and on twitter. that's it for this week's show. thanks to my panel and all of you for watching. i'm paul gigot. hope to see you right here next week. the latest on sergeant bowe bergdahl. you know, we were told his health is improving as he continues to undergo counseling and debriefing at the u.s. military hospital in germany. but, you know, there are a lot of questions that remain about his condition, both before and after his release by the taliban, after nearly five years in captivity. and, of course, if he walked off, was snatched, or deserted. so far, his parents have not been allowed to speak with him. and welcome on this saturday afternoon to "america's news headquarters," i'm eric shaw. >> and i'm arthel neville. we know more about the five taliban leaders released from

guantanamo, and transferred to cutter in exchange for sergeant bergdahl's freedom. they are saying they intend to abide by the conditions for their release in the agreement hammered out between the u.s. and qatar. >> amy kellogg is streaming live. what are the terms of this deal? >> reporter: the terms of the deal involve that they cannot do any political activity, they cannot fundraise, they're not supposed to make any statements. but what they said yesterday, that they would stick whiby the terms of the deal, was an exception, presumably to allay the fears of those people who think this wasn't such a good deal. now, the statement read, we want to assure all stakeholders we are steadfast and loyal to the emirates and state of qatar made specifically for our release. interesting they used the word islamic emirates, not afghanistan. islamic emirates a state they are still hoping to one day achieve.

qatar doesn't have the greatest track record when it comes to keeping tabs on some militants in the past who are supposed to stay in this country. but the white house believes they have learned some lessons from history and have said they feel very strongly that the assurances he would keep tabs on this group will pan out. otherwise, the taliban who are here already, there are ten others who have been associated with a small office, they have kept quiet here. now we don't know exactly what the lives of the taliban five just released will be like. they sit in prison for 12 or 13 years. some family members are said to be in pakistan, and they'll be allowed over here. so pakistan is somewhat involved and believed to be retaining a certain bit of influence over the situation, in that regard, as well. they will spend a year in this small persian gulf emirates, developing at a clip, brokering political deals and modernizing fast. quite the opposite of the stone age taliban living in

afghanistan. now, this country is so rich, eric, i think it's interesting to point out the money it pulls in every year from its sales of energy products, oil and gas, amounts to about half a million dollars per citizen. but it's important also to point out that the citizens of this country are a fraction of the population, just about the amount of people that would fit into the city of rochester, new york. so not everyone is kind of privy to all the wealth that them rats possesses. >> you can see the wealth and the riches and the luxury in that video. thanks so much. arthel? >> indeed, eric. meanwhile, a source at the defense department telling fox news that senior military officials advised president obama not to make the taliban trade for bergdahl. comparing the deal to handing over five four-star generals of the taliban. mike huckabee earlier explaining why he thinks the obama administration would ignore their advice. >> this was driven by politics,

not by interest of national security. not by interest of what's best for the military. this was driven in order that president obama could have a nice political moment in saying, i rescued a soldier. >> and sources told fox news earlier this week that the obama administration also bypassed the intelligence community to green light the swap. we're going to look deeper into this controversy with our political panel later in this half hour. we have a fox alert for you now, some brand-new details on actor and comedian, tracy morgan. he was critically injured in a deadly multivehicle highway accident that happened on the new jersey turnpike overnight. more began is now in intensive care in a new jersey hospital. his limo mini bus he was driving in apparently flipped over on the new jersey turnpike. that accident killed one of his fellow passengers. three others were injured. morgan was returning from a stand-up comedy gig in delaware last night. six people were with him when

the accident took place. it occurred about 1:00 in the morning and police say it involved two tractor-trailers, an suv, two cars, as well as morgan's mini bus. the ntsb confirms it is investigating this deadly accident. prayers for him. we're going to switch gears now. excitement is building ahead of the belmont stakes. california chrome, the winner of the kentucky derby and the preakness stakes, goes for the triple crown in today's race. molly line, live at the belmont racetrack, where she's donning, of course, a lovely hat. what else is going on there? you look beautiful, my friend. >> reporter: thank you so much. and you need the hat today. it's beautiful, sunny, a great day for a horse race. the anticipation is building. the crowds are streaming into belmont park here, and all because we want to know the answer to the big question, whether or not california chrome will take the triple crown. that has not been accomplished in over 30 years.

