situation. even the might kill again. his administration has embarrassed itself by saying that sergeant bergdahl served with honor. did he not. whatever the circumstances what he did, leaving his unit was wrong. so, this is another big mess, for which mr. obama is directly responsible. is his administration at the tipping point? i believe it is. and that's the memo. now for the top story tonight, reaction. we asked senator feinstein to appear this evening. i have always had a good relationship with her but she declined citing a busy schedule. i wanted you dianne feinstein on together to present a bipartisan. how do you pars all of this? >> i first of all i understand why senator feinstein and senator chambliss should be upset. it's their responsibilities as co-chairman of the intelligence committee.

but my problem, frankly, is this whole issue of whether these individuals will be back in the fight. everybody knows they will be, bill. they were now in qatar where there is a taliban office after a year, they are free to go these are the hardest of hard core and for the president of the united states to enter into a deal where he now says they might reenter the fight is really stunning to me because i don't think we should ever release anyone who there is the slightest chance of them posing a threat to the men and women who are serving in the military. >> even at the extent of a guy's life? look the way the president is portraying it is that the sergeant's life was in danger. his health was detier united states. he had to move fast. or the deal might have fallen apart. and you don't leave behind an american military person, no matter what the circumstances. how do you answer that?

>> i answered it i am very grateful that sergeanéntt] bergdahl is back. my heart goes out to his family. but, the responsibility of the commander and chief is to make tough decisions. and those decisions place first priority on national security. in other words, i would have made efforts to arrange for a prisoner exchange, depending on what it was. but not at the expense of putting american fighting men and women in greater danger as a result of this. >> all right. >> you know this admiral said well, when a guy falls overboard, we always -- it doesn't matter how he fell overboard. look, not if that shift is in battle with the enemy. not if that ship may go into harm's way like miles if they went after him. first you take care of national security. then you take care of the individual. unfortunately, that's the nature of war which is a very cruel business. >> now, you, as a prisonerrer of war in north

vietnam saw some of the other prisoners collaborate with the north vietnamese. it was under duress. i don't know if there was anybody there voluntarily collaborating and i don't believe there was. so you have empathy for this bergdahl, i believe, being held for five years. that's enormous amount of time. however, as i said, i believe that it is going to be shown -- i believe it's already known but it's classified. they have got a classified report on this guy that he voluntarily skipped, went up there and did whatever he did. so do you have sympathy for this bergdahl guy? >> oh, you know, i have some sympathy for human frailties. we are all have our weaknesses. but, if those allegations are true, if and i elm elm if a sees -- emphasize if,

and it caused the death of other servicemen and women, there has to be a complete investigation. look, what bothers me more, what i want to see revealed is the assessments of these five people who were clearly judged as risks to the security and men and women of the united states of america if they were released. i want to see those classified studies released which ledmy the people who studied their cases to conclude that they posed a direct risk to the united states of america and would reenter the fight. i would remind you, bill, that 30% of those released already have reentered the fight and reentered in leadership positions. >> those released from guantanamo. >> right. those released from guantanamo. >> look, you know what it's going to say, even though it's classified, these five taliban guys are classified. you know what it's going to say. all of them, we have their resumes we he know they are all killers and they will all go back.

what we don't know bergdahl the extent of what he did is although there is evidence come outvií' now. i think that should be unclassified. his investigation should be be unclassified right now, because if we are a free society. if you, senator mccain and president obama are representing we, the people, we have to know the facts about a story of this magnitude. tell us, a, what you said how bad are these guys and, b, what bergdahl did? shouldn't we know that? >> absolutely. but we should also know if these conclusions are correct, why in the world did the chairman of the joint chiefs of staff and why did the president of the united states and the head of the cia, why did they agree to release these guys? >> because they are going to say. >> put the american in prison. >> but that counters everything that the military and this war, that we're in,

