show "shepherd smith reporting." the taliban that threatened to kill bowe bergdahl when their swap went public. the white house told them that is why they didn't get advanced nose. congressional staffers are saying that is flimsy and ridiculous. in the meantime, president obama says he makes absolutely no apologies for the deal that rescued the last p.o.w. from america's longest war. >> you have a couple of parents whose kid volunteered to fight in a distance land. who they had not seen in five years and weren't sure if they would ever see again. as commander and chief of the united states armed forces, i am responsible for those kids. >> word of the taliban's threat

to kill bergdahl comes after claims that the president broke the law by not giving congress 30 days notice of the deal. the white house said they could wait no longer because his health was getting worse. senators that watched the classified video that the taliban provided say that bergdahl slurred his words and had trouble remembering his name. some say no indication he was in if eminent danger. they demand the president take that video public. >> what was the reason that five taliban being released -- was he in dire straights? this is something that we need to put out in the open, you need to look at the video and judge for yourself. >> sergeant bergdahl's home down called off a homecoming celebration. they were bombarded with hate

mail saying they are celebrating a traitor. sources say he left the post before because he was, quote, bored. but he later came back. the military says desertion is someone who leaves with no claims to come back. we have not heard the final investigation. we're now hearing about his time off base before his capture. we're hearing it from the "washington post" who talked to afghan citizens. they warned him he was going into a dangerous area, but quote, he kept going over the mountain." they tried to give him water and bread and he didn't take it. they say they think he was

probably high. military officials say they will find out what really happened and for now they're focusing on their mehealth. what's the latest on the detainee transfer? >> shepherd, at the state department briefing, they spoke about why there was real urgency siting a combination of factors. not only his health, but also his security. >> harm could have come to him particularly if once we concluded the agreement it would be made public. i won't go into any more detail. >> new details today about the five former detainees. it was confirmed that there is a one-year travel ban, but she said it was not in possible that the men could be seen out shopping. >> the demands were met prior to

doing this. they were important to us. we wanted to make sure we negotiated for them. this is not to say it was hou house arrest, they could be out shopping, but that does not threaten our security interests. >> there was four men living in a seaside villa that had no electronic monitoring, but these men were okayed by guantanamo for release and these five were not. >> and the president promised when he was a candidate to close guantanamo bay, and the transfer of these detainees was part of that, correct? >> yes, they said it was seen by the administration as an important step towards closing

guantanamo bay. they say it may blow up any remaining goodwill that the administration has. >> new transfers from the island, and really hard for the administration to set the idea they need to bring some number of detainees to the united states for further detention even after the war is over. >> and that's the key here about 40 detainees. there is too much evidence to release them, but not enough to prosecute them. unless they can resolve that issue, they will never close those camps. >> thank you, some lawmakers are pushing back at the claims that the taliban would kill bergdahl without a deal. what are you hearing from lawmakers up there? >> shepherd, we have fear push back from lawmakers saying they

police look for a man they say shot and killed three cops. it started last night in new brunswick, kansas. cops there tweeted out this picture of the suspect. you see him walking in it the middle of the streetcar riing not one but two rifles. police say folks spotted him three times today. he is still on the loose and he keeps moving in and out of the woods. he has a facebook page pilled with posts about guns and cops. three cops are dead, two others hurt, and this picture shows the officers taking cover behind their cars. this is an unmarked police suv here. the windows were shot out. it was very chaotic. and this one here, that's blood on the road. folks have been warned to stay

inside and lock their doors. they told people to stop tweeting about police activity to they don't give away officer positions. one man said he saw a built ridden car and a body of one of the officers. he said he was at a corner where police had guns drawn and helicopters were overhead. >> well, it would seem that way for a good stretch of time. i just left and i'm not sure what they found or didn't find. but they disbursed about 20 minutes ago. >> it's my understanding just after it happened you came upon the scene and saw a lot, tell us about it. >> i was with friends in the area, and they're kids got a text saying there was a shooter, a policeman down. and i thought well, you know, i'm a press photographer at

thank you very much, daniel st. louis. the company that operated the deep water oil drilling, bp, never properly tested the equipment. investigators say that blowout preventer had several structural flaws, and right now other ones have similar flaws on rigs all over the place. it killed 11 workers. spilled more than 170 million gallons of oil into the gulf of mexico. anyone that tells you that that ecosystem is back to normal is lying to you. it's not. there are deadzones all over the gulf of mexico.

brazil's largest city has been turned into a commuter nightmare a week for the soccer cup. my first impression of this train station was boy, it's clean. soccer fans might not have a way to get to the stadium. that would be terrible. stranded commuters are trying to pack on to buses. this is just the latest in if the troubles. thousands of workers protesting the billions of dollars that brazil spent on this event while they are homeless. the country has been racing around the clock to finish their 12 stadiums. this is one of three that apparently still needs work. in the meantime, this world cup will be a lot quieter than the

last one. i am sad to report that organizers in brazil have banned vuvuselas. yes, no vuvuselas. they're just one of banned items. if only they could ban cow bells. it is a horrible idea, bra still be, shame on you. a father in michigan is calling his 4-year-old son his only savior after he says the kid helped him escape from under a heavy tree branch. he said without his son, he could have been trapped there for hours. he says he was cutting trees near his home late last week. all of a sudden a large branch rolled on to him. he said his son was the only person around at the time.

in new york, cops say they arrested a man suspected of stabbing two children in an elevator in brooklyn. the attack happened on sunday, wounded a 6-year-old boy. they are looking into if if he was involved in the stabbing of an 18-year-old two days earlier. and a car slams into a pickup truck before crashing into a bus. it happened last week. the driver of that car crawled out of the window, but police were there to arrest him. two people in the truck were hurt, but none seriously. the news continues from the fox news desk after this. and drawing up plays. it's got onenote, so i can stay on top of my to-do list, which has been absolutely absurd since the big game. with skype, it's just really easy to stay in touch with the kids i work with. alright, russell you are good to go! alright, fellas. alright, russ. back to work!

a military jet crashed into a neighborhood and exploded into a fire ball in southern california. you see the thick flames and smoke there in the street. one woman says she saw it when

it happened. >> the plane was coming over and it made a loud backfiring noise. and i thought i department know that planes backfired like that. and it was coming towards me and our house, it backfired again, and it nose dived down. i just saw a huge explosion. >> it crashed and destroyed three homes. the plane sheered the roof off of one of them. somehow in one on the ground got hurt at all. it happened yesterday in imperial, 200 miles south and east of los angeles. we have a former navy fighter pilot joining us now. >> i did quite a bit of bombing practice in that area when i was training. it was the type of plane that

got together, they killed everybody. this has been going on now since 2009. something on the order of, you know, 3,000 to 5,000 people, 2,000 just this year. about 700 or so since the girls were captured. in north eastern nigeria, it's pervasive across the region. towns are emptied out. >> i understand those discussing that you kidnap girls to try to get money for them, why do you go kill a whole village? >> it is an effort to establish an islamic state. they want political control, and their terrorizing those not part of their group. and you see it quite successfully going on right now. some three million nigerians are on the move over the last five

years. it's a very potent group. mind you, this is one answlso t made money off of these kidnappings. they are supplied with weaponry that the government doesn't have. the soldiers are of mixed allegiance. they had instances where they found some of the generals or officers in the army were supplying the group. so it's a poor area. in northeastern nigeria that is suggest to this kind of control by armed groups when the government can't supply protection. >> at this point, it can't or it won't. >> exactly. in the meantime, word of new security threats in. kenya. the embassy has taken new steps for security.