1978, eking out a win over the rival horse. cauthen, a title he may have to give up tonight, but he says he feels ready. >> well, i think after 36 years, i think i'm ready to pass the torch. it's been a great ride. i think one of the things that has been satisfying about, you know, being this long is it just shows how difficult of an achievement it is. >> reporter: a very difficult thing to do, and he stands by that sentiment about how tough it really, really is. there have really only been 12 horses that have accomplished winning the derby and a preakness and given a chance at belmont and we have yet to see a triple crown winner in 36 years. >> 36 years. why has it taken 36 years, and if it is even to happen tonight? >> reporter: right, exactly.

there have been so many theories about what has changed over the decades. a lot of people have theories about horse breeding and the way things have changed. cauthen sees similarities between california chrome and affirm. and what it's about is how tough this race is to win. it's just that hard, and it's all about becoming champion. he actually made a little bit of an analogy with basketball. take a listen. >> i always relate it to like michael jordan in basketball. since michael junior tan retired, there has been a lot of really good basketball players, but maybe lebron james might be the first guy kind of on the same level with michael jordan. great champions just don't come along every year. >> reporter: california chrome will be facing off against ten other horses tonight. it all gets going at 6:52. arthel? >> you have the great assignment of the day, as you know. and i kind of messed up in the beginning. i hope so. i was going to say you look adorable. you look beautiful, suffice to

separatists who are not giving up to lay down their arms. take a look at this funnel cloud. tornadoes touching down in colorado, knocking down trees, power lines and causing damage to some of the farms. but thankfully, there are no reports of anybody being killed or injured. and we are learning more about the controversial prison swap for sergeant bowe bergdahl. a defense official now saying senior military leaders had advised president obama not to make the teal with the taliban. bergdahl was freed in exchange for these five right here, high-ranking taliban commanders detained at guantanamo bay. the president's decision prompting strong criticism. >> there are military decisions, there are national security decisions, and then there are political decisions. this was driven by politics, not by interest of national security. not by interest of what's best for the military. this was driven in order that

p.o.w.s like they which and i'm not sure you had to give up these five to get bergdahl back, given there's reports that there were other offers on the table. frankly -- >> what reports are you referring to? >> fox news, june 4th. basically, there was talk that there was a possible ransom on the table for bergdahl. there is other things we could have given. >> so you're saying -- i'm sorry, so you're saying it was okay to possibly make some sort of negotiation with the taliban, but just not release the members of the taliban. >> absolutely, arthel. you hit the nail on the head. you got it. >> joe, let me pick up with you. i know you have a lot to say about this. i do want to cite a report on fox news.com, which says many in the military were against the swap, considered -- because they considered bergdahl to be a traitor. yet president obama is saying that it was a unanimous decision amongst his principle and his government, his principles and

his government. so joe, how did they miscalculate the repercussions here? >> well, i'm not sure they miscalculated anything on this. the beauty of this whole entire process was the leadership made a decision. the commander in chief did his job. he brought a soldier home. a family is bringing -- is going to get their son back, because of his actions. and that's what we need to stay focused on here. because that's the biggest point. the biggest point is that a soldier is coming home. we sent that young man over there to fight for our freedom. he was captured. the details are the details, but all that matters is that we bring him home. we don't -- outsource punishment to the taliban. >> that's my point, my friend. let me say, i agree with you, we should bring soldiers home, we should never leave a man or woman behind on the battle field. but at the end of the day, why did america have to give up these five people? these guys are awful guys. one of them is wanted for u.n. war crimes and one is ready to get back in the fight. come on, joe. how do i know that the president made the best deal possible for america and the world?

i don't. and that's the problem. and that's why really bergdahl is a smokescreen for liquidating gitmo. the president wants to liquidate gitmo before he ends his term. and frankly, this is about as progressive legacy, not keeping america safe, my friend. >> these five -- let's be clear. these five gentlemen were captured over a decade ago. only a year into the war. if they want to go back to afghanistan, let them go back. they were pretty easy to catch the first time. i'm sure we're not going to have problems catching the second time. and i'll say this too. one u.s. soldier, much more valuable than these five guys. let them go back, do whatever. i'm sure we'll catch them again. everyone u.s. soldier can account for at least five to ten of them. so i think that's a fair trade. >> a little overconfident about our ability to capture them. so you basically -- not to be callus here, you told everyone who fought in afghanistan basically we wasted their time and the fact we were there was for nothing, and frankly, we're going to go back to the war on terror and make america and the world less safe? i'm not sure that's a great idea. >> this is standard operating

hello i'm argentithel nevil welcome to "america's news headquarters." >> and i'm eric shawn. controversy about the plan to free sergeant bowe bergdahl. we'll have the latest fallout. >> and the governor of one state is outraged as the feds say they have no plans to stop dumping thousands of illegal immigrants from another state. and it has happened again. another bounce house gets blown away and two families are filing lawsuits. will they have a case?