said to be undergoing -- ongoing right now. the first time was after he essentially walked off his base in june 2009 and disappeared. that was princely an army investigation. it's known as a 15-6. my reporting has known the intelligence community undertook investigation of sergeant bergdahl. both his final period of active duty that culminated in that miss serious evening and also his conduct over the past five years which is said to have been a period of captivity and then as i say there is now just recently been announced why the secretary of the army jack mchugh a new investigation apparently undertaken just since all of this developed over this past weekend. >> all right. now, why would you say the intelligence cia. all of those people. why would they bother investigating a sergeant who

is taken captive? >> well, with greatest proximity because they were tasked with doing so. my reporting on this and i had a big story on foxnews.com on mondayment' who harbor outstanding concerns. not that sergeant bergdahl may have been a deserter but active collaborator with the enemy. some of his actions just prior to his disappearance such as his pack being home of his effects. the emails we have all read about what he did point to such an intent. beyond that there has been some antidotal evidence that has been in the public domain about his activities over the last five years. daily mail reported in 2010 on the basis of an interview with a deputy districtcru commander. sergeant bergdahl had taught the taliban how to disable a mobile phone and make it

into an ied essentially. in the beginning of your show. you played clips from an interviewee who and on our air earlier who was part of that platoon still working on this story. talking about broadway sources in and out of the government. in and out of the military and all i will say is that there are many forms that active collaboration can take. i'm investigating claims that it could go as serious as you can imagine. to say anything further would be speculative. >> also we also point out that there has been-o-have been conclusions drawn but they are classified now. the cia, the dia they came up with some stuff they slapped it right down. lastly every american is entitled to it presumption of innocence. the comments of the chairman of the joint chiefs of staff yesterday were to the effect that there was a process

here and going to unfold. a process will unfold and that was in stark contrast to the ambassador rice, susan rice the national security advisor of the white house on the sunday shows where she simply said without hesitation or qualification that sergeant bergdahl has searched with honor and distinction. >> okay. what about the controversy in congress that he might? have broken the law. >> owe investigations are twinning. some of that classified saxby chambliss chairman on the republican side of that committee wants to made public and asked the president to do so. tonight lawmakers are meeting behind closed doors for a briefing. north going to be the full classified information. synopses so they will get an idea what was that information for what bergdahl was doing that closed door hearing will begin to hear more opinions

on both sides. treated with partisanship and everybody is going to go to it their respective corner or more bipartisan approach it. carl levin has announced is he going to have a closed hearing next week. a closed hearing can can often lead to just about nothing. so you have already heard as john mccain said there has to be a full investigation. that's likely to be pushed for particularly hard. democrats are arguing that back in december of 2011. there were discussions in the on the hill with the administration and defense department talking about the obama administration's desire to start a reconciliation afghanistan and the taliban in order to bring american troops home and that at that time the possibility of a prisoner swap for as many as five taliban members and potentially even bergdahl was discussed. and then a month later, which would have put us in january of 2012, the defense authorization bill passed the house and senate and the president signed it but in so doing, bill, there was a signing statement attached

to it wherein he essentially gave himself a loophole with that 30 day required window to notify congress of such a prisoner swap. so democrats say it was inappropriate and said to dianne feinstein there has been communication from the pentagon and the administration that this wasn't handled the best of ways and mistakes were made and stopped just short of saying sorry and doing it officially and publicly right now. democrats are beginning to say that that's what they're hearing. >> carl cameron appreciated it rosen, directly ahead the far left desperately unhappy about the prisoner swap. wait until you see how they are defending it. watters defending position of the mexico cab government of the mexico cab government to gwe're moving our company to new york state.

watters world segment tonight. petition signed lie almost 200,000 of you. asking the mexican government to release sergeant andrew tahmooressi, from a prison where he has been held for more.cvñ than two months. as you may know tahmooressi entered mexico in a vehicle containing three firearms which were legal here in the u.s.a. but not in mexico. that was a dumb thing to do. but we believe it was an accident and he should not be subjected to this ordeal.
