more years, haley, idaho was the center for getting one of their own back home. the city received a flood of letters demanding they do the right thing and cancel it. what a turnaround this has been in haley idaho. the city said the organizers expect a significant number in attendance for people in support or protest against it. in the interest of public safety we are going to cancel it. haley is a town of 8,000 and does not have the support an event of this size could become. according to senator behind say graham the very premise of the

say i'm going to close guantanamo. i think he wants the see it closed and i'm afraid that may be part of the motivation for t. bill: does this make it more difficult to do this in the next 2, 2 1/2 years? you change u.s. policy toward detainees. and you get away from gitmo and put them in courtrooms in lower manhattan. what's your view on that? >> i think that's a possibility. my view has been we need to give the commander-in-chief as many options as possible to deal with terrorists. that may be to subject them to military commissions or put them into our criminal justice system. i think it's important for the commander in chief to have all options possible. bill: now we wonder about the law and the 30-day notice that

apparently did not go to any member of congress. >> what's emerging is an imperial presidency. an uber presidency where the president can act unilaterally. this is only the latest example of that. bill: i don't think you disagree with that. >> i try to look at this thing in a fair and objective way in which the critics of president george w. bush never did. as to whether the law is unconstitutional that's a gray area. let's assume the president had the authority to do this. there is a legitimate question whether this was a good deal for the united states. i have a great deal of concern about the people we hold in guantanamo bay. we hold them there for a reason. and we release them with assurances they are not going come back and fight against the

united states. bill: why do you think he did it? what's your calculation on that? >> i don't know the president. you have to know the president personally. how they make decisions, what's important to them and what motivates them. this was his objective early on in his administration. i think he miscalculated the reaction to the way he did it. the reaction from congress and the american people. i think he miscalculated the reaction from bergdahl's former come rads in the field. bill: what do you think about the theory that ultimately he wants to change american policy as it pertains to detainees. get them out of the gitmo and close the things down and hold neferg the future in an american courtroom. >> i believe military commissions exist for a reason. they are helpful and bring people to justice.

they are consistent with the rule of law. they allow us to bring people to justice without the risk to a civic population like in new york city would present. i think that's a viable option for the united states in bringing terrorists to justice. i disagree with the president to take this option off the table. bill: if you signed the law two years ago, whatever the time frame was, 2 1/2 years ago that required you to notify congress 30 days before anyone leaves gitmo. why do you b you bypass that. you knew the law was on the books. why do you make that move? >> the president did issue a signed statement. i think they thought notifying

congress would hinder the ability of the commander-in-chief to handle someone captured on the battlefield. i think he knew this was a possibility and obviously you want to sign a bill because it includes very important provisions. you don't want to veto it. but you inform the congress. you inform the public that -- bill: but as we know, that did not happen here. final question. is that because you are afraid congress is going come back and say you can't do this deal? >> clearly the 30-day notice is to allow congress to provide input. but remember the statute does not require congress to approve of the transfer. it requires congress be notified. so congress -- it's possible after notification congress

bill: and race too close to call. the runoff between thad cochran and chris mcdaniel set for the 24th of june. martha: some terrifying moments in a southern california neighborhood. panic on the street there. a military jet crashed in a residential area. it hit one home and set fire to two others. all of this happened in the town of imperial. this is not far from the mexican border. a marine corps spokesman says the pilot was able to eject safely.

his military service. what do you think having been in the white house about their reaction to this? >> i think they are in a state of panic. these charges are disgraceful to say that these men who have been on your channel and others on cnn and other places to say they are lying which is what they are saying by swift boating. because in their point of view it was a lie. they are saying all these men are liars. these are men who did serve honorably. they did put their lives at risk. some of them are decorated. the fact is it gets us off the point. bergdahl should have been recovered no matter what. he's an american. he's being held in captivity much better off for to us get him away from him. the question is at what price. and the price that we paid for bergdahl might have been too high a price to pay even if you were trying to save a medal of

prisoners at gitmo. only 31% say our veterans get better care. up were a former guard at gitmo for about a year? >> yes. bill: what do you think of this number? >> both republicans and deam democrats say the same thing. sometimes pops are based on incorrect perceptions and sometimes poll are the right. the respond accidents of this poll are correct. the care detainees get at guantanamo bay is exceptional. they are immediately seen from chronic care to specialty care to ptsd, whatever they need, they get that care. contrast that with the stories in the news about the department of veterans affairs. someone has to do a scale.