our panelists weigh in. but first we start with the white house facing growing political fallout over president obama's decision to release the five top senior taliban leaders in exchange for sergeant bowe bergdahl. he did not tell congress as required by law because they claimed the deal had to be secret. for more on this and the growing concern, molly henneberg with this and more. >> reporter: hello, eric. >> so the president said congress is not able to keep a sessentially, yes. if he had gone to select members of congress and informed them per the law the u.s. was going to release five top taliban fighters from gitmo for bowe bergdahl, he believes the information would have leaked and information officials said there was a credible threat if that had happened then the taliban might have killed

bergdahl. president obama said he does not apologize for the deal and would do it again. >> the fact that we are ending a war in afghanistan, we have both under my administration and previous administrations released a large number of former taliban fighters, some of whom rush to the -- return to the battlefield. but by exchange you don't do prisoner exchanges with your friends, you do them with your enemies. >> democrat dianne feinstein was asked about president obama not going to congress about the deal and the threat against bergdahl's life and she said she had seen no evidence of that credible threat. eric. >> thanks so much. arthel. a fox news alert, we are now learning what may have caused the deadly highway pileup that left actor and comedian tracy morgan in critical condition.

he is under intensive care after his limo mini bus was rear-ended by a tractor-trailer on the new jersey turnpike killing one of his fellow passengers and injuring three others. the new jersey state police finding the truck driver may have dozed off and failed to see traffic slowing down. morgan was returning from a stand-up comedy show in delaware with six other people when the accident took place around 1:00 a.m. involving two tractor-trailers, an suv, two cars and morgan's mini bus. the ntsb confirming it is investigationing. >> and the growing veterans affairs scandal. sloan gibson confirming that 18 veterans did die while waiting for appointments at the health facility in phoenix. and there is also new reaction about this from washington. elizabeth prann has the latest on that. >> despite the departure of eric

shinseki, republican lawmakers are continuing to pressure the administration over the mismanagement of the department of veterans affairs. >> this is the biggest health care scandal in the v.a. history. and america deserves to know whether the president is committed to doing whatever it takes to make things right. you deserve to know whether he will personally step in and see this through. >> this, while legislation sits in both chambers. it passed the management accountability act of 2014 last month, allowing the v.a. secretary to remove anybody he deems under performing. the senate is working on a similar piece of legislation with added protections and a section granting veterans more access to alternative facilities. sackeding secretary -- acting secretary sloan gibson is moving ahead prior to any legislation. >> we will be revising and enhancing or scheduling and the

directing and policy. all of these things designed to begin the process of earning back trust of veterans. veterans have to feel safe when they come to v.a. for care. >> gibson said after reviewing 1700 veterans after being put on weight list, 18 died while awaiting care. if the deaths are tied or linked to the bogus list, the agency will discipline those involved. eric, back to you. >> elizabeth, thanks so much. and eric, new concerns about hundreds of illegal immigrants being shipped out of texas by the federal government and abandoned in arizona. governor jan brewer is saying she is disturbed and outraged to learn about the dropoffs, adding she was told by federal officials there are no plans to stop. dominic di-natale live from los angeles with the details. >> reporter: well, arthel, the reason they can't actually stop this because of the sheer numbers of children coming

across the borders. the number of minors with mothers has been 2,000 since memorial day. on average 500 a week are be shifted from texas to arizona because the federal facilities have run out of space. now by u.s. law, the federal government has to reconnect these children with their families if they have in any the united states. emergency shelters are being set up. but they are bringing them across texas and leaving them in arizona and handed a bottle of water and left to whatever awaits them. lawmakers and local law enforcement are shocked by the situation. listen. >> the government is frustrated in a lot of ways and maybe having a real difficult time addressing the problem a little more in a humane way. i hope they come up with a better solution than that.

