks it through and as you well he know, when you do something like, this you want to sit down and say, what's the second bounce, the third bounce, the fourth bounce? what are people going to think? what are the arguments against it? how are we going to explain it? and they just rush to act on sometimes like in this case, i think it is a gin wynn humanitarian impulse. but it doesn't work. and so now -- >> -- okay. let's a -- give him the benefit of the doubt for the sake of this debate. all right? just for the sake of it this

debate because i don't know what his intentions are. but you have rice, his top national security advisor going out looking -- look into the camera and saying bergdahl is an honorable man. that's an insane statement is he a deserter, and he may be a collaborator, bob. this is the second time for this woman. >> we shouldn't use words like that without the hard data. the process in the military is going to go ahead. >> the data is already in, bob. already have eyewitnesses on the scene, primary sources saying the man deserted. now, drab brart, we -- collaborator, we don't know but there are troubling tweets, troubling emails and all of that is on the record. just stay with rice for a minute. >> you are exactly right to ask that question. i think this is the failure, manage and coordinate and spend time on something like that. they say well, it had to be be done very quickly.
8:19 pm
i'm sure that's the case. but there are people in the congress that they deal with on the most sensitive national security issues. >> something wrong. >> and they can talk to them and they can say. >> sure. >> what do you think? and, you know, the bottom line is, and you see dianne feinstein, the democrat, essentially criticizing the president that the president doesn't line up his friends and doesn't. >> the system absolutely. >> they don't. and this, you know, may be a sensible thick to do when we know all the facts. >> i betcha it's going to get worse though that's my prediction. thank you for coming on. >> we will see. thank you. >> charles krauthammer will have more on the obama administration. and that should be interesting. matthew martinek from illinois killed searching for sergeant bergdahl. a factor exclusive moments

that is the only way that you can deal with this. and no matter how you do the deal, the west, whenever it deals with hostages, or prisoners of war, always ends up on the weaker side of the deal. the israelis got back one private. private shalik. they gave up over 1,000 terrorists, including many with actual blood on their hands. the mistake obama made and this is part of his arrogance and also perhaps ignorance is to celebrate the release with that press conference. when you make the swap, you know that the terms are uneven. you know the five guys that you have on the screen now are going it return. they are going to try to kill americans. this is a somber and solemn thing that you do with regret and with sorrow. but you do it in the name of a code. >> so you would have made the swap had you been the
8:50 pm
president? >> >> yes. >> i would not have. i got a letter from a viewer who said this is like in world war ii swapping patton, eyesen hour and bradley for sergeant schultz. i think there is something to that in war you have to make very tough very, very tough decisions and you have to make decisions what's best for america. totality. here these five, all right, are much more valuable to the enemy and i understand the code that the united states doesn't want to leave anybody behind but you're putting more people in danger, i mean physical danger and as commander-in-chief i would not have made the deal. i would have tried to broker another deal. >> you wouldn't have gotten another deal. you can be sure they have been trying another deal. the taliban considered sit and wait. we can't sit and wait. we're leaving in two years but we're really leaving at the end of this year.
8:51 pm
the taliban will be there forever. we know it, they know it. i don't disagree with your analysis. they got a better of the deal by far. they always do. name me one hostage exchange in which the west released hostages and wended up at the upper end of the deal. the reason is we put a premium on individual human lives the way the other guys don't. that's the difference between a civilized society and a bbarbar society. >> the nation will be put in jeopardy. these five guys are commanders. these are guys going to be repatriated back and do an enormous amount of damage until we kill them. i'm making a decision on what's
8:52 pm
best for the country. i respect your opinion and i could be wrong. but i want to ask one more question. bob woodward seems to think that the administration is so isolated, it's just devoid of reality, not in the real world. i think there's more to it than that because when you see that, it's almost like rice is flipping everybody off. >> rice thing is inexplic krmpb amca b le. i think she ought to stay home sunday mornings and let other people speak. that's obviously ridiculous and i also think that the way they presented this as a great triumph is ridiculous. let me end with one note. i respect your view. i can see how someone would refuse to make the deal.
8:53 pm
it's a tough call if a president were to go the other way i would not attack him on this. but let me say just one thing the prime minister of israel is the toughest guy probably of running a government in the world today and he gave up 1,000 killers for one private. and he knew that would hurt the security of his countrybit and will. but sometimes in the west as a matter of honor for your country you have to do it. >> charles, thanks as always. factor tip of the day, a book you might like and a wild mail segment on the taliban controversy. controversy. we're coming right back.

8:57 pm
>> i said i didn't like his presentation, thanking allah. let's get this discussion rolling. frank lynn reed, california, i have an honest question. why of it offensive for the sergeant's father to use the word allah. because allah approved. jihad is driven by allah in the mind of these killers. god of islam is not offensive. within the context of the war on terror, citing allah was inappropriate. from florida, i have a question, if sergeant bergdahl is a deserter why was he promoted during the captivity? good question. the military didn't designate him as a deserter. therefore he was promoted at the usual rate for service time overseas. but the military also did not designate bergdahl a prisoner of war which is very interesting. nancy miller, concord, north carolina, nobody is talking