>> reporter: arizona's governor jan brewers was less tempered in her reaction. it was an attack on president obama. here is how she spelled out. it was a statement like this. i am disturbed and outraged that president obama's administration continues to implement this dangerous and inhuman policy and neglecting to answer questions we deserve. it is really a humanitarian crisis. in fiscal 2014 they are expecting 90,000 children to come across the border looking for either families or just to escape the violence in gent ral america which is what is driving them here. that is an increase of 30% and the problem will only get worse. >> a complicated story indeed. dominique, thank you so much. family, friends and famous admirers are gathering in north

carolina to remember maya angelou, at the university where she taught for more than three decades. first lady michelle obama are among those paying tribute. >> maya angelou, now she was the original. she was the master. for at a time when there were such stifling constraints on how a black woman could exist in the world, she serenely disregarded all of the rules with fiercely passionate, unapologetic self. >> she died in her home last week. she was 86 years old. >> no doubt her life will continue to shine. okay. we move on now to something i guess fun. the belmont stakes set to kick off later in afternoon where history could be made. all eyes are now on california chrome as he seeks to become the

first triple crown winner in 36 years. molly line live at the belmont race track with all of the excitement. i can see the people hustling and bustling behind you to get ready for the big race. what else is happening there? >> we are watching the people stream in. it is up to 100,000 people that may enter into the park to see history possibly being made. the big question is will california chrome take the triple crown. last horse that did it was affirmed, it was 1978, so it is a long time since we've seen a winner at the park. we had a chance to speak to the jockey who rode on affirm and he is still the last jockey to win the triple crown that he might have to give up tonight. many fans are wearing california chrome colors or just sheer fans of the sport and want to witness firsthand a new triple crown

winner. we spoke with one couple that traveled up from tennessee. >> i think -- i've been to 41 preaknesss and belmont stakes. we've been here to see silver charm, [ inaudible ], but california chrome is going to do it today. >> that is true. there are a lot of horses that have tried and failed and everybody is hoping to see things finish differently. >> so they came up from tennessee, how much is the cost to witness history. >> reporter: to get in the park is $10. you have to pay more to get into the upgraded areas in the park, some of the place where's they have more food and that sort of thing. but one of the things that is so spectacular about all of this is happening is the bargain price that california chrome owners managed to create that horse from. $10,000. so in a sense a lot of people

if you do it yourself? >> eric, true story. my oldest son just bought one and i said i'm coming to get it because i've litigated these type of cases because i don't want you getting sued. when you buy these things and put them in your backyard, you have a responsibility and a duty when you invite people over or kids over to play, birthday parties and otherwise and if they are not fastened properly or they collapse and i've had cases where the kids have suffocated in some of these type of things, the bottom line is you are liable. so you separate it out. you have the commercial use where they are used in commercial liability place where's there are events going on, circumstances, fairs on the weekend. and then you have the homeowner liability. both situations could be potential liability for all of the parties involved. these things, i don't know how you regulate them. from the perspective of product liability, eric, you have to have appropriate warnings, you have to be able to let people know when you buy it where the

taliban basically could have had it at any point over the last several years. but they couldn't get their own act together because there is so much in-fighting among the taliban. so the fact that they could actually agree to a deal and then implement the deal says something potentially about who they are and where they are right now. now the fact is you also saw an attempted assassination of abdullah abdullah, one of the leading presidential candidates in afghanistan, suggesting that not everybody in the taliban is happy about what has taken place. but the fact that they could do a deal and implement the deal suggests that after you have a new afghani president, that it is possible you may see some additional negotiation and maybe the negotiation with the taliban could actually translate into something from an american standpoint. the key is can the taliban be separated from al qaeda? if they can, such a deal could ultimately serve our interests in terms of longer term

stability in afghanistan. if they can't, then obviously it becomes quite a threat to us all over again. >> let's get back to this prison swap at hand. why was qatar the chosen government to oversee the trading? can we really trust the qatari government to keep a leash, if you will, on the five taliban members and assure the world they didn't just jump back into the planning phase of a terror attack on americans or american interests? >> it is a very good question. the main reason they were commasen is -- chosen is because the taliban have an office there. it was set up sometime ago. when there was a time that there was an expectation that we could engage in negotiation with the taliban. that is one of the reasons it emerged in the first place. it is not an accident it was done by qatar and qatar has been the go-between for sometime. the real question is qatar is a small country that tries to play on the world stage. if they broken a deal like this and don't fulfill their part of

it, it will be the last deal they will broker. they have an incentive that they can play in the world and their commitment is good. >> that is interesting. talk about had which world leaders who might see this taliban trade as a sign of weakness or strength and how would one of the leaders perhaps try to use it to his or her advantage? >> i think the bigger issue is going to be is this seen as part of a larger american withdrawal? most people will internetly assume the -- internationally assume this might be a larger pullback on our part. the thing that is important for us, is that the u.s. is seen as competing everywhere. that our readiness to maintain a position in the middle east is made very clear. and we do have 35,000 forces in the area, demonstrating that we'll stand up for what is important to us and that we stand by our commitment and that
